The defining characteristics anticipated for any prospective psychophysically neutral language are explored in this essay through the analysis and comparison of two previous approaches. The idea of a psychophysically neutral language was first articulated byWolfgang Pauli in the context of the dual-aspect theory of mind and matter that he developed with C.G. Jung. The first approach discussed is George Spencer Brown's Laws of Form. An overview is given, followed by a review of the critical responses and extensions of the work, (...) particularly Francisco Varela's attempt to use it to formalize biological autopoiesis and Louis Kaufman's development of Brownian algebra. The mathematical basis of Spencer Brown's calculus and its philosophical assumptions and implications are then investigated. The second approach discussed is Marie-Louise von Franz's Number and Time, an investigation of number archetypes through which she continued the inquiry begun by Jung and Pauli. The central tenets of her work are summarized and critically evaluated, and a comparison with Spencer Brown's work is carried out. Finally, implications are drawn for any future attempt to formulate a psychophysically neutral language. (shrink)

National electronic identity (e-ID) card schemes and electronic identity management systems (e-IDMS) in Europe are characterised by considerable diversity. This contribution analyses the creation of a national e-IDMS in Austria with the aim of improving our understanding of the reasons behind the genesis of particular designs of national e-IDMS. It seeks to explain how the system’s specific design evolved and which factors shaped its appearance. Being part of a comparative four country study, a common theoretical framework is employed to (...) allow for a comparison of national e-IDMS in Austria, Belgium, Germany and Spain. It combines the approach of actor-centred institutionalism and the concept of path dependence in order to analyse the innovation process and to explain resulting key characteristics of the e-IDMS in Austria: a technology-neutral system with multiple tokens; an ID model based on the Central Register of Residents; a privacy concept using sector-specific personal identifiers. It is shown that innovation process and outcome are not only shaped by specific actor constellations dominated by strategic e-government bodies, but also by path dependence at three levels: technological, institutional and organisational. Smell denomination and identification are well-known issues. Our first interest of study within this subject field is the denominative situation including names of odors. These are not real odoronyms but they are divided into two categories: on one hand, general names are functioning as the noun “odor” and on the other hand, fake names of smells are fulfilling the role of specifying odors. Secondly we will argue that particuliar and specific odors are usually identified through “odor of N”. In the present paper we empirically investigate the psychometric properties of some of the most famous statistical and logical cognitive illusions from the “heuristics and biases” research program by Daniel Kahneman and Amos Tversky, who nearly 50 years ago introduced fascinating brain teasers such as the famous Linda problem, the Wason card selection task, and so-called Bayesian reasoning problems (e.g., the mammography task). In the meantime, a great number of articles has been published that empirically examine single cognitive illusions, (...) theoretically explaining people’s faulty thinking, or proposing and experimentally implementing measures to foster insight and to make these problems accessible to the human mind. Yet these problems have thus far usually been empirically analyzed on an individual-item level only (e.g., by experimentally comparing participants’ performance on various versions of one of these problems). In this paper, by contrast, we examine these illusions as a group and look at the ability to solve them as a psychological construct. Based on an sample ofN= 2,643 Luxembourgian school students of age 16–18 we investigate the internal psychometric structure of these illusions (i.e., Are they substantially correlated? Do they form a reflexive or a formative construct?), their connection to related constructs (e.g., Are they distinguishable from intelligence or mathematical competence in a confirmatory factor analysis?), and the question of which of a person’s abilities can predict the correct solution of these brain teasers (by means of a regression analysis). Adults without the capacity to make their own medical decisions have their rights protected under the Mental Capacity Act in the UK. The underlying principle of the court's decisions is the best interests test, and the evaluation of best interests is a welfare appraisal. Although the House of Lords in the well-known case of Bland held that the decision to withhold treatment for patients in a persistent vegetative state should not be based on their best interests, judges in recent cases (...) have still held that the best interests of persistently vegetative patients demand that the right to die with dignity prevails over society's interest to preserve life. The basis of suggesting that it is in the best interests for one who is alive in peace to die in peace is weak. Even if it may not be in their best interests to live on, it may not be so to die either. The phrase ‘the right to dignity/to die with dignity’ has been misused as a trump card to justify the speculation that a vegetative patient would necessarily refuse to live on machines. Without disrespect to the court's decision, we argue that the use of the best interests test to authorise withdrawing/withholding treatment from persistently vegetative patients without an advance directive is problematic. We propose that the court could have reached the same decision by considering only the futility of treatment without working through the controversial best interests of the patient. (shrink)

The adage “an ounce of prevention is worth a pound of cure” is widely used in healthcare settings and can be applied to the work of institutional clinical ethics committees. The model of clinical ethics consultation, however, is inherently reactive: a crisis or question emerges, and ethics experts are called to help. In an effort to employ a proactive component to the model of clinical ethics consultation (as well as to standardize our educational interventions), we developed ethics pocket cards. The (...) purpose of this article is to: (1) describe the rationale for using ethics pocket cards, (2) provide examples of our cards, and (3) begin a dialogue about the potential uses of ethics pocket cards. Anthropologists have tended to treat dreams as private fantasies arising from restless libidos struggling with reality. In this view, the dreamer is a victim of what she or he does not want, the intentions of the dreamer, and dreamed of, are often confused or illusory, and what happens in the dream is subj ect to a more primary, more objective, waking reality.The Barok people of New Ireland, Papua New Guinea, define dreams as both sleeping and waking experiences. Their dreams are (...) expressions of spiritually powerful persons who deal with a spiritual reality.In waking and real, but substantially dreamlike experiences such as one I describe in this paper, the desires and intents of all involved were perceived as wild possibilities. In the three sleeping dreams that I describe, the desires and intents of the dreamers were true, clearly expressed, and effective in creating or foretelling reality.Describing such subjective and willful experiences entails personal and professional risk. But toward understanding what happened, I undertake this in personally revealing terms, and I recommend Barok and other Native perspectives for the light they shed on dreams and reality.Social science has, for the most part, left dream analysis to the psychologists, and dreaming experiences to "the natives.” People educated in modern European traditions, and especially in academe, learn to not talk plainly or too much about their more subjective experiences or awarenesses, e.g, sex, emotions, and dreams. This applies not only to our lives as fieldworkers, but to our private lives in Western culture.Even recent publications1 still define dreams as a softer and more subjective, or even false, too private, in contrast to the harder and more objective, true reality of waking life (see Tedlock 1987). From this perspective, the accepted truth of there being an objective, socially defined, wakeful reality is not seriously called into question.Fieldwork experiences have shown me different distinctions between dreaming and not‐dreaming realities. I have learned to both expect and get more from dreams. I did not seek nor intentionally precipitate these experiences. They were a congruent part of my learning during four different periods of fieldwork.These experiences suggest a link between the ambiguity of intent in western style, non‐Native2 dreamers, and a lack of creative power. This contrasts with the clarity in the intent of Native style dreamers, and a real creative power.This link short‐circuits conventional academic distinctions between dreaming and waking experiences. For this reason, people like myself have not paid attention to these kinds of field experiences, much less written them up. We fear being disbelieved and discredited. Treating dreams on a comparable footing with objective reality is tantamount to "going native.”3 As Katherine Ewing has stated it, the problem is how to believe the Native meaning of dreams in defiance of the taboo against anthropologists' accepting the "temptation to believe" that "the subjects of one's research actually know something about the human condition and an encompassing 'reality'"(Ewing 1994:572).The field experiences I describe here have made me a believer of both the Native version of what happened, and the truth of there being an encompassing (Native) reality.4 They also convinced me of the necessity of trying to deal openly with what I know of the internal, private, libidinous, and willful stuff that is a part of these dreaming experiences. I reveal my own intent, desires, and needs, in both personal and professional terms, in order to lay some of the cards on the table, in order to look at them from both Native and non‐Native perspectives on what happened.I have learned that the difference between dreams and reality is not what it has been made out to be. On the one hand, the conventional definition of reality too strongly limits my ability to talk about my subjective experiences of it. On the other hand, the conventional definition of dreams does not make enough sense of my real experiences.By describing the real, non‐dreaming experience in which my subjective feelings are centered, the problematic issues of my own wakeful intent as a person and as an anthropologist are centered. This allows comparison of what is supposedly the nature of waking reality with what I experienced in the three sleeping dreams (hereafter "sleepdreams") which follow.The first three sleepdreams were experienced when I was living among Barok people at New Ireland, PNG, between 1979 and 1985. The doctrine of consent is built upon presumptions of mental capacity. Those presumptions must be tested according to legal rules that may be difficult to apply to COVID-19 patients during emergency presentations. We examine the principles of mental capacity and make recommendations on how to assess the capacity of COVID-19 patients to consent to emergency medical treatment. We term this the CARD approach.

What distinguishes evils from ordinary wrongs? Is hatred a necessarily evil? Are some evils unforgivable? Are there evils we should tolerate? What can make evils hard to recognize? Are evils inevitable? How can we best respond to and live with evils? Claudia Card offers a secular theory of evil that responds to these questions and more. Evils, according to her theory, have two fundamental components. One component is reasonably foreseeable intolerable harm -- harm that makes a life indecent and (...) impossible or that makes a death indecent. The other component is culpable wrongdoing. Atrocities, such as genocides, slavery, war rape, torture, and severe child abuse, are Card's paradigms because in them these key elements are writ large. Atrocities deserve more attention than secular philosophers have so far paid them. They are distinguished from ordinary wrongs not by the psychological states of evildoers but by the seriousness of the harm that is done. Evildoers need not be sadistic:they may simply be negligent or unscrupulous in pursuing their goals. Card's theory represents a compromise between classic utilitarian and stoic alternatives (including Kant's theory of radical evil). Utilitarians tend to reduce evils to their harms; Stoics tend to reduce evils to the wickedness of perpetrators: Card accepts neither reduction. She also responds to Nietzsche's challenges about the worth of the concept of evil, and she uses her theory to argue that evils are more important than merely unjust inequalities. She applies the theory in explorations of war rape and violence against intimates. She also takes up what Primo Levi called "the gray zone", where victims become complicit in perpetrating on others evils that threaten to engulf themselves. While most past accounts of evil have focused on perpetrators, Card begins instead from the position of the victims, but then considers more generally how to respond to -- and live with -- evils, as victims, as perpetrators, and as those who have become both. George Berkeley (1685-1753) is the superstar of Irish Philosophy. He entered Trinity College, Dublin, in 1700 and became a fellow in 1707. In 1724 he resigned his Fellowship to become Dean of Derry, and in 1734 he was made Bishop of Cloyne. He settled in Oxford in 1752 and died the following year. The work of George Berkeley is marked by its diversity and range. His writings take in such topics as mathematics, psychology, politics, health, economics, deism and education, as (...) well as that with which he is most associated - philosophy. Whatever topic he dealt with, his grasp of the subject matter was always impressive and his criticisms of his contemporaries often acute. Among the most noteable of the British Empiricists, he took his starting point from Locke's new 'way of ideas', but he rejected abstract ideas and the possibility of real existence outside perception. It is for this doctrine that he is most known - that there is no such thing as matter, and that things are collections of ideas which can exist only in our minds and only for so long as they are perceived. This philosophy, summed up in his phrase 'to be is to be perceived', he termed 'immaterialism'. A.C. Fraser's collection includes a series of what were previously unpublished notes by Berkeley on all the main topics of his philosophy. This essay argues that current advocacy of lesbian and gay rights to legal marriage and parenthood insufficiently criticizes both marriage and motherhood as they are currently practiced and structured by Northern legal institutions. Instead we would do better not to let the State define our intimate unions and parenting would be improved if the power presently concentrated in the hands of one or two guardians were diluted and distributed through an appropriately concerned community.

Berkeley's idealism started a revolution in philosophy. As one of the great empiricist thinkers he not only influenced British philosophers from Hume to Russell and the logical positivists in the twentieth century, he also set the scene for the continental idealism of Hegel and even the philosophy of Marx. There has never been such a radical critique of common sense and perception as that given in Berkeley's Principles of Human Knowledge (1710). This book argues that a conscientiously objecting medical professional should receive an exemption only if the grounds of an objector's refusal are reasonable. It defends a detailed, contextual account of public reasonability suited for healthcare, which builds from the overarching concept of Rawlsian public reason. The author analyzes the main competing positions and maintains that these other views fail precisely due to their systematic inattention to the grounding reasons behind a conscientious objection; he argues that any such view is plausible (...) to the extent that it mimics the 'reason-giving requirement' for conscience objections defended in this work. Only reasonable objections can defeat the prior professional obligation to assign primacy to patient well-being, therefore one who refuses a patient's request for a legally available, medically indicated, and safe service must be able to explain the grounds of their objection in terms understandable to other citizens within the public institutional structure of medicine. The book further offers a novel policy proposal to deploy the Reasonability View: establishing conscientious objector status in medicine. It concludes that the Reasonability View is a viable and attractive position in this debate. The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. Nel Noddings, in Caring: A Feminine Approach to Ethics and Moral Education, presents and develops an ethic of care as an alternative to an ethic that treats justice as a basic concept. I argue that this care ethic is unable to give an adequate account of ethical relationships between strangers and that it is also in danger of valorizing relationships in which carers are seriously abused.

This essay reflects on issues raised by commentators regarding my book, The Atrocity Paradigm: A Theory of Evil (Oxford 2002). They are (1) Robin Schott's observation of the tension between my discussion of forgiveness and of castration fantasies; (2) Bat-Ami Bar On's questions regarding whether evil is ethical, political, or both; (3) Adam Morton's queries regarding the relative seriousness of evils and injustices; and (4) María Pía Lara's concerns regarding what is valuable in Kant's ethics.

In this paper I defend the Reasonability View: the position that medical professionals seeking a conscientious exemption must state reasons in support of their objection and allow those reasons to be subject to evaluation. Recently, this view has been criticized by Jason Marsh as proposing a standard that is either too difficult to meet or too easy to satisfy. First, I defend the Reasonability View from this proposed dilemma. Then, I develop this view by presenting and explaining some of the (...) central criteria it uses to assess whether a conscientious objection is proper grounds for extending an exemption to a medical practitioner. In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This stimulating and often provocative book contends that understanding the evils in terrorism, torture and genocide (...) enables us to recognise similar evils in everyday life: daily life under oppressive regimes and in racist environments; violence against women, including in the home; violence and executions in prisons; hate crimes; and violence against animals. Card analyses torture, terrorism and genocide in the light of recent atrocities, considering whether there can be moral justifications for terrorism and torture, and providing conceptual tools to distinguish genocide from non-genocidal mass slaughter. George Herbert Mead (1863-1931) had a powerful influence on the development of American pragmatism in the twentieth century. He also had a strong impact on the social sciences. This classic book represents Mead's philosophy of experience, so central to his outlook. The present as unique experience is the focus of this deep analysis of the basic structure of temporality and consciousness. Mead emphasizes the novel character of both the present and the past. Though science is predicated on the assumption that (...) the present is predictable based on a thorough knowledge of the past, the experience of the present, says Mead, is an utterly unique moment comparable to no other, and when it is past the novel character of that unique experience is irrevocable. The emergence of novelty within the perceived rational order of reality is the crux of the problem that Mead explores. The present, in his words, is "the emergent event . . . something which is more than the processes that have led up to it and which by its change, continuance, or disappearance, adds to later passages a content they would not otherwise have possessed." The present as "the seat of reality" heavily conditions our retrospective view of the past as much as it helps to shape the future. The novelty of every present experience causes us to reconstruct our preceding experiences to make sense of the past, which is naturally assumed to be the main cause of what we presently experience. Our perspective on reality is thus relative to the conditioning of each new event and it changes continuously as the effects of the present shift our view of the past and future. This emphasis on the integrative, holistic nature of reality, in which everything past, present, and future is a condition of everything else, makes Mead's philosophy highly relevant to today's scientific picture of a quantum universe, where chance and probability play a role in the emergence of reality. Also of great interest is the way in which he extends his basic analysis of temporal-spatial reality to the emergence of mind and consciousness as a natural development of the evolutionary process. This stimulating and provocative work attests to John Dewey's praise of Mead as "the most original mind in philosophy in America" of his generation. (shrink)
