On Dem. 24.20–23 and the So-Called ἐπιχειροτονία τῶν νόμων: Some Final Clarifications in Response to M. H. Hansen.Mirko Canevaro - 2020 - Klio 102 (1):26-35.
Summary This short article goes back to the problem of the authenticity of the document found at Dem. 24.20–23, with wide implications for the reconstruction of Athenian nomothesia. Without providing a comprehensive response to M. H. Hansen’s recent KLIO article on the topic (M. H. Hansen, The Inserted Document at Dem. 24.20–23. Response to Mirko Canevaro, KLIO 101, 2019, 452–472; itself a response to a previous KLIO article by M. Canevaro), it clarifies some key issues and clears up (...)

The Documents in the Attic Orators: Laws and Decrees in the Public Speeches of the Demosthenic Corpus.Mirko Canevaro - 2013 - Oxford University Press.
In this volume Canevaro studies the 'state' documents preserved in the public speeches of the Demosthenic corpus. Offering a comprehensive account of the documents in the corpora of the orators and in the manuscript tradition, Canevaro summarizes previous scholarship and delineates a new methodology for analyzing the documents.

Nomothesia in classical athens: What sources should we believe?Mirko Canevaro - 2013 - Classical Quarterly 63 (1):139-160.
In the fifth centuryb.c.e.the Athenians did not make any distinction between laws and decrees. The Assembly passed both kinds of measures in the same way, and both general enactments and short-term provisions held the same legal status. At the end of the fifth century, however, the Athenians decided to make a distinction between the two kinds of measures and created the rule that no decree would be superior to a law. The Assembly continued to pass decrees in the same way, (...)

Between ‘The Character of the Athenian Empire’ and The Origins of the Peloponnesian War (and beyond).Mirko Canevaro & David Lewis - 2024 - Polis 41 (1):176-202.
This article discusses the fortune of Geoffrey de Ste. Croix’s famous article ‘The Character of the Athenian Empire’, and reassesses its basic thesis that the Athenian Empire was popular among the lower classes of the allied cities in the light of recent developments in the field. After surveying the article’s immediate and more recent reception, and discussing its relation with The Origins of the Peloponnesian War and The Class Struggle in the Ancient Greek World, it isolates four key new trends (...)

Recognition and Redistribution in Aristotle’s Account of Stasis: a Response to Our Critics.Douglas Cairns, Mirko Canevaro & Kleanthis Mantzouranis - 2023 - Polis 40 (3):349-368.
We reply to the objections raised in Polis 40 (2023) by Ryan Balot and Manuel Knoll to our original paper ‘Recognition and Redistribution in Aristotle’s Account of Stasis’, published in Polis 39 (2022). We argue that Knoll is correct in arguing that Aristotle distinguishes between democratic views of distributive justice and his own, but wrong to argue that this wholly resolves a tension in Aristotle’s exposition between views of democratic justice as, in one sense, based on equality ‘according to worth’ (...)

The Authenticity of the Document at Demosth. or. 24.20–3, the Procedures of nomothesia and the so-called ἐπιχɛιροτονία τῶν νόμων. [REVIEW]Mirko Canevaro - 2018 - Klio 100 (1):70-124.
Summary This article is a response to Hansen's recent defence of the authenticity of the document at Demosth. or. 24.20–3. It discusses the methodology for assessing the authenticity of the documents in the orators, in particular the role of the stichometry and the importance of the epigraphic evidence. It provides an in-depth analysis of the evidence about the nomothesia procedure provided in Demosthenes' „Against Timocrates“, showing, first, that this procedure was one centred on the enactment of new laws, and not, (...)

Recognition and Redistribution in Aristotle’s Account of Stasis.Douglas Cairns, Mirko Canevaro & Kleanthis Mantzouranis - 2022 - Polis 39 (1):1-34.
In Politics 5.1–3, Aristotle sees different conceptions of proportional equality and justice as the fundamental causes of stasis and metabolē. His account shows what happens to notions of ‘particular’ justice when they become causes of individual and collective action in pursuit of moral and political revolution. The whole discussion of the causes of stasis should be read through the filter of individual/group motivation – as a reflection of what goes on in the heads of those who engage in stasis. Movements (...)

The Inserted Document at Dem. 24.20–23. Response to Mirko Canevaro.Mogens Herman Hansen - 2019 - Klio 101 (2):452-472.
Summary At the beginning of this century most scholars believed that the document inserted in Dem. 24.20–23 was authentic. It regulated the legislative procedure practiced by the Athenians in the fourth century B.C. which was introduced shortly after the restoration of the democracy in 404/403 B.C. But in his monograph “The Documents in the Attic Orators” (Oxford 2013), 80–102, Mirko Canevaro rejected the document at Dem. 24.20–23 as a late forgery. I responded with the article “The Authenticity of the (...)

Aristotle’s Understanding of Democratic Justice and His Distinction between Two Kinds of Equality: A Response.Manuel Knoll - 2023 - Polis 40 (2):210-220.
This short article is a response to Douglas Cairns, Mirko Canevaro, and Kleanthis Mantzouranis, who in Polis 39 (2022) explicitly criticize both of my previous interpretations of Aristotle’s view of democratic justice and of the relation of proportional and numerical equality. Against Cairns et al., I argue that there is no tension or contradiction between Aristotle’s statements on these two kinds of equality and on democratic justice. The paper suggests a new reading of Aristotle’s texts that strictly distinguishes between (...)

Platonic Legislations: An Essay on Legal Critique in Ancient Greece.David Lloyd Dusenbury - 2017 - Cham: Springer Verlag.
This book discusses how Plato, one the fiercest legal critics in ancient Greece, became – in the longue durée – its most influential legislator. Making use of a vast scholarly literature, and offering original readings of a number of dialogues, it argues that the need for legal critique and the desire for legal permanence set the long arc of Plato’s corpus—from the Apology to the Laws. Modern philosophers and legal historians have tended to overlook the fact that Plato was the (...)

Decrees in andocides' on the mysteries and ‘latent fragments’ from craterus.Edwin Carawan - 2017 - Classical Quarterly 67 (2):400-421.
The manuscript of Andocides' speechOn the Mysteriescontains a series of documentary inserts culminating in the decrees of Patroclides, Tisamenus and Demophantus. These decrees seem to fit their historical context and they are presented at length, with at least a few of the formalities that we would expect to find in the official record. Modern commentators have relied upon them as substantially genuine, allowing for the usual errors in transmission, but now their authenticity is contested. A close reading by Mirko (...) and Edward Harris rejects all three of these documents as products of feckless ‘forgery’. Alan Sommerstein responded with a strong defence of Demophantus' decree, and Mogens Hansen has recently defended Patroclides' decree and Tisamenus' as well. On many points the defenders are persuasive, but the sceptics make a good case, and so it seems reasonable to reconsider how these documents took shape. (shrink)

Organizational ethics—defined as the alignment of an institution’s practices with its mission, vision, and values—is a growing field in health care not well characterized in empirical literature. To capture the scope and context of organizational ethics work in United States healthcare institutions, we conducted a nationwide convenience survey of ethicists regarding the scope of organizational ethics work, common challenges faced, and the organizational context in which this work is done. In this article, we report substantial variability in the structure of (...)

Why language clouds our ascription of understanding, intention and consciousness.Susan A. J. Stuart - forthcoming - Phenomenology and the Cognitive Sciences:1-22.
The grammatical manipulation and production of language is a great deceiver. We have become habituated to accept the use of well-constructed language to indicate intelligence, understanding and, consequently, intention, whether conscious or unconscious. But we are not always right to do so, and certainly not in the case of large language models (LLMs) like ChapGPT, GPT-4, LLaMA, and Google Bard. This is a perennial problem, but when one understands why it occurs, it ceases to be surprising that it so stubbornly (...)
