Just Interpretations: Law Between Ethics and Politics.Michel Rosenfeld & Professor of Human Rights and Director Program on Global and Comparative Constitutional Theory Michel Rosenfeld - 1998 - Univ of California Press.
"An important contribution to contemporary jurisprudential debate and to legal thought more generally, Just Interpretations is far ahead of currently available work."--Peter Goodrich, author of Oedipus Lex "I was struck repeatedly by the clarity of expression throughout the book. Rosenfeld's description and criticism of the recent work of leading thinkers distinguishes his work within the legal theory genre. Furthermore, his own theory is quite original and provocative."--Aviam Soifer, author of Law and the Company We Keep.

Ethical Criticism and the Interpretation of Art.Ted Nannicelli - 2017 - Journal of Aesthetics and Art Criticism 75 (4):401-413.
This article brings together two prominent topics in the literature over the past few decades—the ethical criticism of art and art interpretation. The article argues that debates about the ethical criticism of art have not acknowledged the fact that they are tacitly underpinned by a number of assumptions about art interpretation. I argue that the picture of interpretation that emerges from the analysis of these assumptions is best captured by moderate actual intentionalism. Reflection upon the (...)

Chiastic Structure of the Vessantara J?taka: Textual Criticism and Interpretation Through Inverted Parallelism.Shi Huifeng - 2015 - Buddhist Studies Review 32 (1):143-159.
The Vessantara J?taka is not only the most popular of all the Buddhist J?taka tales, but is important in the tradition as a whole, generally considered by the Therav?din tradition to display the epitome of the Bodhisatta’s perfection of giving. While most studies have focused on philological approaches, numerous questions as to the text’s structure and how to interpret individual parts within that structure have remained unresolved. My study shall employ the theory of ‘chiasmus’ to shed new light on both (...)

Social Criticism and Ethical Aspects in Patricia Esteban Erlés and Abert Soloviev’s Hypermedial Short Stories.Ana Calvo Revilla - 2020 - Cultura 17 (2):99-115.
In online communication, writers incorporate into fictional representation imaginaries that arise from the interaction between various artistic manifestations. This paper explores the work of two spanish authors, Patricia Esteban Erlés and Albert Soloviev in order to study the social impact and ethical aspects of hypermedial short stories in the virtual space, since their works function as vehicles for social criticism. At the same time, the paper addresses fundamental questions associated with the understanding and interpretation of hybrid narrative microtexts.

An accessible introduction to cultural theory and an original polemic about the purpose of criticism. What is criticism for? Over the past few decades, violent disagreements over that question in the academy have burst into the news media. These conflicts have renewed the Culture Wars over the legacy of the 1960s, becoming entangled in national politics and leading to a new set of questions. Does a concern with race, gender, and sexuality, with unacknowledged power and privilege, with identity, (...)

    Criticism and Revolutions.Mara Beller - 1997 - Science in Context 10 (1):13-37.
The ArgumentIn this paper I argue that Kuhn's and Hanson's notion of incommensurable paradigms is rooted in the rhetoric of finality of the Copenhagen dogma — the orthodox philosophical interpretation of quantum physics. I also argue that arguments for holism of a paradigm, on which the notion of the impossibility of its gradual modification is based, misinterpret the Duhem-Quine thesis. The history of science (Copernican, Chemical, and Quantum Revolutions) demonstrates fruitful selective appropriation of ideas from seemingly “incommensurable” paradigms (rather (...)

Just Above the Fray - Interpretive Social Criticism and the Ends of Social Justice.Andrew Gibson - 2008 - Studies in Social Justice 2 (1):102-118.
The article lays down the broad strokes of an interpretive approach to social criticism. In developing this approach, the author stresses the importance of both a pluralistic notion of social justice and a rich ideal of personal growth. While objecting to one-dimensional conceptions of social justice centering on legal equality, the author develops the idea of there being multiple "spheres of justice", including the spheres of "care" and "merit". Each of these spheres, he argues, is subject to historical (...). He furthers this view by arguing that the social basis for these different spheres is best understood against the canvas of an ideal of self-fulfillment and individuality. Based on the elaboration of these two sets of premises—a pluralistic conception of social justice and a collective ideal of personal self-fulfillment—the article outlines the basis for and challenges inherent to the practice of interpretive social criticism. How is it that some theorists have been able to argue that, regarded as literature, such novels are always fictional? Itcan then be maintained that this imaginary (...)

Literary criticism is neither more nor less important today than it has been since the becoming an accepted activity in the Renaissance. The humanists of the sixteenth and seventeenth centuries created the institution of criticism as we know it: the recovery and analysis of works of art. They printed, edited, and interpreted texts that dated from antiquity and which had been lost or disheveled. Evangelical in their fervor, avid in their search for lost or buried riches, they also (...)

Merleau-Ponty's phenomenological method of description, Reduction and intentionality is interpreted as a schema for rhetorical criticism. The existential nature of "man speaking" becomes the object of criticism, As opposed to traditional concerns with rhetorical "effects" or auditor reactions. Merleau-Ponty's separation of authentic or existential speech (speaking) and sedimented speech (the spoken word) allows the critic to distinguish social-Cultural values from individual volitions in a given communication "gestalt". The dialectic of a body-Subject in communication with others can be examined (...)

In this article, I ask whether Korsgaard’s ethics can be reconciled with a hermeneutic understanding of the human subject. Hermeneutics, inspired by Nietzsche, has traditionally been skeptical about the notion that moral principles have authority over us. But Korsgaard’s account of normativity as grounded in self-consciousness and its reflective distance from beliefs and desires is strikingly similar to Gadamer’s description of human beings as distant and ‘free’ from their environment. The question hermeneutics poses to deontology is how a finite subject (...)

The past seven centuries of scholarly attention to and debate over the Roman de la Rose bear strong witness to the fact that the allegorical figure Faus Semblant presents us with an interpretive crux—one of many such in the poem—that we are not likely to resolve in the coming centuries. Perhaps it should come as no surprise that a character who so embodies paradox—a profane friar who is openly honest about his intent to deceive—should be so difficult to pin down; (...)

It presents the thinking of esteemed Western philosophers, aestheticians, and art and literary historians, and introduces to English-reading audiences some of Japan's most distinguished scholars, whose work has received limited or no exposure in the United States. In the first part, "Hermeneutics and Japan," contributors examine the difficulties inherent in articulating "otherness" without falling into (...)

Yet it is not clear that what stymies democratic justification is the failure to offer or accept public reasons. This ‘semantic reading’ of Nāgārjuna’s theory, despite its importance as a criticism of the ‘metaphysical interpretations’, would in itself be defective and improbable. Indeed, firstly, semantic interpretation presents a formal defect: it fails to clearly and explicitly express that which (...)
