This article examines how efforts at legal legibility acquisition by gender diverse litigants result in problematic (e.g., narratives counter to self-identity) and, at times, erroneous discourses on sex and gender that homogenize the litigants themselves. When gender diverse persons approach the court with a rights claim, the narrative they present must necessarily limit itself to a normative discourse that the court may understand and, therefore, engage with. Consequently, the everyday lived experiences of gender diverse persons are often deliberately erased from (...) the narrative as litigants mould themselves into the pre-existing normative legal categories of gender and sex. As a result of such mechanisms, the article finds that gender diverse litigants face epistemic injustice in the courts as their legal legibility is constructed within a constraining gender binary paradigm of judicial discourse.The article explores the trajectory of transgender rights in India, through an analysis of case law prior to and post the landmark NALSA decision, to understand how the approach to transgender rights and identities has been shaped by and shapes, in turn, normative conceptions of gender. The article argues for the incorporation of temporal pluralism into the law that would allow courts to hear gender diverse litigant accounts premised on contemporary gender diversity beyond the binary (rather than incontestable prior understandings based in past precedent), which would better account for such social injustices. This chapter examines the case for health care policies aimed at holding obese individuals responsible for their weight and for obesity-related health issues. In particular, it considers the merits of two arguments for policies that would seek to make obese individuals bear some of the higher health care costs associated with being that way. On the fairness argument, it is claimed that such policies would serve the interests of fairness by holding obese individuals to account for irresponsible lifestyle choices that (...) are linked to their higher weight and its associated health risks. On the public health promotion argument, it is claimed that adopting such policies could produce impressive public health benefits: encouraging people to make healthier lifestyle choices, reducing obesity rates, and reducing obesity-related health care spending. Both arguments face serious objections. Contrary to the fairness argument, policies aimed at holding obese individuals responsible for their weight or for related health problems would neither treat people as they deserve to be treated nor make the distribution of health care resources fairer. And contrary to the public health promotion argument, those policies would not produce better health outcomes for society at large. Indeed, they would tend to do just the opposite. Reflection on the shortcomings of those arguments reveals that their conclusion is false: society should not adopt policies aimed at holding obese individuals responsible for their weight or for obesity-related health problems. This paper discusses a central idea of our everyday life—human actions and the role of luck in the moral life. The aim of this paper is to formulate and discuss the problem of moral luck, thereby dealing with the question: ‘what is the status or role of luck in the moral life of an individual?’ Bernard Williams and Thomas Nagel highlight the juxtaposition of the two contradictory terms: ‘Luck’ and ‘Morality’ and used the term ‘moral luck’ which inculcates the view (...) that the factor of luck or fortune can affect the moral worth of an individual. In this context, the paper is specifically concerned with the philosophical problem of moral luck which raises a conceptual tension between morality and responsibility by emphasizing that moral assessment, evaluation and justification of human actions are all subjected to luck. Further, in the light of this philosophical problem, the paper also attempts to postulate a possible moral framework with an aim to analyse and conceptually map the status of the juxtaposition of luck and morality. This paper shall make an attempt to critically reflect on the conceptualization of emotions in the Indian Philosophical systems. To bring out the insight, the paper is divided into three main sections. The first section of the paper entitled ‘The Body-Emotions-Mind Complex and the Question of Self: Understanding the Dualistic Tradition’ will make an analysis of emotions and the mind-body complex vis-à-vis the question of self or consciousness in Indian Philosophy with special reference to the study of Advaita Vedānta and (...) the philosophical position of Upaniṣadic teachings. It will also incorporate the Nyāya account of emotions in the Indian philosophical system. The second section of the paper is entitled as ‘Triguṇa and the Emotional Experience: A Perspective in Sāṃkhya Philosophy’. It will reflect on the systematic presentation of Sāṃkhya philosophical system on account of its relation between the two ontological realities — puruṣa and prakṛti. It is this prakṛti which is constituted of the three guṇas — sattva, rajas and tamas; and therefore is the embodied self having its association with emotions. The third section of the paper entitled ‘Understanding Religious Emotions: Towards a Positive Representation of Emotions in Indian Philosophy’ will make an attempt to critically reflect on the necessary shift required in conceptualizing emotions in the Indian Philosophical systems. That is to say, from a negative connotation of emotions to a more significant positive account of emotions in human-spiritual life. This necessary shift will be directed towards the understanding of Religious Emotions — faith and devotion which can serve as a guiding principle to justify the soteriological approach of Indian Philosophy, i.e. towards pure consciousness. In the past few decades, there has been a growing literature on relational egalitarianism. Relational egalitarianism is a view on the nature and value of equality. In contrast to the dominant view in recent debates on equality—distributive egalitarianism, on which equality is about ensuring people have or fare the same in some respect—on the relational view, equality is a matter of the terms on which relationships are structured. But what exactly does it mean for people to relate as equals? And (...) why are relations of equality valuable? Relational egalitarians have offered quite different answers to each of these questions. In this article, I draw attention to some key issues that underlie these disagree- ments, and I offer a taxonomy of different viewpoints that have emerged in the recent literature on these matters. Background The world is urbanizing rapidly; more than half the world’s population now lives in urban areas, leading to significant transition in lifestyles and social behaviours globally. While offering many advantages, urban environments also concentrate health risks and introduce health hazards for the poor. In Bangladesh, although many public policies are directed towards equity and protecting people’s rights, these are not comprehensively and inclusively applied in ways that prioritize the health rights of citizens. The country is thus facing many issues (...) that raise moral and ethical concerns. Methods A narrative literature review was conducted between October 2016 and November 2017 on issues related to social justice, health, and human rights in urban Bangladesh. The key questions discussed here are: i) ethical dilemmas and inclusion of the urban poor to pursue social justice; and ii) the ethical obligations and moral responsibilities of the state and non-state sectors in serving Bangladesh’s urban poor. Using a Rawlsian theory of equality of opportunity to ensure social justice, we identified key health-related ethical issues in the country’s rapidly changing urban landscape, especially among the poor. Results We examined ethical dilemmas in Bangladesh’s health system through the rural–urban divide and the lack of coordination among implementing agencies. The unregulated profusion of the private sector and immoral practices of service providers result in high out-of-pocket expenditures for urban poor, leading to debt and further impoverishment. We also highlight policy and programmatic gaps, as well as entry points for safeguarding the right to health for Bangladeshi citizens. Conclusions The urban health system in Bangladesh needs a reform in which state and non-state actors should work together, understanding and acknowledging their moral responsibilities for improving the health of the urban poor by engaging multiple sectors. The social determinants of health should be taken into account when formulating policies and programs to achieve universal health coverage and ensure social justice for the urban poor in Bangladesh. The advent of the intelligent robot has occupied a significant position in society over the past decades and has given rise to new issues in society. As we know, the primary aim of artificial intelligence or robotic research is not only to develop advanced programs to solve our problems but also to reproduce mental qualities in machines. The critical claim of artificial intelligence advocates is that there is no distinction between mind and machines and thus they argue that there are (...) possibilities for machine ethics, just as human ethics. Unlike computer ethics, which has traditionally focused on ethical issues surrounding human use of machines, AI or machine ethics is concerned with the behaviour of machines towards human users and perhaps other machines as well, and the ethicality of these interactions. The ultimate goal of machine ethics, according to the AI scientists, is to create a machine that itself follows an ideal ethical principle or a set of principles; that is to say, it is guided by this principle or these principles in decisions it makes about possible courses of action it could takea. Thus, machine ethics task of ensuring ethical behaviour of an artificial agent. Although, there are many philosophical issues related to artificial intelligence, but our attempt in this paper is to discuss, first, whether ethics is the sort of thing that can be computed. Second, if we are ascribing mind to machines, it gives rise to ethical issues regarding machines. And if we are not drawing the difference between mind and machines, we are not only redefining specifically human mind but also the society as a whole. Having a mind is, among other things, having the capacity to make voluntary decisions and actions. The notion of mind is central to our ethical thinking, and this is because the human mind is self-conscious, and this is a property that machines lack, as yet. (shrink)

The role of various organizational pressures in influencing performance of firms has been an interesting research topic in a variety of fields and has received the attention of researchers working in the field of environmental strategy. Although there are previous studies that have looked at the influence of various pressures in influencing firms’ environmental strategies, our study provides a more holistic analysis considering a variety of such pressures in a single framework. We discuss a research study to analyze how pressures (...) from internal and external stakeholders of a firm, economic pressures, environmental regulations, and pressures of environmental compliance have affected environmental performance of firms using data collected from manufacturing firms in the United Kingdom. We have found that internal stakeholders provide the greatest impact in shaping environmental performance of firms, closely followed by economic pressures, environmental regulations, and external stakeholders in that order. Fears of penalties due to environmental compliance have the least impact, although this pressure also has a positive and significant impact on environmental performance. (shrink)

In this book, Professor Mohanty develops a new interpretation of the ontology and nature of Indian philosophical thinking. Using the original Sanskrit sources, he examines the concepts of consciousness and subjectivity, and the theories of meaning and truth, and explicates the concept of theoretical rationality that underlies the Indian philosophies. What bearing does living in an increasingly globalized world have upon the moral assessment of global inequality? This paper defends an account of global egalitarianism that differs from standard accounts with respect to both the content of and the justification for the imperative to reduce global inequality. According to standard accounts of global egalitarianism, the global order unjustly allows a person’s relative life prospects to track the morally arbitrary trait of where she happens to be born. After raising some worries (...) with these accounts, the author offers an alternative account of global egalitarianism, “social egalitarianism,” which locates the wrongfulness of global inequalities in their effects on social and political interaction rather than in the unfairness of their source. On this view, global inequalities wrongfully exclude the worse-off from partaking in the benefits of globalization. Consequently, social egalitarianism aims for the elimination of only those inequalities that impede such participation. (shrink)

The problem of academic dishonesty in general and exam cheating in particular, has been ubiquitous in schools, colleges, and universities around the world. This paper reports on the findings from teachers’ and students’ experiences and perceptions of exam cheating at Nepali schools, colleges, and universities. In so doing, the paper highlights the challenges of maintaining academic integrity in Nepali education systems. Based on qualitative research design, the study data were collected by employing semi-structured interviews with the teachers and the students. (...) Findings from the study indicated that over-emphasized value given to marks/grades and the nature of exam questions among others were the predominant factors. Our findings contribute to the practical understanding that academic institutions in Nepal have largely failed to communicate the value of academic honesty and integrity to the students of all levels of education despite the increasing prevalence of exam cheating. Therefore, exam cheating requires urgent attention from academic institutions, educators, and education leaders to educate students about the long-term educational and social values of academic honesty and integrity. This paper discusses the philosophical issues pertaining to Kantian moral agency and artificial intelligence. Here, our objective is to offer a comprehensive analysis of Kantian ethics to elucidate the non-feasibility of Kantian machines. Meanwhile, the possibility of Kantian machines seems to contend with the genuine human Kantian agency. We argue that in machine morality, ‘duty’ should be performed with ‘freedom of will’ and ‘happiness’ because Kant narrated the human tendency of evaluating our ‘natural necessity’ through ‘happiness’ as the end. Lastly, (...) we argue that the Kantian ‘freedom of will’ and ‘faculty of choice’ do not belong to any deterministic model of ‘agency’ as these are sacrosanct systems. The conclusion narrates the non-feasibility of Kantian AI agents from the genuine Kantian ethical outset, offering a utility-based Kantian ethical performer instead. (shrink)

In the name of nationalities like French, Spanish, Portuguese, Polish, and German, Europe got divided into many nation states, but in India Gujarati, Marathi,, Telugu Oriya, Bengali, Punjabi, Assamese, Tamil, Kannada, Malayalam nationalities were not divided into nation states. Instead coexistence has been made for thousands of years. India has maintained multiculturalism not only at the socio-cultural level but also at the political level. The problem of consciousness is one of the most important problems both in cognitive science and in philosophy. There are different philosophers and different scientists who define consciousness and explain it differently. In philosophy, ‘consciousness’ does not have a definition in terms of genus and differentia or necessary and sufficient conditions. In this paper, I shall explore the very idea of machine consciousness. The machine consciousness has offered causal explanation to the ‘how’ and ‘what’ of consciousness, but they fail to (...) explain the ‘why’ of consciousness. Their explanation is based on the ground that consciousness is causally dependent on the material universe and that of all conscious phenomena can be explained by mapping the physical universe. In this regard, consciousness is basically a physical phenomenon and can be mechanically explained following the naturalistic methods of science. In other words, the mechanistic assumption is that consciousness and mind have an artificial origin and therefore have to be understood only within a mechanistic framework available in the sciences. If this is so, then this epistemological theory of consciousness is essentially committed to scientific world view that cannot avoid metaphysical implication of consciousness. At the same time, neo-Advaitins have maintained that the evolution of nature leads to the manifestation of human consciousness only because consciousness is already implicit in the material nature. Thus, the existence of consciousness in this physical world far exceeds the methods of science and needs a non-mechanical metaphysical explanation. (shrink)

he mystery of consciousness is among the most important questions pondered upon, not only in philosophy but also in the cognitive science, psychology, neurobiology and other sciences. The problem of consciousness has been traditionally dealt by philosophy, but its importance in explaining mental phenomena has made it a subject matter for other sciences that emerged later. Each philosopher and scientist has followed his own method in defining it, and arriving at a universal agreement on its definition has become difficult. In (...) philosophy, ‘consciousness’ does not have a definition in terms of genus and differentia, or the necessary and sufficient conditions. On the one hand, idealists put all their efforts into explaining consciousness as a separate entity, without stepping away from their traditional path, because they believe that thinking, experience, and free will are not the properties of the physical entity. On the other hand, the scientific world puts its efforts into reducing consciousness to electrical and neurochemical processes of the brain because they believes that the brain works like a biologically programmed computer. Our approach to consciousness varies between these two explanations. We would like to address the problem of consciousness at two levels: cosmic and individual. Recent years have featured a leap in academic and public interest in Corporate Social Responsibility (CSR) activities and related corporate reporting. Two main themes in this literature are the exploration of management incentives to engage in and disclose this information, and of the use and value of this information to market participants. We extend the second theme by examining the interest that specific investor classes have in the use of CSR information. We rely on feminist intersectionality, which suggests that gender (...) intersects with other identities to yield different values, experiences, and opportunities that can lead to gender-based preferences for CSR information. Based upon a survey of 750 US-based retail investors, we find that female retail investors have a greater interest in the use of CSR information, relative to male retail investors. Women express greater anticipated future demand for this information than do men. Further, the magnitude of the increase from current use to anticipated future demand is greater for women than men. Age is a significant modifying factor in that the discrepancy between women of any age and older men is greater than that between women and younger men. Finally, women also exhibit greater demand for streamlining of the information flow, consistent with pressures induced by time poverty. It appears that current disclosure practices provide a less than optimal match with the needs of the information consumers that are primarily interested in using this information. This mismatch may result in a systematic disenfranchisement of female investing classes which suggests an ethical need to level the playing field. (shrink)

Family planning is the usual modern route to producing a small family. Can human behavioral ecology provide a framework for understanding family planning behavior? Hillard S. Kaplan (Yearb. Phys. Anthropol. 39:91–135) has proposed a general theory of human parental investment based on the importance of skills development in children. As modern, skills-based, competitive market economies are established, parental investment strategies would be predicted to become oriented toward producing increasingly competitive offspring in a pattern of coordinated investment in their embodied capital—in (...) other words, skills training along with good health to ensure their long-term productivity. Parental embodied capital and resources are also expected to be associated with motivation to produce competitive offspring. The basic parental investment trade-off between quality and quantity should predict greater investment in fewer children and the adoption of family planning behavior. Data on family planning in two ethnic groups in Northeast India (Khasi and Bengali) currently experiencing early-phase transition into modern market economies from very different social and ecological baselines are examined within this analytical framework. The results show a mixture of strategies in conjunction with family planning that involve decreased as well as increased investment in the embodied capital of children among Bengali and a divergence of investments in education and health among Khasi. These mixtures of strategies provide some insight into the motivations to use family planning in the face of economic transition, given differing local cultural and ecological conditions and the opportunity structures they provide. Fat stigma is pervasive. Being fat is widely regarded a bad thing, and fat persons suffer numerous social and material disadvantages in virtue of their weight being regarded that way. Despite the seriousness of this problem, it has received relatively little attention from analytic philosophers. In this paper, I set out to explore whether there is a reasoned basis for stigmatizing fatness, and, if so, what forms of stigmatization could be justified. I consider two lines of reasoning that might be (...) advanced to defend fat stigma. The first is broadly consequentialist. It seeks to justify stigmatizing fatness based on the public health benefits that might be produced by doing so. The second argument takes stigmatizing fatness to be a warranted response to the morally blameworthy failure to slim down exhibited by fat persons. Clarifying and assessing each of these two lines of reasoning is the main task of this paper. I argue that, upon careful examination, both these attempts to justify the stigmatization of fatness fail. (shrink)

Posthumanism is one of the well-known and significant concepts in the present day. It impacted numerous contemporary fields like philosophy, literary theories, art, and culture for the last few decades. The movement has been concentrated around the technological development of present days due to industrial advancement in society and the current proliferated daily usage of technology. Posthumanism indicated a deconstruction of our radical conception of ‘human’, and it further shifts our societal value alignment system to a novel dimension. The majority (...) of our population is getting deeply involved in virtual reality in daily life. Sooner or later, we shall get a different conception of ‘biological human being’ through the advancement of artificial intelligence technology. If an automated artificial system could replace the human brain and repair any physical loss of our biological body, it will certainly become a journey towards immortality for scientists. However, we must analyze whether posthumanism will consider ‘hybrid human beings’ as moral agents, similar to biological humans. This is why, in the future, the relation between biological human beings and posthumans will play an active role in designing artificial moral agents. Whether the future posthumans would overpower biological humanity or both of them would work as peers to form a digital utopian society and create new dimensions of rationality is still a case of anticipation. Our aim in this paper is to critically analyze the authenticity of the posthuman cyborg as an agent, their relations with humans and the emergence of ‘AI ethics’. (shrink)

In this paper, we would like to discuss Wittgenstein’s critique of the idea that a person’s experiences are necessarily private, and these experiences can only be expressible in a private language. Taking a clue from Wittgenstein, we intend to say that the person’s experiences though private, can also be known by others. In the following sections 243 of his Philosophical Investigations, Wittgenstein argues against the possibility of a private language about the subject’s inner experiences. He contends that by coining names/words (...) to name sensations and our inner experiences, we cannot create a private language. If we have a list of names, that cannot function as a language. We need predicate terms; we need the syntax to link the words in the form of a sentence. If we use private names and use the predicates from the language that everyone knows, then the private words will acquire public status like the terms ‘pain’ and ‘sensation.’ These terms are already part of the public language, and if private experiences like pain and sensation cannot be made public, we would not have these terms in our language at all. This is the reason why any application of words is public, and therefore, there is no possibility of a private language. Wittgenstein concentrates on the public rules that govern the correct application for the use of words. And the expressions are meaningful only when these are used according to rules of grammar; if these expressions do not follow any rules of grammar, these are simply meaningless. (shrink)
