I will take a famous paragraph from J S. Mill as a starting point for defending the idea that moral philosophy has to take charge definitively of those who have been less fortunate in the natural lottery. This means that we must to take seriously the possibility of increasing the capacity for the well-being of nonhuman animals. En el artículo se lleva a cabo un análisis de las bases en las que descansa el paradigma ético tradicional. La pretensión es mostrar que la propuesta humanista falla en su pretensión de justificar que la responsabilidad moral de los agentes morales se dirige a todos y sólo a los seres humanos. En la parte final se apuesta por una propuesta alternativa más plausible.

Deberíamos usar las nuevas técnicas biomédicas para mejorar a los individuos? Si sabemos que la naturaleza humana contiene también características que podemos considerar no deseables entonces parece que no habría nada en sí mismo erróneo a la hora de alterarla. Algunos autores interesados en este tema hacen referencia a los daños que ello podría ocasionar a otros. Pero entonces, ¿la mejora moral podría funcionar como un contraejemplo a la idea de que la mejora biomédica es siempre moralmente impermisible? Puede que (...) lejos de estar ante algo meramente permisible, la mejora de nuestro carácter moral sea algo a lo que debamos aspirar. ¿Sería entonces obligatorio seleccionar los embriones con un nivel más alto de moralidad? La comunicación que presentamos pretende mostrar las consecuencias que el sistema implementado por el sindicato agrícola Unió de Pagesos en Cataluña -por el que se realiza el reclutamiento, importación y suministro de mano de obra extranjera para el campo catalán- produce: un sujeto limitado en el justo goce de sus libertades y el legítimo ejercicio de sus derechos. La política migratoria la responsable del surgimiento de un sistema tal, cuyo germen está en la relación simbiótica Estado/Sindicato, cuyos intereses -la entrega (...) just in time de la mano de obra y el control social del extranjero- se armonizan en su puesta en práctica. En los alojamientos, infraestructura del sistema, se procura la docilización de los individuos necesaria a su continuo suministro a través de variados dispositivos, entre ellos, normativas de alojamiento, supervisión constante y regímenes de visita. Para o campo da Ciência da Informação (CI), é de grande relevância a discussão sobre o fluxo informacional, que é um objeto focal das pesquisas desenvolvidas nessa área. Por esse motivo, não são estudados apenas os meios e os conceitos, mas as relações que eles têm entre si e as suas mediações, sempre levando em consideração os processos que envolvem sua comunicação, usabilidade e acessibilidade pelo tecido social. Também, observam-se as distintas visões que envolvem a mediação tida na Ciência da (...) Informação e os diversos ramos do conhecimento, tais como a Comunicação, a Psicologia e a Ciência do Direito. Diante disso, este trabalho trata-se de uma revisão bibliográfica que visa conceituar a mediação da informação em áreas distintas e analisar a importância dessa atividade em cada segmento. Quanto aos aspectos metodológicos, esta pesquisa é de natureza aplicada, enquadrando-se nos objetivos exploratório e descritivo. (shrink)

Tienen razón Francisco Lara y Olga Campos en afirmar en la introducción de su libro que “un mérito importante de este libro es que, de manera muy divulgativa, pretende dar respuestas filosóficas al debate sobre nuestra relación con los animales al aplicar ideas bási- cas a cuestiones prácticas como si debemos ser o no vegetarianos, si hay que experimentar con animales o hasta qué punto son justifica- bles las corridas de toros” (p. 15). Y efectivamente, de una manera (...) muy clara, el libro no sólo pretende, sino que en efecto da respuestas a cuestiones centrales sobre nuestra relación con los animales, en particular a la cuestión acerca de cuál es su estatus o su valor moral y, por ende, sobre si tenemos obligaciones morales hacia ellos. Su tesis es que los animales sí tienen un estatus moral independiente de los intereses humanos, que tienen derechos y que es nuestra obligación moral respetarlos. Parte de ese respeto consiste en no tratarlos como meros instrumentos o recursos al servicio de los inte- reses de los humanos. (shrink)

Does justice require that individuals get what they deserve? Serena Olsaretti brings together new essays by leading moral and political philosophers examining the relation between desert and justice; they also illuminate the nature of distributive justice, and the relationship between desert and other values, such as equality and responsibility.

This article examines our moral obligations to refugees and stateless people. I argue that in order to understand our moral obligations to stateless people, both de jure refugees and de facto stateless people, we ought to reconceptualize the harm of statelessness as entailing both a legal/political harm (the loss of citizenship) and an ontological harm, a deprivation of certain fundamental human qualities. To do this, I draw on the work of Hannah Arendt and show that the ontological deprivation has three (...) distinct though interconnected elements: a reduction to the merely human or bare life, a separation from the common realm of humanity and abandonment, and the diminishment of agency or ability to act in the Arendtian sense. If we pull apart the legal/political harm of statelessness from the ontological harm, we are better able to see that we can address some of the features of the ontological deprivation even though we may not be able to rectify the political harm. I conclude this article by discussing some suggestions that follow from a recognition of the reality and harm of the ontological deprivation. (shrink)

The article is devoted to strategies of resistance in late modernity, in particular the forms that find expression in the literature of the generation that entered adulthood during the global financial crisis (2008). The two most important strategies analysed in the article are sleep and other forms of passivity, which have been observed in both the works of millennials and the forms of refusal and resistance in the areas of work and politics in recent years. The theoretical inspirations of the (...) article include Lauren Berlant and her Cruel Optimism and Judith Butler’s works on gathering in public space, as well as another study touching upon the issues of passivity, waiting and opposition. The article considers the possibility of reversing the traditional hierarchy of protest and resistance, and reflects on the possible meaning that the refusal to gather or sleep or, on the other hand, the refusal to be patient and wait may have in modern times. The compensatory desert argument is an argument that purports to justify inequalities in (some) incomes generated by a free labour market. It holds, first, that the principle of compensation is a principle of desert; second, that a distribution justified by a principle of desert is just; and third, that (some) rewards people reap on a free labour market are compensation for costs they incur. It concludes that therefore, a distribution of (some) rewards generated by a free labour market is just. (...) In this chapter I criticise the first two premises of this argument. I argue that the principle of compensation is not a principle of desert (sections 3 and 4), and that a distribution of deserved compensatory payments may be unjust (sections 5 and 6). Before developing my critique of the compensatory desert argument, I start by illustrating further that argument in the version of it which has been defended by Julian Lamont (section 1), and to dispel two objections that have been moved against the view that compensation is a principle of desert. “Love hurts”—as the saying goes—and a certain amount of pain and difficulty in intimate relationships is unavoidable. Sometimes it may even be beneficial, since adversity can lead to personal growth, self-discovery, and a range of other components of a life well-lived. But other times, love can be downright dangerous. It may bind a spouse to her domestic abuser, draw an unscrupulous adult toward sexual involvement with a child, put someone under the insidious spell of a cult leader, and even inspire (...) jealousy-fueled homicide. How might these perilous devotions be diminished? The ancients thought that treatments such as phlebotomy, exercise, or bloodletting could “cure” an individual of love. But modern neuroscience and emerging developments in psychopharmacology open up a range of possible interventions that might actually work. These developments raise profound moral questions about the potential uses—and misuses—of such anti-love biotechnology. In this article, we describe a number of prospective love-diminishing interventions, and offer a preliminary ethical framework for dealing with them responsibly should they arise. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Eight papers are discussed: two concern the management and use of documents available on the World Wide Web, (...) and six apply machine learning techniques to a variety of legal applications. This article reports a study carried out in order to measure how semantic factors affect reductions in the difficulty of the Chinese Ring Puzzle (CRP) that involves removing five objects according to a recursive rule. We hypothesised that semantics would guide inferences about action decision making. The study involved a comparison of problem solving for two semantic isomorphic variants of the CRP ( fish and fleas ) with problem solving for the puzzle's classic variant (the Balls and Boxes problem; Kotovsky (...) learning involves generalising the relations within a coherent, interconnected whole that makes up the puzzle's rules. It seems that semantics make it easier for the puzzle's elements to be grouped together within coherent, meaningful wholes, which reduces relational complexity and facilitates problem solving. Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

Sufficient conditions are given such that a random variable is maximal if and only if it is a Bayes random variable. The aim of this paper is to present the activities and research methodologies of CTL, a laboratory of the Scuola Normale Superiore of Pisa, founded and directed by Lina Bolzoni. CTL’s objective is to investigate the complex structure of relationships between the linguistic and the figurative code in literary tradition, paying particular attention to the XVth, XVIth and XVIIth centuries and using information technologies both as an auxiliary research tool and as a medium for scientific dissemination. Here I shall be (...) discussing the Centre’s digitalization projects, and in particular the project concerned with the Orlando Furioso and its remediation into images. This project, active since 2007, is, I believe, particularly representative of the progressive implementation within CTL of both traditional and computer-related methodologies in the planning of digital collections dedicated to words and images. This paper is an exploration of the role of conscience in the justification of human rights. I argue that in both the western tradition of natural rights and the non-western traditions, human rights are justified, in part, because of their appeal to conscience, and not simply because they issue from a divine source or are based on reason. In contrast, contemporary justifications of human rights primarily look for an objective foundation or simply assert the pragmatic importance of human rights as (...) their justification. While there are distinct advantages to this way of arguing, there are also problems, which I will discuss. As an alternative, I outline Arendt's understanding of conscience as the ability to be with and think with one's self as a secular alternative to both a non-secular version of conscience, and the denial of conscience implicit in contemporary theories. Her view of political judgment helps us to understand how conscience can be understood as subjective but not arbitrary. This paper brings Arendt's insights on conscience and judgment to bear on contemporary discourses of human rights. (shrink)

Parental consent poses challenges to needed research with adolescents who identify as lesbian, gay, bisexual, transgender, queer and/or questioning (LGBTQ+) and are at heightened risk for negative health outcomes. Obtaining parental consent in studies focused on LGBTQ+ issues can prove arduous if adolescents have not yet disclosed their identity or have unsupportive guardians. Institutional Review Boards (IRBs) may be hesitant to grant waivers of parental consent, yet research suggests that studies requiring parental consent deter the participation of adolescents who identify (...) as LGBTQ+. In this article, ethical considerations regarding waivers of parental consent in the context of the American Psychological Association’s (APA) general ethical principles are reviewed and recommendations for psychological researchers seeking waivers of parental consent are offered. A vignette is used to demonstrate a question-and-answer guide to help determine if a waiver of parental consent is ethically justified. (shrink)
