In this paper, I plan to show that the use of a specific population concept—Millstein’s Causal Interactionist Population Concept (CIPC)—has interesting and counter-intuitive ramifications for discussions of the reality of biological race in human beings. These peculiar ramifications apply to human beings writ large and to individuals. While this in and of itself may not be problematic, I plan to show that the ramifications that follow from applying Millstein’s CIPC to human beings complicates specific biological racial realist accounts—naïve or otherwise. I conclude with the notion that even if biological races do exist—by fulfilling all of the criteria needed for Millstein’s population concept (which, given particular worries raised by Gannett (Synthese 177:363–385, 2010), and Winther and Kaplan (Theoria 60:54–80, 2013) may not)—the lower-bound limit for the scope of biological racial realism is at the level of populations, and as such they cannot say anything about whether or not individual organisms themselves have races. Legal norms serve as practical standards for individuals and officials. While this ‘normative aspect’ of law is widely acknowledged, its significance for theories of law remains contested. In this paper, I examine three views on the matter. First, that we should explain legal norms as reason-giving. Second, that we should explain legal discourse as being about reasons for action. Third, that we should explain law as capable of being reason-giving. I survey some challenges associated with each of these views. What (...) they have in common is an implicit assumption about the form that normative explanation must take: that it must be a linear, non-reductive explanation. There is an alternative model for normative explanation available, however. That model explains normative notions in terms of the practices and attitudes involved in recognizing, offering, and demanding them. This chapter aims to bring to the fore some of the ontological presuppositions that undergird the concepts of race and racism as they are used in public health. Included are discussions of differing accounts for race in public health, the ways in which racism is understood to be a public health issue, and where future research in public health, as it relates to the concepts of race and racism, is headed.

This paper is a response to a certain sort of argument defending the rights of animals. Part I is a brief explanation of the background and of the sort of argument I want to reject; Part II is an attempt to characterize those arguments: they contain fundamental confusions about moral relations between people and people and between people and animals. And Part III is an indication of what I think can still be said on—as it were–the animals' side.

Originally published in 1971 by Winthrop Publishers, Inc., this volume provides a discussion and analysis of the theory of natural law as it appears in contemporary political and social thought. This theory of natural law was used from the fifth century B.C. until the end of the eighteenth century to provide a universal, rational standard to determine the nature and limits of political obligation, the evaluation of competing forms of government, and the relation of law and politics to morals.

Wittgensteinian ethics, it may be thought, is committed to detailed examination of realistically described cases, and hence to eschewing the abstract hypothetical cases, many of them quite bizarre, found in much contemporary moral theorizing. I argue that bizarre cases may be helpful in thinking about ethics, and that there is nothing in Wittgenstein's approach to philosophy that would go against this. I examine the case of the ring of Gyges from the Republic; and I consider also some contemporary arguments about (...) thought-experiments in philosophy. (shrink)

There is a natural view of nonsense, which owes what attraction it has to the apparent absence of alternatives. In Frege and Wittgenstein there is a view which goes against the natural one, and the purpose of this paper is to establish that it is a possible view of nonsense.

Beyond the Pleasure Principle is Freud's most philosophical and speculative work, exploring profound questions of life and death, pleasure and pain. In it Freud introduces the fundamental concepts of the "repetition compulsion" and the "death drive," according to which a perverse, repetitive, self-destructive impulse opposes and even trumps the creative drive, or Eros. The work is one of Freud's most intensely debated, and raises important questions that have been discussed by philosophers and psychoanalysts since its first publication in 1920. This article explores the tension between competing discourses within the European Union, as this regional trading bloc seeks to capture further gains from market integration, whilst simultaneously attempting to soften the social impact of regional competition within its borders. This article analyzes the difficulty of maintaining the European social model, or a revised version of it, in the context of increased market integration. Through a close reading of two cases decided by the European Court of Justice in 2007, the article (...) interrogates the extent to which discourses on social rights at the EU level can be made sufficiently robust to ensure the application of international or national labor standards as a buttress against increasingly mobile capital, in order to prevent “social dumping." It concludes, however, that the terms on which the foundational texts of the EU integration project operate—elevating “market" rights to equal, fundamental, status with social and labor rights—means that the exercise of social rights such as the right to strike is ultimately contingent on their compatibility with market integration. The use of certain performance-enhancing drugs (PED) is banned in sport. I discuss critically standard justifications of the ban based on arguments from two widely used criteria: fairness and harms to health. I argue that these arguments on their own are inadequate, and only make sense within a normative understanding of athletic performance and the value of sport. In the discourse over PED, the distinction between “natural” and “artificial” performance has exerted significant impact. I examine whether the distinction makes sense (...) from a moral point of view. I propose an understanding of “natural” athletic performance by combining biological knowledge of training with an interpretation of the normative structure of sport. I conclude that this understanding can serve as moral justification of the PED ban and enable critical and analytically based line drawing between acceptable and nonacceptable performance-enhancing means in sport. This meta-study applies a socio-semiotic framework combining five basic communicational aspects, form, content, act, time, and space, developed to help answering the questionCan animals refer?It further operates with four levels, sign, utterance, genre, and lifeworld, studying relations between utterance and genre in particular. Semantic key terms found in an excerpted ‘resource collection’ consisting of three anthologies, two academic journals, and a monography, studying content in animal communication, are inspected, and discussed, especially information, functional reference, and reference. Since a temporary inspection (...) concluded that the field seems unable to give convincing joint answers, the scope of the meta-study was extended to include critical investigations of implicit communicational epistemologies applied in the sources. Two major challenges were brought to surface. Firstly, the problem of conflicting interrelatedness in animal utterances (parts versus whole). Positioning analyses revealed that theories and project-designs were mostly dyadic, prioritising form/content, content/function, or function/form, and rarely form/content/function, as a whole. The second concerned the issue of functional openness of animal communication systems. The meta-study found that more recent studies tend to reduce an essentialist search for ‘clear’ categories in favor of more complex designs, where focus is less on references in utterances as such and more on a species’ communicational system. This shift in turn leads to a problematisation of the role of context, kinds of communication (life-genres) and semantic levels in animal utterances, in other words, on animal communication for particular species as a whole. Although this study inspects context in general, it is even intended as a prerequisite for a meta-study of contextual time&space in zoo-communication. Moving the scope from linguistics to culture, communication, and semiotics may reveal new similarities between context-perceptions. Paradigmatic historical moves and critical context theories are inspected, asking whether there is a least-common-multiple for perceptions of context. The short answer is that context is relational – a bi-product of attention from a position, creating a focused object, and hence an obscured (...) (back-)ground – the attention’s context. A more comprehensive one is that when the focused phenomenon is culture, semiotics, or communication, context becomes embodied. This recognition triggers new questions: What is the relation between embodied, immanent context and this perception’s external, physical context (its surroundings)? If utterances are regarded as constituted by the triad form-content-act and the dyadic chronotope time&space, what and where is then context? Which challenges will empirical (zoo-)communicational research face if context is split in internal and external versions of context? These questions raise some epistemological and methodological issues. These are discussed based on a framework that regards communication as a micro-macro interplay between utterance and genre. Genres are kinds of communication. More specifically animal genres related to their basic life-functions are called life-genres. A conclusion is that life-genres function as both mental and situational contexts. This complicates empirical research on communication in general, and zoo-communication in particular. The paper concludes that contexts’ relational and embodied nature and the ‘situational’ characteristics of life-genres challenge researchers to validate continuously, shifting between contextualising, decontextualising, and recontextualising. This meta-study of animal semantics is anchored in two claims, seemingly creating a fuzzy mismatch, that animal utterances generally appear to be simple in structure and content variation and that animals’ communicative understanding seems disproportionally more advanced. A set of excerpted, new studies is chosen as basis to discuss whether the semantics of animal uttering and understanding can be fused into one. Studies are prioritised due to their relatively complex designs, giving priority to dynamics between syntax, semantics, pragmatics, and between (...) utterers and receivers in context. A communicational framework based on utterance theory is applied as a lens for inspection of how these aspects relate to the assumed mismatch. Inspection and discussions of the studies bring several features to surface of which five are stressed in the following. Firstly, both syntactic structures and possible semantic content are seen as lean, although richer than earlier believed, and research continues to reveal new complexities in utterances. Secondly, there is a clear willingness to broaden the perception of animals’ semantic capacity to comprehend communication both by arguing theoretically and by generating empirical research in new contexts. Thirdly, the ambition to make sense of these tendencies is still often motivated by an evolutionary search for early building blocks for verbal language, with the pro et cons that such a position can have. Fourthly, the ‘allowed’ scientific frame for studying semantic capacity among animals is extended to new fields and contexts challenging the only-in-the-wild norm. Fifthly, the dilemma of integrating uttering and understanding as aspects of an after all functional communicational system, calls for new epistemological concepts to make sense of the claimed mismatch. P.M.S. Hacker has argued that there are numerous misconceptions in James Conant's account of Wittgenstein's views and of those of Carnap. I discuss only Hacker's treatment of Conant on logical syntax in the _Tractatus. I try to show that passages in the _Tractatus which Hacker takes to count strongly against Conant's view do no such thing, and that he himself has not explained how he can account for a significant passage which certainly appears to support Conant's reading.

Sigmund Freud, the founder of psychoanalysis, declared that religion is a universal obsessional neurosis in his famous work of 1927, The Future of an Illusion. This work provoked immediate controversy and has continued to be an important reference for anyone interested in the intersection of philosophy, psychology, religion, and culture. The introduction claims that there might exist an evolutionary bridge from possible genres in nature to human cultural genres. A sub-hypothesis is that basic life-conditions, partly common for animals and humans, in the long run can generate so-called life-genres. To investigate such hypotheses a framework of interrelated key communicational concepts is outlined in the second, main part. Four levels are suggested. Signs are seen as elements in utterances. Further, sufficiently similar utterances can be perceived as kinds of utterances or genres. (...) Genres are kinds of communication in a species' life-world. Utterance and genre are the framework’s key concepts. Both are seen as products and processes and as constituted by five reciprocal aspects: form, content, act, time, and space, the necessary elements to initiate and interpret communication. A model illustrates this integrative principle. Part three dwells with the idea of life-genres, and part four exemplifies and problematises how a chimpanzee’s ‘begging’ for meat, a fish’s nest-making, and kinds of birdsongs, could be seen as possible life-genres. The idea of a fundamental difference between humans and animals may be used to justify subordinating animals to human interests. The presupposition that may need to be examined is that the moral relation to animals must be based on some fundamental property. Much of the discussion concerning animal awareness is framed in Cartesian terms, suggesting that a different perspective might be helpful in improving human-animal relationships and understanding.

According to the Differences of Sex Development Regulations of the International Association of Athletics Federations, Caster Semenya and other athletes with heightened testosterone levels are considered non-eligible for middle distance running races in the women’s class. Based on an analysis of fair equality of opportunity in sport, I take a critical look at the Semenya case and at IAAF’s DSD Regulations. I distinguish between what I call stable and dynamic inequalities between athletes. Stable inequalities are those that athletes cannot impact (...) or control in any significant way such as inequalities in biological sex, body size and chronological age. Dynamic inequalities, such as inequalities in strength, speed and endurance, or in technical and tactical skills, can be impacted and to a certain extent controlled by athletes. If stable inequalities exert significant and systematic impact on performance, they provide a rationale for classification. If high testosterone level is an inborn, strong and systemic driver of performance development, inequalities in such levels can provide a rationale for classification. As is emphasised by the Court of Arbitration for Sport, this leads to a dilemma of rights: the right of Semenya to compete in sport according to her legal sex and gender identity, and the right of other athletes within the average female testosterone range to compete under fair conditions. I conclude with providing conditional support of the CAS decision in the Semenya case and of IAAF’s DSD Regulations. (shrink)

_Philosophy and Animal Life_ offers a new way of thinking about animal rights, our obligation to animals, and the nature of philosophy itself. Cora Diamond begins with "The Difficulty of Reality and the Difficulty of Philosophy," in which she accuses analytical philosophy of evading, or deflecting, the responsibility of human beings toward nonhuman animals. Diamond then explores the animal question as it is bound up with the more general problem of philosophical skepticism. Focusing specifically on J. M. Coetzee's (...) _The Lives of Animals_, she considers the failure of language to capture the vulnerability of humans and animals. The book stands somewhat apart from the rest of Freud's writings as a study of normal, rather than pathological psychology, and, although it contains the most closely reasoned accounts of complicated psychological processes that Freud ever gave, it remains one of his most readable works. It includes a rich collection of jokes, particularly those of Jewish folk tradition, in which Freud clearly revelled.

Sport occupies a significant role in modern society and has a wide following. In his Leftist Theories of Sport, Morgan examines what he considers to be a degradation of modern sport and the lack of proper critical theory to address this challenge. In the latter part of LTS, Morgan presents a reconstructed critical theory with ‘a liberal twist’ in terms of an analysis of what he sees as the internal ‘gratuitous’ logic of sport, and a call for critical deliberation in (...) sporting practice communities. I depart from Morgan’s ideas of the ‘gratuitous’ logic of sport which, I believe, has significant potential and operative force. I interpret the logic of sport as forms of self-imposed constraints at three levels: in the logic of the rules, in norms for fair play, and in a particular interpretation of sporting excellence as a form of human excellence. Even today the "immaterialist" philosophy of George Berkeley , the Irish bishop, has the power to fascinate: with its apparent idiosyncratic and uncompromisingly idealistic colouring. However, with respect to his radically subjectivist, possibly even solipsist understanding of the time issue, even sympathizers of the philosopher normally share George Pitcher's opinion, according to which this element of his theory constitutes "a total disaster". – The following article entails a résumé of Berkeley's theory of time. The obviously courageous attempt is made, then, (...) to give a text-based interpretation with the aim to avoid "disastrous" consequences. This plan proves to be a difficult task indeed, but nevertheless in the end it is shown that a theistic interpretation in union with a 'Kantian' reading of a central statement of Berkeley's can avoid the aforesaid consequences. – From a historical perspective, this philosophy of time turns out to be a counterpart to Leibniz's critique of the Newtonian perspective of time, as both are documented above all in the famous correspondence with Newton's friend Samuel Clarke. That Berkeley and Leibniz really share common philosophical ground is also shown by the latter's marginal note in his personal edition of the formers Principles of Human Understanding: "Much of this is correct and just as I'd have said".
