But as a matter of fact the majority of illnesses, even the most serious, attack us without warning. Sickness is nearly always a drama in two acts, of which the first takes place, cunningly enough, in the dim silence of bur tissues, with the lights out, (...) before the candles have been lit. Hart Memorial Lecture: "Life’s Dominion: An Argument About Abortion and Euthanasia." Dworkin is Professor of Philosophy and Frank Henry Sommer Professor of Law at New York University. He received B.A. degrees from both Harvard College and Oxford University, and an LL.B. from Harvard Law School and clerked for Judge Learned Hand. ABSTRACTIn April of 2000, Diana Levine went to a clinic in Vermont suffering from a migraine headache. She was given the drug Demerol for the migraine symptoms and Phenergan for nausea. Complications with the administration of Phenergan ultimately resulted in Ms. Levine contracting gangrene, necessitating the amputation of her right arm. Ms. Levine sued the drug maker, Wyeth Pharmaceutical, in state court and prevailed. The lower court's decision was appealed by Wyeth to the state supreme court where the ruling was (...) confirmed. Wyeth next appealed to the U.S. Supreme Court which, to the surprise of many observers, affirmed the judgment of the state supreme court. At issue was the fundamental question of the ability of consumers to obtain redress against negligent manufacturers in state courts. Wyeth's arguments to the Court were based upon preemption: Foodand Drug Administration approval of a drug preempts the ability of injured consumers like Ms. Levine to recover in state courts despite years of precedent to the contrary. Ability to recover damages in state courts represents, perhaps, the most important safety net available to consumers injured by defective products. A ruling by the Supreme Court that FDA‐approved labeling of pharmaceuticals preempts the reach of the state courts would have severely compromised the balance of power between consumers and producers. The university has lost its way. The world needs the university more than ever but for new reasons. If we are to clarify its new role in the world, we need to find a new vocabulary and a new sense of purpose. The university is faced with supercomplexity, in which our very frames of understanding, action and self-identity are all continually challenged. In such a world, the university has explicitly to take on a dual role: firstly, of compounding supercomplexity, so (...) making the world ever more challenging; and secondly, of enabling us to live effectively in this chaotic world. Internally, too, the university has to become a new kind of organization, adept at fulfilling this dual role. The university has to live by the uncertainty principle: it has to generate uncertainty, to help us live with uncertainty, and even to revel in our uncertainty. Ronald Barnett offers nothing less than a fundamental reworking of the way in which we understand the modern university. My thesis is that, although medicine is scientific, it is not and can not become a science. After rejecting as flawed an argument attempting to show that medicine is already a science, I argue that a comparison of such basic, defining features as internal aims, criteria of success, and principles regulating the enterprises demonstrate that medicine and science are inherently different. I then argue that while it may be possible to reduce the cognitive content of medicine to biology, medicine itself (...) cannot be reduced, for as an enterprise it possesses features that make it an inappropriate subject of reduction. Philosophers of religion divide neatly into two camps on the problem of evil: those who think it fatal to the concept of a loving God and those who do not. The latter have established a wide array of defensive positions down through the centuries, but none that has proved impregnable to sceptical attack. In his new book Mr Hick wisely abandons these older fortifications and falls back on highly mobile reserves. Not for him the ‘Fall of Man’ thesis, with its (...) unexplained choice to give up finite perfection; nor the Plotinian principle of plenitude, evil being an inevitable petering out of God's goodness; nor the ‘aesthetic’ gambit where the horrors of life constitute mere ‘shadows’ designed to highlight the beauty of creation; nor the ‘cosmic Toryism’, as someone called it, of Leibniz's ‘best of all possible worlds’; nor even, one might say gratefully, the gaseous obscurantism of Karl Barth's ‘das Nichtige’. All of these defences, and others besides, Mr Hick lumps together under what he calls ‘the majority report’ in Christian theodicy: the Augustinian tradition or type. In place of these venerable ramparts Hick elects the more fluid defence afforded, he thinks, by Irenaeus, Eastern Christianity and, in modern times, by Schleiermacher and a few contemporary thinkers. I critically evaluate the influential new wave account of theory reduction in science developed by Paul Churchland and Clifford Hooker. First, I cast doubt on claims that the new wave account enjoys a number of theoretical virtues over its competitors, such as the ability to represent how false theories are reduced by true theories. Second, I argue that the genuinely novel claim that a corrected theory must be specified entirely by terms from the basic reducing theory is in fact too (...) restrictive for scientific practice and should be rejected. Basic theories co-evolve with nonbasic theories in a mutually interactive way, and thus the basic theories incorporate the concepts and concerns of nonbasic theories. Third, I show that once its ontological consequences are duly noted, the reductive part the new wave account collapses into the classical theory developed within the logical empiricist tradition. As such, it still falls prey to standard anti-reductionist argument based upon multiple realizability and the cross-classification of special science and physical science terms. (shrink)

Most of all, it is limited imaginatively. The range of imagined options is narrow. The imagination has not been given anything even approaching a wide scope. As a result, our sense as to what a university could be and could become in the modern age is itself impoverished. If we are seriously to develop a (...) wide range of ideas of the university that is adequate to the challenges of the modern world, the imagination itself needs to be freed. Imagining the University seeks to address each of these sets of issues and will do so by first, identifying a very wide range of ideas of the university as it is now unfolding and could become; secondly, by evaluating those conceptions of the university with a classification of ideas of the university; and thirdly, by reflecting on the imagination itself, its current impoverishment and its possibilities. My thesis is that biology is most plausibly regarded as a universal, as distinct from a provincial, science. First, I develop the general notion of a provincial science, formulate three criteria for applying the concept, and present brief examples illustrating their use. Second, I argue that a consideration of population genetics as a characteristic example of a basic biological theory strengthens the prior presumption that biology is not a provincial science. Finally, I examine two arguments to the effect that biology (...) is a provincial science. The first concerns biology's exclusively terrestrial evidence base, the second the logical character of its laws. I introduce considerations that weaken the persuasiveness of the first argument and then show that the second one rests upon a false premise and so should be rejected. (shrink)
