This paper shall make an attempt to critically reflect on the conceptualization of emotions in the Indian Philosophical systems. To bring out the insight, the paper is divided into three main sections. The first section of the paper entitled ‘The Body-Emotions-Mind Complex and the Question of Self: Understanding the Dualistic Tradition’ will make an analysis of emotions and the mind-body complex vis-à-vis the question of self or consciousness in Indian Philosophy with special reference to the study of Advaita Vedānta and (...) the philosophical position of Upaniṣadic teachings. It will also incorporate the Nyāya account of emotions in the Indian philosophical system. The second section of the paper is entitled as ‘Triguṇa and the Emotional Experience: A Perspective in Sāṃkhya Philosophy’. It will reflect on the systematic presentation of Sāṃkhya philosophical system on account of its relation between the two ontological realities — puruṣa and prakṛti. It is this prakṛti which is constituted of the three guṇas — sattva, rajas and tamas; and therefore is the embodied self having its association with emotions. The third section of the paper entitled ‘Understanding Religious Emotions: Towards a Positive Representation of Emotions in Indian Philosophy’ will make an attempt to critically reflect on the necessary shift required in conceptualizing emotions in the Indian Philosophical systems. That is to say, from a negative connotation of emotions to a more significant positive account of emotions in human-spiritual life. This necessary shift will be directed towards the understanding of Religious Emotions — faith and devotion which can serve as a guiding principle to justify the soteriological approach of Indian Philosophy, i.e. towards pure consciousness. This paper discusses a central idea of our everyday life—human actions and the role of luck in the moral life. The aim of this paper is to formulate and discuss the problem of moral luck, thereby dealing with the question: ‘what is the status or role of luck in the moral life of an individual?’ Bernard Williams and Thomas Nagel highlight the juxtaposition of the two contradictory terms: ‘Luck’ and ‘Morality’ and used the term ‘moral luck’ which inculcates the view (...) that the factor of luck or fortune can affect the moral worth of an individual. In this context, the paper is specifically concerned with the philosophical problem of moral luck which raises a conceptual tension between morality and responsibility by emphasizing that moral assessment, evaluation and justification of human actions are all subjected to luck. Further, in the light of this philosophical problem, the paper also attempts to postulate a possible moral framework with an aim to analyse and conceptually map the status of the juxtaposition of luck and morality. This article shows how the construction of transnational migrant communities across international borders poses a challenge to the assumed "natural" isomorphism of space, nations, and cultures that typically exists in theories of cultural and cross-cultural psychology. One of the principal aims of this article is to add to the critical impulse that initially defined the vision of cultural psychology by analyzing how transnational diaspora communities have become new sites for the rethinking of core concepts such as culture, self, nation and (...) identity. This article examines how efforts at legal legibility acquisition by gender diverse litigants result in problematic (e.g., narratives counter to self-identity) and, at times, erroneous discourses on sex and gender that homogenize the litigants themselves. When gender diverse persons approach the court with a rights claim, the narrative they present must necessarily limit itself to a normative discourse that the court may understand and, therefore, engage with. Consequently, the everyday lived experiences of gender diverse persons are often deliberately erased from (...) the narrative as litigants mould themselves into the pre-existing normative legal categories of gender and sex. As a result of such mechanisms, the article finds that gender diverse litigants face epistemic injustice in the courts as their legal legibility is constructed within a constraining gender binary paradigm of judicial discourse.The article explores the trajectory of transgender rights in India, through an analysis of case law prior to and post the landmark NALSA decision, to understand how the approach to transgender rights and identities has been shaped by and shapes, in turn, normative conceptions of gender. The article argues for the incorporation of temporal pluralism into the law that would allow courts to hear gender diverse litigant accounts premised on contemporary gender diversity beyond the binary (rather than incontestable prior understandings based in past precedent), which would better account for such social injustices. This paper articulates a functionalist account of intra-party democracy (IPD). Like realist critics, we insist that IPD practices be evaluated on the basis of whether they facilitate resistance to domination and capture at the level of the polity as a whole, and therefore accept certain realist worries about IPD. Yet realists neglect the possibility that wealthy interests could control the political agenda by capturing all viable parties simultaneously-and that mass-facing IPD could counter this threat of oligarchic agenda capture. Taking this (...) as the key function of IPD within broader democratic systems, we conclude that inclusionary party reform is less urgent in more flexible party systems, where dissenters are better able to resist this threat from within the framework of inter-party competition. Regardless of the context, meanwhile, we also conclude that mass-facing IPD practices should aim at enabling ordinary members and supporters of a party to resist agenda capture by oligarchic interests. Though we stop short of defending any particular set of reforms, we reject the emphasis of recent IPD advocates on individualized forms of deliberative participation, in favor of a more oppositional and collectively-oriented approach-on the grounds that the latter is more likely to encourage the development of effective institutions of countervailing power. In recent versions of professional genre analysis, context has assumed increasingly critical importance, thus redefining genre as a configuration of text-internal and text-external factors. The emphasis on text-external properties of genre has brought into focus the notion of interdiscursivity as distinct from intertextuality, which is primarily viewed as appropriation of text-internal resources. Drawing evidence from a number of professional contexts, this article explores the nature, function, and use of interdiscursivity in genre theory, defining interdiscursivity as a function of appropriation of (...) generic resources across discursive, professional and cultural practices, which, it is claimed, is central to our understanding of the complexities of genres that are typically employed in professional, disciplinary, and institutional communication. Similarity is one of the most important relations humans perceive, arguably subserving category learning and categorization, generalization and discrimination, judgment and decision making, and other cognitive functions. Researchers have proposed a wide range of representations and metrics that could be at play in similarity judgment, yet have not comprehensively compared the power of these representations and metrics for predicting similarity within and across different semantic categories. We performed such a comparison by pairing nine prominent vector semantic representations with seven established (...) similarity metrics that could operate on these representations, as well as supervised methods for dimensional weighting in the similarity function. This approach yields a factorial model structure with 126 distinct representation‐metric pairs, which we tested on a novel dataset of similarity judgments between pairs of cohyponymic words in eight categories. We found that cosine similarity and Pearson correlation were the overall best performing unweighted similarity functions, and that word vectors derived from free association norms often outperformed word vectors derived from text (including those specialized for similarity). Importantly, models that used human similarity judgments to learn category‐specific weights on dimensions yielded substantially better predictions than all unweighted approaches across all types of similarity functions and representations, although dimension weights did not generalize well across semantic categories, suggesting strong category context effects in similarity judgment. We discuss implications of these results for cognitive modeling and natural language processing, as well as for theories of the representations and metrics involved in similarity. (shrink)

As social media becomes increasingly popular, human subjects researchers are able to use these platforms to locate, track, and communicate with study participants, thereby increasing participant retention and the generalizability and validity of research. The use of social media; however, raises novel ethical and regulatory issues that have received limited attention in the literature and federal regulations. We review research ethics and regulations and outline the implications for maintaining participant privacy, respecting participant autonomy, and promoting researcher transparency when using social (...) media to locate and track participants. We offer a rubric that can be used in future studies to determine ethical and regulation-consistent use of social media platforms and illustrate the rubric using our study team’s experience with Facebook. The global COVID-19 pandemic has brought the issue of rationing finite healthcare resources to the fore. There has been much academic debate, media attention, and conversation in the homes of everyday individuals about the allocation of medical resources, diagnostic testing kits, ventilators, and personal protective equipment. Yet decisions to prioritize treatment for some individuals over others occur implicitly and explicitly in everyday practices. The pandemic has propelled the socially taboo and unavoidably prickly issue of healthcare rationing into the public spotlight—and (...) as such, healthcare rationing demands ongoing public attention and transparent discussion. This article concludes that in the aftermath of COVID-19, policymakers should work towards normalizing rationing discussions by engaging in transparent and honest debate in the wider community and public domain. Further, injecting greater openness and objectivity into rationing decisions might go some way towards dismantling the societal taboo surrounding rationing in healthcare. (shrink)

In 2012, two major professional societies representing Europe and the United States released influential statements that would propel a commercial market for social egg freezing, in which women bank their oocytes for later use in order to avoid compromised fertility that comes with age. While the European Society of Human Reproduction and Embryology condoned SEF based on reproductive autonomy and justice, the American Society for Reproductive Medicine discouraged SEF based on insufficient data and concerns about false hope. In this article, (...) we map the contexts and discursive moves by which the biomedicalization of SEF proceeded since 2012. We compare professional bioethical arguments that made the case to approve SEF in Europe with news and popular media discourse that formed and shaped the commercial marketization of SEF in the United States despite the recommendation of the ASRM. While a statist pronatalist perspective informed the former, a distinctly private labor market recruitment strategy utilizing a Lean In efficiency model of feminism buttressed the latter. (shrink)

Does language dominance modulate knowledge of case marking in Hindi-speaking bilinguals? Hindi is a split ergative language with a rich morphological case system. Subjects of transitive perfective predicates are marked with ergative case (-ne). Human specific direct objects, indirect objects, and dative subjects are marked with the particle -ko. We compared knowledge of case marking in Hindi-English bilinguals with different dominance patterns: 23 balanced bilinguals and two groups of bilinguals with Hindi as their weaker language: 24 L2 learners of Hindi (...) with age of acquisition (AoA) of Hindi in adulthood and 26 Hindi heritage speakers with AoA of Hindi since birth) in oral production and acceptability judgments. The balanced bilinguals outperformed the English-dominant bilinguals; the L2 learners and the heritage speakers, who showed similar lower command of the Hindi case marking system, with the exception of –ko marking as a function of specificity with direct objects. We consider how dominant language transfer, age of acquisition of Hindi, and input factors may explain the acquisition and knowledge of morphology in Hindi as the weaker language. (shrink)

Background The world is urbanizing rapidly; more than half the world’s population now lives in urban areas, leading to significant transition in lifestyles and social behaviours globally. While offering many advantages, urban environments also concentrate health risks and introduce health hazards for the poor. In Bangladesh, although many public policies are directed towards equity and protecting people’s rights, these are not comprehensively and inclusively applied in ways that prioritize the health rights of citizens. The country is thus facing many issues (...) that raise moral and ethical concerns. Methods A narrative literature review was conducted between October 2016 and November 2017 on issues related to social justice, health, and human rights in urban Bangladesh. The key questions discussed here are: i) ethical dilemmas and inclusion of the urban poor to pursue social justice; and ii) the ethical obligations and moral responsibilities of the state and non-state sectors in serving Bangladesh’s urban poor. Using a Rawlsian theory of equality of opportunity to ensure social justice, we identified key health-related ethical issues in the country’s rapidly changing urban landscape, especially among the poor. Results We examined ethical dilemmas in Bangladesh’s health system through the rural–urban divide and the lack of coordination among implementing agencies. The unregulated profusion of the private sector and immoral practices of service providers result in high out-of-pocket expenditures for urban poor, leading to debt and further impoverishment. We also highlight policy and programmatic gaps, as well as entry points for safeguarding the right to health for Bangladeshi citizens. Conclusions The urban health system in Bangladesh needs a reform in which state and non-state actors should work together, understanding and acknowledging their moral responsibilities for improving the health of the urban poor by engaging multiple sectors. The social determinants of health should be taken into account when formulating policies and programs to achieve universal health coverage and ensure social justice for the urban poor in Bangladesh. The advent of techniques of sex selection that rely on assisted reproduction led to a questioning of whether sex selection should be deemed always and everywhere unethical. While China and India are normally associated with condemned practices, they are also implicated in processes that constitute globally stratified sex selection inclusive of its more valued form, often referred to as family balancing. Through an application of Ong and Collier’s concept of global assemblage, I demonstrate how family balancing, which has taken on (...) a “global form,” is tied to an “assemblage” of factors related to the anti-natal, population control contexts that have been pervasive in Asia. Three simultaneously occurring processes since the mid-1990s constituted stratified sex selection: the surfacing of China and India as figurative counter examples in deliberations of ethics on new techniques; active national surveillance of sex ratios as well as denunciation and criminalization of sex selective abortion in China and India; and the role of China and India in neoliberalizing population control and developing globalized markets in reproduction. Accounting for globally stratified sex selection requires a more robust interpretation of ethics that rethinks disciplinary approaches just as much as relativist ones in which respect for individual autonomy tends to overtake all other concerns. Names are not objective, they accrue subjective associations, for example 'Terrorist' has a very different connotation to 'Freedom-fighter'. The contributors seek the truth beneath the names assigned in an effort to remove the obscurity created by the power of 'the politics of naming' to the reality of the situation, taking examples from Al (...) Qaeda, Russia's demonization of the Chechens and naming in the Israeli-Palestine conflict, among other important contemporary debates. _Terrorism and the Politics of Naming_ makes a substantial contribution towards elucidating the power of naming in the discourse of conflict and will be of great interest to students and scholars of political philosophy, political theory, and politics and the media. Changes and development in education in India; a study.

The months preceding and following the inauguration of Donald Trump as the 45th President of the United States have incited furious debate about the authenticity of media discourse in the shaping of reality, including in particular the reporting of refugees from predominantly Muslim regions and their resettlement in Western nations. Much of this debate is rooted in how opposing discourse clans, such as liberal and conservative ideologies, construct a narrative of nationhood around contested views of refugees. Examining mainstream and alternative (...) media from a critical discourse analytic perspective, the article uncovers how two key narratives about the Syrian refugee crisis emerge when the media attempt to orient their respective audiences to government policy through the discursive formation of the American Dream. Drawing on aspects of historicity, linguistic and semiotic action, and social impact, the analysis of the data reveals a discursive fracas between a humanistic perspective on the crisis that exploits a banal understanding of the American Dream and a more dichotomous narrative that homogenises refugees as a threat to the American way of life. These observations add to the growing body of literature that questions the ways in which the media discursively shapes, and is shaped by, political ideologies. (shrink)

The Australian state of Victoria introduced new legislation regulating medical treatment and associated decision-making in March 2018. In this article we provide an overview of the new Medical Treatment Planning and Decisions Act 2016 and compare it to the former Medical Treatment Act 1988. Most substantially, the new Act provides for persons with relevant decision-making capacity to make decisions in advance regarding their potential future medical care, to take effect in the event they themselves do not have decision-making capacity. Prima (...) facie, the new Act enshrines autonomy as the pre-eminent value underlying the state’s approach to medical treatment decision-making and associated surrogate decision-making. However, we contend that the intention of the Act may not accord with implementation of the Act to date if members of the community are not aware of the Act’s provisions or are not engaged in advance care planning. There is a need for further research, robust community advocacy, and wider engagement for the intention of the Act—the promotion of “precedent autonomy” in respect to surrogate medical treatment decision-making—to be fully realized.
