The introduction first goes back on Jeremy Bentham’s historical scheme to highlight lesser-known traits and show how it was not limited to carceral applications, a versatility which has been reflected in literature. It then moves on to Foucault’s chapter on panopticism in _ Discipline and Punish, _ foregrounding its most influential aspects as well as others which are often overlooked. The third part focuses on the reception of Foucault’s panopticism in literary criticism, from the seminal studies of D.A. (...) Miller and John Bender to contemporary times. The fourth part deals with the influence of panopticism within the field of surveillance studies, as well as the input offered by literature for these discussions. Colonies, Commerce, and Constitutional Law is a major theoretical analysis of the harmful effects of colonies on commerce and constitiutional democracy, and is one of the most important studies of colonialism written in the nineteenth century. Of the four essays collected in this voloume, three have been edited directly from the original manuscript sources. The only essay to have appeared in print, `Observations on the Restrictive and Prohibitory Commercial System', is generally regarded as an early classic statement of the (...) beneficial effects of freedom of trade. In the these pioneering essays written in 1820-2, Bentham provided a penetrating critique of colonialism from within the liberal utilitarian tradition. Applying his general principles to the case of Spain and Spanish America, he argued that any attempt by Spain to maintain dominion over her Empire, or even to maintain a claim to the dominion was fundamentally misguided. Colonies were not a source of wealth to the colonizing country, but rather led to the imposition of increased taxation. Moreover, the existence of colonies increased the amount of patronage at the disposal of Spain's rulers, and thus would facilitate the corruption of the members of the new legislative assembly and eventually lead to the restoration of the ancient despotism. Colonies were not only wasteful and expensive, but posed a threat to constitutional government itself. The should therefore be granted unconditional independence, as a prererequisite to the establishment of unrestricted commercial relations, which would produce mutual benefit to both Spain and Spanish Amarica. Foucault's previously unpublished doctoral dissertation on Kant offers the definitive statement of his relationship to Kant and to the critical tradition of philosophy. This introduction and commentary to Kant's least discussed work, Anthropology from a Pragmatic Point of View, is the dissertation that Michel Foucault presented in 1961 as his doctoral thesis. It has remained unpublished, in any language, until now. This long-unknown text is a valuable contribution not only to a scholarly appreciation of Kant's work but as the first outline of what would later become Foucault's own frame of reference within the history of philosophy. It is thus a definitive statement of Foucault's relation to Kant as well as Foucault's relation to the critical tradition of philosophy. In her 2012 novel The Panopticon, Jenni Fagan chose to examine the possibility of emancipation from within the care system, and between the walls of an institution modelled on Bentham’s 18th century eponymous invention. Setting the adventures of Anais, an orphan and chronic offender, in that building, testifies to the persistence of the master trope of surveillance, which turns the visual world of the novel into an anxiety-ridden field of observation and control. The reference to disciplinary and punitive visuality (...) proves particularly effective in conveying Fagan’s critique of a system that has relinquished its duty of care and devotes itself to the marginalisation and subjugation of the young delinquents it purports to rehabilitate. However the novel also inspires itself from Foucault by reminding us that the visual field of discipline is not one in which power can be exerted absolutely. In the Panopticon, surveillance elicits the resistance of the residents, who repeatedly escape the all-seeing watchtower, claim a “right to look” and eventually bring down the dispositive of disciplinary visuality, allowing Anais’s emancipation in the process. Ultimately the narrative uses the visual paranoia of panopticism as a foil, as its young protagonist looks for practices of seeing and modes of inscription in the visual landscape that will nurture rather than discipline and punish. Far from rejecting visuality altogether, the narrative seeks out spaces where visual care and consideration constitute a response to the failure of the State system of surveillance effectively to reform or care for its citizens. This article aims at introducing the relation between the use of CCTV systems in urban spaces and social control. More specifically, its purpose is to problematize and reaffirm the use of the theoretical background of the panopticon in order to interpret such a relation. In CCTV studies, as a consequence of literal interpretations, as well as the existence of a hegemony in ethnographic studies carried out in control rooms, the theoretical use of the panopticon is then questioned. In (...) this article, based on an ethnographic study conducted in the public spaces surveilled by a CCTV system in a Brazilian city, it can be concluded that the effects of social control through surveillance are paradoxical. The indifferent way in which citizens deal with surveillance, or even the lack of awareness of it, imposes limits to the interpretation of the system as a tool of social control. Thus, the use of the panopticon becomes problematic. However, this research has shown how the presence of cameras in public spaces makes it conducive for a state of control in the form of a network whose project would be a mythical and homogeneous ordering of the spaces. The importance of the interpretation of Jeremy Bentham’s panopticon by Michel Foucault is then reaffirmed, that is, panopticism as a trend of normalization and moralization of the public spaces. Michel Foucault's critical studies concerning regimes of power are of special interest when applied to architecture. In particular, he warned of the hazards of building surveillance into architectural structures for the purpose of monitoring people and took as his historical exemplar English philosopher Jeremy Bentham's ?Panopticon,? a structure originally used to assist in rehabilitating prisoners. He felt this kind of regulatory control resulted in maintaining power of one group over another. This article discusses what Foucault called (...) the general ordering of the visible and the invisible by examining architecture as he viewed it?as an operation of power, control, and domination. More to the point, it places this belief in the context of power constructions in both sacred and school architecture and how this, in turn, creates a carceral society. This article also puts forward some of Foucault's thinking on architecture and connects this to his ideas of perceptual visibles and invisibles. The suggestion of schools as institutions of conformity and how their built environment functions as a regulatory force for this conformity is also explored. (shrink)

This review locates the 1980 lectures within the context of the wider discussions of Foucault and religion; highlighting the influence of George Dumézil on the comparative and structural analysis. Assessing the problem of the historical accuracy of Christian history in Foucault’s work and the nature of the archaeological approach, the review explores what would be fair to ask of Foucault’s 1980 lectures on Christianity. The review focuses on the internal consistency, selections and theoretical tensions. While acknowledging that Foucault picks up (...) the important shift towards external ritual performance of early Christian life, the review questions Foucault’s lack of appreciation of the notion of “sacramentum,” which informs the central interpretative framework of “truth acts.” The review suggests that Foucault’s thinking is shaped by an “expressionist theology” and operates on a false binary distinction between faith and practice. It shows the problematic reading of Tertullian and the indivisibility between acts and faith in his work and reveals the counter-conduct and freedom practices in Tertullian’s later Montanist commitment—which rejected church authority for inner commitment to God—and also suggests a gendered dimension to expressionist acts. The review reveals Foucault’s own inability to split the faith-practice dichotomy—on which his expressionistic argument depends—and highlights the tensions that persist in maintaining a “truth-act” model from early Christian life. It concludes by suggesting that the philosophy-theology relation in Foucault opens more questions than it resolves. (shrink)

Since his death in 1986, Michel de Certeau's reputation as a thinker has steadily grown both in France and throughout the English-speaking world. The consequences of Foucault's work for political theory have been subject to much reinterpretation. This article examines the reception of Foucault's work by the left of politics and argues that the use made of his work is overly negative and lacks a positive political dimension. Through a discussion of the work of Judith Butler and other interpreters of Foucault I argue that the problem facing the poststructuralist left is formulated in a confusing and unhelpful manner, what I will call the (...) 'dilemma of the left libertarian'. Once we get around this formulation of the problem a more progressive political response becomes possible. I end by discussing the political possibilities of Foucault's work in terms of an account of autonomy derived from Foucault's later work on the Enlightenment. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, and (...) three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. Alexander Maconochie, the originator of the “Mark System”, is a major figure in the history of penal discipline and is best known for his attempt to implement it at the Norfolk Island penal station from 1840 to 1844. Among Maconochie’s many works is the eight-page “Comparison Between Mr. Bentham’s Views on Punishment, and Those Advocated in Connexion with the Mark System”, in which Maconochie rejected Bentham’s critique of transportation, as well as fundamental elements of his theory of punishment. Maconochie (...) concluded that mainstream thinking on penal discipline was dominated by “mistakes” that either “in great measure originat[ed] with Mr. Bentham”, or had been “at least sanctioned by his high authority”.This paper questions whether Maconochie’s rejection of Bentham’s views is entirely convincing, since his penal practices, as well as an earlier and lesser-cited work, indicate that Maconochie was, at times, considerably closer to Bentham’s position on punishment than “Comparison” suggests. Section I will provide some brief biographical background. Section II will explore Maconochie’s attempt to implement his reformative system at Norfolk Island, at the heart of which was surveillance and extensive record-keeping to monitor individual behaviour and progress, and in which there are echoes of Bentham’s panopticon scheme. Section III will examine Maconochie’s changing views on criminal transportation, from his adherence to the Benthamite anti-transportation line in 1818, to his qualified support for transportation from 1838 onwards. This paper draws on the work of Michel Foucault in order to analyze the constellation of political strategies and power at the US/Mexico border wall. These strategies, however, are incredibly diverse and often directly antagonistic of one another. Thus, this paper argues that in order to make sense of the seemingly multiple and contradictory political strategies deployed in the operation of the US/Mexico border wall, we have to understand the coexistence and intertwinement of at least three distinct types of (...) power at work there: the sovereign exclusion of illegal life, the disciplinary detention of surveilled life, and the biopolitical circulation of migratory life. By doing so this paper offers an original contribution to two major areas of study: in Foucault studies this paper expands the existing literature on Foucault by analyzing the crossroads of power particular to the US/Mexico border wall, which has not yet been done, and in border studies this Foucauldian approach offers a unique political analysis that goes beyond the critique of sovereignty and toward an analysis of coexisting strategies of power. The Panopticon project for a model prison obsessed the English philosopher Jeremy Bentham for almost 20 years. In the end, the project came to nothing; the Panopticon was never built. But it is precisely this that makes the Panopticon project the best exemplification of Bentham’s own theory of fictions, according to which non-existent fictitious entities can have all too real effects. There is probably no building that has stirred more philosophical controversy than Bentham’s Panopticon. The Panopticon is not merely, (...) as Foucault thought, “a cruel, ingenious cage”, in which subjects collaborate in their own subjection, but much more—constructing the Panopticon produces not only a prison, but also a god within it. The Panopticon is a machine which on assembly is already inhabited by a ghost. It is through the Panopticon and the closely related theory of fictions that Bentham has made his greatest impact on modern thought; above all, on the theory of power. I would like to suggest another way to go further toward a new economy of power relations, a way which is more empirical, more directly related to our present situation, and which implies more relations between theory and practice. It consists of taking the forms of resistance against different forms of power as a starting point. To use another metaphor, t consists of using this resistance as a chemical catalyst so as to bring to light power relations, locate their position, (...) and find out their point of application and the methods used. Rather than analyzing power from the point of view of its internal rationality, it consists of analyzing power relations through the antagonism of strategies.[…]Let us come back to the definition of the exercise of power as a way in which certain actions may structure the field of other possible actions. What, therefore, would be proper to a relationship of power is that it be a mode of action upon actions. That is to say, power relations are rooted deep in the social nexus, not reconstituted "above" society as a supplementary structure whose radical effacement one could perhaps dream of. In any case, to live in a society is to live in such a way that action upon other actions is possible-- and in fact ongoing. A society without power relations can only be an abstraction. Which, be it said in passing, makes all the more politically necessary the analysis of power relations in a given society, their historical formation, the source of their strength or fragility, the conditions which are necessary to transform some or to abolish others. For to say that there cannot be a society without power relations is not to say either that those which are established are necessary or, in any case, that power constitutes a fatality at the heart of societies, such that it cannot be undermined. Instead, I would say that the analysis, elaboration, and bringing into question of power relations and the "agonism" between power relations and the instransitivity of freedom is a permanent political task inherent in all social existence.[…]In effect, between a relationship of power and a strategy of struggle there is a reciprocal appeal, a perpetual linking and a perpetual reversal. At every moment the relationship of power may become a confrontation between two adversaries. Equally, the relationship between adversaries in society may, at every moment, give place to the putting into operation of mechanisms of power. The consequence of this instability is the ability to decipher the same events and the same transformations either from inside the history of struggle or from the standpoint of the power relationships. The interpretations which result will not consist of the same elements of meaning or the same links or the same types of intelligibility, although they refer to the same historical fabric, and each of the two analyses must have reference to the other. Although workplace bullying is common and has universally harmful effects on employees’ outcomes, little is known about workplace bullies. To address this gap in knowledge, we draw from the tenets of social exchange and displaced aggression theories in order to develop and test a model of workplace bullying that incorporates the effects of employees’ individual differences, perceptions of their work environments, and perceptions of supervisory treatment on their tendencies to bully coworkers. The results of mediated moderation analyses that examine responses (...) from two samples of working adults support our hypotheses. Specifically, we find evidence of an indirect relationship between entitlement and coworker bullying through perceptions of abusive supervision that is stronger for employees who report lower levels of felt accountability than employees who report higher levels of felt accountability. This study makes important theoretical and practical contributions to abusive supervision research, bullying research, and organizational efforts to promote ethical work environments devoid of interpersonal mistreatment by providing novel insight into how employees’ entitlement and felt accountability combine to influence their tendencies to perceive themselves as victims of abusive supervision and culprits of coworker bullying. The Declaration of Rights -- I mean the paper published under that name by the French National Assembly in 1791 -- assumes for its subject-matter a field of disquisition as unbounded in point of extent as it is important in its nature. But the more ample the extent given to any proposition or string of propositions, the more difficult it is to keep the import of it confined without deviation, within the bounds of truth and reason. If in the smallest (...) corners of the field it ranges over, it fail of coinciding with the line of rigid rectitude, no sooner is the aberration pointed out, than (inasmuch as there is no medium between truth and falsehood) its pretensions to the appellation of truism are gone, and whoever looks upon it must recognise it to be false and erroneous, -- and if, as here, political conduct be the theme, so far as the error extends and fails of being detected, pernicious. The Courage of the Truth is the last course that Michel Foucault delivered at the College de France before his death in 1984. In this course, he continues the theme of the previous year's lectures in exploring the notion of "truth-telling" in politics to establish a number of ethically irreducible conditionsbased on courage and conviction.

In this consensus report by a diverse group of academics who conduct and/or are concerned about social and behavioral genomics (SBG) research, the authors recount the often‐ugly history of scientific attempts to understand the genetic contributions to human behaviors and social outcomes. They then describe what the current science—including genomewide association studies and polygenic indexes—can and cannot tell us, as well as its risks and potential benefits. They conclude with a discussion of responsible behavior in the context of SBG (...) research. SBG research that compares individuals within a group according to a “sensitive” phenotype requires extra attention to responsible conduct and to responsible communication about the research and its findings. SBG research (1) on sensitive phenotypes that (2) compares two or more groups defined by (a) race, (b) ethnicity, or (c) genetic ancestry (where genetic ancestry could easily be misunderstood as race or ethnicity) requires a compelling justification to be conducted, funded, or published. All authors agree that this justification at least requires a convincing argument that a study's design could yield scientifically valid results; some authors would additionally require the study to have a socially favorable risk‐benefit profile. The course given by Michel Foucault from February to March 1984, under the title 'The Courage of Truth', was his last at the Collège de France.
