How do institutions respond to expert contests over epistemologies of sex and gender? In this article, I consider how epistemological ascendancy in debates over the regulation of women athletes with high testosterone is established within a legal setting. Approaching regulation as an institutional act that defines forms of embodied difference, the legitimacy of which may be called into question, I show how sexed bodies are enacted through and as part of determinations of expertise. I focus on proceedings from 2015 when (...) the Court of Arbitration for Sport was asked to decide whether an Indian sprinter, Dutee Chand, could compete as a female athlete. Despite acknowledging that sexed bodies are unruly, the court ultimately endorsed the use of testosterone as seemingly essential to women’s athletic performance, thereby reasserting a two-category model of biological difference. The legitimacy of these regulatory efforts was established through the concurrent narrowing of expertise and the body, a process that is also revealed to be gendered. (shrink)

This article offers an account of organizational change to explain why women leaders are underrepresented compared to women athletes in many sports organizations. I distinguish between accommodation and transformation as forms of change: the former includes women without challenging binary constructions of gender, the latter transforms an organization’s gendered logic. Through a case study of the International Olympic Committee from 1967-1995, I trace how the organization came to define gender equity primarily in terms of accommodating women’s segregated athletic participation. Key (...) to this was the construction of women’s bodies as athletically able but inferior to men, an arrangement formalized in codified rules and procedures and legitimized by external stakeholders. Defined in these terms, gender equity did little to transform the organization’s binary and hierarchically gendered logic, which continued to shape the informal norms and procedures associated with the organization’s allegedly gender-neutral and meritocratic yet male-dominated leadership. I argue that the exclusion of women from ostensibly gender-integrated leadership positions allows organizations to avoid revealing gender similarity between men and women. This maintains a logic underpinned by notions of binary gender difference and masculine superiority. (shrink)

Ethik-Komitees gehören zum festen Bestandteil des Ethikmanagements und der Organisationsethik in klinischen Einrichtungen des Gesundheitswesens. Entsprechende Ethikstrukturen und die damit verbundenen Angebote stoßen hinsichtlich ihrer Wirksamkeit allerdings an ihre Grenzen. Ihre Arbeitsweisen sind häufig reaktiv und eine Verankerung in den entsprechenden Organisationsebenen fehlt. Ausgehend von diesen Limitationen der klinischen Ethikberatung hat sich die multiprofessionelle „Arbeitsgruppe Ethik“ am Universitätsklinikum Tübingen um die Konzeption und Implementierung eines neuen Ansatzes zur nachhaltigen Integration von ethischen Reflexions- und Entscheidungsprozessen auf den Stationen des UKT bemüht. Mit dem Tübinger Modell der Ethikbeauftragten der Station verfolgt sie ein Pilotprojekt, das speziell geschulte Pflegekräfte aus allen Stationen des UKT als AnsprechpartnerInnen für ethische Fragen einsetzt. Damit stellen die Ethikbeauftragten eine Erweiterung zu etablierten Strukturen der Ethikberatung dar und ergänzen vorhandene Top-Down-Strategien. Der vorliegende Beitrag stellt die Zielsetzungen des Tübinger Modells dar und schildert erste Erfahrungen in der Umsetzung. Neben der Einbettung in organisationale Strukturen der Ethikberatung werden die stationsinternen und stationsübergreifenden Aufgaben der Ethikbeauftragten dargestellt. Zudem wird das Qualifikationsprogramm für Ethikbeauftragte sowie ein Train-the-Trainer-Konzept vorgestellt, welche eine vertiefende Entwicklung von pflege- und medizinethischer Kompetenzen unterstützen und Sicherheit in den stationsbezogenen Reflexions- und Entscheidungsprozessen vermitteln. To deal with the upcoming challenges and complexity of the nursing profession, it is deemed important to reflect on our current organization of care. However, before starting to rethink the organization of nursing care, an overview of important elements concerning nursing care organization, more specifically nursing models, is necessary. The aim of this study was to conduct a mapping review, accompanied by an evidence map to map the existing literature, to map the field of knowledge on a meta‐level and to (...) identify current research gaps concerning nursing models in a hospital setting. Next to nursing models, two other organizational correlates seem to be of importance when looking at the organization of nursing care: nurse staffing and skill mix. Although it seems that in recent research, the theoretical focus on the organization of nursing care has been left behind, the increasingly complex healthcare environment might gain from the use of nursing theory, or in this case, care delivery models. As almost no fundamental studies have been done toward the combination of care delivery models, nurse staffing, and skill mix, those elements should be taken into account to fully capture the organization of nursing care in future research. Mikhail Bakhtin aimed to invent a phenomenology of the self-experience and of the experience of the other in his early work. In order to realize such a phenomenology he combined different approaches he called idealism and materialism / naturalism. The first one he linked to Edmund Husserl, but did hardly name him directly concerning his phenomenology. Does this intersubjective phenomenology give a hint that Bakhtin used Husserlian ideas more than considered yet? Or did they both invent similar ideas independently from (...) each other? Both thinkers dealt with the issue of intersubjectivity. Husserl judged statements on other psycho-physical realities as metaphysics in the Logical Investigations II, but in his Ideas I he described the others as enhancing one’s experience through their “experiential surpluses”. In the same way Bakhtin described the unique perspective of the other as a mandatory and valuable part of the world of the act in his Philosophy of the Act and his investigations on Author and Hero. In order to understand the influence of Husserl’s phenomenology for Bakhtin’s early philosophy we need to take a look closer at those contentual parallels as well as some paraphrases yet unnoticed. This gives hint for the question if for Bakhtin Husserl was more than just a name dropped. In this article I reconstructed the relations between both thinkers and answered the question if the dating of Bakhtin’s early work until 1928 has to be re-considered. (shrink)

Scholars are increasingly concerned about social biases in facial analysis systems, particularly with regard to the tangible consequences of misidentification of marginalized groups. However, few have examined how automated facial analysis technologies intersect with the historical genealogy of racialized gender—the gender binary and its classification as a highly racialized tool of colonial power and control. In this paper, we introduce the concept of auto-essentialization: the use of automated technologies to re-inscribe the essential notions of difference that were established under colonial (...) rule. We consider how the face has emerged as a legitimate site of gender classification, despite being historically tied to projects of racial domination. We examine the history of gendering the face and body, from colonial projects aimed at disciplining bodies which do not fit within the European gender binary, to sexology's role in normalizing that binary, to physiognomic practices that ascribed notions of inferiority to non-European groups and women. We argue that the contemporary auto-essentialization of gender via the face is both racialized and trans-exclusive: it asserts a fixed gender binary and it elevates the white face as the ultimate model of gender difference. We demonstrate that imperialist ideologies are reflected in modern automated facial analysis tools in computer vision through two case studies: commercial gender classification and the security of both small-scale and large-scale spaces. Thus, we posit a rethinking of ethical attention to these systems: not as immature and novel, but as mature instantiations of much older technologies. (shrink)

That reality, and in particular the (dynamic) objects of signs, are independent of our thoughts or other representations is a crucial thesis of Peirce’s realism. On the other hand, his semiotics implies the claim that all reality and all real objects are real for us only because of the signs we use. Do these two claims contradict, even exclude, each other? I will argue that both Peirce’s metaphysics and his semiotics provide a natural via media: a structural account of the (...) openness of processes, featuring transitive relations, connects process ontology implicit in his evolutionary metaphysics and the relational, quasi-inferential features embodied in interpretational sequences of signs. It is shown that Peirce’s notion of a sign, its normative role and his account of the directional force of objects implies a sort of logical causality that supports the unity of objects. In this way sign sequences are able to relate flexibly sign use with contextually specified independent objects. That is to say, relational properties of object-oriented chains of interpretations provide sign users with a flexible, fallibilistic instrument able to capture by contingent identity relations (teridentity) of the identity of objects in changing situations. Introducing the perplexed reader to a philosophy requires both a comprehensive understanding of the philosophy in question and a rigorous simplifying strategy. But clarity and accessibility come at a price: one has to cut down on complicated and perhaps unresolved lines of thought and arguments, stratifying the development of theoretical positions into a coherent and accessible narrative. In this paper, we show that Case-based decision theory, proposed by Gilboa and Schmeidler :605–639, 1995), can explain the aggregate dynamics of cooperation in the repeated Prisoner’s Dilemma, as observed in the experiments performed by Camera and Casari. Moreover, we find CBDT provides a better fit to the dynamics of cooperation than does the existing Probit model, which is the first time such a result has been found. We also find that humans aspire to a payoff above the mutual defection (...) outcome but below the mutual cooperation outcome, which suggests they hope, but are not confident, that cooperation can be achieved. Finally, our best-fitting parameters suggest that circumstances with more details are easier to recall. We make a prediction for future experiments: if the repeated PD were run for more periods, then we would be begin to see an increase in cooperation, most dramatically in the second treatment, where history is observed but identities are not. This is the first application of Case-based decision theory to a strategic context and the first empirical test of CBDT in such a context. It is also the first application of bootstrapped standard errors to an agent-based model. (shrink)

In his famous essay from 1784, Kant denied that we "live in an enlightened age"; yet he claimed that we "live in an age of enlightenment". If we should answer the question if we live in an enlightened age now, we could basically give the same answer. The enlightenment as an ongoing process can be found throughout Kant's whole work. This article focuses on how the concept of enlightenment can be applied to the Kantian psychology, which marks an important change (...) of theory of the soul within modern western metaphysics. Kant's idea of enlightenment and 'critique' will be illustrated with reference to the "Paralogisms" of the Critique of Pure Reason. Finally, an analysis of some passages of the "Paralogisms" shall demonstrate that Kant's critique of the previous metaphysical doctrine of the human soul should not be understood as a complete rejection of this doctrine; rather, Kant's critique of what is called rational psychology should be understood as a critical transformation.
