All the rest is commentary.a (TM) These words at the beginning of the preface of this book perfectly indicate what On Law and Reason is about. It is a theory about the nature of the law which emphasises the role of reason in the law and which refuses to limit the role of reason to the application of deductive logic. (...) In 1989, when the first edition of On Law and Reason appeared, this book was ground breaking for several reasons. It provided a rationalistic theory of the law in the language of analytic philosophy and based on a thorough understanding of the results, including technical ones, of analytic philosophy. That was not an obvious combination at the time of the booka (TM)s first appearance and still is not. The result is an analytical rigor that is usually associated with positivist theories of the law, combined with a philosophical position that is not natural law in a strict sense, but which shares with it the emphasis on the role of reason in determining what the law is. If only for this rare combination, On Law and Reason still deserves careful study. On Law and Reason also foreshadowed and influenced a development in the field of Legal Logic that would take place in the nineties of the 20th century, namely the development of non-monotonic (a defeasiblea (TM)) logics for the analysis of legal reasoning. This paper relates to a formal statement of the mechanisms that are thought minimally necessary to underpin consciousness. This is expressed in the form of axioms. We deem this to be useful if there is ever to be clarity in answering questions about whether this or the other organism is or is not conscious. As usual, axioms are ways of making formal statements of intuitive beliefs and looking, again formally, at the consequences of such beliefs. The use of this style (...) of exposition does not entail a claim to provide a mathematically rigorous formal deductive system. Conventional mathematical notation is used to achieve clarity, although this is elaborated with natural language in an attempt to reduce terseness. In our view, making the approach axiomatic is synonymous with building clear usable tests for consciousness and is therefore a central feature of the paper. The extended scope of this approach is to lay down some essential properties that should be considered when designing machines that could be said to be conscious. In the broader discussion about the nature of consciousness and its neurological mechanisms, it may seem to some that axiomatisation is premature and continues to beg many questions. However, the approach is meant to be open- ended so that others can build further axiomatic clarifications that address the very large number of questions which, in the search for a formal basis for consciousness, still remain to be answered. Of course, in discussions about consciousness many will also argue that the subject is not one that may ever be formally addressed by means of axioms. The books’ goal is to answer the question: Do the weaknesses of value-free economics imply the need for a paradigm shift? The author synthesizes criticisms from different perspectives (descriptive and methodological). Special attention is paid to choices over time, because in this area value-free economics has the most problems. In that context, the enriched concept of multiple self is proposed and investigated. However, it is not enough to present the criticisms towards value-free economics. For scientists, a bad paradigm is better (...) than no paradigm. Therefore, the author considers whether value-based economics with normative approaches such as economics of happiness, capability approach, libertarian paternalism, and the concept of multiple self can be the alternative paradigm for value-free economics. We assume—in contrast to many “legal realists”—that law is a part of reality. Law exists because people believe in law, but law is not identical with beliefs. Law supervenes on human beliefs, preferences, actions, dispositions and artefacts. Moreover, the morally binding personal interpretation of the law supervenes on two things together: on the individual's knowledge of legal institutions and on moral obligation. The first supervenes in its turn on mutual beliefs; the second supervenes on motivations and dispositions of the individual, (...) provided that she is morally sensitive and rational. Personal interpretation of law converts into social law, if other persons on the basis of overriding reasons do not contest it. Morally binding social law supervenes on moral motivation that is triggered by institutions that supervene on mutual beliefs. (shrink)

This paper looks closely at previously enunciated axioms that specifically include phenomenology as the sense of a self in a perceptual world. This, we suggest, is an appropriate way of doing science on a first-person phenomenon. The axioms break consciousness down into five key components: presence, imagination, attention, volition and emotions. The paper examines anew the mechanism of each and how they interact to give a single sensation. An abstract architecture, the Kernel Architecture, is introduced as a starting point for (...) building computational models. The thrust of the paper is to relate the axioms to the kernel architecture and indicate that this opens a way of discussing some first-person issues: tests for consciousness, animal consciousness and Higher Order Thought. The main stream of legal theory tends to incorporate unwritten principles into the law. Weighing of principles plays a great role in legal argumentation, inter alia in statutory interpretation. A weighing and balancing of principles and other prima facie reasons is a jump. The inference is not conclusive.To deal with defeasibility and weighing, a jurist needs both the belief-revision logic and the nonmonotonic logic. The systems of nonmonotonic logic included in the present volume provide logical tools enabling one to speak (...) precisely about various kinds of rules about rules, dealing with such things as applicability of rules, what is assumed by rules, priority between rules and the burden of proof. Nonmonotonic logic is an example of an extension of the domain of logic. But the more far-reaching the extension is, the greater problems it meets. It seems impossible to make logical reconstruction of the totality of legal argumentation. (shrink)

Epistemicism associates vagueness with ignorance produced by semantic plasticity: the shiftiness of intensions in our language resulting from small changes in usage. The recent literature (Caie 2012; Magidor 2018; Yli-Vakkuri 2016) points to a missing piece in the epistemicist theory of vagueness, namely a clear account of the semantics of the definiteness operator Δ. The fundamentals of the epistemicist theory are well understood. However, the technical work of defining the definiteness operator has proven difficult. There are several desiderata that we (...) would like Δ to satisfy. For instance, we would like the epistemicist notion of ‘definiteness’ to interact well with modal operators and validate intuitive principles like ‘necessarily, if φ is definitely true, then φ is true’. Providing an account that would meet all such desiderata has eluded the epistemicists so far. In this paper, I present a novel version of a multidimensional model inspired by the work of Robert Stalnaker and David Kaplan. Using this model, I provide an account of epistemicist definiteness that meets our desiderata. (shrink)

The epistemicist theory aims to explain ignorance due to vagueness by semantic plasticity: the shiftiness of intensions across close possible worlds resulting from shiftiness in usage. This explanation is challenged by the Omniscient Speaker Puzzle (Sennet in Philos Stud 161(2):273–285, 2012). Suppose that an omniscient speaker, Barney, who knows all the facts about usage and how these facts determine the intensions of expressions, cooks up a scheme to stabilise the intension of a normally semantically plastic term like ‘rich’. It seems (...) that ‘rich’ would display all the phenomena associated with vagueness without being semantically plastic, thus making the epistemicist explanation of ignorance due to vagueness insufficient. Here is examined the work done in many laboratories on the proposition that the mechanisms underlying consciousness in living organisms can be studied using computational theories. This follows an agreement at a 2001 multi‐disciplinary meeting of philosophers, neuroscientists and computer scientists that such a research programme was feasible and worthwhile. Here this effort is reviewed both as a historical statement and for the positions held at the time of going to print of this volume. The approaches cover diverse techniques ranging (...) from the machine modeling of neural structures in the brain to abstract models based on the type of logic found in computer programming. In the first part of this chapter, I will focus on two main questions: (1) how Maimonides departs from Aristotle in maintaining a difference of kind rather than degree in identifying prophecy rather than wisdom as the ultimate human perfection; and (2) why Maimonides does not explicitly identify a virtue of practical reasoning that corresponds to Aristotle’s understanding of phronêsis. In the second part of the chapter, I will discuss why Dante, contrary to Maimonides, emphasises the significance of practical judgement (...) in his redeployment of Aristotelian ethical theory. I will also discuss how the didactic and protreptic purposes of his poetic discourse are shaped by the same underlying psychological theory that grounds his emphasis on this intellectual virtue. The modest aim of this chapter is to treat these two engagements with Peripatetic philosophy as case studies that reward attention to the inextricable links between politics/religion and philosophical enquiry, even against the grain of seemingly common lineages sharing similar concerns. Connected with this modest aim, this chapter will also discuss how Maimonides’s and Dante’s attention to didactic and protreptic concerns impacts their treatment of philosophical questions and therefore indicates how attention to the kairos of their writings exposes and helps appreciate their philosophical rigour. Impossible Minds: My Neurons, My Consciousness has been written to satisfy the curiosity each and every one of us has about our own consciousness. It takes the view that the neurons in our heads are the source of consciousness and attempts to explain how this happens. Although it talks of neural networks, it explains what they are and what they do in such a way that anyone may understand. While the topic is partly philosophical, the text makes no assumptions of (...) prior knowledge of philosophy; and so contains easy excursions into the important ideas of philosophy that may be missing in the education of a computer scientist. The approach is pragmatic throughout; there are many references to material on experiments that were done in our laboratories. The first edition of the book was written to introduce curious readers to the way that the consciousness we all enjoy might depend on the networks of neurons that make up the brain. In this second edition, it is recognized that these arguments still stand, but that they have been taken much further by an increasing number of researchers. A post-script has now been written for each chapter to inform the reader of these developments and provide an up-to-date bibliography. A new epilogue has been written to summarize the state-of-the art of the search for consciousness in neural automata, for researchers in computation, students of philosophy, and anyone who is fascinated by what is one of the most engaging scientific endeavours of the day. This book also tells a story. A story of a land where people think that they are automata without much in the way of consciousness, a story of cormorants and cliffs by the sea, a story of what it might be like to be a conscious machine... The goal of the article is to substantiate that despite the criticism the paradigm in economics will not change because of the axiomatic assumptions of value-free economics. How these assumptions work is demonstrated on the example of Gary Becker’s economic approach which is analyzed from the perspective of scientific research programme. The author indicates hard core of economic approach and the protective belt which makes hard core immune from any criticism. This immunity leads economists to believe that they are objective (...) scientists and, consequently, it results in epistemological hubris. Due to its tautological nature, economic approach is considered to be a degenerative programme. This conclusion is extended on value-free economics. In spite of these problems, many economists still believe in positive economics and they dismiss normative approaches. It has a negative influence on people. The conclusion of the article is that thanks to axiomatic assumptions economists do not have objective and ironclad methodology and they should accept normative values in their research. (shrink)

The aim of this paper is to show the main thesis concerning the theory of cognition of the eminent neo-Kantian Heinrich Rickert, as presented in his work “Der Gegenstand der Erkenntnis”. On the one hand, Rickert finds out that thinking is fated to “clash with nothingness”, thus creating a temptation to reject all rigours and to yield to complete discretion. On the other hand, he attributes axiological status to nothingness which subjects thinking to a particular kind of “ought”. In his (...) view, the cognizing subject is faced with an axiological choice: either discretion or truth and argues that it is worth opting for truth. His argumentation could be an interesting point of reference for contemporary culture gradually moving away from the type of thinking rooted in objectively existing principles. (shrink)

This paper critically tracks the impact of the development of the machine consciousness paradigm from the incredulity of the 1990s to the structuring of the turn of this century, and the consolidation of the present time which forms the basis for guessing what might happen in the future. The underlying question is how this development may have changed our understanding of consciousness and whether an artificial version of the concept contributes to the improvement of computational machinery and robots. Legal doctrine is a kind of legal research, occupying the central position in professional legal writing, e.g., handbooks, monographs, commentaries and legal textbooks etc. It consists of a description of the literal sense of legal statutes, precedents etc., intertwined with many moral and other substantive reasons. Legal doctrine has normative components, and produces coherence in the law in many aspects. It also produces some justice. However, legal doctrine has faced repeated criticism, not least from minimalist philosophers.The author proposes a “Copernican (...) revolution” as regards the relation of legal theory to philosophy. Instead of attempting to make legal theory follow one of the notoriously controversial moral theories, he tries to adjust philosophy to legal theory. In the search for philosophy adjusted to legal doctrine, he prefers cautious (weak) philosophical positions to courageous (strong) ones. He also assumes a society‐centered theory of normativity, a coherentist theory of legal knowledge and a coherentist theory of justice.However, a law theorist has no chance to elaborate such theories in detail. Hence, the author poses the following questions to philosophers: How can a law theorist assume society‐centered normativity without being forced to enter the controversies around collectivism? How can a law theorist assume the common core of morality for society without being forced to enter technical controversies in political philosophy? How can the law theorist base his thinking on the coherence theory of law without being forced to enter technical controversies around the concept of coherence? How can the law theorist avoid hopeless ontological controversies? (shrink)

The phenomenon of weakness of will – not doing what we perceive as the best action – is not recognized by neoclassical economics due to the axiomatic assumptions of the revealed preference theory (RPT) that people do what is best for them. However, present bias shows that people have different preferences over time. As they cannot be compared by the utility measurements, economists need to normatively decide between selves (short- versus long-term preferences). A problem is that neoclassical economists perceive RPT (...) as value-free and incorporate present bias within the economic framework. The axiomatic assumption that people do what is best for them leads to theoretical and practical dilemmas. This work examines weakness of will to resolve some shortcomings of RPT. The concept of intention is used to provide multiple self conception with the framework to decide between selves, which had not been done before. The paper concludes that individuals should not always follow their revealed preferences (desires) but the intentions (reason) because the latter indicates what people really want. (shrink)

Despite the conclusions from the contemporary philosophy of science, many economists cherish the ideal of positive science. Therefore, value-free economics is still the central paradigm in economics. The first aim of the paper is to investigate economics' axiomatic assumptions from an epistemological perspective. The critical analysis of the literature shows that the positive-normative dichotomy is exaggerated. Moreover, value-free economics is based on normative foundations that have a negative impact on individuals and society. The paper's second aim is to show that (...) economics' normativity is not a problem because the discussion concerning values is possible and unavoidable. In this context, Weber and other methodologists are investigated. The conclusion of the paper is that science can thrive without strict methodological rules thanks to institutional mechanisms. Therefore, economists could learn from artists who accept the world without absolute rules. This perspective opens the possibility for methodological pluralism and normative approaches. (shrink)

Procrastination as putting off until tomorrow what one had intended to do today is well-known tendency in everyday life. In an attempt to understand the character of procrastination in different life-domains, a large body of research has been accumulated over the last decades. This article was aimed to evaluate a specific decisional procrastination of school-to-work transition that is treated as maturity postponement. Two studies are reported examining SWT procrastination defined as career indecision among Polish students graduating universities. In Study 1, (...) attitudinal and identity statuses were analyzed as correlates of career procrastination. A path analysis conducted for the model, which was aimed to explain the influence of career self-efficacy and occupational commitment on career indecision, revealed its very good fitness. Those two independent variables explain 10% of career indecision variance. Stepwise multiple regression analyses conducted to ascertain relationship of five identity statuses to procrastination measure showed that Commitment Making and Ruminative Exploration are strongest predictor variables. In study 2, the stepwise multiple regression analyses conducted to ascertain the independent relationship of each of Big Five personality factor revealed that Neuroticism and Extraversion accounts of the most of explained variance of school-to-work transition procrastination.
