This paper offers the concept of “justice failure,” as a counterpart to the familiar idea of market failure, in order to better understand managers’ ethical obligations. This paper takes the “market failures approach” to business ethics as its point of departure. The success of the MFA, I argue, lies in its close proximity with economic theory, particularly in the idea that, within a larger scheme of social cooperation, markets ought to pursue efficiency and leave the pursuit of equality to the (...) welfare state. As a result, the core ethical responsibility of business actors is to avoid profiting off of market failure. After reviewing this approach I challenge its emphasis on efficiency. I argue that just as we note the suboptimal efficiency of actual markets, we should also take seriously the suboptimal equality of actual welfare states. Taking this idea seriously results in a whole other set of ethical responsibilities for businesses to take into account; in addition to market imperfections and regulatory lacunae, managers should also avoid profiting from, and exacerbating, structural inequalities and injustices. I offer an outline of the kinds of injustices and inequalities that would have bearing on business ethics, and the kinds of ethical responsibilities that this approach suggests that business actors should take into account. The clinical trial is the major investigational tool of clinical medicine. Two recent reports highlight the fact that the most often quoted mechanisms for the protection of research subjects, viz., research ethics board review and eligibility criteria, are insufficient to achieve this end. In this paper, we argue that the prime mechanism for the protection of persons in clinical trials should be the clinical judgement of the physician-investigator. The clinical investigator has a duty to protect subjects from both harm and (...) undue risk. It is argued that the clinical investigator has a duty to screen for, and exclude, potential research subjects who may be unduly vulnerable to the risks of a particular clinical trial. In order to fulfill this obligation, the investigator should personally screen each potential research subject at the time of accrual. In larger trials in which this is not feasible, this task could be delegated to another appropriately qualified health care professional, with the principal investigator retaining personal responsibility. To reinforce and make explicit this legal and moral duty, we propose that the investigator sign a statement, appended to each subject's consent form, to attest that this duty has been responsibly discharged. It is argued that neoliberal political ideology has redefined the regulatory state to have greater convergence of interests and goals with the pharmaceutical industry than previously, particularly regarding acceleration and cost reduction of drug development and regulatory review. Consequently, the pharmaceutical industry has been permitted to set the agenda about how shorter term and cheaper alternative carcinogenicity testing systems are investigated for validity. The authors contend that, with the tacit approval of the neoliberal regulatory state, the commercial interests of the (...) pharmaceutical industry framed the process and interpretation of validating these new test systems, thereby influencing what counts as knowledge about the carcinogenic status of new pharmaceuticals. While such alternative tests were occasioned by “molecularization,” the framing of their validation was not determined by technoscientific logic or a lack of standards of validation, but by the sociopolitical goals of the controlling institutions. Indeed, a different validation process could have been conducted had the priority been to develop carcinogenicity testing in the interests of public-health protection. While the resulting validation indicated that the short-term alternative tests posed small risks to the commercial interests of pharmaceutical firms, they provided little reassurance that patients would not be exposed to greater risks than before from undetected carcinogens. The human microbiome is the bacteria, viruses, and fungi that cover our skin, line our intestines, and flourish in our body cavities. Work on the human microbiome is new, but it is quickly becoming a leading area of biomedical research. What scientists are learning about humans and our microbiomes could change medical practice by introducing new treatment modalities. This new knowledge redefines us as superorganisms comprised of the human body and the collection of microbes that inhabit it and reveals how (...) much we are a part of our environment. The understanding that microbes are not only beneficial but sometimes necessary for survival recasts our interaction with microbes from adversarial to neighborly. This volume explores some of the science that makes human microbiome research possible. It then considers ethical, legal, and social concerns raised by microbiome research. Chapters explore issues related to personal identity, property rights, and privacy. The authors reflect on how human microbiome research challenges reigning views on public health and research ethics. They also address the need for thoughtful policies and procedures to guide the use of the biobanked human samples required for advancing this new domain of research. In the course of these explorations, they introduce examples from the history of biomedical science and recent legal cases that shed light on the issues and inform the policy recommendations they offer at the end of each topic's discussion.This volume is the product of an NIH Human Microbiome Project grant. When classical mechanics is seen as the short-wavelength limit of quantum mechanics (i.e., as the limit of geometrical optics), it becomes clear just how serious and all-pervasive the measurement problem is. This formulation also leads us into the Bohm theory. But this theory has drawbacks: its nonuniqueness, in particular, and its nonlocality. I argue that these both reflect an underlying problem concerning information, which is actually a deeper version of the measurement problem itself.

Kant, Hume, and the Interruption of Dogmatic Slumber offers an interpretation of Kant’s “confession,” in the Prolegomena, that “it was the objection of David Hume that first, many years ago, interrupted my dogmatic slumber.” It argues that Hume roused Kant not, as has often been thought, by challenging the principle “every event has a cause” that governs experience, but by attacking the principle of sufficient reason, the basis of rationalist metaphysics and of the cosmological proof of the existence of God. This proposal makes it possible to reconcile Kant’s declaration about Hume with his later assertion that it was the Antinomy of pure reason that first woke him from dogmatic slumber, because the Antinomy, like Hume’s challenge, is directed against the dogmatic use of the principle of sufficient reason. The proposal put forward here also makes it possible to understand why Kant speaks of “the objection of David Hume” after mentioning Hume’s attack on metaphysics; for the “objection” that Kant has in mind, it is argued here, is a challenge to metaphysics, rather than to the foundations of empirical knowledge. This article examines the regulation of nonsteroidal anti-inflammatory drugs, with particular focus on products approved for marketing in the United Kingdom, while denied marketing approval in the United States on safety grounds, and then subsequently withdrawn from the UK market on those grounds. Using international comparison of regulatory data never before accessed outside government and companies, together with interviews with relevant industry scientists and regulators, the article demonstrates the importance of regulatory expectations, deficits and paradigms. It is argued both that (...) these sociological concepts can be enriched by their application to detailed comparative case study of regulatory science, and that they provide an important policy-relevant framework with which to understand discrepant drug regulatory processes in a sociohistorical context. It is found that regulatory expectations and paradigms may be regarded as mediating factors between political culture and structural interests, on the one hand, and the outcomes of regulatory science, on the other. The growth of global value chains (GVCs) and the emergence of novel forms of value chain governance pose two questions for normative business ethics. First, how should we conceptualize the relationships between members of a GVC? Second, what ethical implications follow from these relationships, both with respect to interactions between GVC members and with respect to achieving broader transnational governance goals? We address these questions by examining the emergence of transnational eco‐labeling as an increasingly prominent form of GVC governance that (...) is redefining the relationship between nominally independent firms. On the first question, we argue that GVCs occupy a middle ground between intrafirm and interfirm transactions, thereby posing a challenge to theoretical frameworks that attempt to apply ethical standards based on transaction types. On the second question, we argue that this unique institutional status leads to a range of novel ethical considerations and dilemmas for GVC members. Lead firms, their suppliers, and third‐party standard‐setters all confront new ethical quandaries when third‐party eco‐labeling is introduced to a GVC. The nature of these quandaries means that, while GVCs may be well‐positioned to serve as instruments of transnational governance, they are frequently not well‐oriented to do so. Our analysis marks an initial attempt to map the ethical considerations that apply to members of a GVC, and in doing so, places the literature on normative business ethics and transnational governance in a closer conversation. In an important new book on shared agency, Michael Bratman develops an account of the normative demand for the coordination of intentions amongst participants in shared agency. Bratman seeks to understand this form of normative guidance in terms of that associated with individual planning intentions. I give reasons to resist his form of reductionism. In addition, I note how Bratman’s discussion raises the interesting issue of the function or purpose of shared intention and of shared agency more generally. According to (...) Bratman, the function of shared intention is to promote interpersonal coordination of intention and action. I suggest that power sharing amongst participants must also be included as a function of shared intention. (shrink)

This study of internal auditors and auditees, who engage in both financial and operational internal audits in Israel, extends theory and research on internal audits in organizational units. It develops and tests a model that examines the role of top management and internal auditors in facilitating learning from internal audits and driving perceived performance improvement. We argue that support from the top management for the internal audit as well as the auditor’s capacity facilitate learning from audits and help audited units (...) to improve ethicality, efficiency, and effectiveness in organizations. The results of time-lagged survey data provide general support for the hypothesized indirect relationships between auditor capacity, auditor–auditee relational exchanges, learning from audits, and three different perceived performance measures: ethical behavior, efficiency, and effectiveness. We discuss the implications for research on internal audits, proactive learning, ethics, and performance improvement of organizational units in the public sector. (shrink)

With extraordinary chutzpa and deep philosophical seriousness, Solomon ben Joshua of Lithuania renamed himself after his medieval intellectual hero, Moses Maimonides. Maimon was perhaps the most brilliant and certainly the most controversial figure of the late-eighteenth century Jewish Enlightenment. He scandalized rabbinic authorities, embarrassed Moses Mendelssohn, provoked Kant, charmed Goethe, and inspired Fichte, among others. This is the first study of Maimon to integrate his idiosyncratic philosophical idealism with his popular autobiography, and with his early unpublished exegetical, mystical, and Maimonidean (...) work in Hebrew. In doing so, it illuminates the intellectual and spiritual possibilities open to a European Jew at the turn of the eighteenth century. (shrink)

Al principio este trabajo iba a tratar sobre por qué el antropocentrismo es un problema irrelevante para las discusiones de bioética y deberíamos prescindir de él. El argumento era que sostener una actitud antropocéntrica, tanto moderada como dura, tenía las mismas consecuencias a nivel práctico. Un antropocentrista apelará a la utilidad del medio ambiente y de las especies que en él habitan para la vida humana; y por ello sería importante que cuidara del ecosistema para mantener dichos beneficios. Por otro (...) lado, un no antropocentrista apelará a que los animales y el ecosistema cuentan con una suerte de valor intrínseco y deberíamos cuidarlos atendiendo a dicho valor. El objetivo del presente trabajo es analizar la dificultad y los límites para comprender el significado ético de las decisiones profesionales. Éstas denotan tensiones dialécticas entre lo que el individuo considera su responsabilidad directa y las condiciones en las cuales se ve obligado a actuar y no puede controlar. En otras palabras, se cree actuar con buenas intenciones y razones legítimas y termina determinado por una cadena de acciones que lo llevan a un colapso del significado moral, tanto de sí (...) mismo y del valor del acto en sí, lo cual se convierte en un argumento para justificar la violencia de sus actos. Proponemos que la ética puede comprender estas tensiones si se toman en cuenta las problemáticas existenciales internas de la persona que decide, como son la angustia y la desesperación en conjunto con las aportaciones de las teorías del comportamiento y la comunicación organizacional. Der Raum marks a transitional stage in Carnap’s thought, and therefore has both negative and positive implications for his further development. On the one hand, he is here largely a follower of Husserl, and a correct understanding of that background is important if one wants to understand what it is that he later rejects as “metaphysics.” On the other hand, he has already broken with Husserl in certain ways, in part following other authors. Mabel Cooper and Gloria Ferris lived in St Lawrence's Hospital one of the large learning disability institutions which were built round the edges of London. In this paper, Mabel and Gloria share their memories of three nurses at St Lawrence's, supported by Jane Abraham and in this process reveal a number of ethical issues that remain relevant today.

Despite significant economic growth in both developed and emerging markets, several disadvantaged and marginalized segments of the global population still live in poverty. Recognizing the important role of business in alleviating poverty, management scholars have been increasingly investigating the topic of poverty. Although reviews of the extant literature have provided overviews of select poverty-related themes, such as that of the base of the pyramid, no one study has reviewed the topic of poverty across the management literature. The present systematic literature (...) review collects, organizes and analyzes several hundred articles on poverty research, published in business and management journals during the past 25 years. The study identifies major themes in poverty research, reveals thematic overlaps among subdisciplines, summarizes adopted research methodologies, and recognizes opportunities for future research. We find that, despite the wide variation of research topics and approaches, the studied themes remain relatively insulated within each subdiscipline of management research. Drawing on United Nations' Sustainable Development Goals, we conclude that, although the number of articles on poverty has increased considerably during the last decade, there are several research niches that future management scholars can investigate to alleviate one of the most pressing global challenges of our time. RESUMO: O objetivo deste artigo é indagar de que maneira a filosofia pode ser compreendida como um ato de resistência. Deleuze introduz essa tese, ao aproximar a filosofia da arte, porquanto ambas são atos de criação. Nesse sentido, o método filosófico de Bergson - a intuição - já indica um tipo de atividade filosófica que se caracteriza, antes de tudo, pela criação de conceitos. Ora, como é que um conceito filosófico pode constituir um ato de resistência? Para responder a essa (...) questão, retomamos uma análise sobre a relação entre o método de intuição e a criação artística, seguida da interpretação deleuziana acerca do que significa ter uma ideia. Contudo, a passagem da ideia ao ato de resistência exige uma transposição do plano teórico para o plano concreto. Com esse intuito, focalizamos um exemplo sugerido pela filosofia de Bergson: a ideia de um possível retorno à vida simples. Isso nos permitirá avaliar até que ponto uma ideia filosófica pode ser confrontada com a realidade no mundo atual e, nesse sentido, entendida como um ato de resistência. ABSTRACT: The aim of this article is to ask how philosophy can be understood as an act of resistance. Deleuze introduces this thesis approaching philosophy to art, because both of them are acts of creation. In this sense, the philosophical method of Bergson - intuition - already indicates a kind of philosophical activity which is characterized above all by the creation of concepts. So how could a philosophical concept be an act of resistance? To answer this question, we return to an analysis of the relationship between intuition method and artistic creation, forward by Deleuze’s interpretation of what it means to have an idea. However, the passage from idea to the act of resistance requires a transposition of the theoretical field to the concrete field. With this purpose, we focus on an example suggested by the philosophy of Bergson: the idea of a possible return to the simple life. This will allow us to evaluate the extent to which an idea can be confronted with the reality in today’s world and, accordingly, be understood as an act of resistance. (shrink)

Este artigo examina a relação entre subjetividade e vontade à luz de alguns resultados parciais obtidos em nossa pesquisa sobre a filosofia de Henri Bergson, cujo carro-chefe é a noção de “duração”. Pensar a subjetividade a partir da duração significa admitir que a transição ininterrupta que vai do passado para o futuro passando pelo presente é a temporalidade atuando no nível mais simples de nossa relação com o mundo. Destacamos a subjetividade a partir da duração porque já na percepção estamos (...) evocando o passado para iluminar o presente e, assim, podemos compreender o “problema” da subjetividade a partir de uma ação na qual se observa uma diferença de funções: a diferença entre o presente que atua e o passado que já não atua. É precisamente esse caráter temporal da ação que leva os comentadores de Bergson a interpretarem de maneira original a gênese da subjetividade, o papel da memória na percepção e a conceberem novos sentidos para o conceito de “vontade”. Por conseguinte, a estrutura argumentativa que adotamos neste texto deverá mover-se em três níveis de análise que correspondem, respectivamente, a três aspectos da subjetividade humana (percepção, memória e vontade). Desse modo, pretendemos ressaltar a temporalidade viva como marca registrada do bergsonismo. (shrink)

Boxing was arguably the most popular and controversial sport in colonial Zimbabwe. To tame the sport's violence, which was considered too extreme, colonial officials in Zimbabwe sought guidance and advice from South Africa from the mid-1930s on how best to regulate the sport. South Africa occupied a unique position in this regard, not only because of the relationship it had with colonial Zimbabwe as a neighbouring white settler colony, but also because of how sections of its white settler community responded (...) to the triumphs of Black boxers over white opponents around the world. The colony of South Africa played a significant role in shaping the control of boxing in colonial Zimbabwe. The relationship between the two colonies culminated in the passage of the Boxing and Wrestling Control Act of 1956 in colonial Zimbabwe, an identical version to a similarly named law that South Africa had passed just two years prior. This paper applies an Intersectionality Based Policy Analysis Framework to Ontario’s current mental health plan – The Roadmap: A Plan to Build Ontario’s Mental Health and Addictions Services – in order to identify the contextual influences, underlying values and assumptions, which promote or undermine the uptake of human rights and equity as a mental health policy priority in Ontario. We found that dominant framings of the “problem” of mental health (as lack of access, coordination or integration, as a fiscal drain, (...) as an economic burden, and as a clinical or medical problem) served to obscure and ignore the underlying social and structural conditions that impact mental health and the human rights violations that routinely occur in the context of “care.” We discuss the implications of The Roadmap ignoring social and structural determinants of health, and by way of contrast, explore how citizen engagement and activism can support rethinking mental health policy so that it is more just and equitable. This is the first English translation of the 12th-century philosophical and ethical classic that has been a key work in the development of medieval Jewish thought.

The biblical text accords a great deal of attention to King Solomon’s personal abilities and governmental power. Solomon was described as a judge, poet, constructor and the wisest of all people in the Ancient Near East and Egypt. The current study discusses the interpretation of the midrashim that show how Solomon’s wisdom was manifested in his considerable knowledge of ornithomancy, that is, divination using birds, a practice that was considered as an important wisdom in the ancient world because of its (...) practical applications, particularly in the military sphere. It seems that Solomon’s portrayal as a magician is intended and aimed at emphasising his abilities and his impressive character. Moreover, it may have had the purpose of disproving the conception of Solomon as inferior to his surroundings in this respect and the idea that he or his kingdom could be controlled by nations that command this type of wisdom. The train of thought I will follow here begins with two facts about Husserl. First, the main and most intractable problems in interpreting him, and the major conflicts between his interpreters, arise from and are fed by the equivocality and unsteady meaning of his terminology. Second, Husserl has a highly developed theory of terminology, beginning with, but by no means limited to, the earliest periods of his thought. This theory of terminology, moreover, focuses on the causes of equivocality and unsteadiness (...) of meaning. These two facts, taken together, suggest why there is something philosophically deep, some deep aspect of the selfknowledge of knowledge, in Husserl’s work, and helps explains why figures of the stature of Heidegger and Carnap took so much interest in him. Nevertheless, I will suggest that Husserl’s theory of terminology is inadequate to his problems: that the self-knowledge of philosophy is here (as always) incomplete. This helps explain what both Heidegger and Carnap reject in Husserl, and therefore, in turn, why the question, how to give to or recover for terminology an unequivocal and fixed meaning, becomes crucial for both of them. Both of them, in fact, approach this question in a way which is essentially a modification—albeit a root and branch modification—of Husserl’s approach. This paper, despite it’s title, will be devoted mostly to setting up the problem in Husserl. At the end I will then briefly describe Heidegger’s and Carnap’s contrasting solutions. (shrink)

This essay is a review of Daniel Garber's "Descartes' Metaphysical Physics" (Chicago U P 1992) and Michael Friedman's "Kant and the Exact Sciences" (Harvard U P 1992). Garber's study of Descartes is scrupulous but his historicist assumptions result in a failure to grasp Descartes' originality or the unity and power of his thought. Friedman, by taking Kant's conception of science seriously, sheds great light on Kant's thought generally and implicitly raises important philosophical problems for the present day.
