Este artigo tem como objetivo explicitar a complexa relação entre unidade e pluralismo no pensamento político de Carl Schmitt. Tal discussão será feita a partir dos textos O Conceito do Político (Der Begriff des Politischen) e Staatsethik und pluralistischer Staat. Se por um lado, Schmitt confronta-se com a realidade pluralista das sociedades contemporâneas e com o perigo do deslocamento do político para fora da dimensão do Estado, por outro lado, o jurista insiste na procura por uma unidade substancial que transcenda (...) o mero acordo entre as diferentes associações e grupos que compõem a sociedade. Os filósofos Giorgio Agamben e Roberto Esposito mobilizaram as suas concepções de _biopolítica_ para opinarem sobre a pandemia do vírus SARS-CoV-2. O objetivo deste artigo é fazer uma leitura foucaultiana sobre esses posicionamentos. Nossa proposta se fundamenta em três momentos: uma análise do conceito de _biopolítica _a partir dos cursos de Foucault no Collège de France; em seguida fazemos uma análise das intervenções de Agamben e de Esposito à luz de suas propostas de _biopolítica_; por fim, tais leituras serão movimentadas (...) a partir de propostas metodológicas que dão preferência à “um uso” dos textos de Foucault na perspectiva da “caixa de ferramentas” e dos “textos-bombas”, realizando uma leitura que se apoia no potencial crítico das formulações do filósofo francês. In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. In some recent articles, Cobreros, Egré, Ripley, & van Rooij have defended the idea that abandoning transitivity may lead to a solution to the trouble caused by semantic paradoxes. For that purpose, they develop the Strict-Tolerant approach, which leads them to entertain a nontransitive theory of truth, where the structural rule of Cut is not generally valid. However, that Cut fails in general in the target theory of truth does not mean that there are not certain safe instances of Cut (...) involving semantic notions. In this article we intend to meet the challenge of answering how to regain all the safe instances of Cut, in the language of the theory, making essential use of a unary recovery operator. To fulfill this goal, we will work within the so-called Goodship Project, which suggests that in order to have nontrivial naïve theories it is sufficient to formulate the corresponding self-referential sentences with suitable biconditionals. Nevertheless, a secondary aim of this article is to propose a novel way to carry this project out, showing that the biconditionals in question can be totally classical. In the context of this article, these biconditionals will be essentially used in expressing the self-referential sentences and, thus, as a collateral result of our work we will prove that none of the recoveries expected of the target theory can be nontrivially achieved if self-reference is expressed through identities. Rejecting the Cut rule has been proposed as a strategy to avoid both the usual semantic paradoxes and the so-called v-Curry paradox. In this paper we consider if a Cut-free theory is capable of accurately representing its own notion of validity. We claim that the standard rules governing the validity predicate are too weak for this purpose and we show that although it is possible to strengthen these rules, the most obvious way of doing so brings with it a serious (...) problem: an internalized version of Cut can be proved for a Curry-like sentence. The concept of _substructural logic_ was originally introduced in relation to limitations of Gentzen’s structural rules of Contraction, Weakening and Exchange. Recent years have witnessed the development of substructural logics also challenging the Tarskian properties of Reflexivity and Transitivity of logical consequence. In this introduction we explain this recent development and two aspects in which it leads to a reassessment of the bounds of classical logic. On the one hand, standard ways of defining the notion of logical consequence in classical (...) logic naturally induce substructural logics when admitting more than two truth values; on the other hand, these substructural logics give rise to hierarchies of _metainferences_ that can be used to approximate classical logic at different levels. Este trabalho empreende a tarefa de uma recuperação crítica e comparativa dos dois principais projetos brasileiros de reatualização do pensamento dialético: o sistema do dever-ser de Carlos Cirne-Lima e a dialética do Uno e do Múltiplo de Eduardo Luft. Inicialmente, trata-se de iluminar os pressupostos lógico-ontológicos atuantes em cada um destes projetos, fazendo ver suas principais divergências quanto à radicalidade de um distanciamento do sistema hegeliano: o que um vê como possibilidade de correção, o outro reconhece como a necessidade (...) de uma ruptura. Esta reconstrução crítica nos permitirá extrair as devidas consequências para o campo da ética: a ética de coerência dialética é uma ética objetiva e geral que encontra seu fundamento na pressuposição de identidade entre ser e pensar, e que assim permite a dissolução do problema da falácia naturalista quanto à fundamentação teórica do dever-ser. A partir daí, as diferentes interpretações do Princípio da Coerência devem nos guiar à consciência da emergência de um conceito original de liberdade humana, ao passo da qual devemos, por fim, explorar as potencialidades desse conceito para uma renovada abordagem crítica tanto em relação ao âmbito da sociabilidade humana, como ao âmbito do próprio pensamento. Se desarrolla la concepción normativista de la autoconciencia hegeliana, de acuerdo con los aportes de los denominados “neohegelianos de Pittsburgh” (Robert Brandom, John McDowell), así como de otros autores anglosajones como Robert Pippin, Terry Pinkard y Paul Redding. Se presenta el recorrido de la autoconciencia en el capítulo IVde la Fenomenología del Espíritu, y se desarrollan algunos rasgos que pueden extraerse de dicha presentación, de acuerdo con la lectura normativista de los autores mencionados.

This article discusses the relation between colonialism and the sovereignty of peoples through a dialogue between Hegel and the thought of the French Revolution. These two sides are relevant to each other not only because of their historical proximity, but also because of the connections that can be established when we approach the topic of colonialism through these two manifestations. Hegel is explicit that his philosophy of history and his philosophy of right are supposed to be philosophies of freedom. Yet (...) despite the importance that he lends to freedom, Hegel also explicitly defends, in the very same text, colonial domination when he deals with the relation between peoples. A similar problem had arisen in the course of the French Revolution. Following the declarations of war, France is confronted on various occasions with the question of how to deal with other peoples and countries. With the foundation of the Republic in 1792, the relation with other peoples becomes central in the revolutionary debates. The topic of colonialism is part of the constituting debates, and not only because of the uprisings in then Saint Domingue leading to the Haitian Revolution. This article is a part of a larger research project that attempts to reassess the relations between Hegel and the French Revolution, and deals with the question of how we can re-read Hegel's interpretation of the French Revolution based on the evolving historiography of the Revolution. After an introduction of both sides of this dialogue, the paper discusses how Hegel's political philosophy can be applied to understand the debates about the emancipation of colonies that take place during the French Revolution. The next part further analyses some issues, such as the notion of sovereignty and, in the concluding remarks, I summarize my discussion and point to some avenues for further research. (shrink)

Este documento ofrece una propuesta desde la perspectiva de la bioética para la elaboración de un protocolo de triaje en el contexto de la pandemia de COVID-19. Dicha propuesta incluye recomendaciones sobre las normas procedimentales y normas sustantivas que deben regir la asignación y reasignación de recursos terapéuticos en condiciones de escasez extrema.

Democracy is seen today as being in erosion or crisis both in the Global North and South. This article puts forward the concept of ‘dependent democracy’ in order to explain that much of the lack of success of democracy in the South in guaranteeing political participation and economic inclusion and wellbeing for the majority of the population is due to a specific tendency of democracy there. Adapting some insights from the more economics focused Dependency theory towards a more contemporary point (...) of view from political sociology and international political sociology, dependent democracy is understood as a democracy that exists in a subaltern position within the hierarchical, post-imperial and neo-imperial global capitalist order. Dependent democracies thus tend to be less ‘democracies’ and more ‘oligarchies’ within a form of government in the South that can be understood as existing in a global pyramid of semi-peripheries, middle peripheries and outer peripheries. This paper raises the question under what circumstances a plurality forms a set. My main point is that not always all things form sets. A provocative way of presenting my position is that, as a result of my approach, there are more pluralities than sets. Another way of presenting the same thesis claims that there are ways of talking about objects that do not always collapse into sets. My argument is related to expressive powers of formal languages. Assuming classical logic, (...) I show that if all plurality form a set and the quantifiers are absolutely general, then one gets a trivial theory. So, by reductio, one has to abandon one of the premiss. Then, I argue against the collapse of the pluralities into sets. What I am advocating is that the thesis of collapse limits important applications of the plural logic in model theory, when it is assumed that the quantifiers are absolutely general. (shrink)

This work is focused on the philosophy of Emmanuel Levinas. This philosopher is one of the most important impeller of modern review of Neoplatonism. The subjects considered in this paper they are the relationship between goodness, freedom and difference in Levinas' thought. Levinas' thesis is that thought and freedom are originated by the relationship with the others. Thought and freedom suppose the difference.

I analyze some traditional distinctions around euthanasia. In contrast to those who most discuss the justification of active versus passive, or direct versus indirect euthanasia. I claim, following and expanding a Holly Smith´s argument, that the possibility of active and/or direct euthanasia cannot be morally excluded, once we have accepted passive and/or indirect euthanasia, even though we assume the asymmetry between killing and letting die, or between killing someone intentionally as a means and doing that as an undesired side-effect . Fishkin claims that the three liberals principles concerning assignment of social positions constitute a “trilemma”: the realization of any two of these principles precludes the realization of the third. In this paper, I try to prove that this is the case, only if these principles are interpreted in an extreme way. Liberalism, however, has strong reasons to reject such interpretation of each of these principles. Moreover, these reasons are independent from the question of whether their conjunction may be conflictive or (...) not. If we assume moderate versions of the principles , the trilemma disappears or, at least, becomes much weaker. (shrink)

“Moral luck” alludes to the fact of being responsible for things over which we have no control. Typically, we have neither control over the consequences of our acts of will nor over the circumstances in which these acts are performed. The Kantian thesis on oral responsibility claims that every kind of moral responsibility claims that every kind of moral luck should be eliminated from our moral language and practice. In the case of consequences, this aim does not seem impossible. But (...) circumstances are more difficult to avoid because the act of will itself has to be performed within the framework of circumstances that the agent cannot control at all, and these circumstances will dramatically bear on his/her responsibility. Therefore, the following anti-Kantian argument can be construed. Either we reject circumstantial luck argument can be construed. Either we reject circumstantial luck or we accept it. If we reject it, then every attribution of responsibility becomes impossible. If we accept it, then we no longer have a good argument against consequential luck, the core of the Kantian rejection of moral luck. In this paper, I defend the Kantian position from this argument, claiming that both kinds of moral luck are relevantly different. This will, nevertheless, lead to a revision of the scope of our judgments of responsibility. They compare how someone acted with how others would act in identical 8or similar) circumstances. I try to show that Steiner’s theory has very implausible normative consequences since it does not accept the prima facie character or rights. This theory is unable to solve the conflicts of interests in which the only intuitively plausible solution consists in overriding someone’s rights.

Esta sección temática constituye la segunda discusión sobre el desafío de la adopción de reglas lógicas publicado en Análisis Filosófico. Al igual que la primera, esta colección de artículos puede verse como el resultado de la colaboración internacional que durante más de dos décadas hemos mantenido entre el Saul Kripke Center (SKC) y el IIF-SADAF-CONICET. Y más precisamente, entre Saul, Romina y el grupo de lógica de Buenos Aires (BA-Logic). Visitas, seminarios, workshops, proyectos internacionales, y fundamentalmente mucho afecto y pasión (...) por los problemas filosóficos fundamentales han marcado este proceso. Tanto Romina como Saul han apoyado sistemáticamente los esfuerzos desde Argentina para producir conocimiento en el área de lógica. Ambos han estado involucrados no solo institucionalmente en el apoyo al desarrollo de nuestro grupo, sino también a nivel personal. Fueron muchos los momentos que compartimos juntos. Muchos recuerdos e historias. Es importante destacar, solo para mencionar un simple aspecto de nuestras historias comunes, que Saul participó activamente en el proceso de elaboración de la propuesta de ambos números, en la lectura de gran parte del material, e incluso como réferi de algunos trabajos. Saul y Romina asistieron por Zoom a varias reuniones en el marco de los seminarios que generaron parte del material aquí publicado. Recuerdo la alegría de Saul, sus comentarios y la sorpresa de muchos de los participantes de ver aparecer en sus pantallas al filósofo más importante del mundo y uno de los más importantes de la historia. Para ellos quizás era Kripke, para mi ya era Saul. Nos hubiera gustado celebrar juntos. Podría haber sido en Buenos Aires o en Nueva York. Lamentablemente, ya no podrá ser. El paso de la televisión lineal a las plataformas VOD ha favorecido la evolución de los personajes LGTBIQ+ en la ficción. Para conocer cómo se han representado los personajes queer a lo largo de esta transición se acude al análisis narrativo. Con el interés de conocer la percepción de la sociedad, el estudio realizó una encuesta. Los resultados revelan un aumento de los personajes LGTBIQ+ que no necesitan puntos de giro para realizarse. Se concluye que los personajes LGTBIQ+ responden a (...) una normalización real del colectivo en la ficción y que esta visibilidad contribuye a la aceptación de la ciudadanía. (shrink)

Others think that legislation is useful to gain political support from special interest groups in search of privileges, at the expense of those whose cost of rejecting these actions is higher than their individual share of cost of such protection. Yet others think that legislation is the appropriate tool to implement public policy, according with their own “utopia”.To all those people, both (...) of his era and ours, Frédéric Bastiat wrote one of the most persuasive and clearest discussions on the nature and the ends that the law must pursue. In his book The Law Bastiat shows how and why pursuing ends other than justice ultimately leads to the perversion of the law and the fragmentation of society into special interest groups.De nos jours, beaucoup de gens pensent que la législation est suffisamment puissante pour modeler la société et remédier aux maux sociaux. D’autres pensent que la législation est utile pour acquérir les faveurs politiques de groupes d’intérêts spéciaux à la recherche de privilèges, au détriment de ceux pour qui le coût du rejet de telles actions est supérieur à leur part individuelle du coût d’une telle protection. D’autres encore pensent que la législation est l’outil approprié pour instaurer des politiques publiques en accord avec leur propre “utopie”.A tous ces gens, à la fois ceux de son époque et ceux de la nôtre, Frédéric Bastiat adressa une des discussions les plus convaincantes et les plus claires de la nature de la loi et des finalités que celle-ci doit poursuivre. In the background to Ortega’s controversial relationship with some of the most prominent members of the Spanish Generation of '98, there is a gradual shift in Ortega’s original idealism towards a pragmatism. This move takes him from an original confrontation with Maeztu and Baroja to a later critical —even cryptic— acceptance of several of their philosophical theses. The 50th anniversary of the deaths of Ortega and Baroja is a good opporunity to begin an exploration of the question.

The present paper attempts to clarify the meaning of consumption in Hegel’s philosophy. For this purpose I start from the full-blown concept of consumption, as it appears in the Philosophy of Right, in the section on the system of needs. Afterwards I present the less developed form of consumption in the Phenomenology of Spirit, as the first spiritual manifestation of consumption. In the conclusion I explain why consumption in the Philosophy of Right should be understood as the fully developed form (...) of consumption, insofar as the Philosophy of Right presupposes a full intersubjectivity, whereas the Phenomenology of Spirit does not. Finally, I enumerate the contributions of the Phenomenology of Spirit for the understanding of consumption in the system of needs of the Philosophy of Right. (shrink)

Hegel’s Philosophy of Right can be analyzed whether independently from the Science of Logic or on the basis of the metaphysical premises developed in the latter work. In the present paper we enumerate different positions about this question, and we classify a number of attempts which were recently carried out in order to actualize the PhR. the differentiation of five levels of analysis of the articulation of the ethical and the logical in the PhR allows us to conclude that both (...) the thesis on the dependence and the thesis of the independence can be compatible, since they refer to different levels of analysis. This paper addresses the reception of Hegel’s philosophy in Argentina from an exploratory point of view. For this, it offers a preliminary state of the art in which the sources and materials for a study of this type are determined, and a periodization of the reception is proposed that includes the following periods: 1) from the 19th century to the Argentine University Reform of 1918, the time of Hegel’s indirect presence; 2) from 1918 to the First National Congress of Philosophy (...) in 1949, the true beginning of the reception of Hegel; 3) from 1949 to 1982/83, a period of dispute between the existentialist, Marxist, theological and Peronist interpretations of Hegel; and 4) from the democratic restoration to the present, when an institutional consolidation of Hegelian Studies is perceived in the country. As first conclusions, the federal character of the reception of Hegel’s philosophy and the two main moments of the institutionalization of Hegelian Studies in 1931 and 1983 stand out. The first one, in the context of the anti-positivist reaction and the vindication of German philosophy, and the second one, in the framework of the stabilization of academic activity due to the democratic transition. RESUMEN En este artículo se exponen dos espacios de la esfera pública donde pueden ser percibidas con claridad las tensiones propias de la vida ética moderna según las entiende Hegel en los Grundlinien der Philosophie des Rechts. En primer lugar se expone la publicidad de la asamblea estamental, la cual tiene la función de mediar y superar las tensiones características de la esfera privada por medio de la representación política de los intereses particulares de la sociedad civil. En segundo lugar (...) se analiza la ambivalente posición de Hegel con respecto a la opinión pública. Según el filósofo, el pueblo conoce sus intereses verdaderos solo por medio de la representación política. La publicidad de los debates parlamentarios es una condición necesaria para la formación del pueblo. Esta original concepción de la representación política anticipa desarrollos actuales de la teoría política y se distingue con claridad de las concepciones clásicas de la representación. ABSTRACT In this paper, we explain two dimensions of public sphere where the tensions of modern ethical life are clearly perceived, according to Hegel's Girundlinien der Philosophie des Rechts. First, we present the public side of the states assembly, which has the function of mediating and overcoming the tensions characteristic of the private sphere by means of the political representation of particular interests of civil society. Second, we analyze Hegel's ambivalent position regarding public opinion. According to Hegel, a people knows its true interests only through political representation. The publicity of the parliamentary debates is a necessary condition for the constitution of a people. This original perspective ofpolitical representation anticipates current political theories and clearly differentiates itself from classic understandings of representation. (shrink)

A partir de dicha presentación se plantean una serie de críticas a la posición de Adorno con el fin de demostrar la necesidad de reconocer un nivel inmediato de la realidad en base al cual actúen las diferentes mediaciones dialécticas. En el presente artículo se localizan los primeros indicios del surgimiento de la subjetividad viviente en la Filosofía de la Naturaleza de Hegel, especialmente en la primera forma de la naturaleza orgánica: el organismo geológico. Se sostiene que en el abordaje hegeliano del mar, en tanto “Tierra neutral”, puede encontrarse el surgimiento de una subjetividad viviente que, debido a su condición rudimentaria, no logra constituirse aún como un ser independiente.

The global economy’s centre of gravity is shifting. Emerging and developing countries have been contributing over 50% of the global GDP since the onset of the 21st century, which is unprecedented since the Industrial Revolution. This article offers the first analysis of the creeping convergence of the BRIC world (ie Brazil, Russia, India and China) with global legal standards in a key area of International Law: the International Tax Regime (ITR). The ITR is a legal technology fundamentally designed by the (...) League of Nations in the 1920s, when the BRICs played no relevant role. This article proposes a theory that aims to illuminate the core driving forces of the on-going trend towards global convergence in this area of International Law from both the static and dynamic dimensions.
