Although shared decision-making is a standard in medical care, unilateral decisions through process-based conflict resolution policies have been defended in certain cases. In patients who do not stand to receive proportional clinical benefits, the harms involved in interventions such as cardiopulmonary resuscitation seem to run contrary to the principle of non-maleficence, and provision of such interventions may cause clinicians significant moral distress. However, because the application of these policies involves taking choices out of the domain of shared decision-making, they face (...) important ethical and legal problems, including a recent challenge to their constitutionality. In light of these concerns, we suggest a re-conceptualization of informed non-dissent as an alternative approach in cases where the application of process-based policies is being considered. This clinician-directed communication model still preserves what is valuable in such policies and salvages professional integrity, while minimising ethical and legal challenges. (shrink)

The imprints left by quantum mechanics in classical (Hamiltonian) mechanics are much more numerous than is usually believed. We show that the Schrödinger equation for a nonrelativistic spinless particle is a classical equation which is equivalent to Hamilton’s equations. Our discussion is quite general, and incorporates time-dependent systems. This gives us the opportunity of discussing the group of Hamiltonian canonical transformations which is a non-linear variant of the usual symplectic group.

Is the assessment of motor milestones valid and scaled equivalently for all infants? It is not only important to understand if the way we use gross and fine motor scores are appropriate for monitoring motor milestones but also to determine if these scores are confounded by specific infant characteristics. Therefore, the aim of the study is to investigate the latent structure underlying motor milestone assessment in infancy and measurement invariance across sex, birth weight, and gestational age. For this study, the (...) birth cohort data from the United Kingdom Millennium Cohort Study was used, which includes the assessment of eight motor milestone tasks from the Denver Developmental Screening Test in 9-month-old infants, depicting early motor development of the first children of generation Z. Confirmatory factor analyses showed a better model fit for a two-factor structure compared to a one-factor structure, and multiple indicators multiple causes modeling revealed no differential item functioning related to sex, birth weight, and gestational age. The study provides support for the use of gross and fine motor scores when assessing motor milestones in infants—both boys and girls with different birth weights and of varying gestational ages. Further investigation into widely adopted assessment tools is recommended to support the use of valid composite scores in early childhood research and practice. (shrink)

The necessary appearance of Clifford algebras in the quantum description of fermions has prompted us to re-examine the fundamental role played by the quaternion Clifford algebra, C 0,2 . This algebra is essentially the geometric algebra describing the rotational properties of space. Hidden within this algebra are symplectic structures with Heisenberg algebras at their core. This algebra also enables us to define a Poisson algebra of all homogeneous quadratic polynomials on a two-dimensional sub-space, $\mathbb{F}^{a}$ of the Euclidean three-space. This enables (...) us to construct a Poisson Clifford algebra, ℍ F , of a finite dimensional phase space which will carry the dynamics. The quantum dynamics appears as a realisation of ℍ F in terms of a Clifford algebra consisting of Hermitian operators. (shrink)

Il aura fallu, en outre, mettre en oeuvre une démarche d'analyse régressive permettant de décliner les catégories qui, en deçà des normes et des procédés (...) constituant le système des réponses, les font tenir ensemble. L'oeuvre n'est pas une invite à un repli passéiste de la culture négro-africaine sur elle-même. In this paper, I show where Adolf Reinach comes down on the question of conflicts of obligation. The aim is to look at whether Reinach’s phenomenological realism of obligation holds its own against positions developed by Bernard Williams concerning the nature and import of obligations, and their capacity or incapacity to impinge upon each other and other moral and non-moral concerns. It is shown that even if Reinach turns out to succumb to pitfalls Williams identifies, he nonetheless verges upon agreement (...) with Williams in more ways than one might expect. This result is significant because it shows that Reinach’s phenomenological realism, in contrast to certain forms of moral realism, lays the foundations for what can be considered a heterontology of obligation and ethical concerns, which is presupposed by the experience of (moral) conflict in the first place. The hard problem of consciousness is the problem of explaining how and why physical processes give rise to consciousness (Chalmers 1995). Regardless of many attempts to solve the problem, there is still no commonly agreed solution. It is thus very likely that some radically new ideas are required if we are to make any progress. In this paper we turn to quantum theory to find out whether it has anything to offer in our attempts to understand the place of mind (...) and conscious experience in nature. In particular we will be focusing on the ontological interpretation of quantum theory proposed by Bohm and Hiley (1987, 1993), its further development by Hiley (Hiley and Callaghan 2012; Hiley, Dennis and de Gosson 2021), and its philosophical interpretation by Pylkkänen (2007, 2020). The ontological interpretation makes the radical proposal that quantum reality includes a new type of potential energy which contains active information. This proposal, if correct, constitutes a major change in our notion of matter. We are used to having in physics only mechanical concepts, such as position, momentum and force. Our intuition that it is not possible to understand how and why physical processes can give rise to consciousness is partly the result of our assuming that physical processes (including neurophysiological processes) are always mechanical. If, however, we are willing to change our view of physical reality by allowing non-mechanical, organic and holistic concepts such as active information to play a fundamental role, this, we argue, makes it possible to understand the relationship between physical and mental processes in a new way. It might even be a step toward solving the hard problem. (shrink)

Robert Nozick famously asks us whether we would plug in to an experience machine, or whether we would insist upon ‘living in contact with reality’. Felipe De Brigard, after conducting a series of empirical ‘inverted’ experience machine studies, suggests that this is a false dilemma. Rather, he says, ’…the fact is that people tend to prefer the state of affairs they are in currently,’ or the status quo. In this paper, I argue that these studies are a test case for (...) ‘experimental philosophy’ as such. Specifically, I argue that De Brigard offers a series of faulty studies, and so, reaches unfounded conclusions. More generally, I argue that certain philosophical thought experiments cannot be tested empirically at all, and this limits what experimental philosophy can do. (shrink)

In Kant's Critique of Judgment, his exploration of how something like life (organized matter) can appear to the faculties of a finite consciousness makes life as possible as it is impossible. A passing reference Kant makes to the idea that every organ of an organism can be seen as a parasite is taken as a lever to deconstruct his notion of organized beings as forming an ultimately coherent nature (an ethicoteleological whole). This reading is placed alongside Paul de Man's deconstruction (...) of the sublime as Augenschein and Darstellung von Ideen to show that the unity of the third critique, sometimes viewed as a fractured work, comes from the similar failures of sublimity and purposive organization. This reading is offered to suggest the importance of biodeconstruction for an engagement with the history and present of thought about the natural sciences. (shrink)

Lynn Margulis’s writing about symbiosis has profoundly influenced contemporary evolutionary theory, as well as continental and analytic philosophy of science, the materialist turn, and new materialism. Nonetheless, her work, and all symbiosis or evolution, is founded on a paradox: symbiosis fictionalizes customary accounts of the origin and evolution of species, yet it is impossible to speak of symbiosis (cross-species association) unless species-boundaries have been posited in advance. Thus, a tension is legible throughout Margulis’s work between the drive to surpass the (...) limits of species-definitions as they have been traditionally understood, and a need to maintain them in order that there can be “symbiosis” at all. Margulis criticized neo-Darwinian accounts of evolution in part because she saw symbiogenesis as debunking the theory that life was defined by individualistic competition. More recently, Myra Hird has suggested that the gift, such as it has been theorized by certain anthropologists and philosophers, could adequately figure symbiosis and the ethical relations founded on it. I turn to Derrida’s writing on the gift to suggest that, if a gift worthy of the name chances to happen, it necessarily exceeds scientific, theoretical, and philosophical knowledge. (shrink)

Idipsum est une locution qu'Augustin utilise pour désigner Dieu. Elle signifie littéralement "cela même". Ce minimalisme sémantique ne laisse pas de la rendre mystérieuse. Faut-il y voir un emprunt à certains textes bibliques qui déjà en font usage? Dans ce cas, idipsum, tel un nom propre vide de toute signification, se bornerait à indiquer Dieu en tant qu'il échappe à toute définition rationnelle. Ou bien faut-il rattacher idipsum à la tradition platonicienne qui recourt à des locutions grecques similaires pour désigner (...) la réalité intelligible qui est " elle-même en elle-même "? Idipsum serait alors la trace d'un héritage philosophique conduisant Augustin à une définition métaphysique de Dieu comme Etre absolu. Cependant, cette alternative entre origine biblique et tradition platonicienne néglige la diversité des usages philosophiques des locutions formées sur auto puis ipsum: elles expriment d'abord l'identité et le fait d'être soi, puis la réflexivité, au croisement des champs dialectique, pratique et ontologique. Cet ouvrage explore la façon dont ces aspects de l'identité se sont construits, du autos grec à l'idipsum latin, à travers des études portant sur Homère, Platon, Aristote, le stoïcisme, le néoplatonisme grec puis latin, Augustin. Resumo O fundamento teórico deste artigo compreende uma análise teológica, com especial interesse pelo diálogo com a sociologia e com a antropologia. Investiga as relações de dominação, com enfoque específico nas relações de gênero que se engendram a partir dos ritos religiosos ou profanos, Objetiva-se verificar a importância dos ritos para a construção da realidade social, sobretudo das noções de gênero e das relações que delas advêm; expor com embasamento antropológico e sociológico esta premissa, visando contribuir para a discussão da (...) função social da religiosidade como construtora da realidade social; oferecer uma compreensão dos ritos enquanto espaços nos quais podem surgir relações mais igualitárias entre homens e mulheres. Através da pesquisa bibliográfica, procurar-se-á na sociologia de Pierre Bourdieu conceituar o poder simbólico e compreender de que maneira ele é elemento que constrói noções de gênero; posteriormente, serão averiguados em obras da área da antropologia, conceitos de rito, estabelecendo sua ligação com o poder simbólico e seu possível potencial construtor da realidade social e das noções de gênero que orientam as relações entre mulheres e homens. A conclusão buscará apontar de que maneira podem os ritos se tornar espaços para a articulação de um novo modo de relações de gênero. Palavras-chave: Ritos, Sociedade, Gênero.The theoretical basis of this article consists of a theological analysis, with emphasis on a dialogue with sociology and anthropology. It investigates dominance relationships, focusing particularly on gender relationships engendered by religious or profane rites. The objective is to verify the importance of rites for the construction of social reality, above all of gender notions and the relationships that result from them; to expose this premise on an anthropological and sociological basis, seeking to contribute to the discussion of the social function of religiosity as builder of social reality; and to provide an understanding of rites as spaces where more egalitarian relationships between men and women can take place. Through bibliographical research, especially into Pierre Bourdieu's sociology, the text tries to describe symbolic power and to understand how this element builds gender notions. Then, it verifies concepts of rite in anthropological texts, establishing its connection with symbolic power and its potential to construct social reality and gender notions that guide the relationships between women and men. The conclusion tries to indicate how rites can become spaces for the articulation of a new mode of gender relationships. Key words: Rites, Society, Gender. (shrink)
