Calls to decolonise education systems cannot be removed from broader social struggles. Scholars have engaged in theoretical discussions on what decolonisation entails, emphasising the need for transforming thoughts, beliefs, and practices. However, the lack of sustained engagement and widespread resistance to decolonising the curriculum remains evident (Shahjahan, Estera & Surla, 2021; Fataar, 2018; Margolis, 2001), underscoring the urgency to envision new futures and explore relationalities between educators and students.In this article, we delve into the evolving terminologies surrounding Decolonisation, Anti-Colonisation and (...) Indigenisation, emphasising their pivotal roles in the broader project of educational decolonisation (Louie et al., 2017). We argue that a reassertion of Indigenous resistance and futurity in higher education forms the cornerstone of this transformative process. Through an examination and understanding of these terminologies, we aim to contribute to the ongoing dialogue surrounding educational decolonisation and envision inclusive, equitable, and anti-colonial learning environments that center Indigenous knowledge and perspectives. Algunas versiones del realismo jurídico pretenden compatibilizar la pretensión de que el derecho es un conjunto de normas con un fuerte compromiso con el empirismo. De conformidad con este último, el derecho no está constituido por entidades abstractas de ningún tipo sino por hechos empíricamente constatables. En vistas a llevar a cabo esta compatibilización, en varios trabajos Riccardo Guastini ha defendido una concepción de las proposiciones normativas, i.e. aserciones existenciales sobre normas jurídicas, como enunciados teóricos acerca del derecho vigente, necesariamente (...) referentes a ciertos hechos. Se concibe así al derecho vigente como el conjunto de textos que son resultado de interpretaciones estables, consolidadas y dominantes que los jueces han llevado a cabo en sus decisiones en el ordenamiento de que se trate. Partiendo de esta versión del realismo jurídico, este trabajo procura sembrar algunas dudas. Primero, sobre este modo de concebir a las proposiciones normativas. Segundo, sobre el modo en que, en consecuencia, queda configurada la teoría del derecho. Tercero, y más en general, sobre la pretensión de compatibilizar la visión del derecho como conjunto de normas con la tesis empirista. (shrink)

Although Christianity has abundant literature against racism, the menace negatively affects human relationships in contemporary westernised societies. The near silence of most Christian denominations leads to one crucial question: how should Christians deal with racial prejudice in contemporary westernised societies? This article is a social criticism of racism from the perspective of Dietrich Bonhoeffer. As a Christian, Bonhoeffer struggled with the morality of racism, particularly regarding the experience of black people in the United States and Jews in Germany. His reflections (...) and action against racial injustice are a robust framework that could inspire a positive Christian attitude in dealing with racism. This article describes the causes and remedies of racial injustice from his perspective. In the face of these challenges, philosophy must show how to confront issues in a new way: not as problems that admit technical resolution, but as questions which involve openness to meaning and which demand the exercise of freedom.

A partir do final do século passado, na esteira das preocupações e debates sobre a biodiversidade, chega-se à afirmação da importância da Amazônia. No bojo dessa dinâmica, colocam-se também as pressões internacionais e as políticas estatais para a região e para as populações tradicionais, nela concentradas. Até então alijadas dos interesses políticos do Estado, estas populações passam agora a ser vistas como detentoras de culturas, de saberes "locais", cruciais diante da necessidade "global" de conservação da biodiversidade. Em estreita mescla com (...) os saberes tradicionais, expressam-se inumeráveis formas de religiosidade, dentre as quais se destacam a "encantaria" e a pajelança. Em relação à Amazônia brasileira, esse lugar central ocupado pela religiosidade é tratado via três eixos: presença da Igreja Católica e de outras organizações religiosas em seus processos organizativos; politização da natureza e da religiosidade associada à emergência de múltiplas identidades coletivas; importância da "encantaria" e da pajelança ecológica para a conservação da biodiversidade. Palavras-chave: biodiversiade; religiosidade; Amazônia; encantaria; políticas estatais.From the end of the last century, at the base of the concerns and debates on biodiversity, one comes to asserting the importance of the Amazon. Amid this dynamic, there are also international pressure and public policies for the region and its traditional people. It is known that such populations have Ordinarily being shut out from the political interests of the state. However, these traditional population is beginning to be understood as having cultures, there is to say, "local" knowledge, given the crucial need for "global " biodiversity conservation. Closely intertwined with traditional knowledge, innumerable forms of religiosity is expressed, among which is highlighted the so called "encantaria" and "pajelança". Regarding the Brazilian Amazon, this central place occupied by religiosity is handled via three routes: the presence of the Catholic Church and other religious organizations in their organizational processes; politicization of nature and of religiosity associated with the emergence of multiple collective identities; the importance of the so called "encantaria" and of the ecological "pajelança" (shamanism) towards conservation of biodiversity. O texto parte do reconhecimento da importância das populações tradicionais na conservação da biodiversidade, tanto em termos históricos quanto em projetos socioambientais baseados no paradigma da sustentabilidade. Foca a civilização do mangue do Salgado Paraense e, em particular, as comunidades da Reserva Extrativista de Caeté-Taperaçu (município de Bragança/PA). Destaca aspectos de sua territorialidade em articulação com sua religiosidade, na qual são tratados os santos e, sobretudo, os encantes (xamanismo caboclo). A partir desta religiosidade (crenças, superstições, lendas), a discussão se centraliza (...) em torno de dificuldades para a efetivação de diálogos e de interlocuções necessários à construção de projetos de conservação da biodiversidade envolvendo aquelas populações, os quais incluem a participação de mediadores (letrados, ambientalistas, ecologistas, governamentais e não governamentais) e implicam a geração de uma nova ordem social. Ancora-se, ainda, em entrevistas semidirigidas que vêm sendo realizadas há três anos na região e no acompanhamento da implementação da Reserva Extrativista criada em 2005 no município (reuniões do Conselho Deliberativo, recadastramento de usuários). Territorialidade/população tradicional.This article highlights the importance of traditional biodiversity conservation, both in historical terms and in environmental projects, based on the paradigm of sustainability. It focuses on mangrove of "Salgado Pará" and, in particular, on the communities of the Extractive Reserve Caeté-Taperaçu (municipality of Bragança / PA). It also highlights some aspects of its territoriality in connection with its religiosity, in which are treated the saints, especially the Encantes (caboclo shamanism). From this religiosity (beliefs, superstitions, legends) the discussion is organized around the difficulties for building dialogues and interlocutions required to build projects for biodiversity conservation surrounding these populations. These dialogues include the participation of mediators (scholars, environmentalists, ecologists, government and non-government) and the construction of a new social order. This text is anchored in semi-structured interviews that have been conducted for three years and in monitoring the implementation of the Extractive Reserve, created in 2005. The question asked in this article is: what is a parasite?. Defining a parasite requires defining its host at the same time. A difficult question therefore arises about host-parasite relationships. The object of general parasitology is in fact to study the relationship between a host and its parasite. The initial question what is a parasite? has to be reformulated within a conceptual framework, that of relationship. This article is an attempt to transpose into parasitology some concepts which have been profitable (...) in the fields of physics and chemistry. The studies of R. Thom about the individual are also used. Concepts like that of field and principles like that of minimization are probably operational on a high level of organization. The description of host-parasite relationships could benefit from these concepts. (shrink)

Abstrak: Tujuan dari artikel ini adalah menginterpretasi dan mengafirmasi bahwa Ada (das Sein) dalam “pertanyaan tentang Ada” (die Seinsfrage) dalam pemikiran Heidegger adalah univok sebagaimana konsep Ada itu univok dalam pemikiran Duns Scotus. Oleh karena itu, pertanyaan utama yang menuntun artikel ini adalah, bagaimana dapat ditunjukkan hubungan antara konsep Ada itu univok antara Dun Scotus dan Heidegger? Untuk memahami dengan baik tema ini, kita akan mengulasnya dalam empat bagian. Pertama, kita akan berkonsentrasi pada pengertian konsep ekuivok, analog, univok. Kedua, kita (...) fokus pada konsep analogi dan univok dalam pemahaman Abad Pertengahan. Bagaimana Duns Scotus memahami Ada itu univok akan dijelaskan pada bagian ketiga. Kemudian, kita akan mengelaborasi sebuah penafsiran Ada itu univok dalam pemi- kiran Heidegger pada bagian keempat. Pada akhirnya, konsep Ada itu univok dalam pemikian Heidegger terletak pada konsepnya tentang waktu. Kata-kata kunci: Ekuivok, analog, univok, metafisika, Ada, Dasein, In- nerzeitigkeit, Zeitlichkeit, ekstasis, transendental. Abstract: The scope of this article is to interpret and affirm that Being (das Sein) in Heidegger’s “question of Being” (die Seinsfrage) is similarly univocal to Duns Scotus’ concept of the univocity of Being. Therefore, the central question which guides this article is, how can it point to the relationship between Duns Scotus and Heidegger in regards to the concept of the univocity of Being? To understand well this theme, we will explain it in four parts. First, we concentrate on the definitions of equivocity, analogy and univocity. Second, we focus on the concepts of analogy and univocity in the Middle Ages. How Duns Scotus understands the univocity of Being will be pointed out in third part. After that, we will elaborate an interpretation of the univocity of Being in Heidegger’s thought in fourth part. In the end, concept of the univocity of Being in Heidegger’s thought is put in his concept of time. BackgroundGiven that advances in research continuously raise new ethical issues, a multidisciplinary working group of investigators involved in biomedical research has gathered to discuss and compare ethical viewpoints in their daily practice.MethodsThe working group has drafted a Charter for Ethics in Biomedical Research that encompasses all the steps in the research process, i.e. from the initial idea to analysis and publication of the results.ResultsBased on key principles for ethically responsible research, the Charter may serve as a tool for performing research, (...) discussing research issues and training researchers.ConclusionsThe Charter should stimulate researchers to think about their responsibility for research in a progressive, caring society. El autor lleva a cabo una revisión de la obra The Many Faces of Normativity intentado resaltar algunos rasgos comunes que se van presentando a lo largo de los diversos textos que componen la obra revisada. Luego de abordar la visión de Robert Audi acerca de las tendencias hacia la naturalización de la normatividad así como el análisis que Jaap Hage efectúa de los conceptos normativos, se tratan dos ataques a la distinción ser-deber ser que defienden argumentos que, sobre la (...) base de esa distinción, han sido considerados falaces al menos desde David Hume. Posteriormente se tratan una serie de aportes con una tendencia común, y que a criterio del autor dan una especial identidad a la obra en su conjunto. Se trata de la tendencia, en buena medida reduccionista, que acopla la explicación de la normatividad a hipótesis provenientes del flamante campo de las neurociencias. (shrink)

The application of the latest technologies in biology and medicine has brought them to a qualitatively new level of possibilities. Worldwide, biobanking is actively developing through the creation of biobanks of various types and purposes, whose resources are used to solve therapeutic or scientific problems. Legal science remains an open question concerning the boundary that runs between the right to data protection and the scope of disclosure of data needed for medical purposes. In this article, the author considers peculiarities of (...) data processing in the context of biobanking activity on the example of Austria and its national legislation. In addition, the article reveals features of the approaches of the European Court of Human Rights (ECtHR) and the Council of Europe to the issue of biobanking in general, its characteristics in the context of data, and legal regulation of this phenomenon in the national law of states. The author devoted an important part of the study to the role of Austria’s experience in the context of data processing for scientific purposes and the development of biobanking for a number of other European states. The aim of the article is to analyze the Austrian legislation on data processing for scientific research and biobanking, the attitude of the Council of Europe to this phenomenon, and the practice of the ECtHR, as well as to consider the impact of the current world situation on these activities. The leading method of research used in the article is the formal-legal method. The article analyzes the Austrian law in the context of data processing in medical research, the relationship of the specifics of personal data protection, and the need to disclose them for scientific purposes. The author pays special attention to the influence of Austrian law on the legislation of other countries, which is reflected in the conclusions to the article. In addition, based on an analysis of the application of the Austrian experience to the legislation of Poland and Ukraine, the author points out the necessary changes that should be made in the laws of these countries. In this follow-up to The Kingdom and the Glory and The Highest Poverty, Agamben investigates the roots of our moral concept of duty in the theory and practice of Christian liturgy. Beginning with the New Testament and working through to late scholasticism and modern papal encyclicals, Agamben traces the Church's attempts to repeat Christ's unrepeatable sacrifice. Crucial here is the paradoxical figure of the priest, who becomes more and more a pure instrument of God's power, so that his own motives (...) and character are entirely indifferent as long as he carries out his priestly duties. In modernity, Agamben argues, the Christian priest has become the model ethical subject. We see this above all in Kantian ethics. Contrasting the Christian and modern ontology of duty with the classical ontology of being, Agamben contends that Western philosophy has unfolded in the tension between the two. This latest installment in the study of Western political structures begun in Homo Sacer is a contribution to the study of liturgy, an extension of Nietzsche's genealogy of morals, and a reworking of Heidegger's history of Being. Amor Dei, “love of God” raises three questions: How do we know God is love? How do we experience love of God? How free are we to love God? This book presents three kinds of love, worldly, spiritual, and divine to understand God’s love. The work begins with Augustine’s Confessions highlighting his Manichean and Neoplatonic periods before his conversion to Christianity. Augustine’s confrontation with Pelagius anticipates the unresolved disputes concerning God’s love and free will. In the sixteenth-century the Italian humanist, (...) Gasparo Contarini introduces the notion of “divine amplitude” to demonstrate how God’s goodness is manifested in the human agent. Pierre de Bérulle, Guillaume Gibieuf, and Nicolas Malebranche show connections with Contarini in the seventeenth-century controversies relating free will and divine love. In response to the free will dispute, the Scottish philosopher, William Chalmers, offers his solution. Cornelius Jansen relentlessly asserts his anti-Pelagian interpretation of Augustine stirring up more controversy. John Norris, Malebranche’s English disciple, exchanges his views with Mary Astell and Damaris Masham. In the tradition of Cambridge Platonism, Ralph Cudworth conveys a God who “sweetly governs.” The organization of sections represents the love of God in ascending-descending movements demonstrating that, “human love is inseparable from divine love.”. Obraz jako pojęcie filozoficzne ma długą i złożoną historię, która ma swój początek już w starożytności. Uczeni chrześcijańscy włączyli je do swoich badań filozoficznych w postaci imago Dei. W niniejszej pracy autor dokonał analizy dzieł św. Tomasza z Akwinu w celu ustalenia, jakie konsekwencje antropologiczne wynikają z idei stworzenia człowieka na obraz Boży. W pierwszej kolejności ustalono, że człowiek jako istota stworzona na obraz Boga uczestniczy poprzez swój intelekt w naturze Bożej. Dodatkowo przedstawione zostały trzy etapy uczestnictwa człowieka w Bogu. (...) Następnie autor bronił klasycznej teorii Akwinaty przeciwko współczesnym reinterpretacjom jego myśli. Argumentowano, iż Akwinata słusznie utrzymuje, że jedynie intelektualna część duszy ludzkiej jest, ściśle rzecz biorąc, stworzona na Obraz Boży, natomiast ciało ludzkie (i inne stworzenia irracjonalne) upodabnia się do Boga na podobieństwo śladu. There is a pervasive trend in Western theology to identify imago Dei with human intellectual and cognitive capacities. However, several contemporary theologians have criticized this view because, according to the critics, it leads to a truncated view of humanity. In this article, I shall concentrate on the question of rationality, first, through theologies of Thomas Aquinas and contemporary Lutheran Robert Jenson, and second, in some branches of recent cognitive psychology. I will argue that there is a significant overlap between contemporary (...) scientific interpretations of rationality and both a traditional Thomistic view and a contemporary ecumenical interpretation of imago Dei. Consequently, it is possible to give an account of imago Dei which takes structural features as central and which is in accord with contemporary science, without falling prey to the dangers that the critics of structuralism point out.
