Der Wandel der kulturellen Verhältnisse führt zu einer Zuspitzung des Verhältnisses von Gesellschaft und Rechtssystem. In diesem Prozess gestaltet New Political Ecology (NPE) Umwelt und Rechtssystem und ist zugleich evolutiv ausgerichtet. NPE erfährt Evolution in der Zeit als Überfluss und in eigenartiger Vernetzung als knappes Gut. Diese Verbindung basiert auf Zusammenhängen, die bisher noch nicht systematisch bearbeitet worden sind. Dabei geht es ganz wesentlich auch um das Verhältnis von Staat und moderner Risikogesellschaft. El artículo es una reflexión que propone repensar la investigación educativa desde el enfoque cualitativo. El objetivo es describir y comprender sobre las distintas vertientes de la investigación educativa, el enfoque cualitativo en el campo de las educaciones; problematizar sobre el diseño del plan; explicar a la historia oral como método de investigación en el estudio de la educación y reflexionar sobre el rol del investigador. En suma, se plantea pensar la investigación educativa desde el enfoque cualitativo, por un lado, (...) porque permite comprender que los procesos de investigación y construcción de conocimiento son de forma participativa, colaborativa y dialógica; por otro lado, problematizar la posición del investigador en la investigación. Terminal kidney patients are faced with lower quality of life, restricted diets and higher morbidity and mortality rates while waiting for deceased donor kidney transplantation. Fortunately, living kidney donation has proven to be a better treatment alternative (e.g. in terms of waiting time and graft survival rates). We observed an inequality in the number of living kidney transplantations performed between the non-European and the European patients in our center. Such inequality has been also observed elsewhere in this field and it (...) has been suggested that this inequality relates to, among other things, attitude differences towards donation based on religious beliefs. In this qualitative research we investigated whether religion might indeed (partly) be the explanation of the inequalities in living donor kidney transplants (LDKT) among non-European patients. Fifty patients participated in focus group discussions and in-depth interviews. The interviews were conducted following the focus group method and analyzed in line with Grounded Theory. The qualitative data analyses were performed in Atlas.ti. We found that religion is not perceived as an obstacle to living donation and that religion actually promotes helping and saving the life of a person. Issues such as integrity of the body were not seen as barriers to LDKT. We observed also that there are still uncertainties and a lack of awareness about the position of religion regarding living organ donation within communities, confusion due to varying interpretations of Holy Scriptures and misconceptions regarding the process of donation. Faith leaders play an important educational role and their opinion is influential. This study has identified modifiable factors which may contribute to the ethnic disparity in our living donation program. We argue that we need to strive for more clarity and awareness regarding the stance of religion on the issue of living donation in the local community. Faith leaders could be key figures in increasing awareness and alleviating uncertainty regarding living donation and transplantation. (shrink)

In this article, an ethical analysis of an educational programme on renal replacement therapy options for patients and their social network is presented. The two main spearheads of this approach are: (1) offering an educational programme on all renal replacement therapy options ahead of treatment requirement and (2) a home-based approach involving the family and friends of the patient. Arguments are offered for the ethical justification of this approach by considering the viewpoint of the various stakeholders involved. Finally, reflecting on (...) these ethical considerations, essential conditions for carrying out such a programme are outlined. The goal is to develop an ethically justified and responsible educational programme. (shrink)

Beyond Weimar Culture – The Significance of the Forman Thesis for a Cultural Approach to the History of Science. The famous ‘Forman thesis’, published in 1971, argued for a historical linkage among the intellectual atmosphere of Weimar Germany, popular revolts against determinism and materialism, and the creation of the revolutionary new theory of quantum mechanics. Paul Forman's long essay on “Weimar Culture” has shaped research agendas in numerous fields, from the history and philosophy of physics to German (...) history to the sociology of scientific knowledge. Despite its status as a classic and its transformative effect, Weimar Culture has always inspired as much critique as assent. In particular in the history of science, cohorts of students and two generations of scholars have debated the Forman thesis as a conceptual tool for linking scientific change with cultural processes. The Forman thesis raises critical questions for both the ongoing debates over cultural approaches to the history of science and the burgeoning newer scholarship on physics in and beyond Weimar Germany. Exploring these implications has been the aim of a transnational project of the three authors of this article which sheds some light on these debates and briefly introduces the following papers of this special issue devoted to Paul Forman and his seminal works in the history of science. This paper examines relations between eugenics and genetics during the Weimar Republic. Research aims and requests for funding were motivated by a sense that biology could contribute to national reconstruction after the First World War. Geneticists' participation in social policy-making is assessed, as well as the rise of interest in eugenics and racial biology among public health officials. It was important that eugenics be acceptable to the Centre Party, and a sometime Jesuit, Hermann Muckermann, took a leading role as (...) intermediary between the state and human geneticists in the founding of the Institute for Anthropology, Human Heredity and Eugenics. Earlier plans to establish a national institute, the organization of the Institute as it actually materialized, and the scope of research are considered. Finally, the dislocation in 1933 is assessed in order to further emphasize how the Institute was deeply embedded in the Weimar social structure. (shrink)

This selection of the major works of constitutional theory during the Weimar period reflects the reactions of legal scholars to a state in permanent crisis, a society in which all bets were off. Yet the Weimar Republic's brief experiment in constitutionalism laid the groundwork for the postwar Federal Republic, and today its lessons can be of use to states throughout the world. Weimar legal theory is a key to understanding the experience of nations turning from traditional, religious, (...) or command-and-control forms of legitimation to the rule of law. Only two of these authors, Hans Kelsen and Carl Schmitt, have been published to any extent in English, but they and the others whose writings are translated here played key roles in the political and constitutional struggles of the Weimar Republic. Critical introductions to all the theorists and commentaries on their works have been provided by experts from Austria, Canada, Germany, and the United States. In their general introduction, the editors place the Weimar debate in the context of the history and politics of the Weimar Republic and the struggle for constitutionalism in Germany. This critical scrutiny of the Weimar jurisprudence of crisis offers an invaluable overview of the perils and promise of constitutional development in states that lack an entrenched tradition of constitutionalism. Das Nietzsche-Archiv gilt als eine der einflussreichsten deutschen Kultureinrichtungen des 20. Jahrhunderts. Das vorliegende Buch stellt diese kulturpolitische Institution mit all ihren Einflussmöglichkeiten exemplarisch an Hand des Weimar-Jena-Planes vor. Dieses richtungweisende Kulturvorhaben der 1930er Jahre, das heute in Vergessenheit geraten ist, dokumentiert die Kulturpolitik der deutschnationalen sowie der nationalsozialistischen Kreise. Bisher unbekannte Quellen aus dem Nietzsche-Archiv werden in dem vorliegenden Buch erstmals kritisch untersucht und mit der vorhandenen Forschungsliteratur verglichen. The text refers to Peter Sloterdijk‘s maybe most famous book which entails a long chapter about the Weimar Republic. This short time period of German history is seen as an exemplary historical example for a situation in which cynical thinking becomes general. In his first prominent book, he changed the leftist images and the narratives of Weimar Republic after 1968 as a laboratory for modernism and of a tragic end of revolutionary efforts. Instead the first democracy was presented (...) as an apocalyptical period in which cold intellectual affirmation was dominant. As the text argues, Sloterdijk widens the concept of cynical thinking in a way that seems to be problematic. His argumentation discusses melancholy, nihilism, social and cultural discontent under the terminological umbrella of the "cynic". (shrink)

English summary: Stephan Steiner presents a historical-biographical study of Leo Strauss, in which he brings the contexts and genesis of Strauss' political philosophy to light. In order to do this, it is crucial to look at the transformation of Strauss' philosophical position in the USA while also placing it in perspective against the background of the conditions during the Weimar Republic. Taking Strauss' position on the sociology of knowledge, on historicism and on dialectical theology into account, Steiner shows how (...) Strauss brought a specifically German criticism of modernism to America, which he developed during his first years in New York. In order to explore this in more detail, Strauss's understanding of revelation, his criticism of historicism and the philosophical-historical preconditions of his image of Antiquity have been reconstructed. Instead of presenting one-dimensional philosophical narratives and autobiographical self-staging, this makes accessible the history of experience in Strauss' thinking. The collapse of the Weimar Republic remains central to the history of the 20th century and to contemporary debates on 'classical modernity' and its Europe-wide crisis in the wake of the First World War. The years of the Weimar Republic saw complex cultural change in Germany as well as political turmoil. Writing Weimar draws on the large amount of research done on the period since the 1980s in order to show how literary writers developed critical perspectives on the social and political issuesof the time, and how those perspectives were related to longer-term developments in German culture which run beyond the watershed events of 1918 and 1933. Historians have returned to this period with a new sense of the openness of the crisis environment, particularly in areas of social and cultural history. Male homosexuality emerged as a central theme of Weimar social and cultural crisis as it became possible for (...) homosexual men to imagine an identity and a ‘life’ for the first time. These men began to understand their lives as a continuum in terms of their sexuality and to express their lives in writing. The discourse of masculinist homosexuality, which emerged during the first decades of the 20th century, was used by some homosexuals as a means to self-identification and self-validation in the open environment of post-war early Weimar. However, this speculative framework of masculine comradeship and warrior ethos became less and less tenable as the internal contradictions as well as the socio-political pressures of the Republic increased. The paper explores the internal tensions between homosexuality and masculinist identity in two literary works from the Weimar Republic, Max René Hesse’s Partenau and Thomas Mann’s ‘Mario and the Magician’. El artículo aborda la Teoría de la Constitución de Carl Schmitt, atendiendo a su doble acepción de teoría general de la constitución moderna y cuerpo de doctrina acerca de la constitución de Weimar. El primer apartado presenta la sistemática de la teoría positiva de la constitución moderna, reponiendo sus dos elementos estructurantes: la forma política resultante de la aplicación de los principios político-formales de identidad y representación, y las formas de legislación y gobierno propias del Estado de derecho burgués. (...) La segunda parte se centra en el cuerpo de doctrina acerca de la constitución de Weimar que Schmitt desarrolla apelando a las categorías presentadas en la primera parte. En especial, se analizan sus implicancias para comprender la posición de Schmitt respecto a los principales desafíos doctrinarios de la época, contrastando sus posiciones con las de otros grandes juristas contemporáneos. Finalmente, se recapitulan las conexiones de sentido entre los criterios que informan la teoría general de la constitución moderna y la doctrina de la constitución de Weimar, destacando las peculiaridades del esfuerzo de Schmitt por subrayar la integridad de la constitución frente a los diversos modos de relativización que atribuye tanto al positivismo jurídico como a ciertas posiciones políticas de su época. When we pick up a big book like this with big names including Heidegger, Arendt, Benjamin, and Warburg, we want to learn something significant we don't already know by way of reading and reputation. And if we are in rhetoric per se, we are especially eager to see how these people are attached substantially to a field that none of them claimed. Following from these initial expectations, we are then owed a plausible methodology that tends neither toward the wish fulfillment (...) of big rhetoric, nor toward one of the more conventional methods—for example biographic, or dictated by the more familiar scripts of philosophy, politics, and art history—that would render these surprises unlikely because the field would have been...
