Philosopher Judith Butler has influenced how people talk about vulnerable bodies and sees vulnerability as universal, existential, and relational. Being vulnerable is part of the human condition. The main theoretical areas that run across Butler’s work; power, knowledge and subjectivity, performativity, and ethics—are of particular relevance to nursing practice. This review aims to explore how Butler’s theoretical work is reflected in research literature within a nursing context. We conducted a scoping review guided by Arksey and O’Malley’s methodological framework. A systematic (...) literature search of CINAHL (EBSCOhost), MEDLINE (Ovid), Embase (Ovid), PsycINFO (Ovid), and Web of Science identified 15 papers. Butler’s theoretical work was applied at an individual and social level in research literature within a nursing context. Nurses need to reflect on their clinical practice and role as health professionals in relation to power and performativity in encounters with patients who are marginalized. Nurses’ working conditions, recognition, and understanding are strongly influenced by society, and calling nurses heroes undermines their capacity to challenge and resist the hero identity. The healthcare system’s impact on patient-nurse encounters challenges patients’ and nurses’ subjectivity, performativity, and power relations. The review allowed us to describe how Butler’s theoretical work can facilitate a reflection on nursing practice which is a prerequisite for caring, ethical relationships, and working conditions within a nursing context. Butler’s concepts can provide useful perspectives on how nurses understand, communicate with, and care for patients, as well as a nuanced understanding of the nursing role and power relations and structures. In Brazil, the CNPq provides grants, funds and fellowships to productive scientists to support their investigations. They are ranked and categorized into four hierarchical levels ranging from PQ 1A to PQ 1D. Few studies, however, report and analyse scientific productivity in different sub-fields of Biomedical Sciences, e.g., Biochemistry, Pharmacology, Biophysics and Physiology. In fact, systematic comparisons of productivity among the PQ 1 categories within the above sub-fields are lacking in the literature. Here, the scientific productivity of 323 investigators receiving PQ (...) 1 fellowships in these sub-fields of BS was investigated. The Scopus database was used to compile the total number of articles, citations, h-index values and authorship positions in the most cited papers by researchers granted CNPq fellowships. We found that researchers from Pharmacology had the best performance for all of the parameters analysed, followed by those in Biochemistry. There was great variability in scientific productivity within the PQ 1A level in all of the sub-fields of BS, but not within the other levels. Analysis of the most cited papers of PQ 1 researchers in Pharmacology revealed that the citations of researchers in the 1C and 1D levels were associated with publications with their senior supervisors, whereas those in the 1B level were less connected with their supervisors in comparison to those in 1A. Taken together, these findings suggest that the scientific performance of PQ 1A researchers in BS is not homogenous. In our opinion, parameters such as the most cited papers without the involvement of Ph.D. and/or post-doctoral supervisors should be used to make decisions regarding any given researcher’s fellowship award level. Rules of origin (ROO) are pivotal element of the Greater Arab Free Trade Area (GAFTA). ROO are basically established to ensure that only eligible products receive preferential tariff treatment. Taking into consideration the profound implications of ROO for enhancing trade flows and facilitating the success of regional integration, this article sheds light on the way that ROO in GAFTA are designed and implemented. Moreover, the article examines the extent to which ROO still represents an obstacle to the full implementation of (...) GAFTA. In addition, the article provides ways to overcome the most important shortcomings of ROO text in the agreement and ultimately offering possible solutions to those issues. Bashar H. Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius (24–30). Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal (Griechische Bearbeitung des Codex 70) und Van der Waal (Comentar 111) hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Der Kommentar des Codex diente dazu, einen grundsätzlichen lateinischen Text griechischen Studenten zu verdeutlichen, und zwar ausgehend von einer reinen Übersetzung bis zu einem juristischen Kommentar. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)

This article shows the philosophical kinship between Adam Smith and Mary Wollstonecraft on the subject of love. Though the two major 18th century thinkers are not traditionally brought into conversation with each other, Wollstonecraft and Smith share deep moral concerns about the emerging commercial society. As the new middle class continues to grow along with commerce, vanity becomes an ever more common vice among its members. But a vain person is preoccupied with appearance, status, and flattery—things that get in the (...) way of what Smith and Wollstonecraft regard as the deep human connection they variously describe as love, sympathy, and esteem. Commercial society encourages inequality, Smith argues, and Wollstonecraft points out that this inequality is particularly obvious in the relationships between men and women. Men are vain about their wealth, power and status; women about their appearance. Added to this is the fact that most middle class women are both uneducated and encouraged by the conduct literature of their day to be sentimental and irrational. The combined economic and moral considerations of Wollstonecraft and Smith show that there is very little room for love in commercial society as they conceived it. (shrink)

Living in the digital world, we have little choice but to share our personal data with big tech companies. These companies use our data to direct our attention so that they can make money from advertising. In a so-called surveillance society, we stand in an asymmetrical power relationship to these companies (and sometimes governments) and have little to no control over what happens to our data. Our dependence on these asymmetrical relationships is increasing as “big tech” uses the information it (...) gathers about us to cater to our personal habits and desires. (shrink)

Shawn Loht's ground-breaking Phenomenology of Film: A Heideggerian Account of the Film Experience (2017) offers a detailed account of film experience as rooted in Martin Heidegger's existential structure of Dasein. Adapting Being and Time for a phenomenology of cinematic experience, Loht accurately describes how various existential structures of Dasein are “fostered” by the projected world of film: in Loht's account, being-in-the-world is extended in the film experience. Loht's project offers fertile ground for developing the phenomenological basis of film experience. Yet, (...) Loht anchors this account of film experience primarily in Heidegger's early philosophy; this leaves his adaptation not without challenges. First, if the structure of film experience is mapped too closely onto the notion of Dasein projecting itself into the filmworld, this theory presents the risk of taking the early Heidegger's “hands-on” approach too literally. Moreover, in its concern for Dasein's extensions into the world of film, Phenomenology of Film says little about the distinctly mediated character of filmworlds; this leaves ambiguous where the film experience effectively takes place. It has been argued that livestock farming is necessary to feed a growing population, that it enables efficient use of land and biomass that would otherwise be lost from the food system, that it produces manure that is necessary for crop cultivation, and helps improve the sustainability of cropping systems by inclusion of perennial forage crops in otherwise low-diversity crop rotations. In this paper, we analyze these arguments in favor of livestock farming. Through argumentation analysis based on scientific data, we (...) show that the arguments are either invalid or that their validity is limited to certain circumstances. Without taking into consideration any other potential arguments for livestock farming, or arguments against it, we conclude that the arguments analyzed here cannot in isolation provide justification for more than a small proportion of today’s livestock farming. This paper begins from one of the most commonly found questions in phenomenology, “What is Phenomenlogy?”, to argue that phenomenology is a trans-disciplinary approach to engaging with the products of human culture. This approach is characterized by paying particular attention to the distinction between facticity and transcendence within “lived experience” so as to help us better articulate and evaluate the promises that animate every human institution. In 'Een handvol filosofen' staan de filosofen centraal die sinds de oprichting van de Vrije Universiteit in 1880 aan deze instelling verbonden zijn geweest. Het gaat hierbij niet alleen om de inhoud van hun werk, maar ook om de personen zelf. Er waren filosofiedocenten die zich met de universiteit identificeerden en zich volledig konden ontplooien. Er waren er echter ook voor wie dit niet gold, die geïsoleerd of in gewetensnood raakten. Veel filosofiestudenten waren actief betrokken bij wat er in hun (...) faculteit gebeurde. Zij namen initiatieven, protesteerden soms tegen de gang van zaken en kozen partij in conflictsituaties. Sinds het eind van de jaren zestig van de twintigste eeuw verloor de Vrije Universiteit geleidelijk haar christelijk karakter. Tegenwoordig werken alle stafleden vanuit hun eigen motivatie mee aan een hoofdzakelijk seculier geworden universiteit, die ruimte biedt voor religieuze en levensbeschouwelijke diversiteit. (shrink)

Automated technologies and robots make decisions that cannot always be fully controlled or predicted. In addition to that, they cannot respond to punishment and blame in the ways humans do. Therefore, when automated cars harm or kill people, for example, this gives rise to concerns about responsibility-gaps and retribution-gaps. According to Sven Nyholm, however, automated cars do not pose a challenge on human responsibility, as long as humans can control them and update them. He argues that the agency exercised in (...) automated cars should be understood in terms of human–robot collaborations. This brief note focuses on the problem that arises when there are multiple people involved, but there is no obvious shared collaboration among them. Building on John Danaher’s discussion of command responsibility, it is argued that, although Nyholm might be right that autonomous cars cannot be regarded as acting on their own, independently of any human beings, worries about responsibility-gaps and retribution-gaps are still justified, because it often remains unclear how to allocate or distribute responsibility satisfactorily among the key humans involved after they have been successfully identified. Although much of the growing literature on organizational identity implicitly recognizes the normative nature of identity, the ethical implications of organizational identity work and talk have not yet been explored in depth. Working from a meta-ethical perspective, we claim that the dynamic, processual, and temporal activities recently associated with organizational identity always have an ethical dimension, whether "good" or "bad." In order to describe the ethical dimensions of organizational identity, we introduce the balance theory of practical wisdom as a theoretical (...) framework, and connect this theory to existing organizational identity concepts. We present an empirical case focused on an international paint company to illustrate the relevance of this theory for empirical organizational identity research. Our intention is to expand existing theory by bringing an aspect of organizational identity that has been tangentially acknowledged to the forefront, and by identifying it as a fruitful avenue for future theory development as well as empirical research.
