El presente artículo pretende problematizar el concepto de narcomarketing cuestionando su vigencia, explicando desde la perspectiva de los estudios culturales la producción de nuevos consumos digitales en la red social Tiktok donde surgen narrativas que refuerzan representaciones identitarias que se han creado en el imaginario del narcomundo. Partiendo de un sustento teórico sobre la definición de la narcocultura como cultura laboral y social, se utilizan los métodos de la netnografía y el análisis del discurso multimodal en el corpus seleccionado de (...) dos cuentas que transmiten las representaciones identitarias significadas y creadas del narcomundo en medios digitales. Se enfoca el estudio principalmente en el entramado de discursos de producción, tomando en cuenta de manera general las reacciones de recepción de los consumidores, problematizando así la pertinencia del uso del concepto narcomarketing como un aporte a los estudios de la narcocultura desde la perspectiva de los estudios culturales y de consumo digital, señalando que es necesario el trabajo interdisciplinario para estudiar dicha cultura. La instauración del sistema penal acusatorio en varios países de Latinoamérica ha enfrentado el reto, entre muchos, de configurar nuevos estándares para la actuación judicial. Este artículo se centra en el reto que representa para los juzgadores valorar la confiabilidad de la prueba científica, dado que su naturaleza excede el conocimiento de la mayoría de ellos. Evaluar la confiabilidad y corrección de la prueba científica para asignarle un peso específico en el acervo probatorio es una labor para la que el (...) juez requiere de un análisis multidisciplinario. A manera de guía para el juzgador y como una herramienta innovadora en el ambiente judicial latinoamericano, se proponen lineamientos generales y específicos a seguir en la valoración de la confiabilidad de la prueba en tres áreas forenses. El presente artículo es producto de un trabajo etnográfico que se realizó durante más de un año en una escuela primaria pública que contaba con apoyo de un servicio de Educación Especial. Los principales hallazgos versan sobre cotidianeidad de los procesos de evaluación de estudiantes con discapacidad. El trabajo es un llamado a humanizar las prácticas docentes.

El propósito del artículo es explicar el genocidio de la Unión Patriótica en clave de la economía nacional y su ubicación estratégica a partir de una aproximación teórica desde algunos elementos propuestos por Antonio Negri y Michael Hardt. Como conclusión se destaca que el genocidio de la up fue consecuencia de su poderío local, que ponía en riesgo la continuidad de las clases políticas dominantes en razón de sus propuestas como colectivo político. Así mismo, este hecho produjo que a raíz (...) de su origen se construyera sobre ellos un relato negativo de enemigos de la sociedad civil. La Teoría de la Justicia del filósofo norteamericano John Rawls es considerada una de las mayores contribuciones a la filosofía política del siglo XX. En esta, Rawls plasmó su preocupación por un orden institucional justo para todos los individuos. Por ello, concentra sus esfuerzos en la justicia, como primera virtud de las instituciones sociales, para que atraviese, en un ámbito doméstico, la estructura básica de la sociedad y, en el marco internacional, las relaciones entre Estados. With growing vigor, political philosophers have started questioning the Westphalian system of states as the main actors in the international arena and, within it, the doctrine of Permanent Sovereignty over Natural Resources. In this article I add to these questionings by showing that, when it comes to migratory natural resources, i.e., migratory species, a plausible theory of territorial rights should advocate a regime of shared sovereignty among states. This means that one single entity should represent their interests and maybe also (...) those of third parties, managing and making decisions over the resource as a whole. Although such a regime might be the tacit goal of existing international conventions regarding wildlife, it remains untheorized in political philosophy and largely under-theorized in international law. By presenting the critical situation of the monarch butterfly in North America, I point to the inadequacy of the compartmentalized current regime, which generates injustice in migration; namely, the phenomenon whereby range states of a given species may neglect or over-exploit it while in their territory, to the detriment of others. I suggest that more flexible and imaginative governance arrangements are needed to deal in a better way with these and similar natural resources. (shrink)

The Scottish sentimentalist Francis Hutcheson and the Chinese Confucianist Mencius give benevolence (ren) a key place in their respective moral theories, as the first and foundational virtue. Leaving aside differences in style and method, my purpose in this essay is to underline this similarity by focusing on four common features: first, benevolence springs from compassion, an innate and universal feeling shared by all human beings; second, its objects are not only human beings but also animals; third, it is sensitive to (...) proximity; and finally, it has to be constantly cultivated in order to become a character trait. I will conclude with some brief remarks as to how this understanding of benevolence as rooted in feeling rather than reason, and in personal rather than impersonal relationships, helps to illuminate part of the discussion in moral philosophy today. By virtue of the Antarctic Treaty, signed in 1959, the territorial claims to Antarctica of seven of the original signatories were held in abeyance or “frozen.” Considered by many as an exemplar of international law, the Antarctic Treaty System has come to be increasingly questioned, however, in a very much changed global scenario that presents new challenges to the governance of the White Continent. In this context, it is necessary to gain a clearer understanding of the moral weight of those (...) initial claims, which stand as a cornerstone of the treaty. The aim of this article is to offer an appraisal of such claims, which may be divided into two main kinds: those grounded on some relevant link to the territory, and those grounded on official documents and geographical doctrines. After pointing to the limitations and challenges that they face, I conclude with some remarks about how this assessment ought to serve as a starting point to rethink the territorial status of Antarctica. The metaphysics of gender and race is a growing area of concern in contemporary analytic metaphysics, with many different views about the nature of gender and race being submitted and discussed. But what are these debates about? What questions are these accounts trying to answer? And is there real disagreement between advocates of differ- ent views about race or gender? If so, what are they really disagreeing about? In this paper I want to develop a view about what the debates (...) in the metaphysics of gender and race are about, namely, a version of metaphysical deflationism, according to which these debates are about how we actually use or should use the terms ‘gender’ and ‘race’ (and other related terms), where moral and political considerations play a central role. I will also argue that my version of the view can overcome some recent and powerful objections to metaphysical deflationism of- fered by Elizabeth Barnes (2014, 2017). (shrink)

We formulate and explore two basic axiomatic systems of type-free subjective probability. One of them explicates a notion of finitely additive probability. The other explicates a concept of infinitely additive probability. It is argued that the first of these systems is a suitable background theory for formally investigating controversial principles about type-free subjective probability.

That there is a human right to subsistence is a basic assumption for most moral and political theorists interested in the problem of global poverty, but it is not one exempt from controversy. In this article, I examine four justifications for this right and suggest that it takes the form of a claim, that is, a right which creates correlative duties on others who are then taken to be the main agents in its fulfillment. I point to some criticisms made (...) against this conceptualization and offer an alternative approach that emphasizes the key importance of the moral and political agency of the needy. Two aspects of this approach are that the needy are seen as actors in their own right when it comes to poverty alleviation measures and their demands are no longer seen as demands for mere subsistence but ultimately for putting an end to their political marginalization and exclusion. The hard problem of consciousness is about how we could explain in physicalist terms why we are conscious. The meta-problem of consciousness is about how we could explain why we have a hard problem of consciousness. In this note I argue that the phenomenal concept strategy can in principle provide a satisfactory solution to the meta-problem.

The application of Bauman’s and Luhmann’s theories and key concepts calls into questions the characteristics of education and the changes that should be made in the educational field. It is of paramount importance to reconsider the role that social agents who participate in education have in a changing society that presents challenges to education. What does it mean to say that some features, such as gender, race and sexual orientation, are socially constructed? Many scholars claim that social constructionism about a kind is a version of realism about that kind, according to which the corresponding kind is a social construction, that it, it is constituted by social factors and practices. Social constructionism, then, is a version of realism about a kind that asserts that the kind is real, and puts forward a particular view about (...) the nature of the kind, namely, that it is constituted by social factors and practices. Social constructivists about human kinds such as gender, race and sexual orientation often make an additional claim, namely, that these kinds are social constructions but they are typically believed to be biological kinds (that is, people are typically wrong about the nature of these kinds). Ron Mallon (2017) calls social constructions that are (falsely) taken to be biological kinds covert social constructions. Are sexual orientations freely chosen? The idea that someone’s sexual orientation is not a choice is very influential in the mainstream LGBT political movement. But do we have good reasons to believe it is not a choice? Going against the orthodoxy, William Wilkerson has recently argued that sexual orientation is partly constituted by our interpretations of our own sexual desires, and we choose these interpretations, so sexual orientation is partly constituted by choice. In this paper I aim to examine the (...) question of whether our interpretations of our own sexual desires are constitutive of our sexual orientations. I will argue that whereas Wilkerson’s argument for the claim that sexual orientations are in part constituted by our chosen interpretations of our sexual desires is not sound, there are good reasons for endorsing a weaker claim, namely, that there are different but equally apt descriptions of the same sexual desires, depending on which concepts we have. As we navigate physical (e.g., supermarket) and digital (e.g., social media) systems, we generate personal data about our behavior. Researchers and designers increasingly rely on this data and appeal to several approaches to collect it. One of these is data donation, which encourages people to voluntarily transfer their (personal) data collected by external parties to a specific cause. One of the central pillars of data donation is informed consent, meaning people should be _adequately informed_ about what and how their data (...) will be used. However, can we be _adequately informed_ when it comes to donating our data when many times we don’t even know it is being collected and, even more so, what exactly is being collected? In this paper, we investigate how to foster (personal) data literacy and increase donors’ understanding of their data. We introduce a Research through Design approach where we define a data donation journey in the context of speech records, data collected by Google Assistant. Based on the data donation experiences of 22 donors, we propose a data donation framework that understands and approaches data donation as an encompassing process with mutual benefit for donors and researchers. Our framework supports a donation process that dynamically and iteratively engages donors in exploring and understanding their data and invites them to (re)evaluate and (re)assess their participation. Through this process, donors increase their data literacy and are empowered to give meaningfully informed consent. (shrink)

An important question in the debate regarding the nature of politically significant human kinds, such as gender, race, and sexual orientations, is concerned with the question of whether these human kinds are socially constructed (Stein 1999; Root 2000; Haslanger 2012; and Ásta 2013). In order to settle this debate, a more fundamental question needs to be answered: what does it mean to say that a category is socially constructed? -/- Recently, many philosophers have become interested in this issue (Hacking 1999; (...) Stein 1999; Haslanger 2003; Mallon 2007; Diaz-Leon 2015; Ásta 2015). They all seem to agree that there is not a single notion of social construction, but rather, there are different notions of social construction for different purposes. The important question in order to formulate a useful notion of social construction, then, is which project is at issue, and which notion of social construction is more useful for the purposes of that project. In this chapter I will focus on two projects that social constructivists are often interested in, namely, (i) the project of arguing against the inevitability of a trait, that is, to show that those features are not determined by human nature; and (ii) the project of arguing against the universality of a trait, that is, to show that a certain human category or kind is not a universal, transcultural, culture-independent property and that it cannot be applied to other cultures, places, and times; and I will discuss which notion of social construction is more useful with respect to each project. -/- My main questions, then, will be the following: (a) Is there any notion of social construction that entails that if X is socially constructed, then X is not inevitable, that is, X is not determined by human nature? This collection is essential not only for understanding the full-fledged version of Chwistek's conception but also for surveying its development over a span of five years (1916-1921). Reading these essays in chronological order allows us to notice all stages of its development, beginning with its first sketches, drawn in the book Meaning and Reality, where only two (...) realities are considered, and finishing with Chwistek's most famous essay, The Plurality of Realities, in which he discusses four different realities: the reality of things, the reality of physics, the reality of impressions, and the reality of imaginations. The collection is preceded by two introductory essays by Karol Chrobak. The first presents Leon Chwistek against the background of the intellectual, cultural, and political life of the interwar period in Poland. La comunicación analiza la importancia del derecho a la participación en los procedimientos de protección a la infancia, especialmente en los casos de los niños y niñas migrantes no acompañados al ser nuevos actores sociales. Estas niñas y niños son autónomos, poseen su propio plan vida, en el que se incluye su propio plan migratorio, y actúan de una manera distinta dentro de la sociedad. Tienen derecho a participar dentro de los sistemas de protección y que, por tanto, estos sistemas (...) deberían tener en cuenta sus particularidades como nuevos actores sociales, para que se logre una correcta protección de sus derechos. El objetivo de este ensayo es mostrar algunos ejemplos del papel fundamental que tuvo la Biblia en la evangelización del Nuevo Mundo durante el siglo XVI. Tres aspectos serán estudiados aquí: 1) el intento inicial de traducir los textos bíblicos a las lenguas indígenas, finalmente frustrado; 2) la importancia de la Sagrada Escritura para dilucidar las estrategias políticas y religiosas a seguir con respecto al Nuevo Mundo, ejemplarizada en la cita de Lc 14,23; 3) los temas bíblicos en el teatro (...) de evangelización. The aim of this essay is to show some examples of the important role that had the Bible in the evangelization of the New World during the 16th century. Three aspects will be studied here: 1) the initial attempt to translate biblical texts to indigenous languages, finally frustrated; the importance of Sacred Scripture for political and religious strategies to be followed with respect to the New World, exampled on the appointment of Lc 14.23; biblical themes in the theatre of evangelization. David Papineau [1999. “Normativity and Judgement.” Proceedings of the Aristotelian Society 73 : 16–43.] argues that norms of judgement pose no special problem for naturalism, because all such norms of judgement are derived from moral or personal values. Papineau claims that this account of the normativity of judgement presupposes an account of content that places normativity outside the analysis of content, because in his view any accounts of content that place normativity inside the analysis of content cannot explain the normativity (...) of judgement in the derivative way he proposes. Furthermore, he argues that normative accounts of content along those lines are independently problematic. In this paper I aim to respond to both objections, by arguing that normative accounts of content can be seen as naturalist accounts, even if they place normativity inside the analysis of content; and that normative accounts of content are compatible with a derivative account of norms of judgement of the sort Papi... In this paper, I argue that, in his Theory of Moral Sentiments, Adam Smith conflates two different meanings of ‘self-command’, which is particularly puzzling because of the central role of this virtue in his theory. The first is the matrix of rational action, the one described in Part III of the TMS and learned in ‘the great school of self-command’. The second is the particular moral virtue of self-command. Distinguishing between these two meanings allows us, on the one hand, to (...) solve some apparent paradoxes of the text; and, on the other, to identify various features of both the practical reason and deontological ethical traditions that are present in Smith's sentimentalism, enriching his phenomenological account of moral actions. The literature addressing bias and fairness in AI models (fair-AI) is growing at a fast pace, making it difficult for novel researchers and practitioners to have a bird’s-eye view picture of the field. In particular, many policy initiatives, standards, and best practices in fair-AI have been proposed for setting principles, procedures, and knowledge bases to guide and operationalize the management of bias and fairness. The first objective of this paper is to concisely survey the state-of-the-art of fair-AI methods and resources, (...) and the main policies on bias in AI, with the aim of providing such a bird’s-eye guidance for both researchers and practitioners. The second objective of the paper is to contribute to the policy advice and best practices state-of-the-art by leveraging from the results of the NoBIAS research project. We present and discuss a few relevant topics organized around the NoBIAS architecture, which is made up of a Legal Layer, focusing on the European Union context, and a Bias Management Layer, focusing on understanding, mitigating, and accounting for bias. One compelling argument challenging the tenability of physicalism, which sees reality as fundamentally comprised of physical facts, is Jackson's knowledge argument. Through a powerful thought experiment involving the case of Mary, the super neuroscientist, the argument demonstrates how knowledge of phenomenal facts cannot be deduced from knowledge of physical facts. For allegedly leaving out phenomenal facts in its account of reality, physicalism is shown to be incomplete and hence mistaken. Physicalists respond to this argument in a variety of ways, challenging, (...) in turn, some aspects of the knowledge argument. This paper focuses on the replies of the ability hypothesis and the phenomenal concept strategy, which respectively try to block the two crucial moves in the knowledge argument: the establishment of an epistemic gap and the inference from the occurrence of this gap to the existence of an ontological gap. The paper critically examines how proponents of these two replies to the knowledge argument respond to some objections to maintain the viability of physicalism. (shrink)
