A growing discourse in Europe and North America focuses on questions of the religious and political status of Muslim minorities. This essay tries to bring some historical perspective to current discussions, surveying the ways premodern Muslim jurists approached issues pertaining to Muslims living in non-Muslim territories. As the historical material indicates, Muslim juridical opinion on these matters is very diverse. Individual jurists, while working within one or another of the broad traditions of Islamic jurisprudence (Shafi'i, Hanafi, Hanbali, Maliki, or Shi'i), (...) have felt free to craft opinions designed to fit specific situations. Given such variety, I conclude by echoing the judgment given by Rashid Rida earlier in this century: In the final analysis, specific Muslim minorities are the best judges of their own particular situations. There is a serious problem with arguing that God intended to lock the epistemology of the 7th century into the immutable text of the Qur’an, and then intended to hold Muslims hostage to this epistemological framework for all ages to come. Among other things, this would limit the dynamism and effectiveness of Divine text because the Qur’an would be for ever locked within a knowledge paradigm that is very difficult to retrieve or re-create. The author argues for the recognition of (...) three critical categories in Islamic theology: haqq, hikma and ma‘arifa. While haqq connotes the objective and constant truth, it is not reachable without hikma. Hikma is the balance [mizan] of truths in every historical moment with all of its contingencies. Ma‘arifa is the epistemology or the way to searching the objective and constant truth as well as the search for the hikma appropriate for each stage in human consciousness. The author contends that it is contrary to the very nature of a merciful and compassionate God to leave Muslims with a Revelation that is not fully equipped to deal with the altered states of consciousness and perceptions that are inevitable in every stage of human development. The present work is a critical edition of a commentary by Ibn Wāṣil (d.1298) on his teacher Khūnajī’s (d.1248) handbook on logic _al-Jumal_. The work was an influential contribution to a particularly dynamic chapter in the history of Arabic logic.

At the beginning of Nostra aetate, the Church calls for mutual understanding with Muslims in the interests of “peace, liberty, social justice, and moral values.” This paper strives to achieve such an understanding in light of the fragile state of democracy in today’s world. The paper first presents the Church’s approach to democracy through an analysis of the work of the philosopher Jacques Maritain and the Second Vatican Council. It then presents representative views from Islam: the work of the Sunni (...) legal scholar Khaled Abou El Fadl and the Shi’ite scholar Naser Ghobadzadeh. By appealing to the Jesuit scholarDavid Hollenbach’smethodology of “dialogic universalism,” the paper argues finally that there is a rich confluence between the two traditions: Their basic commitment to the dignity and freedom of the human person implies a respect for pluralism, a reverence for reason, and a call for self-transcendence, all of which can serve to enhance democracy. Background Little is known about the attitudes and practices of intensivists working in Lebanon regarding withholding and withdrawing life-sustaining treatments. The objectives of the study were to assess the points of view and practices of intensivists in Lebanon along with the opinions of medical, legal and religious leaders regarding withholding withdrawal of life-sustaining treatments in Lebanese intensive care units. Methods A web-based survey was conducted among intensivists working in Lebanese adult ICUs. Interviews were also done with Lebanese medical, legal and (...) religious leaders. Results Of the 229 survey recipients, 83 intensivists completed it, i.e. a response rate of. Most respondents were between 30 and 49 years old, Catholic Christians, anesthesiologists, working in Beirut. Ninety-two percent of them were familiar with the withholding and withdrawal concepts and 80% applied them. Poor prognosis of the acute and chronic disease and futile therapy were the main reasons to consider withholding and withdrawal of treatments. Ninety-five percent of intensivists agreed with the “Principle of Double Effect”. The main withheld therapies were vasopressors, respiratory assistance and CPR. Most of the respondents reported the decision was often to always multidisciplinary, involving the family, and the patient, or his advance directives or his surrogate and the nurses. The interviewees agreed there was a law governing withholding and withdrawal decisions/practices in Lebanon. Christians and Muslim Sunni leaders declared accepting those practices. Conclusion Withholding and withdrawal of LSTs in the ICU are known concepts among intensivists working in Lebanon and are being practiced. Our results could be used to inform and optimize therapeutic limitation in ICUs in the country. (shrink)

ABSTRACTTwo rival scholars from Shiraz in Persia, Dawānī and Dashtakī engaged in a bitter and extended dispute over a range of metaphysical and logical issues. One of these was the liar paradox. Their debate on this point marked the most extensive scrutiny of the paradox in Arabic until that time. Dashtakī’s solution was to deny that the statement ‘What I say is false’ is true or false, on the ground that there is one statement and one application of the falsity (...) predicate. Given that – ex hypothesi – there is no other statement, there is no basis for a reiteration of the truth or falsity predicate and describing the statement itself as true or false. Dawānī’s solution was to deny that ‘What I say is false’ is a statement at all, and he argued that it is instead akin to a performative utterance such as ‘I hereby sell you this’. (shrink)

The principle that a necessarily false proposition implies any proposition, and that a necessarily true proposition is implied by any proposition, was apparently first propounded in twelfth century Latin logic, and came to be widely, though not universally, accepted in the fourteenth century. These principles seem never to have been accepted, or even seriously entertained, by Arabic logicians. In the present study, I explore some thirteenth century Arabic discussions of conditionals with impossible antecedents. The Persian-born scholar Afdal al-Dīn al-Kh najī (...) (d.1248) suggested the novel idea that two contradictory propositions may follow from the same impossible antecedent, and closely related to this point, he suggested that if an antecedent implies a consequent, then it will do so no matter how it is strengthened. These ideas led him, and those who followed him, to reject what has come to be known as 'Aristotle's thesis' that no proposition is implied by its own negation. Even these suggestions were widely resisted. Particularly influential were the counter-arguments of Na īr al-Dīn al-T ī (d.1274). (shrink)

Recent years have seen a dramatic change in scholarly views of the later career of Arabic and Islamic philosophy. For much of the twentieth century, researchers tended to dismiss the value of Arabic writings on philosophy and logic after the twelfth century, often on the basis of the prejudice that handbooks, commentaries and glosses are of necessity pedantic and unoriginal. This assumption has now been abandoned. As a consequence, a vast amount of later Arabic writings on philosophy and logic, hitherto (...) neglected, are now being studied and edited. The present work is an attempt at giving an overview of the development of Arabic logic from 1200 to 1800, identifying major themes, figures and works in this period, while taking into account regional differences within the Islamic world. BackgroundThe nursing profession requires ethical and legal regulations to guide nurses’ performance. Ethical climate plays a part in shaping nurses’ ethical practice. Therefore, ethico-legal aspects and ethical climate contribute to improving nurses’ ethical practice and competencies with reducing medical errors in hospital settings.ObjectiveThis study examined the effect of ethico-legal aspects and ethical climate on managing safe patient care and medical errors among nurses.Materials and methodsA cross-sectional correlational study was carried out on 548 nurses. Data were collected through self-administered questionnaires about (...) nurses’ knowledge in both ethical and legal aspects, ethical practice, competencies, ethical climate and experience with medical error.ResultsThe main sources of nurses’ knowledge of ethical and legal aspects were undergraduate lectures, job experience and colleagues. Nurses’ knowledge in both ethical and legal aspects, nurses’ ethical practice and competencies were insufficient. Nurses fairly perceived their ethical climate. Also, nurses experienced medical errors about 22.6% in their units. Nurses’ knowledge of ethical and legal aspects, as well as the ethical climate were positive predictors of inadequate nurses’ ethical practice and competencies. Additionally, nurses’ knowledge in both ethical and legal aspects, ethical climate and practice had a negative influence on the occurrence of medical errors.ConclusionEnhancing nurses’ knowledge in both ethical and legal aspects as well as ethical climate could significantly influence improving nurses’ ethical practice, competencies and reducing medical errors in the study units. Relational inferences are a well-known problem for Aristotelian logic. This book charts the development of thinking about this problem by logicians writing in Arabic from the ninth to the nineteenth century. It shows that that the development of Arabic logic did not - as is often supposed - come to an end in the fourteenth century.

Religious freedoms of minorities in Muslim-majority countries such as Pakistan are compromised due to structural issues as well as social and historical concerns. For instance, the abuse of the blasphemy law has led to minority communities facing threats and violence. And in a country where religious scholars are often absent from, if not against, discourses about human rights, the religious rights of minorities remain a secular and hence culturally unsound discourse. There is thus a need for two parallel movements. One, (...) an awareness within Muslim communities about the need to engage with religious freedoms, and hence the modern human rights regime, as an essentially Islamic process requiring reform from within. And two, the human rights structure also giving religion its due since religious freedoms are part of, and engender, many other rights as well. In this article, a case is made for this dual process, by exploring the work of scholars of Islam such as Abdullahi An-Na’im and Khaled Abou El Fadl as well as the insecurities of religious scholars in Pakistan who have reacted to human rights as a western agenda. The study of Islamic philosophy has entered a new and exciting phase in the last few years. Both the received canon of Islamic philosophers and the narrative of the course of Islamic philosophy are in the process of being radically questioned and revised. Most twentieth-century Western scholarship on Arabic or Islamic philosophy has focused on the period from the ninth century to the twelfth. In the thirteenth century, the influential logician Afḍal al-Dīn al-Khūnajī departed from the Avicennan view that the subject matter of logic is “second intentions”. For al-Khūnajī, the subject matter of logic is “the objects of conception and assent”. His departure elicited intense and sometimes abstruse discussions in the course of subsequent centuries. Prominent supporters of Khūnajī's view on the subject matter of logic included Kātibī, Ibn Wāṣil and Taftāzānī. Defenders of Avicenna's view included Ṭūsī, Samarqandī and Quṭb al-Dīn al-Rāzī. Cette notion est venue à être utilisée dans la théorie syllogistique à la fin du Moyen Âge et au début de la période moderne, alors que les logiciens latins cherchaient à établir des règles générales pour la productivité syllogistique à travers les différentes figures. Il est beaucoup moins connu que certains logiciens de la tradition arabe médiévale ont également tenté d’établir des règles générales pour le syllogisme, (...) faisant appel à ce qu’ils appelaient la « généralité du sujet ». Dans le présent article, j’introduis cette utilisation de la « généralité du sujet » dans certains ouvrages arabes influents en logique du XIIIe au XVIe siècle, en particulier Al-ǧumal par Afḍal al-Dīn al-Ḫūnaǧī (mort en 1248) et Tahḏīb al-manṭiq par Saʿd al-Dīn al-Taftāzānī (morten 1390) et certains de leurs commentateurs. A number of recently published studies by reformist-minded Muslim scholars have both questioned the normative nature of and emphasized the need to rethink some of the fundamental assumptions and interpretational models governing traditional Islamic legal theories and ethics. As part of this process they have emphasized the need to develop novel Islamic hermeneutics. One major element in this emergence of novel Islamic hermeneutics is the production of an increased number of what I term ‘gender equality affirmative scholarship on Islam’. What (...) is particularly interesting, if not intriguing, from the perspective of the author of this article is that the scholarship on gender equality affirmative interpretations of Islam is theorized by reformist-minded Muslim male scholars at historically unprecedented levels which is what this study seeks to highlight. This article examines the arguments employed by three prominent contemporary Muslim male reformist scholars, both Shī’ī and Sunnī, in developing gender equality affirmative interpretations of Islam – Nasr Abu Zayd, Mohsen Kadivar, and Khaled Abou El Fadl. The focus on male scholars in this article is intentional and seeks to highlight the most fundamental point and indeed the raison d’être behind it, namely to underscore the historically unprecedented support Muslim male scholars are providing to the development of feminist interpretations of Islam. Hardback, €77.99.Very few unpublished PhD dissertations have had a formative influence on a field. One of the precious few is Larry Miller's Princeton dissertation from (...) 1984 on Islamic disputation theory. It proposed an original and compelling account of the development of the discipline, from the earliest extant Arabic works in the tenth century to the composition of classic madrasa handbooks in the late thirteenth century. It has been cited regularly in the past decades and has served as the starting point for all later studies of Arabic/Islamic dialectics in European languages. The fact that it has finally been published is a fitting tribute to a study that is even more admirable for having been written when many of the primary sources were still only available as manuscripts.Part of the explanation for why the dissertation was not published sooner may be that its author did not pursue an academic career. And as he states in a short preface, he has not kept abreast of all relevant studies and editions that have appeared since his dissertation. A thorough revision and update has therefore not been possible. Though some minor corrections and revisions have been made, the book is still by and large the influential 1984 dissertation, now made available with a short introduction by Walter Young, one of the leading younger scholars in the field, along with helpful indices of proper names and subjects.Miller's narrative begins with Arabic works on disputation (jadal) by a number of theologians from the late ninth and tenth centuries, such as Ibn al-Rāwandī (d. 911), [End Page 518] al-Ash'arī (d. 935), and the Karaite Jewish scholar al-Qirqisānī (d. ca. 960). The basic assumption was that a questioner (sā'il) would ask a claimant (mu'allil) (i) what his view is; (ii) what the ground or reason ('illa) for that view is; (iii) the appropriateness of the ground/reason for the view; and (iv) to verify the ground/reason by showing it to be commensurate with the view. The ground/reason for the theological dialecticians was standardly an entity or property, not a premise. The reasoning tended to be informal and analogical, as opposed to explicitly making syllogistic deductions from quantified premises.Parallel to this theological tradition of jadal, there was an Arabic Aristotelian tradition that took its point of departure from Aristotle's Topics, translated into Arabic more than once in the period from the late eighth to the early tenth centuries. Though also often referred to as jadal, this tradition, represented by the writings of al-Farabi (d. 950), Avicenna (d. 1037), and Averroes (d. 1198), retained distinct features. It tended to deny any epistemic value to dialectics, instead seeing it as useful only insofar as it provided logical training. For the Aristotelian/Neoplatonic philosophers, the pursuit of truth was the preserve of demonstrative syllogism (burhān). Whereas the theological dialecticians envisaged a claimant (mu'allil) and a questioner (sā'il), with the burden of proof on the former, the philosophical tradition had a questioner (sā'il) seek, in the manner of Socratic elenchus, to elicit from a respondent (mujῑb) a series of answers that would allow the construction of a syllogism whose conclusion contradicted the respondent's initial position.From the time of al-Ghazali (d. 1111), Islamic theologians tended to take over the syllogistic ideal of reasoning from the philosophers, perhaps explaining why theological writings on jadal trail off after the eleventh century. The informal, analogical jadal tradition continued, however, in the writings of Islamic jurists. From the eleventh century, scholars such as Abū Isḥāq al-Shīrāzī (d. 1083) and al-Juwaynī (d. 1085) wrote works on jadal in which the examples are disputes about questions of Islamic law and the disputants are partisans of the various legal schools. Even though health care provider reporting of diseases to public health authorities is common, often there is under-reporting by providers, including for notifiable diseases; frequently, under-reporting occurs by wide margins. Two causal factors for this under-reporting by providers have been that: disclosing data may violate their patients’ privacy, and disclosed data may be used to evaluate their performance. A reluctance to disclose information due to privacy concerns exists despite the U.S. Health Insurance Portability and Accountability Act Privacy Rule permitting disclosures (...) of personal health information for public health purposes without patient authorization. On the other hand, such patient privacy concerns are somewhat justified: there have been documented breaches of patient information from public health data custodians.A common way to address this privacy issue is to de-identify patient data before it is disclosed to public health. The use of automation in cars is increasing. In future vehicles, drivers will no longer be in charge of the main driving task and may be allowed to perform a secondary task. However, they might be requested to regain control of the car if a hazardous situation occurs. Performing a secondary task might increase drivers' mental workload and consequently decrease the takeover performance if the workload level exceeds a certain threshold. Knowledge about the driver's mental state might hence be useful (...) for increasing safety in conditionally automated vehicles. Measuring drivers' workload continuously is essential to support the driver and hence limit the number of accidents in takeover situations. This goal can be achieved using machine learning techniques to evaluate and classify the drivers' workload in real-time. To evaluate the usefulness of physiological data as an indicator for workload in conditionally automated driving, three physiological signals from 90 subjects were collected during 25 min of automated driving in a fixed-base simulator. Half of the participants performed a verbal cognitive task to induce mental workload while the other half only had to monitor the environment of the car. Three classifiers, sensor fusion and levels of data segmentation were compared. Results show that the best model was able to successfully classify the condition of the driver with an accuracy of 95%. In some cases, the model benefited from sensors' fusion. Increasing the segmentation level increased the performance of the model for windows smaller than 4 min, but decreased for windows larger than 4 min. In conclusion, the study showed that a high level of drivers' mental workload can be accurately detected while driving in conditional automation based on 4-min recordings of respiration and skin conductance. Background Despite the implementation of codes and declarations of medical research ethics, unethical behavior is still reported among researchers. Most of the medical faculties have included topics related to medical research ethics and developed ethical committees; yet, in some cases, unethical behaviors are still observed, and many obstacles are still conferring to applying these guidelines. Methods This cross-sectional questionnaire-based study was conducted by interviewing randomly selected 331 Lebanese physicians across Lebanon, to assess their awareness, knowledge and attitudes on practice regarding (...) international and national research ethics guidelines and scientific misconduct and misbehaviors. Results Our results revealed that although majority of participants declared familiar with ethical principles governing research that involves human subjects, the overall mean score achieved on their knowledge questions was 46%. Only 27.4% are aware of the presence of the Lebanese National Consultative Committee on Ethics, with only half of them aware of its functions and only 25.7% know about the charter of ethics and guiding principles of scientific research in Lebanon. Significant higher levels of research ethics knowledge were recorded among Ph.D. degree-holding subjects, higher university positions as in professors, research ethics trainings-attendees, and physicians with prior research experience. A significant correlation was observed between knowledge of research ethics principles and positive attitudes toward research ethics principles. Noteworthy, we found that more than one third of participants have reported witnessing scientific misconduct and misbehaviors at some period of their careers. Conclusions The presence of low mean awareness levels regarding research ethical principles among the study population of physicians and high levels of perception of scientific misconduct raises concern on the importance of implementing proper training for physicians on research ethics. The increased use of human biological material for cell-based research and clinical interventions poses risks to the privacy of patients and donors, including the possibility of re-identification of individuals from anonymized cell lines and associated genetic data. These risks will increase as technologies and databases used for re-identification become affordable and more sophisticated. We investigate and analyze the dynamics of hepatitis B with various infection phases and multiple routes of transmission. We formulate the model and then fractionalize it using the concept of fractional calculus. For the purpose of fractionalizing, we use the Caputo–Fabrizio operator. Once we develop the model under consideration, existence and uniqueness analysis will be discussed. We use fixed point theory for the existence and uniqueness analysis. We also prove that the model under consideration possesses a bounded and positive solution. (...) We then find the basic reproductive number to perform the steady-state analysis and to show that the fractional-order epidemiological model is locally and globally asymptotically stable under certain conditions. For the local and global analysis, we use linearization, mean value theorem, and fractional Barbalat’s lemma, respectively. We show that the conceptual distance between any two theories of first-order logic is the same as the generator distance between their Lindenbaum–Tarski algebras of concepts. As a consequence of this, we show that, for any two arbitrary mathematical structures, the generator distance between their meaning algebras (also known as cylindric set algebras) is the same as the conceptual distance between their first-order logic theories. As applications, we give a complete description for the distances between meaning algebras corresponding to structures (...) having at most three elements and show that this small network represents all the possible conceptual distances between complete theories. As a corollary of this, we will see that there are only two non-trivial structures definable on three-element sets up to conceptual equivalence (i.e., up to elementary plus definitional equivalence).
