J.M. R. Lenz hat sich keineswegs als ein „vorübergehendes Meteor“ erwiesen, wie Goethe urteilte, sondern gilt inzwischen als einer der wichtigsten Autoren des 18. Jahrhunderts. Sein unglückliches Schicksal ist, vor allem über Büchner vermittelt, ein bis heute aktuelles Thema der produktiven Rezeption. Seine Werke entziehen sich aufgrund ihrer formalen und thematischen Vielschichtigkeit schnellen Deutungen. Das Lenz-Handbuch, an dem namhafte Vertreter der einschlägigen Forschung wie auch junge Autoren mitgearbeitet haben, vermittelt ein umfassendes und differenziertes Bild von Leben und Werk. Die Artikel (...) erschließen das Werk nach Gattungen sowie nach übergreifenden innovativen Gesichtspunkten. Die Rezeption von Autor und Werk in Wissenschaft, Literatur, Kunst, Musik und Film wird einbezogen. The need to regulate access to genetic resources and ensure a fair and equitable sharing of any resulting benefits was at the core of the development of the Convention on Biological Diversity (CBD). The CBD established a series of principles and requirements around access and benefit sharing (ABS) in order to increase transparency and equity in the international flow of genetic resources, yet few countries have been able to effectively implement them and ABS negotiations are often paralysed by differing interests. (...) -/- This book not only examines these complex challenges, but offers workable, policy-oriented solutions. International contributors cover theoretical approaches, new significant national legislation, the concept of traditional knowledge, provider and user country measures and common solutions. Exploring specific, salient examples from across the globe, the authors provide lessons for national regulation and the ongoing negotiations for an international ABS regime. A well-known problem in the health sciences is the distorted research agenda: the agenda features too little research that is tailored to the health problems of the poor, and it features too little research that supports the development of other solutions to health problems than medicines . This article analyzes these two sub-problems in more detail, and assesses several strategies to deal with them, resulting in some specific recommendations that indicate what governments should do to make the research agenda in (...) the health sciences less distorted. In contrast, the authors consider heuristics to be adaptive strategies that evolved in tandem with fundamental psychological mechanisms. The recognition heuristic, arguably the most frugal of all heuristics, makes inferences from patterns of missing knowledge. This heuristic exploits a fundamental adaptation of many organisms: the vast, sensitive, and reliable capacity for recognition. The authors specify the conditions under which the recognition heuristic is successful and when it leads to the counter-intuitive less-is-more effect in which less knowledge is better than more for making accurate inferences. Arguably the most influential models of human decision-making today are based on the assumption that two separable systems – intuition and deliberation – underlie the judgments that people make. Our recent work is among the first to present neural evidence contrary to the predictions of these dual-systems accounts. We measured brain activations using functional magnetic resonance imaging (fMRI) while participants were specifically instructed to either intuitively or deliberately judge the authenticity of emotional facial expressions. Results from three different analyses revealed (...) both common brain networks of activation across decision mode and differential activations as a function of strategy adherence. We take our results to contradict popular dual-systems accounts that propose a clear-cut dichotomy of the processing systems, and to support rather a unified model. According to this, intuitive and deliberate judgment processes rely on the same rules, though only the former are thought to be characterized by non-conscious processing. (shrink)

In the official statistics, the total number of nonvoters in the post-war parliamentary elections in Belgium, is considerably over-estimated. This is caused by the method of updating the lists of voters, so that many people who appear as nonvoters, are regular voters who died after the moment of updating, but were not droppedfrom the lists. In this article, we endeavoured to calculate the number of deceased voters, who still appear on the lists, using the monthly death-rates of the total Belgian (...) population, abstracting the deceased persons under age and the deceased foreigners. The more realistic rates of nonvoting, calculated this way, are quite lower than the official rates.Yet, because of the introduction of a new method of updating, the problem discussed above, hardly exists any langer since the general election of 1977. In this article, we integrated the data of four inquiries, concerning various activities and features, computing the relations between all these quantitative variables by partialcorrelation and multiple regression techniques.Remarkably, the most determing factor of the amount of preference votes of a candidate seems to be his various activities in parliament.His clientelist activities and his personal electoral campaign influence also, but in a lesser way, the cast of these votes. Parliamentary seniority correlates positively with the number of cumulated offices, which in (...) turncorrelates with the extent of his electoral campaign. The attendance of a representative during the committee meetings and during the plenary voting sessions seems not at all to be influenced by this cumulations of various offices, and only slightly by bis clientelist occupations. This general pattern of parliamentary behavior differs considerably between parties. Finally, the effect of each particular branch ofextraparliamentary offices on the other activities of each member was examined. (shrink)

The lists of candidates, proposed by the parties for the Belgian general elections, is quite determinative. Due to electoral code arrangements, and, notwithstanding the growing proportion of preference votes, only thosecandidates who are placed within the «necessary sequence» of the lists get actually elected. Consequently, the Belgian voter does not appointthe mandataries, hut only the number of mandates due to the several parties.The statutes of the three major Belgian parties, provide large participative opportunities for their members, through the so-called general (...) member polls. In this kind ofprimary system, all party members are franchised to elect the candidates for their party-lists.The elections of the past twenty years show a growing tendency to deviate from these statutary guaranteed participation. In 1958, 89 % of all representatives were placed on their party-lists by general member polls; in 1978, only 10 %. Thus, the conclusive phase of the composition of the partylists has become, since 1958, increasingly a matter where only the national or federal party executives and councils decide upon. (shrink)

In this article, we explain the mechanisms that allow social enterprises to balance their missions, and the risk of mission drift as organizations grow. We empirically explore Incubator-BUS (I-BUS), a student organization within a private Brazilian university, which sought to incubate cooperatives for vulnerable groups. Although initially successful in balancing its missions, I-BUS then failed. We show how scaling-up can complicate the balancing of different missions within the same organization. We propose that, to balance their missions, social enterprises—especially recently formed (...) and democratically managed enterprises—need not only “spaces of negotiation,” as suggested in the literature, but also “herding spaces” that connect an organization to its institutional context. We indicate why herding spaces are critical, but then show how scaling-up can result in organizational “compartmentalization” that undermines them. (shrink)

Background:A total of 71,000 people in Norway suffer from some form of dementia in 2013, of whom approximately 30,000 are in nursing homes. Several studies focus on the experiences of those who have close relatives and who are staying in a nursing home. Results show that a greater focus on cooperation between nursing staff and relatives is a central prerequisite for an increased level of care. Benefits of developing systematic collaboration practices include relief for nursing staff, less stress, and greater (...) mutual understanding. Going through studies focusing on the experiences of nursing home patients’ relatives, negative experiences are in the majority. In this study, relatives are invited to share positive experiences regarding the care of their loved ones; a slightly different perspective, in other words.Aim:The aim of the study is to investigate relatives of persons with dementia’s experiences with quality care in nursing homes.Method:The study is a part of a larger project called Hospice values in the care for persons with dementia and is based on a qualitative design where data are generated through narrative interviews. The chosen method of analysis is the phenomenological–hermeneutical method for the study of lived experiences.Participants and research context:Participants in the project were eight relatives of persons with dementia who were living in nursing homes, long-term residences. The sampling was targeted, enrolment happened through collective invitation. All relatives interested were included.Ethical considerations:The Norwegian Regional Ethics Committee and the Norwegian Social Science Data Services approve the study.Findings:Findings show that relatives have certain expectations as to how their loved ones ought to be met and looked after at the nursing home. The results show that in those cases where the expectations were met, the relatives’ experiences were associated with engagement, inclusion and a good atmosphere. When the expectations were not met, the relatives experienced powerlessness, distrust and guilt.Discussion:The results are discussed considering the concepts of trust, power and asymmetry.Conclusion:When asked about experiences with quality care, the relatives spoke both of expectations met and of expectations not met. Results in this study are important knowledge for developing units where performing quality care is the overall aim. (shrink)

This paper describes the common techniques used in the constitution of candidates-lists for parliamentary elections. A common feature of these techniques is the consultation of party members. But the way in which this is done differs among the parties. AGALEV, the ecologist party, offers every member the possibility to have his say about every candidate. The socialist party uses this system in two constituencies ; in the other constituencies a special congress decides. The christiandemocrats, the liberals and the Flemish nationalists (...) constitute their lists by indirect vote : the leadership performs a first selection and the members then either approve or disapprove of this choice.Our research indicates that there are no essential differences between these two techniques from the point of view of membership participation.In both the ecologist and the socialist party the majority of members does not participate in the candidates-elections. Therefore, as with the indirect vote, candidates-lists are constituted by an active, militant and elitist group of members. Whatever the technique used the infl,uence of the rank-and-file-member is small. (shrink)

Falsification no longer is the cornerstone of philosophy of science; but it still looms widely that scientists ought to drop an explanatory hypothesis in view of negative results. We shall argue that, to the contrary, negative empirical results are unable to disqualify causally explanatory hypotheses—not because of the shielding effect of auxiliary assumptions but because of the fact that the causal irrelevance of a factor cannot empirically be established. This perspective is elaborated at a case study taken from the history (...) of plant physiology: the formaldehyde model of photosynthesis, which for about sixty years dominated the field—despite the fact that in these sixty years all the attempts to conclusively demonstrate even the presence of formaldehyde in plants failed. abstract A number of prominent nonconsequentialists support the thesis that we can wrong the dead by violating their moral claims. In contrast, this study suggests that the arguments offered by Thomson, Scanlon, Dworkin, Feinberg and others do not warrant posthumous rights because having claim‐grounding interests requires an entity to have the capacity to experience significance. If dead people don't have this capacity, there is no reason to attribute claims to them. Raising doubts about prominent hypothetical examples of ‘no‐effect injury’, the (...) study concludes that nonconsequentialists should consider adopting an error theory regarding posthumous claims, and suggests two alternative explanations of the relevant moral domains. Der Band untersucht das durch die Begriffe Musik, Kultur und Gedächtnis abgesteckte Feld in einer zweifachen Bewegung: Zum einen wird Musik als eine wichtige soziokulturelle Ausdrucksform quer durch alle Kulturen gefasst, ihre Bestimmung und Funktion ändern sich mit den jeweiligen soziokulturellen Kontexten und Praxen. Jedes Musikstück steht in spezifischen kulturell entwickelten Traditionen und Formen, die von ihm aktualisiert werden. Musik wirkt als "gemeinschaftsbildende Macht" (Adorno), als Ausdrucksmittel individueller oder kollektiver Identität. Zum anderen ist den vielfältigen Formen von Musik die mehrfache (...) Verbindung von Musik und Zeit gemeinsam: Die jeweilige musikalische Darbietung oder Reproduktion ist ein zeitlicher Ablauf und als solcher gedächtnishaft organisiert. Die ästhetische Erfahrung von Musik ist konstitutiv auf Gedächtnisleistungen angewiesen und Musik selbst eine temporale Kunstform. Neben dieser elementaren Zeitlichkeit zeigen sich in der Musik aber viele weitere Aspekte subjektiver und sozialer Zeit: die Geschichtlichkeit der einzelnen Stücke bzw. Werke selbst, die soziokulturelle zeitliche Lagerung von Ordnungsprinzipien wie Gattungen, Kunstformen, Stilen etc., der Wandel von basalen Formen des Musikmachens (etwa unter dem Einfluss von Medientechnologien). Der Band enthält auch die deutsche Erstveröffentlichung eines Artikels von Maurice Halbwachs zu diesem Themenfeld. Der Inhalt: Theoretische Überlegungen, "Analytische Betrachtungen. Philosophy & Social Criticism, Volume 48, Issue 5, Page 655-673, June 2022. The standard account of the relation between democracy and the rule of law focuses on law’s liberty-enhancing role in constraining official action. This is a faint echo of the complex, constitutive relation between the two. The Greeks used one word – isonomia – to describe both. If democracy is the system in which people have an equal say in determining the rules that govern social life, then the rule (...) of law is simultaneously before, after, concurrent and synonymous with democracy: It contributes to the formation of citizens with the capacity for self-governance, serves as the instrument through which democratic decisions are implemented, functions as one of the central social practices that constitute citizens as equals and addresses the question of how to ensure that government by the people operates for the people. The rule of law has many independently valuable qualities, including impartiality and predictability. But, to valorise the rule of law for its own sake is to fetishize authority. The fundamental values of the rule of law are as the instrument of democratic self-governance and the expression of the equal dignity of all persons. Democracy thus entails the rule of law, but both implicate the yet more comprehensive ideal of equality. Core rule-of-law values require political norms and conditions of equality, generality and comprehensiveness. In a modern, differentiated society, however, the constitutive relation between democracy and the rule of law is fractured and law becomes the agent of authority. Courts in the modern constitutional state have contributed to the decline of rule-of-law values, supporting role specialization through judge-made immunity doctrines that protect officials at all levels. The crisis of police violence against minorities is a symptom of this breakdown. Greater accountability can ameliorate the problem. But an effective solution requires the fair and equal distribution of political power. (shrink)
