In recent years, a number of philosophers have suggested that the aesthetic value sometimes depends on moral value. In this paper, I motivate and defend the inverse position: the view that aesthetic value sometimes partially grounds moral value. I appeal to Grand Budapest Hotel and The Lovely Bones to show that maudlin treatments of morally serious subject matter are sometimes disrespectful, in part because they are maudlin; I appeal to Madame Bovary to show that lyrical treatments of morally serious subject (...) matter are compassionate, in part because they are lyrical. I go on to clarify that aesthetic value and descriptive facts about the subject matter of an artwork jointly ground its moral value, and I conclude by considering and rejecting a number of potential objections to the aestheticist thesis. Modern analytical political philosophy—characterized most notably by the work of John Rawls—has had very little to say about how punishment in particular and criminal law more generally might be justified. This is a puzzling omission, as punishment can be seen as the most serious use of coercive state power and therefore the one in greatest need of philosophical justification. With the idea of filling this gap, this chapter analyzes several major political theories of recent decades and examines how criminal justice (...) might fit into their thought. After discussing the various political theories of libertarianism, liberalism, communitarianism, Marxism, and republicanism, I offer a limited defense of one such theory, Rawls’s “political liberalism,” as offering a suitable way to approach issues of criminal justice and punishment in modern society. More broadly, my chapter invites political philosophers to speak more often and more specifically about how criminal justice fits within their theories. (shrink)

This book expands our understanding of a growing, yet largely unstudied phenomenon: the flow of children across borders through intercountry adoption. What explains the spread of intercountry adoption through the international system over time? McBride investigates the interconnected networks of states, individuals, and adoption agencies that have collaborated to develop the practice of intercountry adoption we see today. This book tells the story of how adoption agencies mediate between individuals and states in two ways: first by teaching states about intercountry (...) adoption as a policy, and second by helping states implement intercountry adoption as a practice. McBride argues that this process of states learning about intercountry adoption from adoption agencies has facilitated the global development of the practice in the past seventy years. (shrink)

Of the most recent turn to literary practices in contemporary art, this article studies one facet: that which relates to the lyric tradition. It hopes to make a case for ‘lyric images’, drawing on the works by artists Tacita Dean, Day for Night (2009), and Roni Horn, Still Water [...] (1999). Read around poems by Emily Dickinson, John Fuller and Margaret Atwood, how these artworks utilize photography’s natural capacity to mirror both the recursive syntactic structure and the blending of instantaneity (...) with immortality common to the lyric poem is explored. Particularly, the article considers notions of cyclical seriality – as composed of singular moments, yet tending towards the infinite – both formally and referentially. Whether these qualities provoke an imaginative and/or emotive looking that contrasts with our response to previous assumptions of the written form in conceptual art practices (e.g. Art and Language) is also reflected upon, in order to contemplate why this particular hybridising may be current in photographic practice. We present a model for several early stages of the sensorimotor transformations involved in targeted arm movement. In psychophysical experiments, human subjects pointed to the remembered locations of randomly placed targets in three-dimensional space. They made consistent errors in distance, and from these errors stages in the sensorimotor transformation were deduced. When subjects attempted to move the right index finger to a virtual target they consistently undershot the distance of the more distal targets. Other experiments indicated that the error was (...) in the sensorimotor transformation rather than in the perception of distance. The error was most consistent when evaluated using a spherical coordinate system based at the right shoulder, indicating that the neural representation of target parameters is transformed from a retinocentric representation to a shoulder-centered representation. According to the model, the error in distance results from the neural implementation of a linear approximation in the algorithm to transform shoulder-centered target parameters into a set of arm orientations appropriate for placing the finger on the target. The transformation to final arm orientations places visually derived information into a frame of reference where it can readily be combined with kinesthetically derived information about initial arm orientations. The combination of these representations of initial and final arm orientations could give rise to the representation of movement direction recorded in the motor cortex by Georgopoulos and his colleagues. Later stages, such as the transformation from kinematic to dynamic parameters, or to levels of muscle activation, are beyond the scope of the present model. (shrink)

There is a great deal of research on the structure of narrative and its mode, and on the narrative positioning and counter positioning of the actor in legal and social contexts. In offender narratives, personal experiences are embedded for observation and analysis of particular realities that contextualize a disposition of the perpetrator being ‘an undergoer’ rather than an ‘effector’ of actions. This is evaluated in the shift from a narrated action to a speaker utterance in prospection and also in anticipation (...) of the criminal act. Using ‘grammatical logic’, it is also possible to demonstrate how the crucial event is not a cause, but an effect of a personal theme that encapsulates pattern of circumstances when the narrative outcome in criminal narrative becomes the product of its discursive practices. This is the ‘story of intentionality’ in crime narratives, characteristically embedded within the 1st the story of crime, the 2nd is the story of investigation [14, 20]. Using techniques from functional grammar and critical stylistics for discourse analysis, I intend to show an effective approach for the search of offender theme that underlies an act of crime. These disciplines provide the analyst with the linguistic material to analyse intersentential cohesion in a chain of semantically linked sentences that explore the ways in which things are ‘made to look’ in the structure and functions of the English language. As a case study, I am using an offender narrative from Tony Parker’s book Life After Life: Interviews with Twelve Murderers showing an effective approach for the search of personal themes underlying the act of crime. Offender theme analyses are also valuable for evaluating the changing nature or development of offender characteristics pre or post crime. (shrink)

Rawls's “public reason” has not been without its critics. One criticism is that public reason is “conservative.” Public reason must rely on those beliefs that are “widely shared” among citizens. But if public reason relies on widely shared beliefs, how can it change without departing from those beliefs, thus violating public reason? In part one of my essay, I introduce the conservatism objection and describe two unsatisfactory responses to it. Part two argues that there are aspects of public reason which (...) diminish the force of the conservatism objection: first, that public reason is historical, and second, that it is mutable. As library collections and services have increasingly moved from print to digital, much of the work that used to be done by libraries themselves with regard to creating, maintaining, and managing the systems that hold collections and facilitate user access to them is now done primarily by vendors. This change to the information services landscape for academic libraries is the occasion not only of technical and procedural challenges, but also some internal conflicts concerning the ethical demands of the library profession. This essay examines the ways in which these conflicts become acute and obvious when attention is paid to the way in which attempts to promote equity, diversity, and inclusion (EDI) are undermined by the handover of library services to vendors, even when—or perhaps especially when—those vendors use their control of content and platforms to commodify diverse content instead of making the necessary systemic changes required by truly effective EDI efforts. The prohibition on “cruel and unusual” punishments, found in the Eighth Amendment to the U.S. Constitution, has long puzzled scholars. If punishments are cruel, why is that not sufficient to prohibit them? What does “unusual” add? Scholars have also disagreed on how to understand “cruel.” Should “cruel” refer only to those things that the authors of the Constitution believed were cruel, or does it extend to those things that are actually cruel? This chapter gives an overview of these debates and (...) describes the United States Supreme Court’s jurisprudence in the area. A concluding part takes a look at the possibility that some contemporary forms of punishment (e.g., imprisonment) are cruel and unusual, and even that punishment itself might be cruel and unusual. In his paper “Public Reason and the Justification of Punishment,” Zachary Hoskins develops and defends an idea of “public reason” that might be applicable to debates over punishment in the Western world. This short reply takes issue with some of Hoskins’ conclusions (while agreeing with many of his premises), and suggests that contra Hoskins, many versions of retribution are not compatible with the ideal of public reason as Rawls articulated it. Instead, debates over criminal justice and punishment should properly revolve (...) around the goods of public safety and harm reduction—rather than around any of the supposed metaphysical goods achieved by retributive punishment. In this book, Dana Birksted-Breen and Sara Flanders of the British Psychoanalytical Society, and Alain Gibeault of the Paris Psychoanalytical Society provide an overview of how French psychoanalysis has developed since Lacan. Focusing primarily on the work of psychoanalysts from the French Psychoanalytical Association and from the Paris Psychoanalytical Society, the two British psychoanalysts view the evolution of theory as it appears to them (...) from the outside, while the French psychoanalyst explains and elaborates from inside the French psychoanalytic discourse. Seminal and representative papers have been chosen to illuminate what is special about French thinking. A substantial general introduction argues in favour of the specificity of 'French psychoanalysis', tracing its early influences and highlighting specific contemporary developments. Sections are made up of introductory material by Alain Gibeault, followed by illustrative papers in the following categories: the history of psychoanalysis in France the pioneers and their legacy the setting and the process of psychoanalysis phantasy and representation the body and the drives masculine and feminine sexuality psychosis. An excellent introduction to French psychoanalytical debate, _Reading French Psychoanalysis_ sheds a complementary light on thinking that has evolved differently in England and North America. It will be ideal reading for beginners and advanced students of clinical theory as well as experienced psychoanalysts wanting to know more about French Psychoanalytic theory, and how it has developed. Drawing on a documentary analysis of two socioeconomic policy programs, one Flemish (“Vlaanderen in Actie”), the other Walloon (“Marshall Plans”), and a discourse analysis of how these programs are received in one Flemish and one Francophone quality newspaper, this article illustrates how Flanders and Wallonia both seek to become top-performing knowledge-based economies (KBEs). The article discerns a number of discursive repertoires, such as “Catching up,” which policy actors draw on to legitimize or question the transformation of Flanders and (...) Wallonia into KBEs. The “Catching up” repertoire places Flanders resolutely ahead of Wallonia in the global race toward knowledge, excellence, and growth, but suggests that Wallonia may, in due course, overtake Flanders as a top competitive region. Given the expectations and fears that “Catching up” evokes among Flemish and Walloon policy actors, the repertoire serves these actors as a flexible discursive resource to make sense of, and shape, their collective futures and their regional identities. The article’s findings underline the simultaneity of, and the interplay between, globalizing forces and particularizing tendencies, as Flanders and Wallonia develop with a global KBE in region-specific ways. Media use can empower people, provided that this is accompanied by a deeper understanding of the actors, processes and structures in the media sector – including media policy. It is, however, to be expected that media users’ literacy of media policy is rather limited. This is problematic as the absence of such understanding makes it impossible for citizens to hold the politicians they elected accountable for the media policy they develop. This article explores what media users know about media policy, (...) what they expect to know, and whether they care. We adopted a case-study approach, researching this question for the region of Flanders based on a combination of quantitative (representative survey) and qualitative (49 in-depth interviews) data. While the article focuses on the case of Flanders, its theoretical basis as well as conclusion section are relevant beyond that specific context. (shrink)
