El presente ensayo se fija como propósito precisar la crítica hegeliana del Derecho natural y del Derecho abstracto y determinar una doctrina propiamente hegeliana del Derecho. En este sentido, nuestra hipótesis es que es en el contexto de la doctrina de la Sittlichkeit,que el Derecho debe ser comprendido según Hegel. En efecto, en sus Lecciones sobre la filosofía de la historia, Hegel define la Sittlichkeit como un “orden de lo sustancial de suerte que todo sujeto singular tiene la universalidad por (...) propósito, por espíritu y por costumbre ética, y que es en y por este espíritu que él quiere, actúa, vive y goza, si bien que es su naturaleza, a saber su naturaleza segunda y espiritual”2. Luego para Hegel la normatividad jurídica debe ser comprendida al interior de este campo, en un sentido social más amplio de normatividad constituido por la praxis de una comunidad que configura un campo inmanente de objetividad que estructura cotidianamente la vida de los individuos. Lejos entonces de una separación de deber y ser, Hegel nos llama a comprender la forma cómo la norma está presente en el corazón del mundo de la vida como reconciliación de lo racional con lo real en la efectividad. Workplace politeness concerns the structural, interactional and individual level. Using the example of mobbing, it is illustrated how small acts of impoliteness can lead to the destruction a person psychologically and physically. Particularly, so-called downward mobbing is an increasing problem worldwide; most of the cases are orchestrated by superiors, the people subordinates depend on the most. Data clearly illustrate the social toxin created by up to 45 seemingly small actions in five areas of work life. These actions result in health (...) hazards and ultimately loss of jobs. By example of workplace harassment, it is illustrated how systematic acts of impoliteness are used to manipulate a person's emotion and identity, to ensure anxiety-born solidarity in others while abusing power, with high costs for the target, the organisation, and society. The discussion gives way to considerations about intercultural cooperation at the workplace, showing similarities between subtle devaluations in intercultural communication called microaggression and what has been discussed as mobbing. Overall, impoliteness is deconstructed as a sign of degrading social bonds, security and health, thereby raising awareness of the importance of intercultural interaction without microaggression. The practical value of linguistic impoliteness research and its connection to work psychology becomes apparent. (shrink)

Philosophical Investigations §§19–20 have received little critical attention and their importance has mostly gone unappreciated. In this paper these sections are examined a few sentences at a time in the order they were written with an eye to determining what Wittgenstein does and does not say and how he has been and can be misinterpreted. In addition it is suggested that the material deserves careful consideration because it sheds light on Wittgenstein’s way of tackling philosophical problems, illuminates his pronouncements about (...) philosophy later in the Investigations, and serves as a valuable antidote to the widely-held view that whenever he discusses a philosophical problem he ends up advancing a philosophical thesis. This paper seeks to widen the dialogue between the “epistemology of peer disagreement” and the epistemology informed by Wittgenstein’s last notebooks, later edited as On Certainty. The paper defends the following theses: not all certainties are groundless; many of them are beliefs; and they do not have a common essence. An epistemic peer need not share all of my certainties. Which response to a disagreement over a certainty is called for, depends on the type of certainty in question. Sometimes a (...) form of relativism is the right response. Reasonable, mutually recognized peer disagreement over a certainty is possible.—The paper thus addresses both interpretative and systematic issues. It uses Wittgenstein as a resource for thinking about peer disagreement over certainties. (shrink)

Relativism is often motivated in terms of certain types of disagreement. In this paper, we survey the philosophical debates over two such types: faultless disagreement in the case of gustatory conflict, and fundamental disagreement in the case of epistemic conflict. Each of the two discussions makes use of a implicit conception of judgement: brute judgement in the case of faultless disagreement, and rule-governed judgement in the case of fundamental disagreement. We show that the prevalent accounts work with unreasonably high levels (...) of idealization. We defend two claims. First, philosophical discussions of disagreement need to be de-idealized. Second, once a less idealized account of disagreement is available, both our conception of judgement and our understanding of relativism need to be revised. Our example is a case study in the Sociology of Scientific Knowledge: Steven Shapin and Simon Schaffer’s classic Leviathan and the Air-Pump. This case study gives a less idealized account of disagreement that conceptualizes judgements as situated. We argue that this conception can and should be applied to cases of gustatory and epistemic disagreement. The payoff will be a reformulation of relativism in terms of rationally resolvable yet contingent disagreements. (shrink)

This essay accounts for the notion of _Lebensform_ by assigning it a _logical _role in Wittgenstein’s later philosophy. Wittgenstein’s additions of the notion to his manuscripts of the _PI_ occurred during the initial drafting of the book 1936-7, after he abandoned his effort to revise _The Brown Book_. It is argued that this constituted a substantive step forward in his attitude toward the notion of simplicity as it figures within the notion of logical analysis. Next, a reconstruction of his later (...) remarks on _Lebensformen_ is offered which factors in his reading of Alan Turing’s “On computable numbers, with an application to the _Entscheidungsproblem_“, as well as his discussions with Turing 1937-1939. An interpretation of the five occurrences of _Lebensform_ in the PI is then given in terms of a logical “regression” to _Lebensform_ as a fundamental notion. This regression characterizes Wittgenstein’s mature answer to the question, “What is the nature of the logical?”. (shrink)

The later Wittgenstein advanced a revolutionary but puzzling conception of how philosophy ought to be practised: Philosophical problems are not to be coped with by establishing substantive claims or devising explanations or theories. Instead, philosophical questions ought to be treated ‘like an illness’. Even though this ‘non-cognitivism’ about philosophy has become a focus of debate, the specifically ‘therapeutic’ aims and ‘non-theoretical’ methods constitutive of it remain ill understood. They are motivated by Wittgenstein’s view that the problems he addresses result from (...) misinterpretation, driven by ‘urges to misunderstand’. The present paper clarifies this neglected concept and analyses how such ‘urges’ give rise to pseudo-problems of one particular, hitherto little understood, kind. This will reveal ‘therapeutic’ aims reasonable and ‘non-theoretical’ methods necessary, in one clearly delineated and important part of philosophy. I.e.: By developing a novel account of nature and genesis of one important class of philosophical problems, the paper explains and vindicates a revolutionary reorientation of philosophical work, at the level of both aims and methods. In the preface of the Philosophical Investigations, Wittgenstein says that his “most fruitful ideas” are due to the stimulus of Sraffa's criticism, but Sraffa is not mentioned anywhere else in the book. It remains a puzzle in the literature how and why Sraffa influenced Wittgenstein. This paper presents a solution to this puzzle. Sraffa's criticism led Wittgenstein away from the calculus conception of language of the Big Typescript (arguably, an adaptation of the calculus of the Tractatus), and towards the “anthropological (...) view,” which structures both the opening sections of the Philosophical Investigations and Wittgenstein's later philosophy of mathematics. Das vorliegende Buch präsentiert eine phänomenologische Analyse der verschiedenen Formen zwischenmenschlicher Gewalt und ihrer oft unterbelichteten Beziehungen. Auf der Grundlage einer Transformation der Phänomenologie und im Rekurs auf den aktuellen Diskurs der Gewaltforschung entwickelt es einen methodologischen Rahmen für eine nicht-reduktive Analyse von Gewalt, der in angewandten phänomenologischen Fallstudien erprobt wird. -/- Gewalt war bislang vorwiegend in den Human und den Sozialwissenschaften ein zentrales Thema, wurde aber nur allzu selten zum Gegenstand genuin philosophischer Reflexion. Um dieses Desiderat aufzugreifen und die (...) Bedeutung philosophischer Reflexion für den Diskurs über Gewalt zu demonstrieren, entwickelt das vorliegende Buch einen phänomenologischen Ansatz zur Analyse zwischenmenschlicher Gewalt. Seine Intention besteht darin, ein Korrektiv zu den konventionellen, allzu einseitig verfahrenden instrumentalistischen, essentialistischen oder funktionalistischen Erklärungen von Gewalt vorzulegen. -/- Im Anschluss an eine kritische Reflexion auf zentrale Aporien des Gewaltdiskurses, denen es sich zu stellen gilt, integriert der Autor relevante Theoreme klassischer Phänomenologie mit neueren Ansätzen in einen umfassenden Analyserahmen. In drei „Fallstudien“ wird dieser Rahmen in konkreten Phänomenanalysen angewandt und der ihm zugrunde liegende weite Gewaltbegriff auf die Probe gestellt. Das Buch schließt mit einem Entwurf einer „relationalen Phänomenologie“, die es erlaubt, die vielfach unterbelichteten bzw. ausgeblendeten Beziehungen zwischen den verschiedenen Formen von Gewalt ins Auge zu fassen. Las críticas que brotan en un medio en que el debate epistemológico parece encabezar los problemas que competen al filosofar, tienen en el negar el sentido de verdad al discurso de índole religiosa la ratificación del estatus de cientificidad. Esta es la apuesta de teóricos inscritos a la tradición analítica surgida en el pasado siglo. No obstante, frente a los discursos neopositivistas y el radical evidencialismo vienen las posiciones de algunos filósofos y teólogos analíticos quienes paralelamente abogaron por la validez (...) y el sentido de lo religioso. Frank Plumpton Ramsey (1903–30) made seminal contributions to philosophy, mathematics and economics. Whilst he was acknowledged as a genius by his contemporaries, some of his most important ideas were not appreciated until decades later; now better appreciated, they continue to bear an influence upon contemporary philosophy. His historic significance was to usher in a new phase of analytic philosophy, which initially built upon the logical atomist doctrines of Bertrand Russell and Ludwig Wittgenstein, raising their ideas to a new level of (...) sophistication, but ultimately he became their successor rather than remain a mere acolyte. This paper outlines an interpretation of Ludwig Wittgenstein’s remark in the _Big Typescript_ in which he compares the philosopher bewitched by the workings of language to “the suffering of an ascetic”. The interpretation takes as its starting point Friedrich Nietzsche’s terse account of the philosopher, the history of philosophy, and his diagnosis of ascetic self-misunderstanding, from the Third Essay, “What do ascetic ideals mean?”, in _On the Genealogy of Morality_. In its assumption of an affinity between Wittgenstein’s remark and Nietzsche’s (...) descriptions, and in its analysis, this paper introduces a “method of voice borrowing” to approach the question: “Wittgenstein and Nietzsche?” The juxtaposition of Wittgenstein’s conception of the philosopher’s linguistic self-misunderstanding with Nietzsche’s notion of the ascetic self-misunderstanding leads finally to the question of what is gained by introducing this method, and hence by reading Wittgenstein’s remark on the suffering of an ascetic with the help of Nietzsche’s voice. The article gives an owerviev of the large collection of Wittgenstein originals kept in the Austrian National Library, which contains manuscripts like Mss 105, 106, 107, 112, 113 and 142, typescripts like Tss 203 and 204 letters and other documents like correspondence and photos of the Wittgenstein family.

O objetivo geral da pesquisa da qual esse artigo faz parte é investigar o sistema metafísico que emerge dos trabalhos de David Lewis. Esse sistema pode ser decomposto em pelo menos duas teorias. A primeira nomeada como realismo modal genuíno (RMG) e a segunda como mosaico neo-humeano. O RMG é, sem dúvida, mais popular e defende a hipótese metafísica da existência de uma pluralidade de mundos possíveis. A principal razão em favor dessa hipótese é a sua aplicabilidade na discussão de (...) problemas losó cos, esse motivo não será diretamente abordado neste artigo. Pois, o foco está em compreender o mosaico neo-humea- no e como ele relaciona-se com a metafísica de mundos possíveis. Em outras palavras, o meu objetivo é entender as bases losó cas que sus- tentam o realismo modal genuíno. (shrink)
