Objectives—While clinical practice is complicated by many ethical dilemmas, clinicians do not often request ethics consultations. We therefore investigated what triggers clinicians' requests for ethics consultation. Design—Cross-sectional telephone survey.Setting—Internal medicine practices throughout the United States.Participants—Randomly selected physicians practising in internal medicine, oncology and critical care.Main measurements—Socio-demographic characteristics, training in medicine and ethics, and practice characteristics; types of ethical problems that prompt requests for consultation, and factors triggering consultation requests. Results—One hundred and ninety of 344 responding physicians (55%) reported requesting ethics (...) consultations. Physicians most commonly reported requesting ethics consultations for ethical dilemmas related to end-of-life decision making, patient autonomy issues, and conflict. The most common triggers that led to consultation requests were: 1) wanting help resolving a conflict; 2) wanting assistance interacting with a difficult family, patient, or surrogate; 3) wanting help making a decision or planning care, and 4) emotional triggers. Physicians who were ethnically in the minority, practised in communities under 500,000 population, or who were trained in the US were more likely to request consultations prompted by conflict. Conclusions—Conflicts and other emotionally charged concerns trigger consultation requests more commonly than other cognitively based concerns. Ethicists need to be prepared to mediate conflicts and handle sometimes difficult emotional situations when consulting. The data suggest that ethics consultants might serve clinicians well by consulting on a more proactive basis to avoid conflicts and by educating clinicians to develop mediation skills. (shrink)

Clinical Study Agreements can have profound effects both on the protection of human subjects and on the independence of investigators to conduct research with scientific integrity. Sponsors, institutions, and even investigators may fail to give adequate attention to these issues in the negotiation of CSAs. Despite the key role of CSAs in structuring ethically important aspects of research, they remain largely unregulated and unreviewed for adherence to ethical norms. Academic institutions routinely enter into research contracts that fail to meet adequate (...) ethical standards. This is a failing that can have serious consequences.Accordingly, it is necessary that some independent body have the authority both to review research contracts for compliance with norms of subject protection and ethical integrity, and to reject studies that fail to meet ethical standards. Such review should take place prior to the start of research, not later. Because of its expertise and authority, the institutional ethics review board is the appropriate body to undertake such review. Much recent commentary has focused on contractual restrictions on the investigator’s freedom to publish research findings. The Olivieri experience, and that of other investigators, has brought freedom of publication issues into sharp focus. Clinical study agreements also raise a number of other ethical issues relating to human subjects and research integrity, however, including disclosures relating to patient safety, data analysis and reporting, budget, confidentiality, and premature termination of the study. This paper describes the ethical issues at stake in structuring such agreements and suggests ethical standards to guide institutional ethics review. (shrink)

The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

The structure—as nothing more than the relation between parts—naturally implies a point of view. It calls into question the necessity of form and the way that differences and similarities are established. It plays with resemblances, or, les airs de famille. It asks what in the drawing is regular or continuous and what is not. And it wonders where to begin. The series, Cristal, is also a magnetic proximity, a minimalist rhythm: it creates the possibility of successive metamorphoses, until there is nothing left to say.It is no doubt possible to interpret Cristal as a geometric abstraction. Deep learning and other black-box models are becoming more and more popular today. Despite their high performance, they may not be accepted ethically or legally because of their lack of explainability. This paper presents the increasing number of legal requirements on machine learning model interpretability and explainability in the context of private and public decision making. It then explains how those legal requirements can be implemented into machine-learning models and concludes with a call for more inter-disciplinary research on explainability.

ABSTRACTResearch that dissociates different types of processes within a given task using a processing tree approach suggests that attitudes may be acquired through evaluative conditioning in the absence of explicit encoding of CS-US pairings in memory. This research distinguishes explicit memory for the CS-US pairings from CS-liking acquired without encoding of CS-US pairs in explicit memory. It has been suggested that the latter effect may be due to an implicit misattribution process that is assumed to operate when US evocativeness is (...) low. In the present research, the latter assumption was supported neither by two high-powered experiments nor by complementary meta-analytic evidence, whereas evocativeness exerted an influence on explicit memory. This pattern of findings is inconsistent with the view that CS-liking acquired without encoding of CS-US pairs in explicit memory reflects an implicit misattribution process at learning. Hence, the underlying learning process is awaiting further empirical scrutiny. (shrink)

Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les familles nucléaires, (...) le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. It was only progressively, by confronting their spiritual experience and the cultural conditions of their apostolate, that Ignatius and his companions were led to found a new order and then to recognize the importance of teaching in colleges. This article sets out the different stages of that progressive discovery. It recalls how Ignatius passed from his chivalrous desires to those of service of and in the Church, by attending to the interior experience of the Spiritual Exercises and to their being (...) set down in writing. The experience of liberty and an objectifying putting down in writing were two poles, characteristic of modernity, that formed the main bases for inventing Jesuit colleges. Moreover, they were also bases which supported the writing of the Constitutions of the Society. For the Jesuits of today they remain ever innovative points of reference for discernment. (shrink)

_The Scarlet Empire_ (1906) by David Maclean Parry, a former president of the National Association of Manufacturers (NAM), offers an anti-utopian romance set in an authoritarian socialist Atlantis. Supplementing the efforts of NAM to limit the power of unions and diminish the appeal of socialism through political and editorial suasion, the novel promised a new and powerful way of proselytizing middle-class readers by competing with prominent literary utopians and socialists, especially Edward Bellamy and Upton Sinclair. The novel's protagonist is converted (...) to individualism and capitalism and comes to see socialism as emasculating. _Empire_ bundles capitalism and masculinity together through a redemptive adventure romance narrative that serves capitalist ideological purposes and has the protagonist combining tremendous wealth, a powerful faith in individualism, and a recovered masculine subjectivity to become a captain of industry and paragon of a hegemonic masculinity at the turn of the twentieth century. This study assesses the impact had by institutional isomorphic pressures in the organisational fields of 185 businesses operating within the United Kingdom. The emphasis throughout is on how external institutions affect the socially and environmentally responsible aspects of an organization’s purchasing practice. Factor analyses and a linear regression model are employed to test the influence of these pressures. Initial findings suggest that what other industry participants are doing in this area is not as important in affecting the procurement practice of (...) the focal organisation as is the managers’ perception of how legitimacy is awarded by stakeholders and, indeed, if competitors with well-developed social and environmental supply chain management programs are perceived favourably in the industry. The following text seeks to identify the origins of what has come to be called the Sokal hoax. It appears that these origins remain problematic insofar as they cannot be thought without engaging into intrinsically duplicitous thinking. Thus, « originally », the gesture of the hoax is indeed « productive and conflictive, and no self-identity, no unity, and no inherent simplicity can possibly precede it », as « he » said, but « he » was disseminating, as we say. But (...) that is precisely the « strength » of the « form » of the Sokal hoax. With the delicate question of origins as its stumbling block—a stumbling block which may also be the question of irony—, the present text takes its cue from an passage from La Barbarie à visage humain and proposes to reveal the constructive consequences of the affair triggered by the hoax, while constantly paying tribute to its performance. Whether my argument will make it possible to distinguish the consequences from the origins remains moot : post hoc ergo propter hoc. One must remember that this is a sophism. (shrink)

Este trabalho apresenta uma pesquisa sobre a religiosidade em Mazagão Velho, expressa por meio das festas devocionais que ali ocorrem, buscando compreendê-las como um elemento histórico de coesão social. Para tanto, parte-se do estudo da mentalidade formada no Brasil colônia com sua ideologia de expansão da fé cristã. É nesse contexto que toma forma o catolicismo popular. A localidade escolhida como base para este estudo apresenta especificidades que a tornam um caso único. Ela traz a memória das antigas lutas entre (...) cristãos e mouros ainda no Marrocos, onde foi primeiramente fundada, sendo posteriormente transferida para o Brasil no século XVIII. Além disso, apresenta um rico processo de interação com os indígenas e africanos, caracterizando-a como uma sociedade multicultural. Essa história ainda é marcada pela degradação social ocorrida no final do século XVIII. Contudo, mesmo passando por diversos reveses, a comunidade subsistiu e mantém-se viva até os dias atuais. Como principal prática social, destacam-se as festas devocionais, que são eventos coletivos que congregam elementos, como as crenças e os rituais que expressam a vida em sociedade. Também fazem parte dessas festas as manifestações culturais surgidas a partir do encontro das culturas ali presentes. Para entender essa longa história, a ideia de coesão social foi essencial. Neste sentido, a pesquisa buscou mostrar que essa comunidade manteve sua existência graças à coesão social ali formada e sustentada pela religiosidade que se manifesta, de maneira mais efetiva, por meio das festas em devoção aos santos católicos em um ciclo que se renova a cada ano. Para tanto, o trabalho foi realizado por meio de uma abordagem interdisciplinar, com uma análise que compreende tanto uma perspectiva histórica quanto uma abordagem sociológica. Para isso, houve a observação de algumas festas in loco, a pesquisa documental e a pesquisa bibliográfica. Conclui-se que as festas devocionais são eventos sociais fortemente marcados pela tradição histórica do local. Ademais, a continuidade histórica dos acontecimentos mostra que, diante dos problemas passados pela localidade, a sociedade encontrou forças na união de seus moradores, nas tradições e na memória de seus antepassados, fortalecendo-se por meio da realização das festas devocionais. Les individus, comme les constellations de jugement qu’ils forment, sont passés au crible d’une écriture digressive qui démonte les mécanismes idéologiques de l’agir. Les institutions écclésiales sont mises à mal, cela va de soi, en raison des atteintes qu’elles portent à la liberté individuelle. Pourtant, Diderot (...) dépasse une visée polémique, par trop démonstrative, pour faire de l’écriture dialogique, construite sur deux niveaux, le lieu d’une exploration des conditions d’application de la « loi naturelle » dans le champ de la morale et, partant, du politique. Language is a complex intentional, syntactical and referential system involving a left-hemispheric specialization of the brain in which some cerebral regions such as Broca’s and Wernicke’s areas play a key-role. Because nonhuman primates are phylogenetically close to humans, research on our primate cousins might help providing clues for reconstructing the features of our ancestral communicative systems. In the present paper, after emphasising the tight relation between gestures and language in humans, we underlie the specific significance of communicative gestures and of (...) the progressive control of the oro-facial system and the vocal tract in the course of the language evolution. For this purpose, we will then review the findings related to the features, the lateralization and brain correlates of both vocal and gestural systems in nonhuman primates. (shrink)

Le genre épigrammatique est connu pour son potentiel comique mais également pour la dimension ludique qu’il peut mettre en place. Cette étude s’intéresse précisément à ces deux aspects et à leur mise en relation au sein des épigrammes à caractère sexuel d’Ausone et de Claudien afin d’observer les interactions entre ces trois dimensions (comique, ludique, sexualité) mais également pour délimiter les moyens et les bornes du comique et du ludique.

Dans le Traité de la réforme de l’entendement, le jeune Spinoza réconcilie sans les confondre les deux principales composantes de la vera Methodus et, dans une certaine mesure, unifie Méthode réflexive et Philosophie. Or, ces deux démarches apportent un éclairage sur la Méthode d’interprétation de l’Écriture conçue au chapitre VII du Traité théologico-politique. En effet, il existe une cohérence trop négligée dans les études spinozistes entre la vera Methodus et ce qu’est devenue la Philosophie ultérieure de Spinoza lorsqu’il formule les (...) règles de l’interprétation de l’Écriture. Cette cohérence s’exprime sur deux plans. Primo, l’interprétation spinozienne des Lettres sacrées implique dans un autre registre l’histoire de l’entendement fondée par le jeune Spinoza sur la connaissance réflexive de l’idée vraie donnée et l’expérimentation. Secundo, l’impossibilité d’une « science vraie » de l’Écriture et l'emploi d'outils intellectuels innés placent le Traité théologico-politique et le Traité de la réforme de l’entendement dans un horizon commun : celui d’un usage spécifique de l’entendement et d’une alternative à la connaissance causale déployée dans l’Éthique.
