There is a lack of procedure in the UK guiding social researchers faced with ethical questions. In particular, investigators concerned with family violence and its effects on children face some of the most complex ethical dilemmas in social research and there is a need for greater transparency of ethical procedures. This paper summarizes some key ethical principles guiding social research focused on children, and the decisions that researchers face when conducting studies in the area of child maltreatment or (...) domestic violence. A case example of a study conducted in Dublin, Ireland is used to illustrate difficulties surrounding decisions of informed consent, confidentiality and disclosure, distress and danger, and questioning children directly about their experiences of family violence. The advice of the ethics committee and the solutions agreed by the research team are shared. While the study was subject to a review by an independent ethics committee, in the absence of nationally-recognized or agreed guidelines, good ethical practice is largely dependent upon the moral judgments of the research team. Domestic violence is one of the most serious forms of violation of basic human freedoms and rights regardless of ethnicity, gender, religion, and status. A reflection on many international statistics shows that women are the most frequent victims of domestic violence. Based on the definition of the phenomenon of domestic violence, the forms of abuse, the manner how violence is treated, the possibility of children, men, extramarital spouses, brothers, sisters, and old people living (...) in an extended domestic community, of also being victims is not excluded. Since domestic violence is not only a national problem but a worldwide problem, international organizations have worked towards the eradication of this phenomenon by sanctioning it in various international conventions. Also, the legal systems of many countries prohibit and sanction domestic violence by special laws obliging the state authorities to act in all situations when there are indications that there are direct or indirect violent acts in a family. In this paper, the authors present only the domestic violence against children as an evident problem in families, but which is often unreported. The legal frameworks of the Republic of North Macedonia and Republic of Kosovo are presented in this paper with the aim to describe the material-legal and procedural-legal treatment of domestic violence by pointing out the failure of the state authorities in implementing the laws on protection and prevention of this phenomenon. The authors take the approach of only treating the legal consequences of child abuse by parents that in both legislations is deprivation of parental rights for the violent parent. They conclude that the state authorities should intensify their work in taking control measures towards all the families where there are suspicions that the parental rights are neglected, and the child is abused. Because many cases of abuse have not been detected or reported, and in both countries a special study especially on domestic violence against children does not exist, the possibility that the number for this type of child abuse is great. This article examines how domestic violence impacts the lives and education of young children, children, and young people and how they can be supported within the education system. Schools are often the service in closest and longest contact with a child living with domestic violence; teachers can play a vital role in helping families access welfare services. In the wake of high profile cases of child abuse and neglect, concerns have been raised about the effectiveness of (...) multi-agency responses to children living with abuse. In the UK, the case of four-year-old Daniel Pelka who died in 2012 following abuse and starvation by his mother, who experienced domestic violence, and her partner, led to a serious case review. It found recording systems in Daniel’s school were not used consistently, and details held by different agencies were not collated to enable the formation of a coherent assessment. The lack of integrated working cited in the report echoes findings from previous serious case reviews. A strong correlation exists between domestic abuse and child abuse, with approximately half of all domestic violence situations involving direct child abuse. Children can also be affected indirectly by violence occurring in their home by seeing or hearing it taking place. This article examines the impact of domestic violence on the mental health of children, and the impact on their education. Violence in children’s lives often causes disruption to their schooling and harms the quality of their educational experiences and outcomes. The abuse children experience can result in emotional trauma, physical and psychological barriers to learning, and disruptive behavior in school, while the underlying causes of these problems remain hidden. Knowing when and how to seek advice from multi-agency professionals is an essential part of effective practice among school staff. Despite their vital role in identifying signs of abuse and signposting referral pathways, research indicates teachers often lack confidence and knowledge for such work. The article examines how the professional learning and professional confidence of teachers can be developed, and how recent policy and practice developments in the UK have the potential to influence work in this area. In this paper, I discuss how Turkish feminists have approached the phenomenon of male violence in Turkey as a political problem by following the feminist precept that the private is public. In the last twenty years, feminist activists in media have made male violence increasingly visible, by criticizing the framing of femicides as fatalities of jealousy and love. I argue that Turkish feminists do not consider male violence as just a “situation” or a structure of “oppression.” They (...) problematize it as systematic political violence, which calls for a critique of the anti-feminist state policies that restitute masculine supremacy by the promotion of patriarchal values. The political consolidation of masculinity by the rejection of gender equality is a key aspect of authoritarianism. Turkish government does not frame domestic violence as a women’s problem but as a family problem. In contrast, feminist arguments invite the government to confront domestic violence as male violence. I suggest that the male violence that women experience in Turkey can be seen as a manifestation of bio-power at the age of the crisis of neo-liberalism. (shrink)

In the popular misconception fostered by blockbuster action movies and best-selling thrillers--not to mention conventional explanations by social scientists--violence is easy under certain conditions, like poverty, racial or ideological hatreds, or family pathologies. Randall Collins challenges this view in Violence, arguing that violent confrontation goes against human physiological hardwiring. The impact of domestic violence and abuse is far reaching not least in terms of both the immediate and longer term physical and mental wellbeing of those who have experienced abuse. DVA also exerts a considerable detrimental impact on the wider family including children. While professional perspectives of working with DVA survivors is increasingly well documented, there remains a paucity of accounts of encounters with healthcare services and/or healthcare professionals from survivors of DVA themselves. A central aim (...) of this study was the exploration of women’s experiences of healthcare encounters told purely as personal narrative rather than framed in more traditional research terms. The focus of this paper therefore is unedited personal stories of encounters with healthcare professionals. Federal funding for abortion was eliminated; no permanent offices that would have advocated for women’s issues were created; and bills supporting domestic violence shelters, support for “displaced homemakers,” and quotas for female-owned businesses were defeated or extremely diluted. In addition, no additional states ratified the Equal Rights Amendment (ERA) and several states rescinded earlier ratification votes. Some of these failures can be attributed to the general loss of feminist momentum and the emergence of a conservative backlash in the late 1970s. Anti-ERA organizing fueled the rise of a conservative “family values” movement that would shape social policies for more than a generation, and neoliberal economic conservatives were challenging the welfare-state programs that feminists sought to expand. But in Washington, there was an addition challenge —the unreliable support of Carter himself. Despite his promises, Carter felt that by appointing women he had met his commitment to feminists and did little to support feminist policy goals that went beyond eliminating discrimination. This paper makes an important contribution to the history of feminist action by looking in detail at the efforts of Jimmy Carter’s feminist appointees to influence policy. In particular, it discusses the actions of the most visible feminist in the White House, Margaret “Midge” Costanza. Carter named Costanza director of the Office of Public Liaison, a department that was created to manage relations between the White House and citizens’ groups. Her position as the first woman to serve as Assistant to the President, in concert with her gregarious nature and strong support for women’s issues, made Costanza a very visible symbol of affirmative action for Carter. Yet Costanza, like many other high-level feminist appointees, met opposition within the White House when she tried to advance women’s issues. Her persistent advocacy contributed to her marginalization within the White House. It starts with the Torrance family— Jack, Wendy, and Danny—moving from their Boulder, Colorado, apartment into the Overlook Hotel, where Jack (Jack (...) Nicholson) has accepted a job as the winter caretaker. By the film’s climax, an axe-wielding Jack says to his terrified wife and son (Shelley Duvall and Danny Lloyd), through the door to the bathroom where they are hiding, “Little pigs, little pigs, let me come in. Not by the hair on your chinny chin chin? Then I’ll huff and I’ll puff and I’ll blow your house in!”1 Jack assumes the role of the Big Bad Wolf, the nightmarish, predatory beast of fairy tales. These lines, along with Nicholson’s exaggerated performance as a crazed killer, parody the Gothic horror genre and slasher films and even children ’s fairy tales in what is, at its core, a story about domestic violence. In both Kubrick’s film and Stephen King’s 1977 novel, from which the film was adapted, the Gothic genre becomes a vehicle for a serious tale about violence within the family. While most analyses of both the novel and the film have come from literary and cinema studies perspectives, I offer a sociological approach focused on the profound effect of changing social mores on cultural production. I draw also on feminist and queer theorizing of audience identification, gender, and erotic pleasure in horror films to explain the significant contributions made by King, Kubrick, Duvall, and screenwriter Diane Johnson to the film’s intervention in US public discourse about domestic violence.3 The first scholar who argued that Kubrick’s film is essentially a domestic abuse narrative was James Hala, who based his analysis on a close reading of critical reviews of the film and a discussion of the performances, with no reference to its social, political, or historical context.4 But it is important to note that both the novel and the film came at the end of a decade when the recognition of domestic violence as a social problem was still relatively new. Although the family is the safest environment for each member, sometimes violence and abuse can come from the family members. Violence causes family relationships to deteriorate as in all other relationships among people. Sibling violence, as a form of domestic violence, can sometimes have dire consequences that can result in family breakup, death or long-term loss of one of the siblings. In this study, sibling violence, which has the potential to (...) harm family relations in such a way, will be discussed in the context of two stories in the Qurʾān. It is aimed to contribute to other disciplines that study on this subject by examining the attitude of Islam against this violence, which affects the family, and the solutions of the Qur’ān to sibling violence. These stories in the Qur’ān are the story of Prophet Adam’s two sons who narrate an incident of violence that result in the brother killing his brother, and the story of Prophet Joseph and his brothers who narrate the sibling violence resulting in long-term loss. Both stories provide clues to the prevention of violence in the light of the causes of sibling violence and the behavior of the victim sibling in the development of events. In addition, because of the fact that these stories have taken place in the family of the prophets, they give people the message that sibling violence can happen in any family.Summary: Because of the social nature of the mankind, it must live in structured societies. Family is the medium for him where he is born, raised, socializes and prepares for his future life. It is normal sentiments of love, mercy and tolerance which dominate in a family. But despite this, it is possible for a family member to be a transgressor against another family member’s rights. Emotions like jealousy and hostility can cause violence between siblings. Psychologists generally attribute the source of this kind of violence to the parents’ failure to show equal love and affection to all children. While this is an important cause for violence among the siblings, craving for attention and acceptance from society, trying to achieve material and sensual superiority and desire for social success can incite feelings of envy among the siblings. While feelings of jealousy is unproblematic when its intensity can be considered normal, it can cause psychological imbalance if it increases to the level beyond manageable limits. If the latter case occurs, this produces a state of mind where a sibling becomes capable of committing every act of transgression to another sibling, which is the most important cause for the violence among siblings.Archetypical stories of Cain and Abel, and Prophet Joseph in the Qur’ān provide some clues pertaining to recognition and prevention of violence among the siblings. In these two parables, the real reason for envy does not lie in the other sibling. According to the Qur’ān, the true reason for this envy is attributed exclusively to the transgressor. In the parable of Cain and Abel, source of the problem between the siblings is the sacrificial offering to Allah. While the offering of Abel was accepted, Cain’s was not. Cain felt jealous and threatened his brother with death. Facing with his brother’s threat, Abel stayed firm and peaceful, said to his brother that if he were to attack him, he will not retaliate even for self-defence. He reminded Cain that his envy and anger was not due to him, Abel. Abel reminded Cain that the act that Cain was contemplating was a great sin in Allah’s eyes and that it is punishable by eternal hellfire. Cain, despite these warnings, went on to implement his intention of murder successfully.When we inspect the parable we can see that Abel was free from any guilt on his part for his brother’s envy which is the source of his transgression. His sacrifice was accepted because Abel was among the pious and this doesn’t harm or effect negatively Cain in anyway. Therefore the main cause for the jealousy of Cain is his unworthiness in the eyes of Allah, in reality, the reason is solely Cain himself. Therefore it is totally unfair when Cain put the blame on his brother Abel. By the way of this example, the Qur’ān reminds mankind not to blame others for his problems and to take responsibility. Envy, which is the main reason for violence among siblings, will cloud judgment and prevent clear thinking. In the parable of Cain and Abel, the Qur’ān recommends not to taunt the already jealous sibling by way of words and actions and instead, encourages warning against the grave consequences of evil intentions both in this world and in the hereafter. In the parable of Prophet Joseph, because of jealousy of their father from Joseph, bigger brothers of Joseph planned to kill him but they give up on the idea of killing him and instead they dumped him in a well. Later on in the parable, some merchant finds Joseph and brings him to Egypt. There, Joseph becomes a high ranking statesman and meets with his older brothers. Because of the famine, older brothers are in need of Joseph for food and asks him for it, without knowing that the person they are asking from is their little brother, Joseph. Although Joseph faces with his brothers on a superior position his behavior exemplifies the best course of action to end violence among the siblings. In order to remove animosity and callousness from his brothers’ heart, the gradual plan that Joseph had implemented is a great example for healing the wounds that violence among the siblings can cause. It is unreasonable to expect all the animosity and jealousy that brothers of Joseph held for years to go away completely in a moment. Prophet Joseph did not remind his brothers of their crime, on the contrary he was very generous to them. He brought their father and their brother Benjamin to Egypt and in front of them Prophet Joseph forgave his older brothers for the crimes they had committed against him. In this way, Prophet Joseph prevented his brothers potentially denying every transgression they did if he were to confront them in their first meeting, and made them ready to accept their evil deeds.Parables of Cain and Abel and Prophet Joseph are important for recognizing that envy can destroy the mercy that the siblings innately have for each other. It is understood from the parables that envy must be controlled and violence can’t be realized under any circumstances. It is clear from these parables that violence is never a solution for the jealousy among the siblings. A positive and viable solution would be for Cain to seek Allah’s approval instead of killing Abel and for brothers of Joseph this would be to earn their father’s love and respect. Introspection and analysis regarding possible reasons for jealousy and trying to resolve them and striving to be a better human, sibling, or child is a solution prescribed by the Qur’ān. Also, importance of speaking in a soft tone with the person who is experiencing intense jealousy, avoiding provocative language and behavior and trying every possible way to set this person straight is emphasized. The Qur’ān reminds us through these two parables that the human nature is prone to evil suggestions from the satan and for this reason humans need generous and benevolent help from others in order to clear themselves from these evil temptations. This introduction to the special issue asks, in the company of Jacques Derrida’s recently ‘rediscovered’ seminar Geschlecht III, what it might mean to read this text against the grain of everything that is said in the German word Geschlecht, including the gesture of having made an archival discovery and its attendant enforcements of recovered origins, philological-genealogical authority, familial unity and consonance of signification. It reflects on how returning to Heidegger gives Derrida the opportunity to take stock of the risks and (...) structural inequities inherent in texts and their legacies, and from which Heidegger retreats in the very instances he insists on his own attention to textual and philosophical idiomaticity. We explore how, for Derrida, Heidegger is indebted to a tradition of thinking sameness in difference that coerces conciliation in the name of achieving a ‘tender duality’ between pairs. With Derrida, we argue that Heidegger’s thinking on the two-in-need-of-compromise conceals a violence of domination or subordination to the gentle tones of simplicity and gathering. We ask, finally, what it means to specify (domestic, racial, anthropocentric) unicity as ‘good’ and what this implies for reading archives and legacies once we understand such specification as a form of coercion and violence. Violence often happens among more than just the adults within one family. Even if CV has been thoroughly investigated in the general population very few studies have investigated this objective on a clinical sample, and none of these have included family (...) class='Hi'>violence.AimThis article identifies and describes the group of clients that have issues of physical couple and family violence. It analyses a model that can help to discover physical violence and help therapists to assess what actions to take in therapy to prevent further physical violence.MethodologyDescriptive analysis, t-tests, and structural equation modeling (SEM) are used on a sample of clients receiving couple and family therapy (CFT) in Norway (N = 830). Family violence is modeled by the partner’s expectations toward each other, levels of anger, sexual satisfaction, and self-control.ResultsOne-in-five clients experienced physical CV in their current relationship and one-in-four experienced physical family violence. The group of clients who experienced CV differed from those without such experiences in having lower income, more prior experience with psychotherapy, more experience with alcohol abuse in childhood, and far more physical family violence in their current family. Background and ObjectivesThe purpose of this study was to draw the attention toward the implications of COVID-19 and the related restrictions imposed worldwide especially in Pakistan. The primary objective was to highlight the levels of psychological distress, anxiety, family violence, suicidality, and well-being due to COVID-19 and the secondary objective was to associate it to social demographic factors.Materials and MethodsIt is designed as a cross-sectional study by employing an online questionnaire in the English language and obtaining responses using (...) a snowball sampling technique. We used three validated measures including Kessler Psychological Distress Scale, Generalized Anxiety Disorder index and World Health Organization Well-Being Index.ResultsA sample of 420 participants was recruited from across Pakistan, with most participants were females, students and belonging to Punjab. Nearly one-fourth of the participants scored above the minimum value set for moderate or high psychological distress. There was a higher prevalence of distress among females and resident of province Punjab. The majority of individuals reported that they were living with their family and more than half were neutral regarding their satisfaction with their living conditions. 40.5% believed that the lockdown has had a negative impact on their mental health. 31.4% have reported that they themselves have experienced abuse from a family member. 48.6% scored high on the GAD-7 scale and low wellbeing score was found among 80.2%. Students were found to be more vulnerable to mental illness and anxiety.ConclusionWith the lockdown restrictions, psychosocial distress has become prevalent in Pakistan. (shrink)

Islam is a religion of vast dimensions which has inspired great civilizations and today offers many men and women comfort and ethical guidance. In this paper I suggest that the tension between the Qur'an accepted as the perfect timeless word of God and the encultured dynamic Islam of nearly a quarter of the world's population results in contending perspectives of women's role and rights. The Qur'an gives men and women spiritual parity, but there are verses in the Qur'an that some (...) feminists find difficult to reconcile with the modern rights of women. In some countries it is illegal for women to drive a car, or to move freely outside the home, in others women have become heads of state. The decision to wear the veil, often a sign of empowerment in Europe, is in parts of the Islamic world obligatory. Voices representing an exclusivist, literalist understanding of Islam have entered the mainstream of Muslim lives due in part to the fact that Wahhabism imposes a narrow, sectarian view of Islam, and the Saudi government with its massive oil wealth propagates this puritanical form of Islam across the world. Some traditionalist maulanas and maulvis are concerned above all with women's modesty and enforce customs that refine, purify and protect their chastity. They, like some Islamic feminists, position Islamic rights and roles for women with regard to the exoticized and eroticized `other' — in this case Western civilization, Western imperialism and the rise of Western feminism. `The West' becomes for traditional interpreters a kind of contemporary jahilya. There are also many progressive Muslim scholars who seek to articulate a historically accurate, non-idealized, now challenged, now challenging, view of Islam with an uncompromising emphasis on social justice, equality and pluralism. This paper argues that the ongoing, postcolonial battle against Western `imperialism' demands epistemological humility. Nevertheless, women are fighting for basic human rights and freedoms in parts of the Islamic world where the State, religious authorities and the patriarchal family assume the right of legal and moral surveillance. In considering the nature of violence to Muslim women in Pakistan and the UK, I hope to show that accusations of orientalism should not deter us from recognizing the courage of women activists who themselves risk imprisonment and of the struggle of women victims of rape and domestic violence to overcome feelings of shame and dishonour. I argue that both the private and public spheres need to be made safe for all Muslim women, and not just a professional elite. This can only be achieved by a fuller recognition of women's rights encapsulated in law and all aspects of public life. (shrink)

This article reports on interviews conducted with 11 women at the Thohoyandou Victim Empowerment Programme, a centre located in Sibasa, Thohoyandou, in the Limpopo province of South Africa. The centre provides support and advocacy to female survivors of domestic violence. The participants were victims of gender-based violence and the study aimed at exploring the spiritual experiences of women assaulted by their partners. Interviews were conducted over 4 days and were held on the TVEP premises. This article discusses (...) how women of faith found meaning and support through their religious beliefs when experiencing violence in intimate spaces. Furthermore, the article drew insights from spiritual perceptions held by women that make them feel safer and assist them to find ways to cope with violence in intimate relationships. However, the study found that women prayed for divine intervention and change in their families and for God to help their husbands by removing all evil spirits from their lives. It was found that apart from prayer, the women do not have any other spiritual resources to combat gender-based violence. The authors suggest the deconstruction of harmful religious discourses towards healing religious discourses as a type of ‘intervention’ in the lives of the interviewees.Contribution: The article contributes towards understanding the harmful impact of religious discourses on the lives of women who are vulnerable towards domestic violence. Religious discourses that are either harmful or healing are here identified through the stories of women who have been violated in their intimate relationships, thus contributing to the body of knowledge in gender studies and to religious and social sciences in general. The most significant influences on our lives as we grow and develop from babies into children, teenagers into young adults, are usually our parents or primary care-givers. How we understand who we are in relation to our family structures, as well as the wider community, is influenced, nurtured and directed by our care-givers. Beyond our day to day interaction with others on an individual and communal basis, our care-givers not only influence our moral and ethical thinking but also our (...) experience and expression of faith. As a child of a devoutly religious mother and an agnostic father, religion was often a source of conflict. The expression of faith not only exacerbated the domestic violence within the family home, it was also a tool of violence. This paper uses the creative tools of poetry and narrative story-telling to explore the connection between religion, children and violence and ultimately, healing and spirituality. (shrink)

Domestic violence is a growing societal concern that often spills over into the workplace. However, employers are not recognizing the spillover of domestic violence as a workplace issue. This is problematic considering the serious financial, legal, and ethical consequences for organizations. We analyzed six cases involving domestic violence that were litigated under specific legal bases: Violence Against Women Act, discrimination laws including Title VII, Family and Medical Leave Act, Americans with Disabilities Act, (...) Social Security Disability, Occupational Safety and Health Act, and associated state and municipal ordinances. We chose cases that illustrate the problems of companies meeting the legal standards but not necessarily reaching ethical expectations. Our approach is congruent with the perspective that both legal and ethical analyses should be used in organizational decision making. We suggest for future research the analysis of additional litigated cases, other ethical perspectives, and additional sources of data. In addition, we suggest that companies who are striving for corporate social responsibility should integrate the ethical treatment of domestic violence victims. (shrink)

The phenomenon of domestic violence is as old as humanity itself, but legal protection against violence both internationally and nationally begins to be provided very late. In the Republic of North Macedonia, until 2004, there was no legal protection of victims of domestic violence, nor was adequate sanctioning of perpetrators. Only since 2004, with the amendments and additions to the Criminal Code in the criminal sphere, and the Law on the Family in the civil (...) sphere, the phenomenon of domestic violence began to receive due legal attention, with the application of provisions for the sanctioning of perpetrators and temporary measures protection for victims. The adoption of the Istanbul Convention (The Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence) and its ratification in 2018 undoubtedly contributed to the Republic of North Macedonia undertaking a series of reforms in the field of domestic violence. So initially, in 2021, the new Law on domestic violence was adopted in harmony with the principles of the Istanbul Convention, whereas in 2023 the Law on the amendment of the Criminal Code was adopted. This law focused on changes in criminal offenses related to domestic violence and gender-based violation, as well as the incorporation of new criminal offenses in this regard. These legislative reforms, especially the amendments approved in February 2023 which are of particular importance in the prevention and fight against domestic violence and violence against women in the Republic of North Macedonia are the focus of this research. Children are the most sensitive part of a sciety, therefore the violence against them is considered a serious violation of their personal rights and their higher interests. In most of cases, children in Republic of Macedonia are very little or not at all informed concerning the possibilities of reporting the cases of violence against them by their parents or relatives. The issue of domestic violence is still considered a private problem which occurs within the home. Thus, (...) in most of cases, this problem remains unsolved in silence, without any alert for the state institutions or SOS phone lines for reporting domestic violence. Some children who are more aware for being subjected to violation of their rights are afraid to report the case because of further consequences. In this article some facts will be given about observing the symptoms and signs of violence against children, forms and types of violence against children, determination factors of the violence as well as the consequences and the impact of the domestic violence on the physical and psychological development of children. Based on the legal provisions and international conventions, parents, responsible institutions and the society in general are morally and legally obliged to respect and preserve the interest of the child. This article will show that in practice, these legal obligations are violated by parents and in specific cases also by the competent institutions because the lack of intervention. (shrink)

Although there has been much research on the connection between nonhuman animal cruelty/ abuse and domestic violence, the link between nonhuman animal care and domestic violence has received less attention. This study, based on responses from 477 college students in New Provi-dence, The Bahamas, indicates that the presence of domestic violence in homes is linked with the level of care and the prevalence of negative interactions with dogs. Dogs received 10 or more of 11 (...) components of essential care in 58.0% of homes without domestic violence compared with 43.7% in homes with domestic violence. A dog was reported being physically injured in 6.8% of homes when domestic violence was absent and in 13.6% of homes when domestic violence was present. The study suggests that in homes with domestic violence, dogs as well as people are at higher risk of intentional harm and/or neglect. (shrink)

This paper explores the feasibility of offering a restorative justice (RJ) approach in cases of domestic violence (DV). I argue that widely used RJ processes—such as ‘conferencing’—are unlikely to be sufficiently safe or effective in cases of DV, at least as these processes are standardly designed and practiced (Sections 1-6). I then support the view that if RJ is to be used in cases of DV, then new specialist processes will need to be co-designed with key stakeholders to (...) ensure they embody not only RJ principles, but also feminist theory and the concept of transformative justice (Section 7). This article aims to clarify and expand our conceptual repertoire for understanding domestic violence and abuse by making legible different characteristic harms, particularly those that cannot be made sense of in terms of physical harm. Sections 2 and 3 of this article review popular understandings of the harms of domestic violence and abuse. These often emphasize either (a) pain and suffering or (b) the loss of capacities for self-governance as characteristic harms of domestic violence (...) and abuse. In its second half, this article argues that domestic violence and abuse characteristically involve yet another harm to the victim, one that cannot neatly be explained in terms of hedonistic welfare or concerns for a victim's capacities for self-governance. More specifically, this article argues that through the characteristic social isolation of domestic violence and abuse, perpetrators alienate victims from what motivationally roots them to the world. Although relationships that motivationally root us to the world might make us fundamentally dependent on others and can cause us great pain, they nevertheless play a profoundly valuable role in our lives by giving us reasons to go on living. During the early months of the COVID-19 pandemic, domestic violence came to be understood as a national emergency. In this paper, we ask how and why domestic violence was constructed as a crisis specific to the pandemic. Drawing from newspaper data, we show that the domestic violence victim came to embody the violation of gendered boundaries between “public” and “private” spheres. Representations of domestic violence centered on violence spilling over the boundaries (...) of the home, infecting the home, or the home imploding. While theorists of crisis have focused on the central role of temporality in crisis construction, and especially the performative invocation of “new time,” we argue that crisis rhetoric often relies on anxiety about the transgression of spatial boundaries. Our spatial approach to crisis has two components. First, we argue that crisis framings often invoke the idea that seemingly distinct arenas of social life are becoming disorganized or blurred. And second, because thresholds between social spaces are coded as sacred during crisis, this spatial reordering is rendered dangerous, resulting in calls to resecure boundaries. (shrink)

The aim and objective of this study is to analyse the causes of domestic violence against married women in Pakistan providing a complete picture of understanding on the phenomenon. This study was conducted in Safoora Goth, Karachi one of the oldest residential centre of Karachi where all local ethnic groups and class of people are inhabited. The factors included in the study were various reasons of domestic violence, nature of domestic violence, types of (...) class='Hi'>domestic violence, separation, and feeling of deprivation, husband drug addiction, partner violence, family system, family economic, ages of women and all other such related causes regarding domestic violence. The universe of the study was Safoora Goth, Karachi. The calculated sample size was 313 respondents in which researcher selected simple random sampling technique. The tool for the data collection was a questionnaire. Hypotheses were tested statistically among 5 hypotheses all have gotten accepted and showed the result as there are various causes of domestic violence. Thus, the researcher concluded that family system, family income and husband drug addiction are related to the domestic violence in a great deal. (shrink)

Domestic violence is one of the most common forms of violence against women. Domestic violence during pregnancy is associated with adverse perinatal and maternal outcomes. We aimed to assess whether domestic violence was associated with mode of delivery, low birthweight and preterm birth in two sites in Nepal. In this prospective cohort study we consecutively recruited 2004 pregnant women during antenatal care at two hospitals between June 2015 and September 2016. The Abuse Assessment (...) Screen was used to assess fear and violence. Having ever experienced either fear or violence was defined as any domestic violence. Obstetric outcomes were obtained from hospital records for 1381 women, selecting singleton pregnancies only. Mode of delivery was assessed as birth by cesarean section or not. A birthweight of less than 2500 g was defined as low birthweight and preterm birth as birth before completion of 37 weeks gestation. Descriptive and multiple logistic regression analyses were performed to assess associations. Twenty percent of the women reported any domestic violence. Among all 1381 women, 37.6% gave birth by cesarean section. Of those women who delivered by cesarean section, 84.7% had an emergency cesarean section. Less than 10% of the babies were born prematurely and 13.5% were born with low birthweight. We found no significant association between exposure to any domestic violence during pregnancy and risk of a low birthweight baby or birth by cesarean section. However, having experienced both violence and fear was significantly associated with giving birth to a preterm infant [aOR 2.33 ]. Domestic violence is common in Nepal. This is a potential risk factor for severe morbidity and mortality in newborns. We found that the risk of having a preterm baby was higher for pregnant women who experienced both fear and violence. This should be recognized by the health sector. In this study, no significant differences were found in the rate of cesarean section nor low birthweight for women who had experienced any domestic violence compared to those who did not. (shrink)

In this article, I argue that victims of domestic violence characteristically suffer from two distinct kinds of moral harm: moral damage and moral injury. Moral damage occurs when the ability to develop or sustain good moral character has been compromised by an agent’s circumstances. Moral injury refers to a kind of psychological anguish that follows from when an agent causes or becomes causally implicated in actions that we ordinarily would understand to be morally grievous offenses because of their (...) circumstances. A person can experience moral damage or moral injury separately, but the experiences of moral damage and moral injury can also overlap. Because abusers often expect victims to adopt morally deficient dispositions and often implicate victims in wrongdoing, I argue that victims of domestic violence characteristically suffer from both moral damage and moral injury. By appreciating the different yet overlapping moral experiences of the victim, we become better positioned to identify strategies for responding to and repairing the different harms they suffer. In this paper I discuss two related ideas and cross-reference them, as it were, on the common ground of the Spinozistic text. First, I want to construct a Spinozistic account of domestic violence and a Spinozistic response to such violence. This will involve attempting to explicate the phenomenon (or at least one aspect of it, to be defined) through the terms and conceptual structure of Spinoza's Ethics. Second, I want to discuss a feminist reading (interpretation) of Spinoza, (...) that of Luce Irigaray. The projects work together, as a better Spinozistic account requires a charitable reading of Spinoza to which Irigaray points the way. Irigaray will turn out to be more Spinozistic that Spinoza himself. In addition, the construction of a Spinozistic response to domestic violence will highlight the textual basis of Irigaray’s reading. It is hoped that this will contribute to making Irigaray’s reading accessible to philosophers trained in the analytic tradition. The undercurrent of both discussions will be an attempt to explicate and further what I take to be a shared moral insight in the late twentieth century, namely, that domestic violence, and particularly violence against women as wives and partners, is morally wrong. In this article, the authors assess the still limited literature on domestic violence among immigrant women in major receiving countries so as to begin delineating a framework to explain how immigrant-specific factors exacerbate the already vulnerable position—as dictated by class, gender, and race—of immigrant women in domestic violence situations. First, a review of this scholarship shows that the incidence of domestic violence is not higher than it is in the native population but rather that (...) the experiences of immigrant women in domestic violence situations are often exacerbated by their specific position as immigrants, such as limited host-language skills, isolation from and contact with family and community, lack of access to dignified jobs, uncertain legal statuses, and experiences with authorities in their origin countries. This paper presents a case study that explores the application of systemic family therapy in working with children who are victims of violence within their family. The case study focuses on the Johnson family, comprising a father, mother, and their two children, who sought therapy after a traumatic incident of domestic violence. The therapeutic approach utilized a systemic family therapy framework, aiming to address the complex dynamics resulting from the violence and its (...) impact on family members. The goals include providing a safe environment for children to process their experiences, enhancing communication, promoting non-violent parenting, and strengthening the family’s support network. The interventions involved individual sessions with the children, family sessions, psychoeducation, and collaborative goal setting. Throughout the therapy process, significant improvements were observed, including enhanced communication, improved emotional well-being for the children, non-violent parenting strategies, and the development of a support network. The findings of this case study highlight the effectiveness of systemic family therapy in promoting healing, fostering healthy relationships, and creating a nurturing environment for children affected by family violence. Law No. 11,340/2006, also known as the "Maria da Penha" Law, was created after the condemnation to exclusively protect women victims of violence. In Article 9, § 2, item II, there is a specific rule on the employment contract, which allows the judge to ensure that women in situations of domestic and family violence maintain the employment relationship for up to six months. During this period, women have the right to be absent from work, thus contributing (...) to the preservation of their physical and psychological integrity. The objective of this paper is to better analyze how the international system may further contribute to increasing the labor legal protection of women victims of domestic violence. A prospective-documentary technique was employed to analyze the Brazilian domestic legislation and the international system, including norms of the International Labor Organization (ILO) and the jurisprudence of the Inter-American Commission on Human Rights of the Organization of American States (OAS). These analyses reveal that despite the separation of social phenomena – domestic violence occurring in the private sphere, and work belonging to the public sphere of the victim's life – international principles, so-called soft law rules, can be used to further enhance the protection of women victims of domestic violence in Brazil. These women require a whole set of mechanisms that protect their physical, psychological, and emotional integrity, but also guarantee financial and professional support. This multidimensional response to domestic violence is central to a country that ranks 5th in the world for femicide. (shrink)

Theoretically, violence is a human rights issue, and human rights are fundamental to values of dignity, equality, non-discrimination and non-interference, and these cut across gender, social, cultural, political, class, religious and geographical issues. Human beings, properties and resources are in millions daily destroyed. Children are abused. Women remain injured and humiliated, so much so that men’s status seemed to be changing. Hence, this study embarked on examining Women in Domestic Violence inNigeriausing gender perspectives. Battles against domestic violence in the People’s Republic of China have been carried out since 1995. In this study, legislative progression of laws related to domestic violence is first examined and clarified; second, findings from the legislative review are investigated on the basis of civil and criminal cases; third, the interaction among social and traditional norms, legislation, and judicial outcomes is explored and interpreted from a sociosemiotic perspective. It is found in this study that: 1) legislation (...) and judicial practices of domestic violence in the P. R. C. are closely intertwined with social and traditional norms; 2) there is a gap between judicial practices dealing with domestic violence and the legislation; 3) the Anti-Domestic Violence Law offers a notch for state powers to embrace the familial relationship and to safeguard a victim. This article examines the complexity of feminized domestic labor in the context of global migration. I view unpaid household labor and paid domestic work not as dichotomous categories but as structural continuities across the public and private spheres. Based on a qualitative study of Filipina migrant domestic workers in Taiwan, I demonstrate how women travel through the maid/madam boundary—housewives in home countries become breadwinners by doing domestic work overseas, and foreign maids turn into foreign brides. While (...) migrant women sell their domestic labor in the market, they remain burdened with gendered responsibilities in their own families. Their simultaneous occupancy of paid and unpaid domestic labor is segmented into distinct spatial settings. I underscore women’s agency by presenting how they articulate their paid and unpaid domestic labor and bargain with the monetary and emotional value of their labor. (shrink)

Typology of perpetrators of domestic violence The objective of the research conducted by the author was to obtain an answer to the question: could we distinguish different types of intrafamily violence perpetrators considering a specified profile of personality factors and temperament traits and how domestic violence perpetrators cope with stressful situations? The research was conducted on a group of 325 men who were convicted pursuant to article 207§1 & 2 of harassment over family members. (...) In terms of a gender the group was homogenous. On the basis of the literature on the subject, the following personality traits of violence perpetrators were categorised: locus of control, self-acceptance, aggressiveness, hostility, intelligent quotient and temperament traits. The following research techniques were employed in the study: the Wechsler Intelligence Scale, Berger's Self-Acceptance Scale, the Delta Questionnaire by R. Drwal, the SABD Questionnaire - Buss-Durkee, Formal Characteristics of Behaviour - Temperament Inventory by J. Strelau, the WCQ questionnaire by R.S. Lazarus and S. Folkman, a categorised interview and an analysis of court records. As a result of the analysis conducted on a group of the studied sample of violence perpetrators, four subgroups, differing in terms of selected personality traits, were specified. They are reactively aggressive perpetrators, perpetrators of low preventive competences, psychopathic and retaliatory perpetrators and perpetrators with a big adaptive potential. Further on, four distinguished groups have been characterised in terms of stress-coping strategies, and psychological processes of coping with stress proceeded differently in the research group. Investigations and commentaries on domestic violence and its sequelae have been featured in several recent medical journals. For discussion purposes, I will highlight aspects from three of them. According to Megan Bair-Merritt and her colleagues, in a recent issue of the Journal of Pediatrics, screening for domestic abuse in a pediatric practice can uncover cases that otherwise might not be identified.1 Of the women who brought their children to a pediatric clinic at Johns Hopkins Children’s Center, 23 (...) percent disclosed that they had been victims of either emotional or physical abuse; 57 percent of the abused women indicated that at least one child had been exposed to this violent interaction. This essay argues that "the family" should be understood in functional terms:whatever functions as a family should have the legal status of a family. Theauthor's argument thus avoids two extreme positions. The first is the position ofthe hard-line "platonic" essentialists who, on grounds of nature, supernature, orcultural history, argue that a family unit must comprise heterosexual partners.The second is the position of the radical relativist, who argues that there are noessences whatsoever or that essences are purely (...) arbitrary. A complex conjuncture of ideological constructions obscured and rationalized the systematic exploitation of farm women. First, farming and homemaking, to which people cling in an attempt to avert the alienation of wage labor, provide a basis for evaluating one's labor in terms that, ironically, makes them vulnerable to super-exploitation. Second, agrarian ideologies, with their strongly patriarchal bias, did not allow women to understand themselves as public actors. Modernizing elite ideologies, specifically the equation of entrepreneurial individualism and efficiency with “progress” and (...) affluence, and the “cult of domesticity” with its redefinition of men's and women's roles, promised women greater equality within the family; however, these normative codes simultaneously opened the farm and home to greater dependence on capitalist markets. The ideology of entrepreneurial individualism also provided templates through which farm men and women (mis)understood their relative poverty as being the result of private, individual choices. In addition, virtually all media assumed a sector differentiated only by commodity, rendering size, class, or other distinctions invisible. Finally, the ideology of separate spheres, as it developed in the nineteenth century, created a segmented and discriminatory labor market for women. The period focused on, the late 1940s and the 1950s, was crucial in establishing the terms of the post-War order. (shrink)

Psychodrama is a therapeutic method in which the stage is used to enact and reenact life events with the aim of instilling, among other positive changes, hope and empowerment in a wide range of populations suffering from psychological duress. The therapeutic process in psychodrama moves away from the classic treatment of the individual in isolation to treatment of the individual in the context of a group. In domestic violence situations, in which abusive men seek to socially isolate their (...) victims from family and friends, the social support that psychodrama provides can positively influence the psychological health and well-being of the participants. This qualitative study examines the manner in which psychodramatic treatment can empower abused women residing in domestic violence shelters and help them regain control of their lives. An action research study of domestic violence survivors living in a women's shelter in Israel, over a 12-month period, demonstrates the role of psychodrama therapy in promoting the reduction of anxiety, stress, guilt, and self-blame, while reinforcing perceptions of self-worth and confidence. These findings contribute to our understanding of the potential of psychodrama in helping reshape life roles and reframe experiences within a creative process, with the aim of facilitating a transition from powerlessness to powerfulness among vulnerable populations. The dismantling of the welfare state across the United Kingdom (and indeed a number of other Western industrialised democracies, such as Canada and the United States) and the reductions to welfare provisions and entitlements are having a detrimental impact on women's equality and safety. Towers and Walby argue that the recent cuts to welfare provision in the United Kingdom, particularly for women's services, could lead to increased levels of violence for women and girls. This paper makes the argument that (...) female victims of domestic abuse experience violence on two levels: first, at the intimate/personal level through their relationship with an abuser and, second, at a structural level, through the state failing to provide adequate protection and provision for women who have experienced violence in intimate relationships. Using a specific example of post-violence community services delivered to both the children of women who have experienced domestic violence and the women themselves, this paper draws on empirical research carried out in 2010–2011 with London-based third-sector and public sector organisations delivering the Against Violence and Abuse Project ‘Community Group Programme’. We argue that the lack of services for women involved in, or exiting, a violent relationship can amount to state-sanctioned violence, if funding is withheld, or indeed, stretched to breaking point. This article is an attempt to develop a theory of peace education through an examination of the Fukushima Daiichi nuclear disaster. It examines why Japan did not avoid this terrible nuclear disaster. This is an educational issue, because one of the major impacts of Fukushima's catastrophe is that it indicates the failure of peace education. In order to reestablish a theory of peace education, the concept of domestic tranquility is discussed. This article questions whether the Japanese public order is (...) consistent with democratic principles. Jane Roland Martin's examination of the concept of domestic tranquility is shown relevant. Martin's language analysis helps to distinguish whether or not Japanese domestic tranquility under nuclear crisis is democratic. I propose that post-Fukushima disaster peace education should be reformed as consistent with two democratic principles: acceptance of the diversity of peace and continuous negotiation among these different narratives. Domestic violence discourse challenges cultural acceptance of male violence against women, yet it is often constituted by gendered, racialized, and class-based hierarchies. Transformative efforts have not escaped traces of these hierarchies. Emancipatory ideals guiding 1970s feminist activism have collided with conservative impulses to maintain and strengthen family relationships. Crime control discourse undermines critiques of dominance through its focus on individual men. Domestic violence discourse exemplifies both resistance to and replication of hierarchies of power.

Adolescent-to-Parent Violence or Child-to-Parent Violence is a specific form of violence that has remained inconspicuous until recently, but is becoming a mounting social issue and is increasingly the focus of scientific research. Of the variables related to APV, the study assessed the characteristics of the family system and its relationship to the psychosocial adjustment of adolescents, an aspect scarcely examined in the literature. Thus, a field study was performed on a community sample of 210 adolescents aged (...) 12–17 years who were assessed on measurements of APV, parenting, victimization, and psychological adjustment. The results revealed higher rates of psychological APV, and no gender effects in violence exercised against either parent. The adolescents involved in APV exhibited a greater psychological maladjustment in the different areas under analysis. Moreover, adolescents engaging in psychological APV reported a parental socialization style characterized by severe strictness and supervision in comparison to non-aggressors not implicated in psychological APV. Finally, adolescents exercising APV who were victimized by their parents showed more psychological, personal, and school maladjustment. These results have implications for needs analysis and the planning of community prevention strategies. (shrink)

This research examines the implementation and judicial response to Uzbekistan's new domestic violence laws enacted in 2023. Through an exploration of the semiotics of these laws, we uncover the nuanced portrayal of victim as "wife" instead of "human," reflecting a societal prioritization of family dynamics over individual rights. Through this analytical lens, we examine how domestic violence laws, as legal transplants, are interpreted by the judicial system. We highlight their translation into people’s behavior, judicial traditions, (...) and the struggling with socio-cultural norms. The findings from both quantitative and qualitative research contribute to understanding effectiveness and improving practices to achieve justice for victims. We investigated how new domestic violence laws are applied in the judicial system and the challenges victims face in seeking justice. The research highlights the necessity and effectiveness of laws while revealing socio-cultural resistance within the judicial system, such as holding victims accountable in domestic violence cases. The judicial response to domestic violence cases often favors restorative justice mechanisms, emphasizing reconciliation and lenient penalties. Notably, 61% of criminal cases conclude with reconciliation. Despite the impossibility of reconciliation in administrative cases, courts resort to the concept of "insignificance" of the violation, terminating cases on this basis in 28% of instances. However, the absence of reconciliation significantly diminishes the effectiveness of laws, depriving victims of restitution and the ability to influence the perpetrator's behavior. In the era of restorative justice application, rising questions emerge regarding its effectiveness, particularly due to socio-cultural pressure on victims and their unequal negotiation opportunities. In 2018, Attorney General Jeff Sessions, in Matter of A-B-, attempted to bar victims of non-state actors—such as intimate partners and local gangs—from obtaining asylum in the United States. This article focuses on domestic violence-based asylum claims that made it to the US Circuit Court of Appeals during the Trump administration and the first five months of the Biden administration. My interdisciplinary approach goes beyond analysing the effect that Matter of A-B- has had on the outcomes of cases (...) and asks how judges evaluate the credibility of petitioners, determine whether domestic violence can rise to the level of persecution, and decide whether a government was unwilling or unable to protect the victim. A systematic analysis of 83 appellate level verdicts shows that asylum decisions are fraught with inconsistencies and that many judges lack a sophisticated understanding of domestic violence, credibility, and trauma.
