The paper discusses inappropriate (futile) treatment by analyzing the casuistics of palliative patients in the terminal stage of illness who are hospitalized at the Department of Internal Medicine and Geriatrics of the Faculty hospital with policlinic (FNsP). Our research applies the principles of palliative care in the context of bioethics. The existing clinical conditions of healthcare in Slovakia are characteristic of making a taboo of the issues of inappropriate treatment of palliative patients. Inductive-deductive and normative clinical bioethics methods of palliative (...) care and ethical strategy are applied for defining issues found in inappropriate hemodialysis treatment. An algorithm of hemodialysis treatment requires the definition of those lege artis criteria which, in the context of a patient’s autonomy and his/her decision, precondition the avoidance of the situation in which hemodialysis treatment is inappropriate (futile). Futile treatment in a terminal condition is ethically inappropriate medical treatment that extends the suffering of patients and their relatives. Its definition is determined by the relevant legislation and the methods of bioethics. An active palliative strategy is aimed at managing the process of incurable diseases in the patient’s bio-psycho-socio-spiritual continuity in the process of special bioethics. The global bioethical objective of general bioethics for palliative care is based on the paradigm of social harmony and solidarity in the context of an authentic modus of the patient’s existence as a constitutive principle for the phenomenon of the patient’s being to finite being (death). Bioethical phenomena of current medicine re-evaluate the universal validity of the bioethical principles of autonomy and justice. Individual areas of medicine feature various degrees of inherent paternalism in clinical situations. External paternalism in itself is not ethical. Abstract principles of medical ethics need to be (re)interpreted. From the bioethical point of view, clinical situations require methodological plurality, i.e., a combination of principilism and inductive models (casuistic ethics, ethics of care). Case studies are used to reflect on the treatment of patients with dementia hospitalized at the Geriatric Department of the Faculty hospital in Prešov, emphasizing human dignity in clinical practice. The discussion is focused on the palliative care of patients with severe dementia. The biomedical method, which respects human dignity is defined by means of inductive, deductive, and normative bioethical methods. They make it possible to provide guidelines for palliative care and individualized prognosis strategy. An analysis of health status of (...) individuals with severe dementia enables us to offer a clinical definition of purposeful treatment based on normative justice and decision-making that reflects the patient’s best interest, thus respecting their dignity. An evaluation of a patient’s care is based on a biomedical method that considers the dementia stage. Applying a bioethical model in a holistic context preconditions the human rights of patients with dementia. (shrink)

The paper discusses the problem of triaging the elderly in the period of the COVID-19 pandemic crisis by analyzing the triage process, caused by lack of resources, in Germany, Holland, the Czech Republic, and Slovakia. We apply inductive, deductive, and normative bioethical methods, comment on various recommendations for the indication of intensive care during a crisis, and discuss the utilitarianism of benefit maximization. As it follows from the evaluation of the elderly by the frailty parameter, medically inappropriate treatment, as a (...) result of limited resources, is characterized by clinical and bioethical uncertainty. If the main bioethical objective of general bioethics for the COVID-19 pandemic is, in the case of limited resources, based on the non-utilitarian consequentialism paradigm, from the perspective of medical ethics, we face a borderline situation closely related to the topic of dying and death. Such a situation requires social, ethical, and professional reflection. An algorithm for intensive care indication in the situation of crisis and limited resources in the period of the pandemic requires a definition of criteria that identify an acceptable reason for abandoning the treatment in the context of the autonomy of the elderly and by respecting their human dignity and humanity. A global objective of general bioethics in the situation of the pandemic crisis should be based on the paradigm of social justice. (shrink)

Relying on Husserl as well as on the reflections by Merleau-Ponty on Cézanne, Henry on Kandinsky and Deleuze on Bacon, this essay sketches some basic problems that arise in a phenomenological account of non-figurative painting. An investigation of the distinction between phenomenological and pictorial perception, of the transposition of the painter’s mode of perception into a painted image, and of the expressive force of paintings inevitably confronts one with the enigma of the appearing of something invisible. The essay proceeds in (...) three steps. The first step describes pictorial perception in terms of a ‘seeing according to’. Such a mode of perception pays attention to visual ambiguities, to the ‘gaze of things’ and to the conditions of visibility that are ordinarily overlooked. The second step moves on to the issue of the transposition of a pictorial perception in a painted image. Deleuze’s account of “manipulated chance” proves to be very helpful here. APA PsycNET abstract: This is the first volume of a two-volume work on Probability and Induction. Because the writer holds that probability logic is identical with inductive logic, this work is devoted to philosophical problems concerning the nature of probability and inductive reasoning. The author rejects a statistical frequency basis for probability in favor of a logical relation between two statements or propositions. Probability "is the degree of confirmation of a hypothesis (or conclusion) on the basis of some given evidence (...) (or premises)." Furthermore, all principles and theorems of inductive logic are analytic, and the entire system is to be constructed by means of symbolic logic and semantic methods. This means that the author confines himself to the formalistic procedures of word and symbol systems. The resulting sentence or language structures are presumed to separate off logic from all subjectivist or psychological elements. Despite the abstractionism, the claim is made that if an inductive probability system of logic can be constructed it will have its practical application in mathematical statistics, and in various sciences. 16-page bibliography. One of the most pressing points in the philosophy of sport is the question of a definition of sport. Approaches towards sport vary based on a paradigm and position of a particular author. This article attempts to analyse and critically evaluates a recent definition of sport presented by Jim Parry in the context of argument that e-sports are not sports. Despite some innovations, his conclusions are in many ways traditional and build on the previous positions. His research, rooted in the (...) conceptual analysis, starts with a stipulation that sport is paradigmatically Olympic sport. He defines it then as an ‘institutionalised, rule-governed contest of human physical skill’ i.e., identifies six necessary elements of sport: human (not animals), physical (not chess), skill (not jogging), contest (not mountaineering), rule-governed (not ‘field sports’), institutionalized (not hula-hooping). Our claim is that this definition, despite its methodological clarity, is not accurate and does not sufficiently represent sport outside the Olympic context. First, to say for something to be a sport it is necessary to be a contest leads to a narrow concept of sport. Secondly, Parry’s account lacks the emphasis on game and play-like structures that are inherently present in sport (even in the Olympic sport), namely non-necessity, non-ordinariness, arbitrariness and gratuitousness. We try to direct the attention precisely on these structures and offer an alternative account of sport understood as a modern ‘hard core’ sport that nevertheless reaches important congruences with Parry’s definition. The originality of this contribution lies in presenting the essential qualities of modern ‘hard core’ sports, which, although sometimes hidden in the modern emphasis on high level performances, competition, and results, play an important role in the question how sport ought to be played and approached. The first question asks under what conditions a sentence has meaning, in the sense of cognitive, factual meaning. The second one asks how we get to know something, how we can find out whether a given sentence is true or false. The second question presupposes the first one. Obviously we must understand a sentence, i.e. we must know its meaning, before we can (...) try to find out whether it is true or not. But, from the point of view of empiricism, there is a still closer connection between the two problems. In a certain sense, there is only one answer to the two questions. If we knew what it would be for a given sentence to be found true then we would know what its meaning is. And if for two sentences the conditions under which we would have to take them as true are the same, then they have the same meaning. Thus the meaning of a sentence is in a certain sense identical with the way we determine its truth or falsehood; and a sentence has meaning only if such a determination is possible. (shrink)

In 1632 Rodrigo de Arriaga, an important Baroque scholastic thinker, published a textbook in philosophy, of which the last revised and extended edition was published in 1669. Arriaga develops in it a peculiar theory of beings of reason, drawing on Pedro Hurtado de Mendoza, according to which beings of reason are that which is expressed by false judgments. It is a theory quite different from the classical theories held by Francisco Suárez, the Thomists and the majority of Scotists on the (...) one hand, and reductive theories held by Richard Lynch and a growing number of later Baroque authors on the other. The current paper addresses two methodological problems pertinent to the analysis of observer studies in nonverbal rapport and beyond. These problems concern: the production of standardized stimulus materials that allow for unbiased observer ratings and the objective measurement of nonverbal behaviors to identify the dyadic patterns underlying the observer impressions. We suggest motion capture and character animation as possible solutions to these problems and exemplarily apply the novel methodology to the study of gender and cultural differences in nonverbal rapport. We (...) compared a Western, individualistic culture with an egalitarian gender-role conception and a collectivistic culture with a more traditional gender role conceptions. Motion capture data were collected for five male and five female dyadic interactions in each culture. Character animations based on the motion capture data served as stimuli in the observation study. Female and male observers from both cultures rated the perceived rapport continuously while watching the 1 min sequences and guessed gender and cultural background of the dyads after each clip. Results show that masking of gender and culture in the stimuli was successful, as hit rates for both aspects remained at chance level. Further the results revealed high levels of agreement in the rapport ratings across gender and culture, pointing to universal judgment policies. A 2 × 2 × 2 × 2 ANOVA for gender and culture of stimuli and observers showed that female dyads were rated significantly higher on rapport across the board and that the contrast between female and male dyads was more pronounced in the Arab sample as compared to the German sample. nonverbal parameters extracted from the motion capture protocols were submitted to a series of algorithms to identify dyadic activity levels and coordination patterns relevant to the perception of rapport. A clarification of Husserl's changing conceptions of imaginary consciousness ( phantasy ) and memory, especially at the level of auto-affective time-consciousness, suggests an interpretation of Freud's concept of the Unconscious. Phenomenology of consciousness can show how it is possible that consciousness can bring to present appearance something unconscious, that is, something foreign or absent to consciousness, without incorporating it into or subordinating it to the conscious present. This phenomenological analysis of Freud's concept of the Unconscious leads to a partial critique (...) of Freud's metapsychological determination of the Unconscious as a simple, internally unperceived representational consciousness. It also suggests an account of how a reproductive inner consciousness can free the subject from the experience of anxiety by allowing for possibilities of self-distanciation and symbolic self-representation that protect the subject from traumatic affection by and through its own instinctual drives.
