On a non-piecemeal alternative, derivative contents can be recognizably local to, or manifest within, one part of our cosmos while reflecting some more global elemental base. Background:The ability to save the life of an extremely premature baby has increased substantially over the last decade. This survival, however, can be associated with unfavourable outcomes for both baby and family. Questions are now being asked about quality of life for survivors of extreme prematurity. Quality of life is rightly deemed to be an important consideration in high technology neonatal care; yet, it is notoriously difficult to determine or predict. How does one define and operationalise what is considered to (...) be in the best interest of a surviving extremely premature baby, especially when the full extent of the outcomes might not be known for several years?Research question:The research investigates the caregiving dilemmas often faced by neonatal nurses when caring for extremely premature babies. This article explores the issues arising for neonatal nurses when they considered the philosophical and ethical questions about quality of life in babies ≤24 weeks gestation.Participants:Data were collected via a questionnaire to Australian neonatal nurses and semi-structured interviews with 24 neonatal nurses in New South Wales, Australia.Ethical considerations:Ethical processes and procedures have been adhered to by the researchers.Findings:A qualitative approach was used to analyse the data. The theme ‘difficult choices’ was generated which comprised three sub-themes: ‘damaged through survival’, ‘the importance of the brain’ and ‘families are important’. The results show that neonatal nurses believed that quality of life was an important consideration; yet they experienced significant inner conflict and uncertainty when asked to define or suggest specific elements of quality of life, or to suggest how it might be determined. It was even more difficult for the nurses to say when an extremely premature baby’s life possessed quality. Their previous clinical and personal experiences led the nurses to believe that the quality of the family’s life was important, and possibly more so than the quality of life of the surviving baby. This finding contrasts markedly with much of the existing literature in this field.Conclusion:Quality of life for extremely premature babies was an important consideration for neonatal nurses; however, they experienced difficulty deciding how to operationalise such considerations in their everyday clinical practice. In this paper, I examine a puzzle that emerges from what J. P. Moreland has called the traditional realist view of quality instances. Briefly put, the puzzle is to figure out how quality instances fit into the overall structure of a concrete particular, given that the traditional realist view of quality instances prima facie seems incompatible with what might be called the traditional realist view of concrete particulars. After having discussed the traditional realist views involved and the puzzle that emerges (...) from their juxtaposition, I propose an alternative realist view of quality instances which resolves the puzzle. In short, the puzzle is solved by treating the distinction between a concrete particular and its quality instances as a distinction of reason, and by adopting the view that the individuating element of a concrete particular must also serve as its unifying element – a view which Moreland, one of traditional realism’s most stalwart contemporary defenders, rejects. Al Mele’s Manipulated Agents: A Window to Moral Responsibility (OUP 2019) is an extraordinarily careful and clear little book. A central recurring element is the use of examples of radical value reversals due to manipulation. In this commentary, I discuss the relevance of these examples to a simple quality of will account of blameworthiness without explicit historical conditions. Such an account, I suggest, can fairly straightforwardly explain how value reversals might mitigate blameworthiness. But I also suggest that the intuition that (...) they completely remove blameworthiness should instead be explained away. (shrink)

Medical decision making relies heavily on the notion of the quality of a person's life in providing a reason to utilize one therapy over another or to withhold certain therapies altogether. The concept of quality of life, however, lacks clear definition as well as consensus on its constitutive elements. ;Chapter one engages a basic controversy in the literature: whether 'quality of life' should be understood as a subjective concept, or whether objective "lists" can help us assess a person's quality of (...) life. Chapter two examines whether anthropological data might provide guidance. While it is often argued that anthropological data supports relativism, John Finnis argues that anthropological data supports universalism which, in turn, bolsters objectivist claims. I argue that anthropological data may plausibly be interpreted to support either subjective or objective accounts, and thus, does not settle our approach to quality of life. ;Chapter Three examines objective list theories, in particular those of Bernard Gert and John Finnis. I find Gert's account to be problematic because it seems incomplete. Finnis's criteria, too, seems ultimately indefensible. Thus, I conclude that while objectivist claims may offer insight into human values and motivations, existing accounts are flawed. Chapter Four examines subjective accounts of quality of life. I focus on "preference satisfaction" accounts. While these accounts provide intuitively plausible descriptions, they fall victim to a host of difficulties. Perhaps the best example of this is the "fleeting preferences" problem, which undermines our confidence in making life-and-death decisions on the basis of quality of life considerations. ;The concluding chapter offers that much progress can be made by understanding quality of life in terms of finding meaning in life. Thus, the quality of one's life is determined by how much purpose and meaning is found in that life. While this notion is not without its problems, it does capture the complex elements of the kinds of cases in which we are particularly interested, and combines some of the best features of both the objective and subjective accounts. The traditional analysis of substances in terms of qualities which are supported by a "substratum" was rejected by conscientious empiricists like Berkeley, Hume and Russell on the grounds that only qualities, not the substratum, could be experienced. To these philosophers the proper alternative seemed obvious. One simply eliminates the "unknowable" element in which qualities are alleged to inhere. In Russell's words, "What would commonly be called a 'thing' is nothing but a bundle of coexisting qualities such (...) as redness, hardness, etc."' But this empiricist formula has difficulties of its own, and some philosophers have attempted to develop other views of particulars which avoid the errors of the Substratum Doctrine on the one hand and the Bundle-of¬Qualities Theory on the other.2 Discussions of what this third alternative might be have generally approached the question through an examination of the epistemologically suspect concepts of a substratum and its close relative, the concept of a "bare particular". The concept of a quality of something, because it seemingly presents no epistemological difficulties, has attracted much less critical attention. This imbalance in critical interest is unfortunate, however, for a close scrutiny of this latter concept, especially in its role as the key element in the "bundle" analysis of particulars, throws a great deal of light on the relation between particulars and their attributes. -/- . The integrity of biomedical research depends heavily on the quality of research data collected. In turn, data quality depends on processes of data collection, a task undertaken by frontline research staff in many research programmes in Africa and elsewhere. These frontline research staff often have additional responsibilities including translating and communicating research in local languages, seeking informed consent for study participation and maintaining supportive relationships between research institutions and study participants and wider communities. The level of skills that fieldworkers need (...) to undertake these responsibilities clearly affects the quality of data collected, the ethics of research ‘on the ground’ and the short and long term acceptability of research.We organised an international workshop in Kenya in July 2014 to discuss the role of frontline staff in scientific research. A total of 25 field managers from 9 African countries and the UK met for 2.5 days to discuss the relationship between data quality and institutional performance management systems and how they affect career progression and supportive supervision policies of research frontline staff.From this workshop, and supporting an expanding literature on the role of fieldworkers in international health research, participants agreed that fieldworkers’ roles present them with practical and ethical challenges that their routine training does not adequately prepare them for. We argue that the common and complex challenges facing fieldworkers should in part be addressed through increased investment and collaborative agreements across types of research institutions in Africa. We call for standardization of core elements of training for this critically important cadre of research staff who perform similar roles and encounter similar challenges in many African settings. Although many valuable training elements are offered in institutions, there is a need to develop broader, more grounded and innovative strategies to address complex realities for fieldworkers, and support the integrity and ethics of health research in these settings. Software quality is one of the important elements of project management. Software review is one of the most cost effective techniques for detect and remove defects for improving software quality during software development life cycle. Literature suggests that experience and training have positive effect on software review performance. However, there is no empirical study conducted to analysis the important relationships between, experience, training and performance. A laboratory study was conducted with 192 volunteer university students to examining the above relationships in (...) a software review task. The results suggests that (1) there is positive relationships between role experience and performance, (2) training has no impact on performance, (3) working experience has an positive effect on performance (4) working experience has an impact and (5) role experience has no impact on performance. A consideration of Mach's elements, his philosophy of neutral monism, and philosophy of physics, especially space and time, much of it based on unpublished writings from the Nachlass and other original sources. The historical connection between Mach and logical positivism is shown to be superficial at best, and Mach's elements are shown to be mind independent natural qualities (world-elements) with dynamic force, not limited to human sensations.

This paper outlines a procedure for assessing the quality of failure explanations in engineering failure analysis. The procedure structures the information contained in explanations such that it enables to find weak points, to compare competing explanations, and to provide redesign recommendations. These features make the procedure a good asset for critical reflection on some areas of the engineering practice of failure analysis and redesign. The procedure structures relevant information contained in an explanation by means of structural equations so as to (...) make the relations between key elements more salient. Once structured, the information is examined on its potential to track counterfactual dependencies by offering answers to relevant what-if-things-had-been-different questions. This criterion for explanatory goodness derives from the philosophy of science literature on scientific explanation. The procedure is illustrated by applying it to two case studies, one on Failure Analysis in Mechanical Engineering (a broken vehicle shaft) and one on Failure Analysis in Civil Engineering (a collapse in a convention center). The procedure offers failure analysts a practical tool for critical reflection on some areas of their practice while offering a deeper understanding of the workings of failure analysis (framing it as an explanatory practice). It, therefore, allows to improve certain aspects of the explanatory practices of failure analysis and redesign, but it also offers a theoretical perspective that can clarify important features of these practices. Given the programmatic nature of the procedure and its object (assessing and refining explanations), it extends work on the domain of computational argumentation. (shrink)

Quality of work life is generally associated with a series of objective organizational conditions and practices that enables employees of an organization to perceive that they are virtually safe, satisfied and have better chances of growth and development as individual human beings. QWL is nowadays drawing more attention globally as in modern society people spend about more than one-third of their lives at their workplace. Hence, the eminence and importance of QWL is unparalleled and unquestionable. This article first focuses on (...) the definitions of QWL, followed by various paradigms of QWL, which form the basic element of QWL in any organization: health and safety, employment security, job satisfaction, occupational stress, work environment, work–life balance and human relations. Finally, the article proposes some strategies to improve QWL in organizations that focus on different areas of organizational functions: employee participation, job design and work organization, workforce awareness and career guidance, inter-group relationships, role of HR managers, self-managing work teams, rewards, alternative work schedules and supportive organizational culture. Athenaeus of Attaleia (fl. mid-first century BC) offers a fascinating example of the interest among Graeco-Roman physicians in marking out the boundaries between medicine and philosophy. As founder of the so-called Pneumatist medical sect, he was deeply influenced by contemporary Stoicism. A number of surviving ancient testimonia tell us that he held a distinctive view on the question of how far medicine should analyse the composition of the human body. Rather than having recourse to the Stoic cosmic elements fire, air, (...) earth and water, he maintained that in the context of the medical art, the relevant elements were the elemental qualities hot, cold, wet and dry. This paper is an attempt to pin down Athenaeus’ position on these issues, and his motivations for holding it, despite a number of conflicting and problematic claims in the surviving evidence. Although ethics consultation is offered as a clinical service in most hospitals in the United States, few valid and practical tools are available to evaluate, ensure, and improve ethics consultation quality. The quality of ethics consultation is important because poor quality ethics consultation can result in ethically inappropriate outcomes for patients, other stakeholders, or the health care system. To promote accountability for the quality of ethics consultation, we developed the Ethics Consultation Quality Assessment Tool. ECQAT enables raters to assess the (...) quality of ethics consultations based on the written record. Although the importance, both historically and systematically, of the seventeenth century distinction between primary and secondary qualities is commonly recognised, there is no consensus on its exact nature. Apparently, one of the main difficulties in its interpretation is to tell the constitutive from the argumentative elements. In this paper, we focus on the primary-secondary quality distinctions drawn by Boyle and Locke. We criticise, more specifically, MacIntosh’s analysis of them. On the one hand, MacIntosh attributes too many different primary-secondary quality (...) distinctions to Boyle and Locke. On the other hand, he forbears to attribute a particular primary-secondary quality distinction to them, which, at least in the case of Boyle, differs genuinely from his main distinction between the mechanical affections of matter and all of matter’s other qualities. Ethics and Qualities of Life looks at what enters into ethical judgment and choice. Interpretation of a case and of what the options are is always a factor, as is a sense of the possible values at stake. Intuitions also enter in, but often are unreliable. For a long time it seemed only fair that oldest sons inherited, and struck few people as unfair that women were not allowed to attend universities. A moral judgment is putatively part of a (...) moral order in a society that any reasonable person would accept. But what counts as "reasonable" is generally contestable. The unreliability of intuitions leads naturally to ethical theory. Kantian, contractualist, and consequentialist theories all have some important truth in them, but not the whole truth. Contractualism lacks the resources required for a fully determinate account of what counts as "reasonable". Broad general rules are important to Kant and are at the center of everyday morality. But can Kantian ethics explain why they have to have this central role? Our evolving social contract now contains elements that once would have seemed counter-intuitive to most people. But could consequentialists have predicted with entire confidence the consequences of social changes that we now think were desirable? The last part of this book contains a double argument. One is that ethical theory is employed by humans in a state of semi-ignorance of relevant factors, grasping at likely truths and evolved intuitions. The other is that consequentialist considerations have a major role at the fundamental level, but much more in justification or criticism than in ethical discovery. (shrink)

This article discusses the future of quality control in an academic publication system that will be largely based on electronic publishing. Information and communication technologies both challenge traditional ways and open remedies for existent problems of present gate-keeping. New forms of ex-ante and of ex-post quality control may partly replace and partly amend peer review, citation indices and quality filters based on the reputation of the publisher. Open peer review, online commenting, rating, access counts and use tracking are evaluated and (...) put in perspective. Refuting the common argument that e-publishing leads to less quality, this paper puts forward scenarios of the future quality control system. The aim of the present study is to propose an approach to legal translation quality so as to address the idiosyncrasies in legal studies and to confront the challenges and flaws of previous paradigms and models of translation quality assessment. The present approach is associated with the micro-macro textual, contextual, and legal components/variables in the pursuit of an adequate strategy through elaborating the decision making process for translation. The elements of the decision making process remain constant between translation relevancy/brief, and (...) the translation product in the source text analysis, reformulation and revision stages. Translation competence, translation product, and the translation decision making process are all the evaluative standards for both quality controllers and translators. Also, this study scrutinizes the impact of translation quality assessment involving professional and training contexts besides managerial quality. In the upshot, this approach has the potential to reduce subjectivity in the quality of legal translation based on particular methodologies. Total Quality Management (TQM) is an overall management philosophy that includes a set of principles whose application is increasing. In fact, the business world and public institutions, such as hospitals, universities or city councils, are implementing quality programs. However, despite the wide diffusion of TQM, the success rate of this type of initiative is limited and the results, heterogeneous. Academics and professionals are therefore trying to identify the keys that explain the success or failure of this kind of initiative. Different (...) explanations have been given, but most of the literature agrees that managerial commitment, implication and leadership are indispensable elements in a successful implementation of TQM. Nevertheless, a study on the specialised literature shows a terminological confusion between managerial commitment and managerial leadership. Is it the same to have a committed manager in the implementation process as to have a leader of the implementation process? The author of this paper defends the thesis that "commitment" and "leadership" are not synonymous, and states that only managerial leadership is able to promote and sustain profound organisational changes. The paper will show that, to understand the previous distinction, it is necessary to consider the ethical dimension of leadership. While committed managers may lead the process by using exclusively their power (with the necessary resource assignment), those who are leaders need authority. Authority goes further than power by generating a kind of confidence (trust) that is able to influence the members of the organisation and bring about profound changes, more than power alone can do. Air pollutants pose a threat to biodiversity throughout the world. This study was conducted to evaluate atmospheric element accumulation in Isparta city, including Gölcük Nature Park, located in the Western Mediterranean Region of Turkey. It is aimed to determine the air quality and potential pollutant sources in the region through lichen biomonitoring. Specimens of the epiphytic foliose lichen Physcia aipolia (Erh. ex Humb.) Fürnr. were sampled from 14 sites in the study area and analyzed by ICP-MS with reference material in (...) order to detect 11 trace elements; Al, As, Cd, Cr, Cu, Fe, Mn, Ni, Pb, V, and Zn. The spatial distribution of these airborne elements in the study area was mapped. The results showed that the elemental sequence in terms of average concentrations measured was as follows: Ni >Cr >V >Fe >As >Al >Zn >Cu> >Cd >Mn >Pb. The results of cluster analyses of the elemental data indicated that the 3 major contaminants in the urban area were Cr, Ni, and V, probably due to the extensive use of coal in heating facilities and gasoline in vehicles. P. aipolia specimens accumulated maximal concentrations of As, Cr, Fe, Ni, and V in the northern and the southeastern localities surrounding the city, while Cd, Pb were most abundant in the eastern edge of Gölcük Nature Park. The pollution in Isparta city with heavy metal is worse than expected, mostly due to the extensive use of coal as fossil fuel. In addition, it seems to be associated with the city's topographic and climatic characteristics, e.g. inversion effects. (shrink)

Background Meaningfully evaluating the quality of institutional review boards (IRBs) and human research protection programs (HRPPs) is a long-recognized challenge. To be accredited by the Association for the Accreditation of Human Research Protection Programs (AAHRPP), organizations must demonstrate that they measure and improve HRPP “quality, effectiveness, and efficiency” (QEE). We sought to learn how AAHRPP-accredited organizations interpret and satisfy this standard, in order to assess strengths, weaknesses, and gaps in current approaches and to inform recommendations for improvement.Methods We conducted 3 (...) small-group interviews with a total of 19 participant representatives of accredited organizations at the 2019 AAHRPP annual meeting. Participants were eligible if they had familiarity with their organization’s approach to satisfying the relevant QEE standard.Results Participants reported lacking clear definitions for HRPP quality or effectiveness but described various approaches to assessing QEE, typically focused on turnaround time, compliance, and researcher satisfaction. Evaluation of IRB members was described as relatively superficial and information regarding research subject experience was not reported as central to QEE assessment, although participants described several efforts to improve consideration of patient, subject, and community perspectives in IRB review. Participants also described efforts to educate and build relationships with key stakeholders as important features of a high-quality HRPP. While generally satisfied with their approaches, participants expressed concern about resource and time constraints that pushed them to be reactive and automatic about QEE, rather than proactive and critical.Conclusions The relevant AAHRPP accreditation standard may obscure critical gaps in defining and measuring QEE elements. We recommend that AAHRPP: (1) offer a definition of QEE or require accredited organizations to provide their own, to help clarify the rationale and goals behind assessment and improvement efforts, and (2) require accredited organizations to establish QEE objectives and measures focused on participant outcomes and deliberative quality during protocol review. When we start with a scientific view of the world, we are at a loss when we try to deal with notions such as value, beauty, or meaning -- or more down to earth: anger, fear, joy, colour, smell, and other ‘secondary’ qualities whose putative reduction seems today as difficult as ever. Do these qualities then have to be put in by hand, so to speak? Or could it mean that the scientific view itself fails to capture aspects (...) of reality at least as fundamental as basic physical notions such as space, time, energy? These were some of the questions that came up in conversations between an astrophysicist and a philosopher that began two years ago, as they met, often by accident, usually in a cafe for breakfast. What happens if a philosopher and a scientist discuss such questions? Well, this was an experiment, and here is the outcome. We still think of it as an experiment, an exploration, without any definite conclusion. (shrink)

Positive psychology is a thriving field with increasing political influence, yet there are few evolutionary studies that have had a tangible impact on rethinking mechanisms of well-being. This Element reviews existing literature and proposes synthesizing insights into human flourishing under an umbrella of multilevel selection (MLS). Conceptualizing quality of life as 'Happiness + Meaning = Well-being' draws attention to how people navigate between individual and group needs, and how they reconcile selfish pursuits with altruism and cooperation. We define happiness as (...) the cluster of affects that reward individuals for solving adaptive challenges. We approach meaning as a reward that individuals experience when contributing to their community. By way of examples, we critically examine the Nordic well-being societies whose ethos and education advance prosocial values and practices and strike a balance between individualist and communitarian ideals. BackgroundInformed consent is an ethical and legal requirement for research involving human participants. However, few studies have evaluated the process, particularly in Africa.Participants in a case control study designed to identify correlates of immune protection against tuberculosis (TB) in South Africa. This study was in turn nested in a large TB vaccine efficacy trial.The aim of the study was to evaluate the quality of consent in the case control study, and to identify factors that may influence the quality of consent.Cross-sectional (...) study conducted over a 4 month period.MethodsConsent was obtained from parents of trial participants. These parents were asked to complete a questionnaire that contained questions about the key elements of informed consent (voluntary participation, confidentiality, the main risks and benefits, etc.). The recall (success in selecting the correct answers) and understanding (correctness of interpretation of statements presented) were measured.ResultsThe majority of the 192 subjects interviewed obtained scores greater than 75% for both the recall and understanding sections. The median score for recall was 66%; interquartile range (IQR) = 55%–77% and for understanding 75% (IQR = 50%–87%). Most (79%) were aware of the risks and 64% knew that they participated voluntarily. Participants who had completed Grade 7 at school and higher were more likely (OR = 4.94; 95% CI = 1.57 – 15.55) to obtain scores greater than 75% for recall than those who did not. Participants who were consented by professional nurses who had worked for more than two years in research were also more likely (OR = 2.62; 95% CI = 1.35–5.07) to obtain such scores for recall than those who were not.ConclusionNotwithstanding the constraints in a developing country, in a population with low levels of literacy and education, the quality of informed consent found in this study could be considered as building blocks for establishing acceptable standards for public health research. Education level of respondents and experience of research staff taking the consent were associated with good quality informed consent. (shrink)

The subject of the paper is the philosophical aspects of the quality of life. Although in philosophical terminology this notion is not used very often, the question “What is a good happy and high-quality human life?” is one of the earliest in the anthropological philosophy. Philosophical questions concerning this problem might therefore be inspiring, and determining for the theoretical and methodological orientations of the researches in this field. The author approaches the quality of life from three points of view: from (...) the point of view of the ontological difference – as a certain ontological modus, as an ontic experience and as a substantive, existential characteristic of being. According to the author the fundamental element of the quality of life as a whole is the compensation of existential anxiety and focusing on the meaning of life. (shrink)

Eco-labels emphasize information disclosure as a tool to induce environmentally friendly behaviors by both firms and consumers. The goal of eco-labels is to reduce information asymmetry between producers and consumers over the environmental attributes of a product or service. However, by focusing on this information asymmetry, rather than on how the label meets consumer needs, eco-labels may send irrelevant, confusing, or even detrimental messages to consumers. In this article, the authors investigate how the environmental signal of eco-labels interacts with product (...) characteristics such as brand, quality, and price. In a discrete choice experiment, the authors examine consumer response to two similar eco-labels for wine, one associated with a quality reduction and the other not. The results show that respondents preferred both eco-labeled wines over otherwise identical conventional counterparts when the price was lower and the wine was from a lower quality region. However, they preferred conventional, more expensive wine from a high-quality region. This preference indicates that respondents not only obtain some warm glow value from eco-labeled wine but also possibly interpret eco-labeling as a signal of lower quality. This relationship held across both types of eco-labels, meaning that consumers did not understand the difference between them. This research contributes to the literature on information disclosure policies by highlighting important elements for effective eco-labels. These elements include consumer awareness and understanding of the eco-label, and consumer willingness to pay for an eco-labeled product. The results emphasize the need to create eco-labels that communicate clearly both the environmental attributes and the private benefits associated with them. (shrink)

The objective of this paper is to examine the ‘Code of Ethics Quality’ (CEQ) in the largest companies of Australia, Canada and the United States. For this purpose, a proposed CEQ construct has been applied. It appears from the empirical findings that while Australia, Canada and the United States are extremely similar in their economic and social development, there may well be distinct cultural mores and issues that are forming their business ethics practices. A research implication derived from the performed (...) research is that the construct provides a selection of observable and measurable elements in the context of CEQ. The construct of CEQ consists of nine measures divided into two dimensions (i.e. staff support and regulation). They should not be seen as a complete list. On the contrary, it is encouraged that others propose and elaborate revisions and extensions. A practical implication of this paper is a structure of what and how to examine the CEQ in a managerial setting. It may assist companies in their efforts to establish, maintain and improve their ethical culture, norms and beliefs within the organization and supporting them in their ethical business practices with different stakeholders in the marketplace and society. The dimensions and measures of the construct may be used as a frame of reference for further research. They may be useful and applicable across contexts and over time using similar samples when it comes to large companies, as small‐ or medium‐sized ones may not have considered all areas nor have the elements in place. This is a research limitation, but it provides an opportunity for further research. (shrink)

The American Educational Research Association and American Psychological Association published standards for reporting on research. The transparency of reporting measures and data collection is paramount for interpretability and replicability of research. We analyzed 57 articles that assessed alphabet knowledge using researcher-developed measures. The quality of reporting on different elements of AK measures and data collection was not related to the journal type nor to the impact factor or rank of the journal but rather seemed to depend on the individual author, (...) reviewers, and journal editor. We propose various topics related to effective reporting of measures and data collection methods that we encourage the early childhood and literacy communities to discuss. (shrink)

In brief, Scotus denies that the forms or qualities of the elements are present in a mixed body . This theory is surprising because, as Richard Cross has noted, it seems that Scotus’s theory of body-organ unity could serve as the basis for a (...) more plausible Scotistic account of mixing. Here, I will explore the possibility that Scotus’s discussion of the unity of a body and its organs may provide Scotus with the principles for a better theory of mixing. I will argue that Scotus cannot use body-organ unity as a model for his theory of mixing unless he accepts a position developed by Richard of Mediavilla, namely, that forms of one species can enjoy different grades. The Oxford English Dictionary says that a rite is ‘a formal procedure or act in a religious or other solemn observance’. The word comes into English through the French rite from the Latin ritus . Its original meaning escapes etymologists; and this is a mixed blessing, for we neither can nor must attempt a retrieval of its hidden roots. We are told by respectable etymologists that the word is associated from earliest times with Latin religious usage, but that even in (...) the early Latin it was already extended to ‘custom, usage, manner or way’ of a non-religious sort. [Lewis and Short, A Latin Dictionary .] So, too, in modern languages the terms ‘rite’ and ‘ritual’ have specifically religious meaning, but they are also used in social and cultural settings that we would not call religious. What first strikes us about the terms ’ and ‘ritual’ is an emphasis upon a certain formality, upon a regular and stable way in which an action or set of actions is to be performed. A ritual is more than a formalism, however, since there are formalisms that are not rites, such as the logical rules for making a valid argument. Moreover, the term is frequently associated with the terms ‘myth’, ‘symbol’ and ‘faith’. These, too, are primarily religious, but are also extended to non-religious contexts. Indeed, there seems to be a network of such terms whose usage touches upon some extraordinary quality in things. Like them, the term ‘ritual’ shares both a wide variety of meanings and a certain hint of impropriety. The variety of ritual forms is notorious, ranging from the most sacred religious liturgies to the absurdities of a fraternity initiation; and the impropriety of the term breaks out whenever we brand a certain action ‘ritualistic’, just as we sometimes refer slightingly to an assertion, saying it is ‘mythical’, ‘merely symbolic’ or ‘credulous’. In medieval epics such as the Byzantine Digenis Akritis and the Persian Šāhnāme, dragons are usually considered to be mere opponents of the hero. But the symbolism attached to them is far from being exclusively that of a monstruous creature fighting a good hero. The motif of the three-headed dragon combines an allegorical meaning with a mythological framework. The confrontation between a dragon and an apparently weaker protagonist like a maiden or a younger son highlights the latters’ inner strength and (...) intelligence, while dangerously revealing the dragon’s possession of these human qualities. On an axiological level, the dragon’s symbolism displays the same variety: the dragon is a malevolent creature, and the archetype of the enemy, but also serves as an auxiliary to sound out men’s hearts, as in Fereydūn’s trial of his three sons. The dragon furthermore symbolizes power when painted on banners. When united to its celestial foe, the dragon’s lineage leads to the birth of the greatest hero of the Persian epic, Rostam. Thus the dragon ultimately guarantees the world’s balance between good and evil. (shrink)

Objective: To assess whether continuous consent, a process in which information is given to research participants at different stages in a trial, and clinician training in that process were effective when used by clinicians while gaining consent to the Total Body Hypothermia (TOBY) trial. The TOBY trial is a randomised controlled trial (RCT) investigating the use of whole-body cooling for neonates with evidence of perinatal asphyxia. Obtaining valid informed consent for the TOBY trial is difficult, but is a good test (...) of the effectiveness of continuous consent. Methods: Semistructured interviews were conducted with 30 sets of parents who consented to the TOBY trial and with 10 clinicians who sought it by the continuous consent process. Analysis was focused on the validity of parental consent based on the consent components of competence, information, understanding and voluntariness. Results: No marked problems with consent validity at the point of signature were observed in 19 of 27 (70%) couples. Problems were found mainly to lie with the competence and understanding of the parents: mothers, particularly, had problems with competence in the early stages of consent. Problems in understanding were primarily to do with side effects. Problems in both competence and understanding were observed to reduce markedly, particularly for mothers, in the post-signature phase, when further discussion took place. Randomisation was generally understood but unpopular. Information was not always given by clinicians in stages during the short period available before parents gave consent. Most clinicians, however, were able to give follow-up information. Discussion: Consent validity was found to compare favourably with similar trials examined in the Euricon study. Conclusion: Adopting the elements of the continuous consent process and clinician training in RCTs should be considered by researchers, particularly when they have concerns about the quality of consent they are likely to obtain by using a conventional process. This paper develops and defends a compound powerful qualities view of properties. According to this view, properties are essentially composed of distinct powerful and qualitative elements. First, I outline an argument for the compound powerful qualities view, based on the claim that it has the explanatory power of other views, without incurring their costs. Second, I argue that the view has the resources to explain how properties are individuated, by claiming that properties are partially individuated by their qualitative (...) elements, and partially by their powerful elements. Third, I distinguish two versions of the view, one of which says that the qualitative and powerful are parts of properties, the other of which says that they are aspects of properties. I argue that the parthood view is the more parsimonious because it can avoid postulating a novel metaphysical relation. Fourth, I argue that the relation between the powerful and qualitative elements of a property is necessary, and lay out various viable options concerning what the relation might be, including grounding and primitivism. Any discipline of human knowledge is characterized by three fundamental elements: the complexity of its content, the method used for its elaboration, and the language used for its expression. This article argues that any method for making knowledge is a particular combination of three main components that we can call science, art, and revelation. The right combination depends on the complexity of the slice of reality that we wish to understand in each case. Is there a relationship between the quantity (...) and quality of a particular piece of knowledge and the quantity and quality of its eventual audience? Such a relationship serves, I believe, to avoid certain old misunderstandings. (shrink)

Reoccurring instances of unethical employee behavior raises the question of the effectiveness of organization’s employee ethics training programs. This research seeks to examine employee ethics training programs among US-based global organizations by asking members of the Ethics and Compliance Officer Association to describe various elements of their organizations’ ethics training programs. This investigation and assessment reveal that there are some effective aspects of ethics training but five serious concerns are identified and discussed as potential contributions to the lack of ethics (...) among business organizations’ employees. One element of the American Society for Bioethics and Humanities’ recently-piloted quality attestation portfolio for clinical ethics consultants is a “philosophy of clinical ethics consultation statement” describing the candidate’s approach to clinical ethics consultation. To date, these statements have been under-explored in the literature, in contrast to philosophy statements in other fields such as academic teaching. In this article, I argue there is merit in expanding the content of these statements beyond clinical ethics consultation alone to describe the author’s approach (...) to other important “domains” of healthcare ethics practice. I also claim such statements have at least three additional uses outside quality attestation: as a reflective practice learning tool to increase role clarity among practicing healthcare ethicists and bioethics fellows; assisting practicing healthcare ethicists in clarifying role expectations with those they work with; and helping inform developing professional practice standards.
