Do Clinicians Have a Duty to Participate in Pragmatic Clinical Trials?Andrew Garland, Stephanie Morain & Jeremy Sugarman - 2022 - American Journal of Bioethics 23 (8):22-32.
Clinicians have good moral and professional reasons to contribute to pragmatic clinical trials (PCTs). We argue that clinicians have a defeasible duty to participate in this research that takes place in usual care settings and does not involve substantive deviation from their ordinary care practices. However, a variety of countervailing reasons may excuse clinicians from this duty in particular cases. Yet because there is a moral default in favor of participating, clinicians who wish to opt out of this research must (...)

Gender dysphoria in adolescents: can adolescents or parents give valid consent to puberty blockers?Simona Giordano, Fae Garland & Soren Holm - forthcoming - Journal of Medical Ethics.
This article considers the claim that gender diverse minors and their families should not be able to consent to hormonal treatment for gender dysphoria. The claim refers particularly to hormonal treatment with so-called ‘blockers’, analogues that suspend temporarily pubertal development. We discuss particularly four reasons why consent may be deemed invalid in these cases: the decision is too complex; the decision-makers are too emotionally involved; the decision-makers are on a ‘conveyor belt’; the possibility of detransitioning. We examine each of these (...)

  4. The emergence of the idea of ‘the welfare state’ in British political discourse.David Garland - 2022 - History of the Human Sciences 35 (1):132-157.
This article traces the emergence of the term welfare state in British political discourse and describes competing efforts to define its meaning. It presents a genealogy of the concept's emergence and its subsequent integration into various political scripts, tracing the struggles that sought to name, define, and narrate what welfare state would be taken to mean. It shows that the concept emerged only after the core programmes to which it referred had already been enacted into law and that the referents (...)

Cultural Transmission, Evolution, and Revolution in Vocal Displays: Insights From Bird and Whale Song.Ellen C. Garland & Peter K. McGregor - 2020 - Frontiers in Psychology 11:544929.
Culture, defined as shared behavior or information within a community acquired through some form of social learning from conspecifics, is now suggested to act as a second inheritance system. Cultural processes are important in a wide variety of vertebrate species. Birdsong provides a classic example of cultural processes: cultural transmission, where changes in a shared song are learned from surrounding conspecifics, and cultural evolution, where the patterns of songs change through time. This form of cultural transmission of information has features (...)

Conventional behaviors develop from practice for regularly occurring problems of coordination within a community of actors. Reusing and extending conventional methods for coordinating behavior is the task of everyday reasoning. The computational model presented in the paper details the emergence of convention in circumstances where there is no ruling body of knowledge developed by prior generations of actors within the community to guide behavior. The framework we assume combines social theories of cognition with human information processing models that have been developed (...)

Faculty Perceptions of Consensual Sexual Relationships Between University Faculty and Students.April Carrillo, Courtney Crittenden & Tammy Garland - 2019 - Journal of Academic Ethics 17 (4):331-343.
Consensual sexual relationships between faculty and students at universities are a growing issue for administrators. Often times, administrators view these relationships as potential sexual harassment cases given the power disparities that often exist between the parties involved. Therefore, many universities have written policies essentially equating CSRs to sexual harassment. Despite the recent growth of these policies, how faculty compare CSRs and sexual harassment is often overlooked, particularly as it relates to perceived power differentials. The current study examined responses from 166 (...)

Framed within theories of fairness and stress, the current paper examines bystanders’ intervention intention to workplace bullying across two studies based on international employee samples (N = 578). Using a vignette-based design, we examined the role of bullying mode (offline vs. online), bullying type (personal vs. work-related) and target closeness (friend vs. work colleague) on bystanders’ behavioural intentions to respond, to sympathise with the victim (defender role), to reinforce the perpetrator (prosecutor role) or to be ambivalent (commuter role). Under the leadership of Senator John Kitzhaber, President of the Oregon Senate, the lawmakers put together a package of bills designed to bring every Oregonian the security of third party financing for needed health care. The Oregon Plan's key innovation is the idea that, from (...)

There are two puzzles that confront observers of American capital punishment at the start of the 21st century. One concerns the legal and administrative arrangements through which it is enacted, which strike many commentators as irrational, or at least poorly adapted to the traditional ends of criminal justice. The other concerns the persistence of capital punishment in the USA in a period when comparable nations have decisively abandoned its use. In this essay, I will address both of these two questions, (...)

Modern, liberal democratic states and civilized, squeamish moderns would rather avoid the sights, sounds, and smells of the body in pain. So we eliminate them where that is possible and we hide them behind the scenes when it is not. The body thus creates a problem for modern liberal state punishment, especially in the United States, where nonphysical penalties, such as fines, restitution, or compensation, are notably underdeveloped and where mass imprisonment and capital punishment dominate the penal scene. The problem (...)

    Negating That Which Negates Us.Christian Garland - 2013 - Radical Philosophy Review 16 (1):375-385.
Marcuse’s thought is significant for the renewal of a critical theory with a basis in radical praxis or what can be defined as a politics of refusal: the negation of that which negates us. To be sure, refusal and resistance should not be mistaken as simply passive withdrawal or retreat but the active form of a radically different mode-of-being and mode-of-doing: Marcuse’s own definition of “the Great Refusal.” It is thus possible to speak of a negative ontology, and this paper—with (...)

In Grief: A Philosophical Guide, Michael Cholbi presents a compelling account of the nature of grief. To further illustrate how fruitful the philosophical study of grief, and Cholbi’s account of it is, I present three sets of comments. The first regards the extent to which Cholbi’s account of grief also provides an account of vicarious grief. The second concerns the paradox of grief and the good of grief, and suggests one reason we may recommend grief is that grieving is healthy. (...)

After a preliminary discussion of the proper role of theory in historical and sociological research it seeks to clarify and develop the following ideas: the concept of the field and its role in the study of crime control and criminal justice; the (...)

    Evolutionary physiology at 30+: Has the promise been fulfilled?Ismael Galván, Tonia S. Schwartz & Theodore Garland - 2022 - Bioessays 44 (1):2100167.
Three decades ago, interactions between evolutionary biology and physiology gave rise to evolutionary physiology. This caused comparative physiologists to improve their research methods by incorporating evolutionary thinking. Simultaneously, evolutionary biologists began focusing more on physiological mechanisms that may help to explain constraints on and trade‐offs during microevolutionary processes, as well as macroevolutionary patterns in physiological diversity. Here we argue that evolutionary physiology has yet to reach its full potential, and propose new avenues that may lead to unexpected advances. Viewing physiological (...)

In the mid-twentieth century when One-Dimensional Man was first published, the rapid advance of technology was already beginning to render “labor”—that is, what is known as “work”—superfluous. In 2016, half a century later, the process of “work” is being made largely redundant, if not “unnecessary”: the material truth of capitalist society that can never be uttered since as “work” disappears, so does what was one of its functional cornerstones. This article seeks to contribute to identifying some of the trends in (...)
