O artigo aborda a discussão entre John Rawls e Jürgen Habermas no que diz respeito ao processo democrático e à neutralidade. Indica que a formação do processo democrático acontece de maneira distinta em uma perspectiva liberal e republicana e que ambos os autores assimilam essa questão de forma diferente. No que se refere à neutralidade, embora tanto Rawls quanto Habermas defendam uma prioridade do justo sobre o bem, o intuito é mostrar que as implicações derivadas de suas perspectivas também são (...) distintas. Trata-se de uma das críticas fundamentais de Habermas a Rawls e um dos principais pontos de desacordo entre as duas perspectivas sobre o liberalismo político. (shrink)

O texto apresenta a ideia de um mínimo existencial como condição de possibilidade para a realização dos direitos e liberdades fundamentais incluídos no primeiro princípio de justiça de Rawls. Ao distinguir moralidade de eticidade, mostra que um princípio ético deve passar pelo processo de mediação das vontades a fim de constituir-se em lei universal. Apresenta a Família, a Sociedade Civil e o Estado como instâncias mediadoras ou determinações da Eticidade Hegelina.

The present paper has the purpose of making a critical approach of the so called “independence thesis” (Unabhängigkeitsthese) between Law and Ethics based on the Kantian text about equity in his Doctrine of Law. To this critical approach, a weakening of the “independence thesis” is demonstrated according to some endogenous concepts of the Kant work, which we believe deals with an oblique opening of the Kantian’s law to ethics. To demonstrate this, we follow a methodological analytic way divided in three (...) moments: (i) an analysis of the concept of law in Kant; (ii) an explanatory approach of the “independence thesis”; and (iii) a critical approach of the “independence thesis”. A moral kantiana recebe de Hegel a crítica de se constituir um "vazio formalismo', onde o Imperativo Categórico não passa de uma 'indeterminação abstrata'. O debate entre os dois autores pretende recolocar os objetivos fundamentais de cada um e demonstrar a necessidade de sua complementariedade no que se refere a uma avaliação global do agir humano do ponto de vista moral.

O artigo tem por objetivo investigar a apropriação rawlsiana do imperativo categórico de Kant. Entra no mérito da distinção entre o procedimento do imperativo categórico e o procedimento da posição original, adotado pela “justiça como equidade”. Procura explicitar e avaliar a interpretação das formulações do imperativo categórico kantiano, elaborado por Rawls. Por fim, investiga o âmbito do imperativo categórico enquanto procedimento de construção de normas morais.

O propósito do artigo é entrar na controvérsia entre liberais e comunitaristas no referente à concepção de justiça e sua fundamentação. Mais especificamente, o texto discute a crítica de M. Sandel ao liberalismo político de J. Rawls. Aponta vários equívocos daquele considerando os significativos esclarecimentos e reformulações por este, nos livros posteriores à publicação de Uma Teoria da Justiça. Comenta a crítica, feita por Sandel, do afastamento das questões morais, a controvérsia em torno da prioridade do justo em relação ao (...) bem e a restrição do âmbito da razão pública. (shrink)

A Filosofia do Direito de Hegel trata da Ideia da Liberdade e suas formas de concretização. É a expressão do exercício efetivo da autonomia da “pessoa do direito” enquanto capacidade jurídica. Isso inclui o direito de propriedade e do contrato; o direito da vontade moral, enquanto trata das condições da responsabilidade subjetiva; e as mediações da eticidade, enquanto desenvolve o exercício da autonomia nas instituições sociais: a família, as corporações e o Estado.

O presente estudo tem por objetivo demonstrar uma via de interpretação na qual o conceito de Reconhecimento, como abordado por Axel Honneth a partir da obra hegeliana, é uma engrenagem fundamental no processo de determinação da Liberdade na obra de Hegel. Para isso, é necessário que se caminhe para além da fronteira erigida na tradição, a qual liga o conceito de Reconhecimento à dialética do senhor e do escravo na Fenomenologia. Dado que os trabalhos de Honneth se fundam nos escritos (...) do jovem Hegel, anteriores a esta, é possível ir além de tais fronteiras. A conexão de Reconhecimento e Liberdade torna-se possível por meio da tentativa de reatualização da Filosofia do Direito honnethiana, a qual tem por objeto lançar as bases de uma teoria da justiça. O estabelecimento de um paralelismo entre razão teórica e razão prática permite explicitar o âmbito de cada uma delas. A restrição do uso da razão assegura, por um lado, o caminho seguro da ciência e mostra, por outro lado, que há um uso prático da razão - a moral, isto é, que ela pode determinar imediatamente à vontade.

Um Estado democrático de Direito fundamenta suas bases em princípios de justiça universalizáveis. Aplicados a uma Constituição, objetivam-se nos direitos e liberdades fundamentais dos cidadãos. O dever de obedecer a leis injustas, a desobediência civil e a objeção de consciência pressupõem senso de justiça e uma concepção do bem, capacidades morais de uma “pessoa ética”. A possibilidade de se tolerar um desobediente civil é parte integrante, para muitos autores, do próprio conceito de Estado Democrático de Direito. Porém, a fundamentação e os limites da referida desobediência é matéria controversa, mormente quanto à possibilidade de infringir uma lei com fulcro na objeção de consciência. A discussão central, portanto, permeia a incorporação ou não da objeção de consciência como um fundamento válido para a desobediência civil. Percebe-se, a partir deste debate, que questões morais e legais poderão entrar (...) em conflito e os limites da desobediência dependerão da fundamentação e da justificação tanto filosófica quanto jurídica. Frente à vasta e complexa gama de autores que trabalham o tema, optou-se, no presente ensaio, pela análise crítica e comparativa das teorias de John Rawls e Ronald Dworkin, que divergem exatamente no ponto acima descrito. O primeiro, alicerçado em sua teoria da justiça como equidade, promove o entendimento procedimental da desobediência civil fundamentada em princípios políticos publicamente aceitos, excluindo questões morais. O segundo, por seu turno, entende que em toda regra há um conteúdo moral, passível, portanto, de desobediência com fulcro na objeção de consciência. Tendo em vista a referida dicotomia entre princípios morais e princípios políticos, busca-se verificar se a teoria de Rawls impõe um caráter exageradamente restritivo ou se a compreensão de Dworkin traduz comportamentos estatais excessivamente tolerantes. O presente artigo se justifica pela influência decisiva que ambos os autores têm desempenhado no que se refere à fundamentação da desobediência civil, principalmente no debate em relação às doutrinas liberais de justiça. Even though scenarios where single events at the molecular level make the difference in the outcome of such processes are realistic, this falls short of establishing indeterminism, because it is not clear that these molecular events are subject to quantum mechanical uncertainty. Furthermore, attempts to argue for indeterminism autonomously (i.e., independently of quantum mechanics) fail, because both deterministic and indeterministic models can account for the empirically observed (...) behavior of ion channels. Logical paradoxes – like the Liar, Russell's, and the Sorites – are notorious. But in Paradoxes and Inconsistent Mathematics, it is argued that they are only the noisiest of many. Contradictions arise in the everyday, from the smallest points to the widest boundaries. In this book, Zach Weber uses “dialetheic paraconsistency” – a formal framework where some contradictions can be true without absurdity – as the basis for developing this idea rigorously, from mathematical foundations up. The guiding focus is on a more basic question, of why there are paradoxes. Max Weber (1864-1920), generally known as a founder of modern social science, was concerned with political affairs throughout his life. The texts in this edition span his career and include his early inaugural lecture The Nation State and Economic Policy, Suffrage and Democracy in Germany, Parliament and Government in Germany under a New Political Order, Socialism, The Profession and Vocation of Politics, and an excerpt from his essay The Situation of Constitutional Democracy in Russia, as well as other shorter (...) writings. Together they illustrate the development of his thinking on the fate of Germany and the nature of politics in the modern western state in an age of cultural 'disenchantment'. The recent literature on causality has seen the introduction of several distinctions within causality, which are thought to be important for understanding the widespread scientific practice of focusing causal explanations on a subset of the factors that are causally relevant for a phenomenon. Concepts used to draw such distinctions include, among others, stability, specificity, proportionality, or actual-difference making. In this contribution, I propose a new distinction that picks out an explanatorily salient class of causes in biological systems. Some select causes (...) in complex biological systems, I argue, have the property of enabling coherent causal control of these systems. Examples of such control variables include hormones and other signaling molecules, e.g., TOR (target of rapamycin), morphogens or the products of homeotic selector genes in embryonic pattern formation. I propose an analysis of this notion based on concepts borrowed from causal graph theory. (shrink)

There are several theses in political science that are usually explicitly called ‘laws’. Other theses are generally thought of as laws, but often without being explicitly labelled as such. Still other claims are well-supported and arguably interesting, while no one would be tempted to call them laws. This situation raises philosophical questions: which theses deserve to be called laws and which not? And how should we decide about this? In this paper we develop and motivate a strategy for thinking about (...) laws in political science which integrates two core concepts: spatio-temporal stability and social mechanisms. The proposed strategy is a set of guidelines that political scientists can use to reflect on and argue about specific cases within their discipline, not a clear-cut demarcation criterion. We defend and motivate this strategy and apply it to two cases (one with respect to state repression, one about parliamentary elections). After we have developed and motivated our strategy for political science, we show that our proposal is relevant for other disciplines in the social sciences. We explain how our views fit into critical realism and embed them in the debate on laws in general philosophy of science and in the philosophy of the social sciences. (shrink)

Standardly, epistemic peers regarding a given matter are said to be people of equal competence who share all relevant evidence. Alternatively, one can define epistemic peers regarding a given matter as people who are equally likely to be right about that matter. I argue that a definition in terms of likelihood captures the essence of epistemic peerhood better than the standard definition or any variant of it. What is more, a likelihood definition implies the truth of the central thesis in (...) the debate on peer disagreement, the so-called Equal Weight View, according to which we should give the opinions of our peers the same weight we give our own. Adopting a likelihood definition, however, does not end the debate on peer disagreement, because the alleged theoretical alternatives to the Equal Weight View, reinterpreted in the light of a likelihood definition, can in fact be shown to be compatible with this view—though the reinterpreted versions may appear less plausible than the original ones. Several authors have used the notion of causal specificity in order to defend non-parity about genetic causes (Waters 2007, Woodward 2010, Weber 2017, forthcoming). Non-parity in this context is the idea that DNA and some other biomolecules that are often described as information-bearers by biologists play a unique role in life processes, an idea that has been challenged by Developmental Systems Theory (e.g., Oyama 2000). Indeed, it has proven to be quite difficult to state clearly what the alleged special (...) role of genetic causes consists in. In this paper, I show that the set of biomolecules that are normally considered to be information-bearers (DNA, mRNA) can be shown to be the most specific causes of protein primary structure, provided that causal specificity is measured over a relevant space of biological possibilities, disregarding physical as well as logically possible states of the causal variables. In the mathematics education research literature, there is a growing body of scholarship on how mathematicians practice their craft. The purpose of this chapter is to survey some of this literature and explain how it can contribute to the philosophy of mathematical practice. We first describe how mathematics educators use empirical methodologies to investigate the behaviors of mathematicians and argue that findings from these studies can inform the philosophy of mathematical practice. The evidence that we get from peer disagreement is especially problematic from a Bayesian point of view since the belief revision caused by a piece of such evidence cannot be modelled along the lines of Bayesian conditionalisation. This paper explains how exactly this problem arises, what features of peer disagreements are responsible for it, and what lessons should be drawn for both the analysis of peer disagreements and Bayesian conditionalisation as a model of evidence acquisition. In particular, it is pointed (...) out that the same characteristic of evidence from disagreement that explains the problems with Bayesian conditionalisation also suggests an interpretation of suspension of belief in terms of imprecise probabilities. A commonly neglected feature of the so-called Equal Weight View, according to which we should give our peers’ opinions the same weight we give our own, is its prima facie incompatibility with the common picture of philosophy as an armchair activity: an intellectual effort to seek a priori knowledge. This view seems to imply that our beliefs are more likely to be true if we leave our armchair in order to find out whether there actually are peers who, by disagreeing (...) with us, force us to revise our beliefs. This article argues that the Equal Weight View should be spelled out in such a way that not only actual peer disagreement requires us to revise our beliefs, but also merely possible peer disagreement. This result is not a reductio ad absurdum of the view. Quite the opposite: it shows that the view is, contrary to appearance, compatible with our common way of doing philosophy. (shrink)

Die vorliegende Arbeit schliesst diese Lucke, indem sie das Material von Caesar bis Maurikios analysiert. Dabei ergeben sich spezifische Motive, die besonders mit Traumen und Visionen verbunden sind: Geburt und Kindheit, Verheissung der Herrschaft, Erringung eines Sieges und gottliches Eingreifen, Ausubung der Herrschaft, besondere Befahigung und gottliche Begunstigung, nahendes Ende. Durch den breiten zeitlichen Ansatz gelingt (...) es, fur die Motive unterschiedliche Schwerpunkte auszumachen: Sie stehen alle in der Spannung zwischen einer gezielten Verbreitung zur Schaffung von Akzeptanz und der Literarisierung durch die antiken Autoren. Fur die Behandlung der Thematik waren nicht nur definitorische Vorarbeiten notwendig, sondern auch der mentale Horizont moglicher Rezipienten musste durch die Interpretation von Inschriften, Papyri und Selbstaussagen antiker Autoren in den Blick genommen werden. The author argues the following hypothesis: the medical clinic is an experimental practice, in the sense given to this term by Claude Bernard, and the clinic is its specific laboratory. Its object is not the disease, but the patient. Careful examination of the clinic attests to its very close proximity to the experimental method, and the comparison also raises a number of difficulties. The main obstacle arises from the specificity of medicine, which involves treating individual human subjects whose words cannot (...) be suppressed.
