Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common (...) features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. The volume is based on papers presented at a conference in Münster (Germany) in 2016 and comprises contributions by Judith Koschorke, Karen Meeschaut, Yvonne Prief, Ulrike Qubaja, Werner de Saeger, Ido Shahar, Katrin Seidel, Konstantinos Tsitselikis, Vishal Vora and Ihsan Yilmaz. Two experiments were conducted to investigate the roles of covariation and of causality in people's readiness to believe a conditional. The experiments used a probabilistic truth-table task (Oberauer & Wilhelm, 2003) in which people estimated the probability of a conditional given information about the frequency distribution of truth-table cases. For one group of people, belief in the conditional was determined by the conditional probability of the consequent, given the antecedent, whereas for another group it depended on the probability of (...) the conjunction of antecedent and consequent. There was little evidence that covariation, expressed as the probabilistic contrast or as the pCI rule (White, 2003), influences belief in the conditional. The explicit presence of a causal link between antecedent and consequent in a context story had a weak positive effect on belief in a conditional when the frequency distribution of relevant cases was held constant. A historical investigation of the exclusion of Africa and Asia from modern histories of philosophy.

Oaksford and Chater (1994) proposed to analyse the Wason selection task as an inductive instead of a deductive task. Applying Bayesian statistics, they concluded that the cards that participants tend to select are those with the highest expected information gain. Therefore, their choices seem rational from the perspective of optimal data selection. We tested a central prediction from the theory in three experiments: card selection frequencies should be sensitive to the subjective probability of occurrence for individual cards. In Experiment 1, (...) expected frequencies of the p- and the q-card were manipulated independently by concepts referring to large vs. small sets. Although the manipulation had an effect on card selection frequencies, there was only a weak correlation between the predicted and the observed patterns. In the second experiment, relative frequencies of individual cards were manipulated more directly by explicit frequency information. In addition, participants estimated probabilities for the four logical cases and of the conditional statement itself. The experimental manipulations strongly affected the probability estimates, but were completely unrelated to card selections. This result was replicated in a third experiment. We conclude that our data provide little support for optimal data selection theory. (shrink)

The hypothesis of two separate reasoning systems, one subserving individual goals and the other our genes, is theoretically implausible and not supported by the data. As an alternative, I propose a single system for analytical reasoning backed up by simple mechanisms for the selection of relevant information. This system can generate normative behavior as well as systematic deviations from it.

Oaksford & Chater (O&C) subscribe to the view that a conditional expresses a high conditional probability of the consequent, given the antecedent, but they model conditionals as expressing a dependency between antecedent and consequent. Therefore, their model is inconsistent with their theoretical commitment. The model is also inconsistent with some findings on how people interpret conditionals and how they reason from them.

I argue that O'Regan & Noë's (O&N's) theory is in a no better position than any other theory to solve the “hard problem” of consciousness. Getting rid of the explanatory gap by exchanging sensorimotor contingencies for neural representations is an illusion.

How (Not) to Be Secular is what Jamie Smith calls "your hitchhiker's guide to the present" -- it is both a reading guide to Charles Taylor's monumental work A Secular Age and philosophical guidance on how we might learn to live in our times. Taylor's landmark book A Secular Age (2007) provides a monumental, incisive analysis of what it means to live in the post-Christian present -- a pluralist world of competing beliefs and growing unbelief. Jamie Smith's book is a (...) compact field guide to Taylor's insightful study of the secular, making that very significant but daunting work accessible to a wide array of readers. Even more, though, Smith's How (Not) to Be Secular is a practical philosophical guidebook, a kind of how-to manual on how to live in our secular age. It ultimately offers us an adventure in self-understanding and maps out a way to get our bearings in today's secular culture, no matter who "we" are -- whether believers or skeptics, devout or doubting, self-assured or puzzled and confused. This chapter provides an introduction to higher-order metaphysics as well as to the contributions to this volume. We discuss five topics, corresponding to the five parts of this volume, and summarize the contributions to each part. First, we motivate the usefulness of higher-order quantification in metaphysics using a number of examples, and discuss the question of how such quantifiers should be interpreted. We provide a brief introduction to the most common forms of higher-order logics used in metaphysics, and indicate a (...) number of questions which can be raised in such systems using logical vocabulary alone. Using a further example, we return to applications of higher-order logics in metaphysics. We also mention key developments in the history of higher-order logic as it pertains to metaphysics. Finally, we mention certain arguments which have been raised against the use of higher-order logic, and some ways of responding to them. (shrink)

Practical deliberation often involves conditional judgements about what will (likely) happen if certain alternatives are pursued. It is widely assumed that the conditionals useful in deliberation are counterfactual or subjunctive conditionals. Against this, I argue that the conditionals of deliberation are indicatives. Key to the argument is an account of the relation between 'straightforward' future-directed conditionals like ' If the house is not painted, it will soon look quite shabby' and * "w e r e ' ' e d F (...) D C s like ' If the house were not to be painted, it would soon look quite shabby': an account on which both of these types of FDCs are grouped with the indicatives for semantic treatment and on which, while conditionals of both types are properly used in means/ends deliberations, those of the ' were'ed-up variety are especially well suited for that purpose. In the traditional form of canonical quantization, certain field components (not having “conjugate” momenta) must be regarded as noncanonical. This long-known distinction enters modern gauge theories, when they are canonically quantized as by Kugo and Ojima. We avoid that peculiarity by not using any conjugate “momenta” at all. In our formulation, canonical quantization can be related to Feynman's path integral.

Aggregating individuals’ consistent attitudes might produce inconsistent collective attitudes. Some groups therefore need the capacity to form attitudes that are irreducible to those of their members. Such groups, group-agent realists argue, are agents in control of their own attitude formation. In this paper, however, I show how group-agent realism overlooks the important fact that groups consist of strategically interacting agents. Only by eliminating group agency from our social explanations can we see how individuals vote strategically to gain control of their (...) groups and produce collective attitudes we cannot make sense of if we treat groups as agents. 'Pataphysics: The Poetics of an Imaginary Science is a survey that attempts to describe a hypothetic philosophy--the avant-garde pseudo-science imagined by Alfred Jarry. 'Pataphysics is a supplement to metaphysics, accenting it, then replacing it, in order to create a philosophic alternative, whose discipline can study cases, not of conception, but of exception: variance , alliance , and deviance . 'Pataphysics synthesizes the romantic schism between a literal, scientized discourse and a figural, poeticized discourse, and my thesis suggests that this revision (...) of the signifier "science" by 'pataphysics is symptomatic of a postmodern transition in science from a paradigm of absolutism to a paralogy of relativism. Structured as a descriptive explication, which emphasizes a theoretical perspective, this survey is divided into five chapters: the first chapter recounts the history of the conflict between science and poetry ; the second chapter examines the avant-garde pseudo-science of 'pataphysics itself ; and finally, the last three chapters discuss the influence of 'pataphysics upon the poetics of its subsequent successors . While my thesis focuses upon theories of textual poetics rather than poetry itself , my thesis does nevertheless strive to be as conceptually encyclopedic as 'pataphysics itself: instead of normalizing 'pataphysics within one theoretical perspective, this survey alludes intermittently to 'pataphysical enterprises that constitute exceptions to such a genealogy of Jarryites. What is at stake is the status of poetry in a world of science. How might poetry reclaim its own viable truth? How might science benefit from its own poetic irony? For the postmodern condition, such questions have already opened up a novel space for speculative imagination; hence, this survey presents itself as a kind of primer for a future of possible research.
