In recent years, a number of philosophers have suggested that the aesthetic value sometimes depends on moral value. In this paper, I motivate and defend the inverse position: the view that aesthetic value sometimes partially grounds moral value. I appeal to Grand Budapest Hotel and The Lovely Bones to show that maudlin treatments of morally serious subject matter are sometimes disrespectful, in part because they are maudlin; I appeal to Madame Bovary to show that lyrical treatments of morally serious subject (...) matter are compassionate, in part because they are lyrical. I go on to clarify that aesthetic value and descriptive facts about the subject matter of an artwork jointly ground its moral value, and I conclude by considering and rejecting a number of potential objections to the aestheticist thesis. Loi favorisant le respect de la neutralité religieuse de l’État et visant notamment à encadrer les demandes d’accommodements pour un motif religieux dans certains organismes, dont l’un des objectifs est d’enrayer ce problème perçu en adoptant les « balises » qui font défaut, nous entendons montrer que cette rhétorique véhicule une série de mythes sur le droit. | : A certain narrative emerged during the debate on religious accommodation in Québec, according to which the law suffers from a lack of rules in that area. As a result, decision-makers that are responsible for granting accommodations – it is said – have no choice but to base their decisions on personal beliefs about justice and/or on particular circumstances of the case at hand. Using the example of the Act to foster adherence to State religious neutrality and, in particular, to provide a framework for requests for accommodations on religious grounds in certain bodies, which aim is in part to fix this perceived problem by adopting the rules that are said to be missing, this article attempts to show that this rhetoric is penetrated by a number of myths about the law. Social standards have become important tools in corporate governance. They are often presented as voluntary initiatives in CSR and are generally based on the principle of multi-stakeholder collaboration as a means to gain legitimacy. Yet, based on a case study of a company in the textile industry, the paper shows that not all CSR standards are equally valued and that the adoption of particular CSR standards can be the result of external constraints on managerial discretion, e.g. emerging from business partners (...) and activist groups. This book expands our understanding of a growing, yet largely unstudied phenomenon: the flow of children across borders through intercountry adoption. What explains the spread of intercountry adoption through the international system over time? McBride investigates the interconnected networks of states, individuals, and adoption agencies that have collaborated to develop the practice of intercountry adoption we see today. This book tells the story of how adoption agencies mediate between individuals and states in two ways: first by teaching states about intercountry (...) adoption as a policy, and second by helping states implement intercountry adoption as a practice. McBride argues that this process of states learning about intercountry adoption from adoption agencies has facilitated the global development of the practice in the past seventy years. (shrink)

Of the most recent turn to literary practices in contemporary art, this article studies one facet: that which relates to the lyric tradition. It hopes to make a case for ‘lyric images’, drawing on the works by artists Tacita Dean, Day for Night (2009), and Roni Horn, Still Water [...] (1999). Read around poems by Emily Dickinson, John Fuller and Margaret Atwood, how these artworks utilize photography’s natural capacity to mirror both the recursive syntactic structure and the blending of instantaneity (...) with immortality common to the lyric poem is explored. Particularly, the article considers notions of cyclical seriality – as composed of singular moments, yet tending towards the infinite – both formally and referentially. Whether these qualities provoke an imaginative and/or emotive looking that contrasts with our response to previous assumptions of the written form in conceptual art practices (e.g. Art and Language) is also reflected upon, in order to contemplate why this particular hybridising may be current in photographic practice. RésuméContrairement aux États-Unis et au Royaume-Uni, la reconnaissance de l’expertise en linguistique en contexte judiciaire canadien francophone semble, à première vue, marginale. Toutefois, l’état réel de la situation est inconnu puisque le portrait global de la nature des interventions des linguistes lors de procès en tant que témoins experts devant ces tribunaux n’a jamais été réalisé. Notre article a donc pour objectif de contribuer à combler en partie cette lacune. Plus spécifiquement, à l’aide de jugements de tribunaux québécois et fédéraux (...) canadiens, nous dresserons un portrait global de la nature des interventions des linguistes lors de procès en tant que témoins experts devant ces tribunaux. Ensuite, nous discuterons des résultats de notre analyse dans un contexte plus large, soit le contexte judiciaire, afin de tenter d’évaluer l’impact des chercheurs œuvrant en linguistique légale. Notre article se terminera par un appel à la vulgarisation scientifique de la linguistique légale, au dialogue entre les professionnels du système judiciaire et les chercheurs, et à la collaboration interdisciplinaire entre les chercheurs. Traditional health sciences (including nursing) paradigms, conceptual models, and theories have relied heavily upon notions of the ‘person’ or ‘patient’ that are deeply rooted in humanistic principles. Our intention here, as a collective academic assemblage, is to question taken‐for‐granted definitions and assumptions of the ‘person’ from a critical posthumanist perspective. To do so, the cinematic works of filmmaker David Cronenberg offer a radical perspective to revisit our understanding of the ‘person’ in nursing and beyond. Cronenberg's work explores bodily transformation and (...) mutation, with the body as a fragile and malleable vessel. Cronenberg's work allows us to interrogate the body in all its complexity, contingency, and hybridity and provides avenues of rupture within current understandings of ‘the person’. Reinventing the definition of what it means to be human, critical posthumanism offers opportunities to both critique humanist theories and build affirmative futurities. Also drawing on the work of Deleuze and Guattari, specifically, their concept of becoming, we propose a critical posthumanist alternative to the conceptualization of the person in the health sciences, that of the becoming‐mutant, so frequently explored in Cronenberg's films. Such a conceptualization permits the inclusion of various technological interventions of the contemporary subject: The postperson. This position offers the health science disciplines a radical reconceptualization of the conceptual and theoretical approaches, extending beyond those trapped within the quagmire of humanistic principles. As library collections and services have increasingly moved from print to digital, much of the work that used to be done by libraries themselves with regard to creating, maintaining, and managing the systems that hold collections and facilitate user access to them is now done primarily by vendors. This change to the information services landscape for academic libraries is the occasion not only of technical and procedural challenges, but also some internal conflicts concerning the ethical demands of the library profession. This essay examines the ways in which these conflicts become acute and obvious when attention is paid to the way in which attempts to promote equity, diversity, and inclusion (EDI) are undermined by the handover of library services to vendors, even when—or perhaps especially when—those vendors use their control of content and platforms to commodify diverse content instead of making the necessary systemic changes required by truly effective EDI efforts. Self-organized complexity in the physical, biological, and social sciences Donald L Turcotte*f and John B. Rundle* *Department of Earth and Atmospheric ...

Researchers studying health systems in low-income countries face a myriad of ethical challenges throughout the entire research process. In this article, we discuss one of the greatest ethical challenges that we encountered during our fieldwork in West Africa: the difficulty of protecting the confidentiality of participants while locally disseminating results of health systems research to stakeholders. This reflection is based on experiences of authors involved in conducting evaluative research of interventions aimed at improving health systems in West Africa. Our observation (...) and collaboration with the research projects’ stakeholders informed our analysis. Examples from two research projects illustrate the issues raised. We found that in some cases there is a risk that local stakeholders may be able to identify research participants, or at least groups of participants, during the dissemination of results, even if they are anonymized. Four factors can interact and influence this challenge: 1) hierarchical structure, 2) small milieu, 3) immersion in a few sites, and 4) vested interests of decision-makers. For example, local stakeholders can sometimes find out when and where the data were collected. Moreover, health systems, especially rural healthcare centres, in West African countries can be small settings, so people often know each other. Some types of participants have unique characteristics or positions in the health system that may make them more easily identifiable by local stakeholders familiar with the environment. We identified a number of potential strategies that can help researchers minimize this difficulty and improve ethical research practices. These strategies pertain to the development of the study design, the process of obtaining informed consent, the dissemination of results, and the researchers’ reflexivity. Researchers must develop and adopt strategies that enable them to respect their promise of confidentiality while effectively disseminating sometimes sensitive results. Reflections surrounding ethical issues in global health research should be deepened to better address how to manage competing ethical responsibilities while promoting valuable research uptake. Under the influence of neoliberalism, academic work faces mounting pressure to align with imperatives of visibility and perceptibility. Traditionally criticised for working in isolated ‘ivory towers’, academics are now compelled to showcase the societal value of their work through performance metrics and evaluations. Paradoxically, these efforts have unintentionally led to the rigidification and commodification of academic work, stifling the production of knowledge beyond predefined parameters. In this paper, we contend that academics should resist the imposition of this neoliberal ‘grid’ and (...) instead seek a path of ‘becoming‐imperceptible’, drawing inspiration from the insights of Deleuze and Guattari. Becoming‐imperceptible does not entail silent disengagement; rather, it represents a creative form of resistance challenging prevailing modes of assessment rooted in visibility and perceptibility. By incorporating the concept of ‘fast feminism’ to subvert Paul Virilio's hypermasculine speed theory, we uncover the transformative potential of temporary absences. Leveraging these moments of absence, academics can intensify their affective connections with both their peers and their work, making them undiscernible to the confines of the academic establishment. We argue that these instances of imperceptibility create fertile ground for creative and inventive academic endeavours on the margins of established boundaries, where original scholarship can flourish. Such a subversive approach is particularly relevant in fields like nursing and the health sciences, where it can challenge the dominant discourses that typify neoliberal academia. (shrink)

This article explores how US legal expansions narrow justice possibilities. Drawing from Joan Scott's work on experience, echo and reverberation, the article puts forth a method for reading the convergence of historical absences within legal subjectivity. In particular, it traces the denial of one Nigerian woman's US political asylum claim within the context of US handlings of Nigerian human rights cases focused on petroleum violence alongside the expansion of political asylum to include gender and sexual violence. The article accounts for (...) the production of gender within a larger context of colonial state violence and questions how gender becomes a viable legal category through a variety of violent histories that implicate the US. By reframing questions of feminist justice within the site of law, the article argues for a deeper engagement with discontinuous narratives, which read against our common sense understandings, as a first step in divesting in US legal privilege. The purpose of this article is to examine empirically the impact of environmental certification on firm financial performance (FP). The main question is whether there is a "green premium" for certified firms, and, if so, for what kind of certification. We analyze the short-run and the long-run stock price performance using an event-study methodology on a sample of Canadian and U.S. firms. The results of short-run event abnormal returns indicate that forest certification does not have any significant impact on firm (...) FP regardless of the certification system carried out by firms. Unlike the short-run results, the long-run post-event abnormal returns suggest that forest certification has, on average, a negative impact on firm FP. However, the impact of forest certification on firm FP depends on who grants the certification, since only industry-led certification (Sustainable Forestry Initiative, Canadian Standards Association and ISO14001) are penalized by financial markets, whereas non-governmental organizations—led Forest Stewardship Council certification is not. Le thème de l'autobiographie foetale qui hante la littérature masculine récente est très représentatif de la masculinité en crise; il cristallise ses angoisses, ses résistances ou sa nouvelle quête émotive, affective et corporelle.The following four-part paper try to analyse in recent quebecer and french littérature the manifestations of a changing society, wether it be willing or not to break with gender stereotypes and reconcile the masculine/feminine dichotomy. Female writers still show leadership in wanting both body and mind, life and fiction; in thinking ofalterity and multiple identities; and in working at fictionnal, theoretical and incarnate texts wich take reality into considerations. Their reflexion and creation in effect never stops questionning the artistic device, the lies of both small and big history to prove that we cannot inconsiderately dissociate Ethics from Esthetics ! The foetal autobiography team now haunting recent male littérature is very representative of the masculinity crisis; it cristallizes his anguish resistances or his new emotive, affective and corporeal quest. This paper reports on comparative research on how textual representations of issues related to corporate social responsibility (CSR) in corporate annual reports from Sweden, Canada and the Netherlands have changed over time. The results show a substantial increase on a number of topics that can be linked to the general CSR-discourse in the 2001 sample in comparison to the 1991 and 1981 samples. The rise in the CSR-discourse appears to be related to a drop in other discourses related to issues (...) of social responsibility regarding the social, economic and political development of a company’s native country. We compare the traits of companies receiving social policy shareholder resolutions with those of a set of matching firms. We show that targeted firms tend to be much larger and riskier, less profitable and less socially performing than their counterparts. The five largest investors in firms receiving social proxies tend to hold a lower stake in those firms vis‐à‐vis the matching firms. Firms in both samples, however, are not statistically different in terms of percentages of shares held by institutional and (...) insider investors. We provide possible explanations for our results.
