The declaration of equal rights arguably created the modern political community. But this act of empowering individuals caused the disempowering of the political community. While in neo-Aristotelian conceptions of virtue and Bildung the concept of “second nature” describes the successful completion of human education, Hegel uses this term in order to analyze the irresolvably ambiguous, even conflictive nature of spirit. Spirit can only realize itself, in creating (1) a second nature as an order of freedom, by losing itself, in creating (2) a second nature—an order of externality, ruled by the unconscious automatisms of habit. In the second meaning of the term, “second nature” refers (...) to spirit’s inversion of itself: the free enactment of spirit produces an objective, uncontrollable order; "second nature" is here a critical term. On the other hand, the very same inversion of free positing into objective existence is the moment of the success of ("absolute") spirit. The „left Hegelian” interpretation of Hegel′s theory of Sittlichkeit has shown that the claim of the concept of autonomy to establish an internal connection between normativity and freedom can only be carried out, if the subject of autonomy is defined by its participation in social practices. While the left Hegelian interpretation thereby solves the paradoxes of the Kantian tradition of understanding autonomy, it is destined to repeat the paradoxical structure of autonomy in a new and fundamental form. This follows from (...) the insight – articulated by Hegel′s anti-Aristotelian concept of “second nature” – that participation in social practices is at the same time the medium and the other of autonomy. Is wanting not to be right – the endeavor that Martin Seel not only explores and defends but practices in his eponymous book (›Nichtrechthabenwollen‹) – the expression of a paradox, a self-contradictory undertaking? It is indeed if to want something means to judge it as right. The text proposes to understand the wanting Martin Seel speaks of differently. This can be done with the help of the figure of »active passivity,« in which Seel sees the essential thought of Adorno.

This essay examines how Joseph Beuys uses the social plastic concept (›soziale Plastik‹) to think about the relationship between art and democracy. To this end, the first part analyzes the oppositions that define this concept in order to read them as the basic determinations of a dialectical concept of democracy. Against this background, the second part of the essay deals with how Beuys understands the contribution of art to democracy. _Tragic Play_ explores the deep philosophical significance of classic and modern tragedies in order to cast light on the tragic dimensions of contemporary experience. Romanticism, it has often been claimed, brought tragedy to an end, making modernity the age _after_ tragedy. Christoph Menke opposes this modernist prejudice by arguing that tragedy remains alive in the present in the distinctively new form of the playful, ironic, and self-consciously performative. Through close readings of plays by William Shakespeare, Samuel Beckett, Heiner Müller, and (...) Botho Strauss, Menke shows how tragedy re-emerges in modernity as "tragedy of play." In _Hamlet_, _Endgame_, _Philoktet_, and _Ithaka_, Menke integrates philosophical theory with critical readings to investigate shifting terms of judgment, curse, reversal, misfortune, and violence. In Philosophy and Real Politics, Raymond Geuss outlines the program of a “realistic” investigation of politics and develops a critique of the normativistic approach that defines the mainstream of contemporary analytic political philosophy. The paper discusses the question of how these two elements, “realism” and “critique”, are related in Geuss. Drawing on some of Geuss′ considerations in Outside Ethics the paper argues that the very existence of “real politics” depends on the critique of those normativistic forms of thinking that threaten (...) to dissolve the reality of politics. In the Critique of Judgment, Kant quotes the traditional view of the relation between the ethical and the aesthetical ('the beautiful is the symbol of the morally good'). However, he elaborates this view in a radically new way: as equivalence between two forms of reflection, between ethical and aesthetic reflection. The article distinguishes three different aspects of aesthetic reflection in Kant and discusses their respective ethical meaning. It shows the unresolved tension between Kant's program of an 'aesthetics of autonomy' on (...) the one hand, and his reference to sensualistic and vitalist motifs of an aesthetic 'energetism' on the other. En la segunda (...) acepción del término, segunda naturaleza refiere a la inversión de sí mismo del espíritu. Por otro lado, la misma inversión de la libre posición en la existencia objetiva es el momento del éxito del espíritu (“absoluto”). Dieser herausgehobenen Bedeutung, die das Werk für Adorno hatte, entspricht nicht nur die lange Zeit, die er mit der Abfassung des Buchs beschäftigt war, sondern auch die lange Geschichte, die ihre zentralen Motive in seinem Denken haben. Philosophische Begriffsklärung, die Arbeit an "Begriff und Kategorien“ einer negativen Dialektik, versteht Adorno dabei als dialektischen Übergang in inhaltliches Denken – (...) und so betreibt er sie auch hier. Das hat Konsequenzen für die Form des kooperativen Kommentars, der in diesem Band versucht wird. The idea of Geistesgeschichte was an idealistic program. The critique of this program, however, leaves us with the task of thinking the historicity of spirit: There is no history without spirit. This thesis requires a materialist explanation.

This paper argues that modernity can only be properly understood when tragedy is viewed as one of the conditions internal to it. Modernity and tragedy are not mutually exclusive, as Hegel and Schlegel, for example both argue, but mutually inclusive. Each is determined by the other—as tragic modernity and as modern tragedy.

Sensibility: the indeterminacy of the imagination -- Praxis: the practice of the subject -- Play: the operation of force -- Aestheticization: the transformation of praxis -- Aesthetics: philosophy's contention -- Ethics: the freedom of self-creation.

The concept of negation is the central operator in distinguishing between historical change and natural evolution, which is constitutive of modern thinking. The crisis of this distinction is therefore the »crisis of negation « (Alain Badiou). The text examines this crisis by first considering Hegel’s concept of »determinate negation« and its impact on the modern understanding of revolution and then discusses two possible alternative understandings of negation: abstract negation (Luhmann) and infinite negation (Agamben).

Das Rechtssystem geht davon aus, dass der Mensch – und nur der Mensch – eine natürliche Person ist. Das sei ein Irrtum, argumentiert Malte-Christian Gruber, denn die Rechtssubjektivität wird keineswegs alleine mit dem bloßen Menschsein begründet. Es ist die sittliche Autonomie, die den Menschen zu einem »Subjekt, dessen Handlungen einer Zurechnung fähig sind« (Kant) und mithin zur Person macht. Personen werden nicht mit dem Menschsein als solchem identifiziert, sondern durch die Zuschreibung von Handlungs- und Rechtsträgerschaft. Eine solche funktionale Vorstellung von (...) Rechtssubjektivität ist prinzipiell auch dazu imstande, neben Menschen noch weitere autonome Agenten als Träger von Rechten und Pflichten ein- zusetzen, z.B. technische Artefakte und andere nicht-menschliche Agenten. Christoph Menke macht dagegen darauf aufmerksam, dass die Erfindung neuer Rechte das eigentliche Bewegungsgesetz der politischen Emanzipation in der Moderne war. Das begann mit den bürgerlichen Revolutionen und ist immer noch das generelle Modell, mit dem Politik und Theorie operieren, die neue Rechte für nicht-menschliche Lebewesen und Artefakte einfordern. So wie im 19. und 20. Jahrhundert die rechtliche Emanzipation zunächst über die Grenzen bürgerlicher Subjektivität hinausgeführt hat und soziale und kulturelle Rechte erfand, so sollen wir nun den weiteren, konsequenten Schritt tun und auch noch die Bindung der juridischen Anerkennung an die Kategorie menschlicher Subjektivität aufbrechen. Auch Bio- und Artefakte sollen als eigenständige Rechtssubjekte rekonstruiert werden. Es fehlt ihnen allerdings etwas, das in den emanzipatorischen Kämpfen der Vergangenheit schlechthin grundlegend war: Ein Träger von Rechten zu sein, hieß, ein Fordernder von Rechten, ja, ein Kämpfer für Rechte gewesen zu sein. Man konnte keine rechtliche Person als Träger von Rechten sein, ohne ein politisches Subjekt als Kämpfer und Denker von Rechten gewesen zu sein. Wenn die Bindung der rechtlichen Personalität an die menschliche Subjektivität aufgelöst wird, damit es Bio- und Artefakt-Rechte geben kann, löst sich zugleich auch diese Einheit von rechtlicher Personalität und politischer Subjektivität auf, die die moderne Idee der Rechte definiert hatte. Parallax, or the change in the position of an object viewed along two different lines of sight and more precisely, the assumption that this adjustment is not only due to a change of focus, but a change in that object's ontological status has been a key philosophical concept throughout history. Building upon Slavoj Žižek's The Parallax View, this volume shows how parallax is used as a figure of thought that proves how the incompatibility between the physical and the theoretical touches (...) not only upon the ontological, but also politics and aesthetics. Spanning philosophy, parallax is then a rich and fruitful concept that can illuminate the studies of those working in epistemology, ontology, German Idealism, political philosophy and critical theory. The Value of Critique casts its gaze on the two dominant modes of passing judgment in art--critique and value. The act of critique has long held sway in the world of art theory but has recently been increasingly abandoned in favor of evaluation, which advocates alternate modes of judgment aimed at finding the intrinsic "value" of a given work rather than picking apart its intentions and relative success. This book's contributors explore the relationship between these two practices, finding that one (...) cannot exist with the other. As soon as a critic decides an object is worthy enough of their interest and time to critique it, they have imbued that object with a certain value. Similarly, theories of value are typically marked by a critical impetus: as much as critique takes part in the construction of evaluations, bestowing something with value can then trigger critiques. Assembling essays from an international array of authors, this book is the first to put value, critique, and artistic labor in conversation with one another, making clear just how closely all three are related.
