The subject of this study will be to analyze the contribution of an important figure of the period known as the period of new ilm al kalām in the history of kalām, which started in the mid-nineteenth century and included the first periods of the Republic. This person is Mehmet Şerafettin Yaltkaya (1880-1947). Yaltkaya stands out with his original aspects such as being both a school and a madrasa student, representing his scholar and government bureaucrat personality together and strongly, and (...) his open support for the changes and transformation periods of Republican Turkey. It is known that difficult and troubled times in history have been the source of the emergence of rich intellectual movements. Yaltkaya was also nourished by such a political and intellectual hinterland. As is known, the changes in Western thought in the nineteenth century led to the emergence of atheist and materialist worldviews, which was one of the important reasons that caused us to open a new era in kalām. It has even been interpreted that the Ottoman scholars' work on the criticism of materialism was the main reason for the opening of this new era in kalām. In this regard, before discussing Yaltkaya's point of view and his contributions, we have tried to briefly discuss the historical conditions, changes and transformations of the new period of kalām, accompanied by the views of some of its representatives, which will help us to recognize the period. Secondly, we have endeavored to deal with the main dynamics of Şerafettin Yaltkaya's theological views, especially his scholarly and actional aspects that came to the fore in the course of his life, and in particular his up to date understanding of isbāt al-wājib regarding the existence of God and the social theory of kalām (ictimaī ilm al-kalām) about which the debates intensified. As far as we have been able to determine, Yaltkaya's theological views are actually a multiple-polarized structure that draws from all schools of kalām, philosophy, and Sufism. His interest in different disciplines of Islamic sciences and his curiosity in modern sciences also contributed to his vigorous personality. On the other hand, it must be said that he was also influenced by Western intellectuals and evaluated the possibilities of reason and instinct. Yaltkaya's support for Ottoman modernization and Republic reforms are among the significant aspects of Yaltkaya, both an Islamist and a kind of cultural nationalist. He made great contributions to the world of scholarship and thought of his time with his knowledge and works in different disciplines such as kalām, philosophy, literature, sufism history of sects and history of medicine. In addition, we believe that his lectures on kalām, philosophy and history of sects in important high schools and universities that were newly opened at the time and his position as the second head of the Presidency of Religious Affairs supported the background of his ideas that we highlight in this article. We have determined that Yaltkaya, who criticized the theological views of the traditional scholars, was also closely familiar with and influenced by Western scholars and philosophers who were his contemporaries. Bundaki amacım birey- kamu ilişkisinde, bireyin özgürlük alanlarının ihmal edildiği yönündeki varsayımımdır. Bu girişten sonra, çalışmada İslam inanç ekollerinin konuya ilişkin yaklaşımları ve bu yaklaşımlarına kaynak teşkil eden metinlere yer verilecektir. The most fundamental subject and aim of the Islamic belief system is the subject of maʿrifatullah (knowing Allah). Studies on this subject are mostly called ithbāt al-wājib (the demonstration of God) in the literature. They are considered the most valuable work for kalām, philosophy and mysticism schools. Kalām schools started to use this conceptualization intensively after Fakhr al-Dīn al-Rāzī, mainly under the influence of Ibn Sīnā. Sūfis, on the other hand, most participated in these studies based on the theory of (...) the unity of existence. In kalām, all the principles of belief are ultimately grounded to explain and strengthen faith in Allah. For this reason, belief in Allah is referred to as aṣl al-uṣūl (the origin of all principles). Throughout history, scholars of kalām discussed the creedal issues of Islam in the Muslim society while it tried to answer the creedal issues abroad by the expanding Islamic geography with studies on ithbāt al-wājib. In this framework, the problems of prophecy and the hereafter are included in kalām. Since the beginning of the history of kalām, it has used the theory of atomism to a large extent, especially in defending the existence of Allah against materialists. The systematisation of Islamic philosophy and mysticism in time, the kalām cosmological argument, the argument from contingency of philosophers and the argument from kashf and ilhām of Sūfis strengthened this area from three different branches. On the other hand, the interaction of these schools within themselves and the diversification of the interlocutors of studies on ithbāt al-wājib brought these arguments closer together. The convergence in terms of terminology, subject and methodology, especially after Shahrestānī and Rāzī, revealed the tradition of philosophical theology. In this process, theologians began to use both the concepts of temporality (hudūth) and contingency (imkān) to use ontological, cosmological and teleological proofs. Dawānī, one of the eminent figures of these studies in the last periods of Ottomans, is the subject of our research, due to his skills in utilising these proofs of ithbāt al-wājib and his influence in the studies after him. His review of the matter can be observed in his effort in his works where he deals with the so-called deficiencies and errors of his predecessors regarding ithbāt al-wājib. For this reason, many annotations and commentaries were made for his treatises and ideas until the 19th century. Especially, the advance of materialism in the West in this century showed great influence on many scholars and intellectuals in the Ottoman Empire seems to be a parallel historical experience. Therefore, it has become necessary to utilise the arguments for the existence of Allah by supporting each individual argument together. In this regard, in our study, to see the process, we also discussed the views of Aḥmad Nūrī, one of the scholars in the last period Ottoman, who dealt with the common arguments about ithbāt al-wājib produced by the three primary schools of Islamic thought: kalām, Islamic philosophy and mysticism. This article aims to investigate and analyze Yusuf b. Muhammad Jān al-Karabāghī's (d. 1035/1626) treatise in which he discusses some issues related to existence (wujūd) and the Necessary Being (wājib al-wujūd). This study aims to bring this treatise of al-Karabāghī, which has not been studied yet, into the literature of the history of Islamic thought by investigating and analyzing its content. There is no information about Yusuf al-Karabāghī's birthplace and education in bio-bibliographical sources. It is known that he wrote works (...) in the fields of tafsīr and theology (kalām). Some of his works are Erbau' Ta'līkātin fi't-Tafsīr, Risāla fi'l-Mubāḥasa allatī waka'at fī surat al-Fath bayna al-ulamā, Hāshiya 'alā Sharhi'l-Aqā'id al-Adudiyya, Sharḥ Risāla Ithbāt al-wājib li al-Dawwānī. Three copies of this treatise, which is the subject of this study, have been identified in manuscript libraries. The first of these copies is listed as MS 791 in Selimiye Manuscript Library, the second is listed as MS 1210 in Suleymaniye Library, Carullah Efendi Collection, and the third is listed as 1960 in Suleymaniye Library, Manuscript Donations Collection. Among the mentioned copies, the copy registered in Selimiye Library ms. no 791 was preferred as the main one in the analysis both because it is very clear and readable, and because of the scribes’s collation note in the ferağ record. This is because the scribe wrote this copy in correspondence with other copies that existed in his period but have not survived to the present day. The author does not explicitly mention the name of this treatise in the introduction. In the introductory part of the treatise, he states that he has collected topics that will serve as a remedy for finding the right thought. When its content is analyzed, it is understood that the treatise includes some issues related to existence (wujūd) and especially the Necessary Being (wājib al-wujūd). It is seen that the author followed a different method in the treatise. Yusuf al-Qarabāghī divided the treatise into seven chapters, which he called "halwa". He also added subheadings to each section, sometimes one and sometimes two, which he called "waqf". In these sub-headings he added to each section, he included the views of a thinker who is an authority on the subject he examined. In the treatise, the author examines the methods of demonstration such as burhān al- tatbīq, burhān al- tazāyuf, burhān al-sullamī and concepts such as revolution, succession, wujūd, wājib al-wujūd, possible, qadīm, hadīth, cause, ma'lūl, complete cause, nūr, zulm, al-ālam al-misālī, berzāh, and juz al lā yetajjazā (jawhar al-fard). In this framework, he discusses Karabāğī's proof of the existence of the Necessary Being through the cancellation of the vicious circle and infinite regression (tasalsul), the unity of the Necessary Being (tawḥīd), the relation between essence and attribute, and the attribute of knowledge of the Necessary Being. As a result, in this treatise, Yusuf al-Karabāghī analyzed some debates and views on existence (wujūd) and the concept of Necessary Being, which is an important issue in the tradition of Islamic thought, employing his unique methodological approach. Scientists often diverge widely when choosing between research programs. This can seem to be rooted in disagreements about which of several theories, competing to address shared questions or phenomena, is currently the most epistemically or explanatorily valuable—i.e. most successful. But many such cases are actually more directly rooted in differing judgments of pursuit-worthiness, concerning which theory will be best down the line, or which addresses the most significant data or questions. Using case studies from 16th-century astronomy and 20th-century geology and (...) biology, I argue that divergent theory choice is thus often driven by considerations of scientific process, even where direct epistemic or explanatory evaluation of its final products appears more relevant. Broadly following Kuhn’s analysis of theoretical virtues, I suggest that widely shared criteria for pursuit-worthiness function as imprecise, mutually-conflicting values. However, even Kuhn and others sensitive to pragmatic dimensions of theory ‘acceptance’, including the virtue of fruitfulness, still commonly understate the role of pursuit-worthiness—especially by exaggerating the impact of more present-oriented virtues, or failing to stress how ‘competing’ theories excel at addressing different questions or data. This framework clarifies the nature of the choice and competition involved in theory choice, and the role of alternative theoretical virtues. (shrink)

We argue that in implanted neurotechnology research, participants and researchers experience what Henry Richardson has called “moral entanglement.” Participants partially entrust researchers with access to their brains and thus to information that would otherwise be private, leading to created intimacies and special obligations of beneficence for researchers and research funding agencies. One of these obligations, we argue, is about continued access to beneficial technology once a trial ends. We make the case for moral entanglement in this context through exploration of (...) participants’ vulnerability, uncompensated risks and burdens, depth of relationship with the research team, and dependence on researchers in implanted neurotechnology trials. This study aims to discuss the historiography of standing up Maḥallu al-Qiyām in the cultural expression in Indonesia. This research is classified as qualitative research with a historical approach method reinforced with documentation, interview and observation. To deepen the meaning of Maḥallu al-Qiyām using analysis using the symbolic interpretive theory of Clifford Geertz. Interestingly, the tradition of Maḥallu al-Qiyām becomes a symbolic meaning of the expression of homage to the Prophet Muhammad and has the content of Maḥabbah teachings to the (...) Prophet. This research concluded that standing up Maḥallu al-Qiyām began when Sheikh Tajuddin as-Subkhi started his stand while reading the Prophet’s Mawlīd as a symbol of respect for the Prophet Muhammad. The Maḥallu al-Qiyām has various forms of celebration as a cultural expression in Indonesia, manifested in various forms of celebration in Javanese cultures, such as muludan, srakalan, kekahan, temu manten, manakiban, sema’an al-Qur’an, and respect for newly arrived ulama.Contribution: This article has contributed to discovering the traditions that developed in Indonesia, which intersected with Maḥallu al-Qiyām, thus identifying some expressions of Javanese culture in whose dialectic with standing Maḥallu al-Qiyām. Some argue that time’s causal arrow is grounded in an underlying thermodynamic asymmetry. Often, this is tied to Humean skepticism that causes produce their effects, in any robust sense of ‘produce’. Conversely, those who advocate stronger notions of natural necessity often reject thermodynamic reductions of time’s causal arrow. Against these traditional pairings, I argue that ‘reduction-plus-production’ is coherent. Reductionists looking to invoke robust production can insist that there are metaphysical constraints on the signs of objects’ velocities in any state, given (...) other—including far later—states’ properties. The Past Hypothesis may thus be a metaphysical condition, not a physical law. (shrink)

Older adults process emotional speech differently than young adults, relying less on prosody (tone) relative to semantics (words). This study aimed to elucidate the mechanisms underlying these age-related differences via an emotional speech-in-noise test. A sample of 51 young and 47 older adults rated spoken sentences with emotional content on both prosody and semantics, presented on the background of wideband speech-spectrum noise (sensory interference) or on the background of multi-talker babble (sensory/cognitive interference). The presence of wideband noise eliminated age-related differences (...) in semantics but not in prosody when processing emotional speech. Conversely, the presence of babble resulted in the elimination of age-related differences across all measures. The results suggest that both sensory and cognitive-linguistic factors contribute to age-related changes in emotional speech processing. Because real world conditions typically involve noisy background, our results highlight the importance of testing under such conditions. (shrink)

We present PhrasIS, a benchmark dataset composed of natural occurring Phrase pairs with Inference and Similarity annotations for the evaluation of semantic representations. The described dataset fills the gap between word and sentence-level datasets, allowing to evaluate compositional models at a finer granularity than sentences. Contrary to other datasets, the phrase pairs are extracted from naturally occurring text in image captions and news headlines. All the text fragments have been annotated by experts following a rigorous process also described in the (...) manuscript achieving high inter annotator agreement. In this work we analyse the dataset, showing the relation between inference labels and similarity scores. With 10K phrase pairs split in development and test, the dataset is an excellent benchmark for testing meaning representation systems. (shrink)

The approach used by physics is based on the identification and study of ideal objects, which is also the basis of biophysics, in combination with von Neumann heuristic modeling and functional fractionation according to R.Rosen is discussed as a tool for studying the properties of consciousness. The object of the study is a kind of line of analog systems: the human brain, the vertebrate brain, the invertebrate brain and artificial neural networks capable of reflection, which is a key property characteristic (...) of consciousness. Reflection in the broad sense of the word, understood as an internal representation of the external world, is characteristic of a wide range of animals, and some of them (bumblebees, fish) even demonstrate reflection in the narrow sense of the word, understood as an inner self-representation. This complex behavior is realized by miniature brains of ~1 million neurons. The use of simple recurrent neural networks (RNNs) to obtain answers to general questions is illustrated. For example, it has been shown a small RNS is able to pass delayed matching to sample (DMTS) test, forming an individual dynamic representation of the received stimulus, allowing decoding by a special external neural detector.. It has been demonstrated in the reflexive game “even-odd”, the RNS has a huge advantage over a multi-layered neural network, with the same and a larger number of neurons – reflection defeats regression. It was found that the asymmetry of outcomes in the odd-even game, which was explained by various causes, including psychological ones – “it’s easier to catch up than to run away”, is reproduced in the game of two RNNs. Obviously, there are no psychological causes here and the advantage of the player playing for “even” is explained by the more complex strategy of the “odd” player – he needs to predict the opponent’s move and choose the opposite one. Edmund Burke, long considered modern conservatism's founding father, is also widely believed to be an opponent of empire. However, Daniel O'Neill turns that latter belief on its head. This fresh and innovative book shows that Burke was a passionate supporter and staunch defender of the British Empire in the eighteenth century, whether in the New World, India, or Ireland. Gideon Yaffe argues that children should be treated as less culpable by the criminal justice system because children have little political say over the law. I analyze several elements of Yaffe’s argument and express qualified agreement with his thesis. Though I reject the role he assigns to the notions of desert and legal reasons, I agree that people who lack political power are less accountable to the criminal justice system’s legal authorities.

The research analyzes the process of formation of the ethics committee as a new institution in the system of regulation of genetic research. The external factors of this process are the increasing digitalization of medical and research practices, as well as the special situation that is developing in the field of genomic research and the use of genetic technologies, where issues of philosophy, jurisprudence and administration have generated many fundamentally new, and sometimes unexpected contexts. The author shows the similarity and (...) difference of approaches to the inclusion of the ethics committee in the national regulatory systems of different countries and determines the prospects for further integration of the new institution into normative and administrative-regulatory and law enforcement practices. The research applies all the main methods of system analysis and structural and functional analysis, as well as the comparative legal method. At the stage of generalization of empirical material, the author turns to the means and methods of philosophical phenomenology and phenomenological sociology. The study revealed that the ethics committee may have different institutional and regulatory functions in a variety of management and legal systems. Being hybrid in nature, the ethics committee performs various functions, and in various state legal systems and traditions it can combine elements of legislative, executive and judicial power. At times, the ethics committee may go beyond the scope of both a purely administrative and exclusively legal regulator. All this indicates that the integration of this institution into the legal system and into a variety of social practices is far from being completed. (shrink)

This article is about the cholera epidemic that occurred in the Benghazi Sanjak, a region under the rule of the Ottoman Empire, in the year 1858. The purpose of this study is to highlight the measures taken by both the central and local governments against the cholera epidemic that occurred in 1858 and to shed light on the management of the outbreak. In this context, the social health practices and the public's sensitivity towards health in the Benghazi Sanjak during the (...) Karamanli administration in Tripolitania in the early 1800s, as well as the period after it became directly connected to the Ottoman central government from 1835, will be examined, and the historical process leading up to the epidemic will be presented. The implementation of the quarantine measures introduced by the Ottoman Empire from the 1840s onwards, particularly in Benghazi, also holds a significant position in understanding the outbreak. The study is crucial in revealing the advancements in the health sector of the Benghazi Sanjak. The article emphasizes that the region of Berka, where the Benghazi Sanjak is located, was frequently afflicted by epidemics, but by the 1860s, there was noticeable improvement in the health sector. Ethical youth work is ‘good' youth work but how do youth work practitioners collectively determine what is ‘good'? This article presents findings from four-country surveys of youth workers' attitudes and understandings of what constitutes ‘good', that is to say ‘ethical’ practice. The article presents the principles that youth workers say underpin ethical practice in Australia, Estonia, Iceland, and Ireland. The first three countries have well established Codes of Ethics and/or Practice and Professional Associations, while Ireland does not. A survey of (...) youth work practitioners funded by Erasmus Plus, was conducted across the four countries (n = 405). A comparative analysis of data across countries revealed consensus around key characteristics of youth work practice such as the participation, empowerment, and safety of young people. These core principles form the basis of good and ethical action by practitioners. In countries which have codified these principles, these Codes were reported to be useful tools to support practitioners in their work. The survey further suggests that reflective practice is important in the application of ethical codes to concrete practice situations acting as a form of collective accountability and praxis. To conclude, we consider the implications of these findings for professionalism, and professionalisation in youth work nationally and internationally. (shrink)

Whidden IIISTUDENTS OF THOMAS AQUINAS have argued over many issues in the last 150 years or so; in fact, it is nearly impossible to get out of the very first question of the Summa Theologiae without entering into a century-long debate about the status of sacred doctrine as an Aristotelian science. We ponder whether theology meets (...) the requirements of a scientia and argue about just how to understand the task of theology in the face of Aquinas’s concern about theology as a scientia. Part of this ongoing argument is shaped by the philosophical and epistemological needs of theologians attempting to justify their positions in an academic world driven by the secular and scientific norms of the Enlightenment. Additionally, some interest in theology as a scientia is driven by the desire to provide a philosophically acceptable alternative to secular forms of reason—thus Leo’s XIII’s promotion of Thomistic philosophy.The interest in theology as a science was shaped by the historical work of Chenu in his influential articles on the topic and then by almost every other important Thomist in the last fifty years.1 Theology as a scientia is such a pressing topic that it would almost be fair to say that Thomists have developed their own scientia of theology as a scientia. [End Page 273]Beyond the modern and, perhaps, postmodern concerns driving this interest, there are good reasons to pay attention to Aquinas on the status of theology. If we focus on theology as a scientia, it is because Aquinas invites us to do so by taking up this question in one form or another at the beginning of his major theological syntheses. We are, after all, only following his lead and pondering with him just what we are thinking about, and how we are thinking, when we think about God.Within the Thomistic corpus there is, however, a minority report with regard to the status of theology. In his prologue to his commentary on Boethius’s Hebdomads, Aquinas looks at theology in a very different way, one that can supplement our understanding of sacred doctrine in its role as both an intellectual and an affective enterprise. In this commentary Aquinas journeys into a different territory and explores theology, not as a scientia, but as a kind of play—a play that evokes delight and pleasure in the one who pursues wisdom.My approach will be first to describe Aquinas’s theology with regard to regular play—the kind of recreational activities we all engage in, whether they are physical or verbal. He takes up the question of the morality of play in several places and in a way that will inform our understanding of what he means when he describes theology as play. With this understanding of regular play in place, we will then explore theology as play, based on the supposition that there is something analogical between regular play and theology as play. I will finish with some reflections on how this might contribute to our present understanding of theological work.IWhile he scatters comments about play across his corpus and mentions it in all of his theological syntheses, Aquinas gives sustained attention to play in two places: first, in his commentary on Aristotle’s Ethics, and second, in question 168 of the Secunda secundae (in the treatise on temperance) of the Summa theologiae. CROSBY, III Franciscan University of Steubenville Steubenville, Ohio I PROPOSE TO explore the idea that persons do not exist as replaceable specimens of or as mere instances of an ideal or type, but rather exist in some sense for their own sakes, each existing as incommunicably his or her own.1 I undertake this study in the conviction that the incommunicability of persons (...) is profoundly characteristic for them precisely as persons, and has a major role to play in any philosophy of the person. And there is an entirely different reason which attracts me to this subject. I think that most of what I have to say here can find acceptance across a broad spectrum of philosophical positions. At a time when thinkers are increasingly suspicious of universally valid truth about man, when many of them think that a vision of man is proper only to some tradition and valid only within that tradition and not beyond it, one can offer a salutary challenge to one's contemporaries by showing a centrally important truth about persons which, as I say, can be accepted by philosophers coming from the most various points of view. Again, everyone understands that if you treat people having excellences as if they were replaceable specimens of those excellences, then you lose your grip on them as persons. But why is this? Why is personhood driven out of human beings as soon as their species-membership, or their particular excellences, are thought to predominate in them? What is that incommunicability of each person which is obscured as soon as persons are thought to be only specimens? One commonly thinks that this aspect of personal selfhood has been recognized only in modern thought; in fact it was recognized already by St. Thomas Aquinas. This article proposes a theological emphasis to the definition of προσλαμβάνω in Romans 14–15. Previous accounts have emphasised the domestic and social implication of Paul's imperative—‘welcome one another’ (Rom. 15:7a). The result has been that what Paul might have meant by God's and Christ's ‘welcome’ (Rom. 14:3 and 15:7b) has been governed by the ethical imperative. In order to investigate the ‘welcome’ of God and Christ, this article proposes a context of three important Septuagintal antecedents as yet unconsidered: 1 Samuel (...) 12, Psalm 18, and Psalm 65: In this context, God's and Christ's ‘welcome’ in Rom. 14–15 incorporates notions of justification, election, salvation, and unified worship. A theological reading of προσλαμβάνω, using these intertextual resources, therefore provides a stronger position from which to understand Paul's imperative—‘welcome one another’. (shrink)

Van der Pijl et al outline data suggesting an alarmingly high incidence of violation of the bodily integrity of patients in labour, including episiotomies performed without patients’ consent, or over their explicit objection.1 Similar data have been reported from the USA and Canada.2 The authors appropriately conclude that explicit consent is required at the time of all invasive obstetrical procedures, including episiotomy. Commonsense adjustments to the duration and detail of consent under conditions of clinical urgency are appropriate and should be (...) familiar to any clinician involved in perinatal care, as well as non-obstetric proceduralists caring for acutely ill patients. However, complete omission of consent for any of these procedures is both disrespectful to patients’ autonomy and strongly associated with morbidity from birth-related psychosocial trauma.3–5 The true incidence of obstetrical procedures performed without patients’ consent is difficult to determine for multiple reasons, including sample selection, recall bias and patients’ reluctance to reengage with traumatic experiences; however, …. This article utilises Gadamerian hermeneutics method and Freirean theory of the purpose of Religious Education to explore how Religious Education can contribute to achieving United Nations Sustainable Development Goal (SDG) 4, emphasising education for sustainable development. The study contends that Religious Education in Lesotho occupies a distinctive position in the education system, surpassing other countries in its extensive integration. Due to historical factors, Religious Education is taught in nearly all religiously affiliated schools, comprising about 90% of all educational institutions in (...) Lesotho, and even in certain public schools. The curriculum of Religious Education in Lesotho aligns directly with the educational objectives of SDG 4. Additionally, Lesotho’s Religious Education corresponds to three levels of school education for sustainable development: whole school approach, classroom approach, and community approach. Nevertheless, the study asserts that for Religious Education in Lesotho to better align with education for sustainable development, various enhancements are required. Firstly, inclusivity across all religious traditions is essential, moving beyond a sole focus on Christianity. Secondly, there is a need for wider dissemination and implementation of Religious Education in all schools, irrespective of their affiliation. Lastly, a shift from traditional pedagogies to transformative approaches is recommended to boost the effectiveness of Religious Education in advancing sustainable development.Contribution: This article contributes by analysing Lesotho’s case and its implications for enhancing Religious Education teaching to effectively address SDGs. It broadens existing knowledge on Religious Education’s potential as a platform for sustainable development and provides recommendations for its improved implementation in a specific context. The UK Supreme Court’s recent judgement inMcCulloch v Forth Valley Health Boardclarifies the standard for the identification of ‘reasonable’ alternative medical treatments. The required standard is that of a reasonable doctor: treatments that would be accepted as proper by a responsible body of medical opinion. Accordingly, the assessment of consent involves a two-stage test: first, a ‘reasonable doctor’ test for identifying alternative treatments; followed by a ‘reasonable person in the patient’s position’ test for identifying the material risks of these reasonable (...) alternative treatments. The separation of consent into two stages is consistent with not only a certain conception of freedom but also a nuanced construct of respect for autonomy that has a normative base. Furthermore, reliance on a reasonable doctor in the first stage is in keeping with a sociological account of medical professionalism, which posits that only doctors, and none others, can determine what is a proper treatment. Yet, reliance on a reasonable doctor permits a plurality of standards for reasonableness, because differences in opinion among doctors are pervasive. The reasons for some differences might be acceptable as unavoidable imperfections in medical decision-making to a reasonable person. But reasons for other differences might be objectionable; and the resultant inequalities in medical treatments would be considered unfair. One solution is to make the plurality of reasonable alternatives available to the patient, but this would introduce practical uncertainty and it is rejected by the Court. The Court’s approach may be pragmatic; however, it seems to allow avoidable injustice in healthcare. (shrink)
