In this groundbreaking work, French legal scholar Alain Supiot examines the relationship of society to legal discourse. He argues that the law is how justice is implmented in secular society, but it is not simply a technique to be manipulated at will: it is also an expression of the core beliefs of the West. We must recognize its universalizing, dogmatic nature and become receptive to other interpretations from non-Western cultures to help us avoid the clash of civilizations. In Homo (...) Juridicus, Supiot deconstructs the illusion of a world that has become flat and undifferentiated, regulated only by supposed "laws" of science and the economy, and peopled by contract-makers driven only by the calculation of their individual interests. Such a liberal perspective is nothing but the flipside of the notion of the withering away of law and the state, promoted this time not under the banner of the struggle between classes, but rather in the name of the free competition between sovereign individuals. Since the 1980s, two different paradigms have reshaped industrial societies: the Neoliberal paradigm and a Research and Innovation paradigm. Both have been conceptualized and translated into strong policies with massive economic and social consequences. They provide divergent responses to the environmental transition. The Neoliberal paradigm is based on economic models and geopolitical solutions. The Research and Innovation paradigm's goal is to manage knowledge differently in order to reorient the evolution of society. Since the mid-1990s, a version of the Research and (...) Innovation paradigm has led to the design of large-scale research and innovation policies. This book examines how these policies have evolved and how they can be extended and reformed to respond to present and future environmental constraints. It studies the transformation of the conception, organization and role of science and technology in the evolution of industrial societies and explores the future of these developments. The book offers three unique lines of enquiry. The first is to focus not specifically on economics, sociology, political science or history, but on knowledge creation from an institutional and reflexive point of view. The second is to establish a convergence between the British school of science and technology studies and the research trends opened by the work of Michel Foucault. Both introduced trans-disciplinary and policy-oriented research associating case studies, long-term perspectives and theory. The third is to consider climate change as the overwhelming challenge of our time. The book is an insightful guide for students, scholars and researchers across the humanities and social sciences, including philosophy, political science, law, economics, business and media. Les expériences de «classe inversée» apparaissent aujourd'hui prometteuses. Alors que, dans les «classes traditionnelles», on «fait cours» à l'Ecole avant d'envoyer les élèves «travailler» chez eux, dans les «classes inversées», le professeur propose aux élèves de prendre connaissance d'un exposé enregistré ou d'une séquence illustrée puis les accueille en classe pour répondre à leurs questions et les accompagner dans la réalisation d'exercices ou de projets... On comprend que ce modèle pédagogique soit particulièrement attractif : à l'ère du numérique, au moment (...) où tant de ressources documentaires sont disponibles, le professeur voit ainsi son rôle renouvelé et peut se consacrer pleinement à l'appropriation des connaissances. Mais il ne faut pas, pour autant, basculer dans la naïveté spontanéiste. Prendre connaissance d'une information ou regarder une vidéo pour en tirer quelques enseignements ne vont pas de soi et le risque existe que beaucoup d'élèves n'en profitent guère. De même, interroger le professeur pour mieux comprendre un phénomène, faire un exercice de manière autonome ou travailler en petits groupes pour résoudre un problème ne sont pas des comportements faciles à mettre en oeuvre. Etre intellectuellement actif, s'engager dans un travail et le mener à bien ne se décrète pas, cela se forme. Et, précisément, l'ouvrage d'Alain Taurisson et de Claire Herviou nous montre comment faire. Prenant appui sur des travaux scientifiques éprouvés et des expérimentations solides, présentant les références théoriques nécessaires et donnant de très nombreux exemples d'outils utilisables, les auteurs fondent une véritable «pédagogie de l'activité», garantissant pleinement l'engagement de chaque élève tant dans la prise d'information que dans l'assimilation et le réinvestissement des connaissances. ExcerptCarl Schmitt (1888–1985) is known as the most consequential German legal and political mind of the twentieth century.1 Many crimes of the Nazi regime found support in his conceptual justifications, and Schmitt is called the “Crown Jurist” of the Third Reich with good reason. Historians, political scientists, and sociologists must grapple with the author in order to understand the course of totalitarianism in modernity. Whether literary historians should do so is far less settled, though he was fascinated by their object (...) of study. His writings on literary topics are said to reveal much about Schmitt’s person, politics, and period, but little about literature itself.2 This explains why his “Don Quijote und das Publikum” (“Don Quixote and the Public”), published in the arts and cultural journal Die Rheinlande in 1912, was almost unknown in literary studies for a century.3 Schmitt’s text on the novel by Miguel de Cervantes has not been reprinted, and until recently it had not been translated from the original German. Size has a role too. At under two thousand words, the text has probably escaped notice due to its small scale.4 Recent English and Italian translations in major humanistic journals may signal the end of its obscurity though.5 “Don Quixote and the Public” is at the door of literary studies. La publication de l'Emile a produit une rupture épistémologique qui n'a pas échappé à Kant. Mais, rejetant toute assomption philosophique, l'ouvrage de 1762 met en récit une méthode qui prétend accomplir l'homme en ce qu'il est, tout en même temps qu'en ce qu'il doit être. Consacrant le pouvoir d'autoformation du sujet, Rousseau ouvre pourtant, à son corps défendant, une nouvelle brèche philosophique dans le rapport que ce sujet triomphant entretient avec ce que le Genevois s'obstine à présenter comme " la (...) bonté absolue du projet ". C'est à penser cette brèche, et le chemin pour la franchir, que se consacreront un certain nombre de penseurs et acteurs pédagogiques, qui peuvent ainsi s'inscrire dans la postérité éducative de l'Emile, et que présentent des spécialistes de chacun d'entre eux : Condorcet (A. Trouvé), Kant (B. Vandewalle), Pestalozzi (M. Soëtard), Fichte (J: M. Lamarre), Herbart (J: F. Goubet), Dilthey (D. Moreau), Dewey (M. Fabre), Freinet (R. Hétier). Ont-ils réussi? The Western metaphor of self-as-identity?as a static, inherently exclusive entity?has been instrumental, historically, to our radical separation from nature, and still hampers a reviving of genuine participation with nature. Suggesting an alternative to this metaphor (informed by literacy as technology), I explore the more nature-informed metaphor of dynamic, complex self-systems, involving both natural and human subsystems. Through this latter metaphor, I re-vision radical participation with nature: in the process of perception, in epistemology/ontology, and in the ways of indigenous, oral cultures. (...) Manchmal ist es nur eine Anspielung, zuweilen bloss ein Werktitel oder Künstlername, dann wiederum werden mit wenigen Sätzen Gemälde gleichsam reproduziert. Von Sternbildern bis Briefmarken, von Meissner Nippes bis zu Deckengemälden reichen die Bildbeispiele, die in den Romanen genannt, vom Erzähler und seinen Figuren erinnert, diskutiert, gekauft, vererbt, geschaffen und zerstört werden. Alle (...) wichtigen Geschehnisse und Themen spiegeln sich in Bildern, mit Bildern lernen sich Figuren kennen und lieben, wegen Bildern zerstreiten und trennen sie sich. Fontane hat in seinen Romanen an über 1 500 Textstellen Bildmotive eingearbeitet: Porträts, Wappen, Orden, Ornamente, Denkmäler oder Heiligenbilder schimmern wie Wasserzeichen durch seine Texte hindurch. Viele dieser Bilder sind jedoch für heutige Leserinnen und Leser?verblasst?, ihr ikonografischer Gehalt ist kaum noch gegenwärtig. Die Erkundungen des Lese- und Bilderbuches führen insofern oftmals durch Terra incognita. Dabei ist es nicht nötig, Fontanes Werke zu kennen, um der Tour durch sein Musée imaginaire folgen zu können. Diese navigiert durch den gesamten Raum seiner Geschichten wie durch einen einzigen Riesenroman und geht den Motivlinien und Mustern nach, die der Autor gesetzt hat, etwa den Bildern der Liebe, der Macht und des Todes, den Bildern des Wissens und den neuen Bildmedien des 19. One of the admirable purposes of the current anthology is to attempt a dialogue between professional philosophers of biology and biological scientists. This is indeed an ambitious undertaking, because although the former group pays a lot of attention to the latter, active scientists rarely pay heed to what the philosophers of biology, or even of science in general, have to say. The current paper is an attempt to address some reasons why this might be so from the bench-level view of (...) a biological scientist who has only a superficial acquaintance with the philosophy of science. Any excursion out of the confines of one’s professional discipline, such as the current one, generates the healthy fear that the exercise will end up in humiliation for the fool who attempts it. I have, perhaps foolishly, overcome this fear in the spirit of this symposium, with the hope that my more glaring errors of interpretation of the philosophy of science will be forgiven by the professional philosophers reading this paper, in the interest of establishing a dialogue. The following account is based on the idea that metaphors are not only illustrative but constructive: they connect things and create new meanings that would not exist without them. The tricky point seems to me that metaphors are unavoidable, yet can only be determined situatively, because they are the result of complex transfers of meaning. In order to make these assumptions plausible, I will use some examples from the history of microbiology, especially from the discourse of the parasite.

It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. Legal scholars and theorists have recently drawn a more sustained attention to the link between international human rights law (hereafter IHRL) and international criminal law (hereafter ICL). This concerns both positive and more normative accounts of the link. Whether positive or normative, the predominant approach to constructing the link is substantive. This overlap is normatively justified in similar terms by reference to a subset of moral human rights. In this paper, I offer an alternative to the substantive approach. After identifying (...) two flaws in the substantive approach (the problem of threshold and the problem of ethical neutrality), I defend what I call a structural account by focusing on duty‐holders. I start by reconstructing two structural characteristics common to IHRL and ICL qua international legal regimes: who has the authority to address violations of IHRL and ICL, and who can be liable for those violations. I then infer that public authority (functionally construed) constitutes the common structural core of IHRL and ICL. I rely on the extraterritorial application of IHRL and on the collective dimension of ICL violations to further support the argument. I finally offer an argument explaining the normative point of those structural features. I hold that IHRL and ICL (their adjudicative and liability regimes) are both necessary (but clearly not sufficient) to render this exercise of public authority legitimate to its subjects. (shrink)

In this paper, I offer an analytical and normative framework to re-visit the question of whether state parties should derogate from the European Convention on Human Rights (ECHR) in order to combat the COVID-19 pandemic via harsh ‘lockdown’ measures. It is three-pronged. First, I show that the predominant debate on the (non-)derogation question is informed by a textual approach to adjudication, which severely limits the analytical and evaluative horizon for addressing the issue. Most importantly, it cannot address one salient fact (...) about the effects of lockdown measures, namely their highly disproportionate effects on vulnerable groups and minorities. Second, I argue that proportionality assessment should be the basis for determining whether state parties ought to derogate or not. This is because proportionality’s very purpose is in part to track the effects of state interferences on minorities and vulnerable groups by measuring the disproportionate burden imposed on them. It is also because proportionality assessment has very different requirements between limitation clauses built into the relevant Convention articles (e.g. Article 5, Articles 8–11) and the derogation clause (Article 15) under the ECHR. Surprisingly, while the emerging literature almost always mentions proportionality as an important component of the analysis, it does not investigate the extent to which each regime (derogation or limitation) better performs it, and why. Third, I draw from the philosophical literature on the ‘right to justification’ to clarify the egalitarian and justificatory function of proportionality. Unlike derogation, limitation clauses have a much higher and systematic requirement of justification, which makes the case for non-derogation clearer and stronger. (shrink)

Self-awareness represents the capacity of becoming the object of one’s own attention. In this state one actively identifies, processes, and stores information about the self. This paper surveys the self-awareness literature by emphasizing definition issues, measurement techniques, effects and functions of self-attention, and antecedents of self-awareness. Key self-related concepts (e.g., minimal, reflective consciousness) are distinguished from the central notion of self-awareness. Reviewed measures include questionnaires, implicit tasks, and self-recognition. Main effects and functions of self-attention consist in selfevaluation, escape from the (...) self, amplification of one's subjective experience, increased self-knowledge, self-regulation, and inferences about others' mental states (Theory-of-Mind). A neurocognitive and socioecological model of self-awareness is described in which the role of face-to-face interactions, reflected appraisals, mirrors, media, inner speech, imagery, autobiographical knowledge, and neurological structures is underlined. This book studies the occurrence (or not) of a case of circular reasoning in Kant's attempt to establish the foundation of knowledge. The response to this question instigates a commentary on the transcendental deduction of the categories, which lie at the heart of the Critique of Pure Reason, in both the 1781 and 1787 editions.

A single, fairly simple proposition lies at the heart of the present contribution, viz. that the development of early-modern literature on international law should be regarded as a specific form of the early usus modernus during the second half of the sixteenth century and the first half of the seventeenth century.In Section 1 that general proposition and some of its ramifications will receive some further explanation. First, the main characteristics of usus modernus will be set out, and, subsequently, their applicability (...) to early-modern literature on international law will be outlined. In addition, the question should be raised, what purpose the characterisation of that literature as part of the more general usus modernus may serve. These considerations may inevitably appear somewhat abstract. Section 2 will therefore aim to provide a particular illustration, based on two contemporary works on the law of naval warfare, viz. A. Gentili's Hispanicae Advocationis Libri Duo and H. Grotius' De jure praedae. (shrink)

The aim of this article is to examine the potential influence of mass-media on public’s opinions and attitudes towards economic liberalism. It shows that, without relying to the assumption that journalists pursue such a purpose, the nature of the media system leads them to give a rather negative image of how the market economy works and doesn’t give the same place to liberal thesis with respect to others. Our argument is founded on a critique of the economic model of spatial (...) competition currently used in this field, on the crucial role that norms inherent to the profession of journalist play and the characteristics of the demand which media face. L’objet de cet article est d’examiner la question de l’influence éventuelle des médias de masse sur les opinions et attitudes du public à l’égard du libéralisme économique. On y montre que, sans recourir à l’hypothèse que les journalistes poursuivent consciemment un tel objectif, la nature du système médiatique les conduit à donner une image plutôt négative du fonctionnement de l’économie de marché et à ne pas donner une place équilibrée à l’exposé des thèses libérales par rapport aux autres. L’argumentation suivie repose sur la critique du modèle économique de la concurrence spatiale habituellement utilisé à ce sujet, sur le rôle déterminant que jouent les normes propres à la profession de journaliste et les caractéristiques de la demande s’adressant aux médias. Quite a few recent models are rapidly introducing new concepts describing different levels of consciousness. This situation is getting confusing because some theorists formulate their models without making reference to existing views, redundantly adding complexity to an already difficult problem. In this paper, I present and compare nine neurocognitive models to highlight points of convergence and divergence. Two aspects of consciousness seem especially important: perception of self in time and complexity of self-representations. To this I add frequency of self-focus, amount (...) of self-related information, and accuracy of self-knowledge. Overall, I conclude that many novel concepts (e.g., reflective, primary, core, extended, recursive, and minimal consciousness) are useful in helping us distinguish between delicate variations in consciousness and in clarifying theoretical issues that have been intensely debated in the scientific literature—e.g., consciousness in relation to mirror self-recognition and language. Inner speech is postulated to play a key-role in this model, as it establishes important connections between many of its ele- ments. This paper first reviews past and current references to a link between self-awareness and inner speech. It then presents an analysis of the nature of the relation between these two concepts. It is (...) suggested that inner speech can inter- nally reproduce and expand social and physical (ecological) sources of self- awareness. Inner speech can also create a psychological distance between the self and mental events it experiences (thus facilitating self-observation) it can act as a problem-solving device where the self represents the problem and self-information the solution, and can label aspects of one’s inner life that would otherwise be difficult to objectively perceive. Empirical evidence supporting the role of inner speech in self-awareness is also presented. (shrink)
