By promising, requesting and commanding we can give ourselves and each other reasons for acting as promised, requested, and commanded. Call this our capacity to give reasons robustly. According to the triggering account, we give reasons robustly simply by manipulating the factual circumstances in a way that triggers pre-existing reasons. Here I claim that we ought to reject the triggering account. By focusing on David Enoch’s sophisticated articulation of it, I argue that it is overinclusive; it cannot adequately distinguish between (...) threats and robust reason-giving; and it cannot adequately explain why epistemic reasons cannot be robustly given. I suggest that when we give reasons robustly, we do so directly, without explanatory intermediaries. (shrink)

Mark Greenberg argues that legal obligations are those moral obligations created by the actions of legal institutions in the legally proper way. Here I defend three main claims. First, I argue that, although very often misunderstood, Joseph Raz is also a defender of MITL. Secondly, I argue that while both Greenberg and Raz are committed to MITL, they disagree about the conditions under which a moral obligation can be said to be created in the legally proper way. Finally, I argue (...) that Raz’s variant of MITL is better than Greenberg’s. It rests on a more plausible account of authority and it avoids one of the crucial defects threatening Greenberg’s view, namely, its overinclusiveness. (shrink)

In a recent paper, Daniel Whiting has argued that there are no exclusionary reasons (i.e., second-order reasons not to act for a reason). The premise of the argument is what he calls the motivation constraint, according to which for the fact that p to be a reason for you to ϕ, it must be possible for you to ϕ for the reason that p. However, the argument goes, it is not possible to act (or not to act) for a reason (...) for a reason. Therefore, he concludes, there are no second-order reasons. In this paper, I shall argue that Whiting's argument ought to be rejected. Thus, I will argue that we should not accept the motivation constraint on which it is based. It is true that for the fact that p to be a reason for you to ϕ, it must be possible for you to ϕ guided in the right way by the consideration that p favours you ϕing. However, I shall argue that it is possible for exclusionary reasons to guide us in the right way, even if it not possible for us to not to ϕ for a reason for a reason. (shrink)

There are reasons to believe that conventional obligations are impossible. Thus, it could be argued that for me to have an obligation to Φ in virtue of the fact that a convention so requires, it must be the case that I have a convention-independent obligation to do something else such that, given the existence of the convention, Φing is a way of doing just that. But, then, my obligation to Φ would not really be conventional at all. On closer inspection, (...) so-called conventional obligations turn out to be no more than a specification of what our nonconventional obligations require given the circumstances. In this paper, I shall argue that contra to what this argument suggests, there can be genuinely conventional obligations. To do so, I develop a second-personal account of conventional obligations, according to which obligations are grounded by conventions in virtue of an explanation that does not follow the indicated pattern. In this paper I critically analyse Nino’s thesis according to which the epistemic value of democracy solves the paradox of the superfluousness of law. In this regard, I address two issues. First, if the epistemic value of democracy is a reason to believe that we have reasons to act in conformity with democratic laws. Second, if the epistemic value of democracy is a reason to act in conformity with democratic laws independently of the merits of the case and, in that case, if that can adequately explain the normativity of law. In a series of recent papers, Darwall has argued that Raz’s Normal Justification Thesis ought to be rejected. Here I shall argue that Darwall’s criticisms are unsuccessful. First, I argue that, contrary to what Darwall suggests, the NJT does not rely on an inference from the fact that B has a reason to treat A’s directives as protected reasons to the conclusion that A’s directives are protected reasons for B. Second, I argue that Darwall’s arguments to the effect that the (...) reasons that obtain in virtue of the satisfaction of NJT cannot ground accountability are either ill-conceived or insufficient. En este trabajo examino el concepto de normas permisivas y la distinción entre permisos débiles y permisos fuertes. En primer lugar, explico la distinción entre permisos débiles y fuertes, tal como fue presentada por Alchourrón y Bulygin. En segundo lugar, reconstruyo los argumentos de Alf Ross contra la noción de "normas permisivas", los que implícitamente socavan tal distinción. En tercer lugar, analizo las respuestas de Alchourrón y Bulygin a las objeciones de Ross, y sostengo que, en última instancia, no son (...) satisfactorias. La conclusión es que, a menos que se aduzcan otras razones, el concepto de normas permisivas y, por lo tanto, la distinción entre permisos débiles y fuertes, debería abandonarse. In this paper, I examine the concept of permissive norms and the distinction between weak and strong permissions. First, I explain the difference between weak and strong permissions as given by Alchourrón and Bulygin. Second, I reconstruct Alf Ross' arguments against the very notion of "permissive norms", which implicitly undermine the aforementioned distinction. Third, I analyse Alchourrón and Bulygin's answers to Ross' objections and claim that these answers are not satisfactory. In this article, we inquire into Maxine Sheets-Johnstone and Michele Merritt’s descriptions and use of dance improvisation as it relates to “thinking in movement.” We agree with them scholars that improvisational practices present interesting cases for investigating how movement, thinking, and agency intertwine. However, we also find that their descriptions of improvisation overemphasize the dimension of spontaneity as an intuitive “letting happen” of movements. To recalibrate their descriptions of improvisational practices, we couple Ezequiel Di Paolo, Thomas Buhrmann, and Xabier (...) E. Barandiaran’s enactive account of the constitution of agency with case studies of two expert performers of improvisation: a dancer and a musician. Our analyses hereof show that their improvisations unfold as a sophisticated oscillation of agency between specialized forms of mental and bodily control and, indeed, a more spontaneous “letting things happen.” In all, this article’s conclusions frame thinking in movement concerning improvisational practices as contextually embedded, purposively trained, and inherently relational. This is the first complete, one-volume English translation of the ancient Chinese text Xunzi, one of the most extensive, sophisticated, and elegant works in the tradition of Confucian thought. Through essays, poetry, dialogues, and anecdotes, the Xunzi articulates a Confucian perspective on ethics, politics, warfare, language, psychology, human nature, ritual, and music, among other topics. Aimed at general readers and students of Chinese thought, Eric Hutton’s translation makes the full text of this important work more accessible in English than ever (...) before. Named for its purported author, the Xunzi has long been neglected compared to works such as the Analects of Confucius and the Mencius. Yet interest in the Xunzi has grown in recent decades, and the text presents a much more systematic vision of the Confucian ideal than the fragmented sayings of Confucius and Mencius. In one famous, explicit contrast to them, the Xunzi argues that human nature is bad. However, it also allows that people can become good through rituals and institutions established by earlier sages. Indeed, the main purpose of the Xunzi is to urge people to become as good as possible, both for their own sakes and for the sake of peace and order in the world. I consider some of the objections that have been raised against a conceptualist solution to the “grounding problem”, I address in particular two objections that I call Conceptual Validity and Instantiation, and I attempt to answer them on behalf of the conceptualist. My response, in a nutshell, is that the first of these objections fails because it ascribes to the conceptualist some commitments that do not really follow from the view’s basic insight, while the second objection also fails because it (...) denies the conceptualist resources that the alternative positions are allowed to use. Recent crises in Europe and beyond have renewed a longstanding debate on the status and treatment of refugees. Hannah Arendt famously questioned the limits of universalistic human rights discourse based on the widespread phenomena of statelessness and displacement that emerged during and after World War II. In this paper, we analyze recent patterns of inclusion and exclusion of refugees in Italy through the lens of Arendtian narrative and theorizing. We consider three cases of interaction between families, schools, and other public (...) institutions in light of the shifting normative framework before and during the war in Ukraine. Two major insights emerge from this analysis. From a pedagogical point of view, the most promising educational practices with refugees are those centered on enabling their agency and corresponding experiences of "natality". From an ethical-political perspective, these practices highlight a latent tension between the universalistic scope of human rights enshrined in the human rights declarations and their structural dependence on the particular norms and procedures enacted by nation states. The understanding and teaching of human rights within our political communities is inseparable from the practices that engage with refugees. In this sense, our practices of inclusion and exclusion affect the understanding of national borders as a barrier or threshold with other political communities, but also the interpretation of our own ethical-political principles. Passive frame theory attempts to illuminate what consciousness is, in mechanistic and functional terms; it does not address the “implementation” level of analysis (how neurons instantiate conscious states), an enigma for various disciplines. However, in response to the commentaries, we discuss how our framework provides clues regarding this enigma. In the framework, consciousness is passive albeit essential. Without consciousness, there would not be adaptive skeletomotor action.

Workplace spirituality research has sidestepped religion by focusing on the function of belief rather than its substance. Although establishing a unified foundation for research, the functional approach cannot shed light on issues of workplace pluralism, individual or institutional faith-work integration, or the institutional roles of religion in economic activity. To remedy this, we revisit definitions of spirituality and argue for the place of a belief-based approach to workplace religion. Additionally, we describe the construction of a 15-item measure of workplace religion (...) informed by Judaism and Christianity – the Faith at Work Scale (FWS). A stratified random sample (n = 234) of managers and professionals assisted in refining the FWS which exhibits a single factor structure (Eigenvalue = 8.88; variance accounted for = 59.22%) that is internally consistent (Cronbach’s α = 0.77) and demonstrates convergent validity with the Faith Maturity Scale (r = 0.81, p > 0.0001). The scale shows lower skew and kurtosis with Mainline and Catholic adherents than with Mormons and Evangelicals. Validation of the scale among Jewish and diverse Christian adherants would extend research in workplace religion. (shrink)

What is the primary function of consciousness in the nervous system? The answer to this question remains enigmatic, not so much because of a lack of relevant data, but because of the lack of a conceptual framework with which to interpret the data. To this end, we have developed Passive Frame Theory, an internally coherent framework that, from an action-based perspective, synthesizes empirically supported hypotheses from diverse fields of investigation. The theory proposes that the primary function of consciousness is well-circumscribed, (...) serving the 'somatic nervous system[. For this system, consciousness serves as a frame that constrains and directs skeletal muscle output, thereby yielding adaptive behavior. The mechanism by which consciousness achieves this is more counterintuitive, passive, and “low level” than the kinds of functions that theorists have previously attributed to consciousness. Passive frame theory begins to illuminate (a) what consciousness contributes to nervous function, (b) how consciousness achieves this function, and (c) the neuroanatomical substrates of conscious processes. Our untraditional, action-based perspective focuses on olfaction instead of on vision and is 'descriptive' (describing the products of nature as they evolved to be) rather than 'normative' (construing processes in terms of how they should function). Passive frame theory begins to isolate the neuroanatomical, cognitive-mechanistic, and representational (e.g., conscious contents) processes associated with consciousness. (shrink)

In 'Een handvol filosofen' staan de filosofen centraal die sinds de oprichting van de Vrije Universiteit in 1880 aan deze instelling verbonden zijn geweest. Het gaat hierbij niet alleen om de inhoud van hun werk, maar ook om de personen zelf. Er waren filosofiedocenten die zich met de universiteit identificeerden en zich volledig konden ontplooien. Er waren er echter ook voor wie dit niet gold, die geïsoleerd of in gewetensnood raakten. Veel filosofiestudenten waren actief betrokken bij wat er in hun (...) faculteit gebeurde. Zij namen initiatieven, protesteerden soms tegen de gang van zaken en kozen partij in conflictsituaties. Sinds het eind van de jaren zestig van de twintigste eeuw verloor de Vrije Universiteit geleidelijk haar christelijk karakter. What role does the wild duck play in Ibsen's famous drama? I argue that, besides mirroring the fate of the human cast members, the duck is acting as animal subject in a quasi-experiment, conducted in a private setting. Analysed from this perspective, the play allows us to discern the epistemological and ethical dimensions of the new scientific animal practice (systematic observation of animal behaviour under artificial conditions) emerging precesely at that time. Ibsen's play stages the clash between a scientific and (...) a romantic understanding of animals that still constitutes the backdrop of most contemporary debates over animals in research. Whereas the scientific understanding reduces the animal's behaviour, as well as its environment, to discrete and modifiable elements, the romantic view regards animals as being at one with (or violently disconnected from) their natural surroundings. Anjan Chakravartty sostiene que – tradicionalmente - el debate realismo-antirrealismo científico ha sido eminentemente epistémico, estando en juego si debemos comprometernos o no con la creencia de que nuestras mejores teorías científicas son verdaderas o aproximadamente verdaderas y sus términos centrales refieren exitosamente a los aspectos del mundo. Sin embargo, las versiones contemporáneas del realismo científico muestran una clara tendencia hacia la profundización de los aspectos metafísicos de la ciencia, a tal punto que una de las características más prominentes de (...) estas son tesis metafísicas sustanciales. Frente a esta situación, Chakravartty afirma que, más allá de ciertos compromisos metafísicos “básicos” - basados en la práctica científica -, el realista científico puede mantener una postura más pragmática - incluso escéptica - frente a los compromisos metafísicos más “profundos”, más propios de la metafísica de la ciencia que del debate que nos compete. El presente trabajo se propone demostrar que los argumentos esgrimidos por Chakravartty no logran justificar dicha postura pragmática y ofrece un ejemplo en el cual dicha postura resulta insostenible para el realista científico. Large Language Models (LLMs) are generative AI systems capable of producing original texts based on inputs about topic and style provided in the form of prompts or questions. The introduction of the outputs of these systems into human discursive practices poses unprecedented moral and political questions. The article articulates an analysis of the moral status of these systems and their interactions with human interlocutors based on the Habermasian theory of communicative action. The analysis explores, among other things, Habermas's inquiries into (...) the analogy between human minds and computers, and into the status of atypical participants in the linguistic community such as genetically modified subjects and animals. Major conclusions are the LLMs seem to qualify as authors that originally participate in discursive practices but do display only a structurally derivative form of communicative competence and fail to meet the status of communicative agents. In this sense, while the contribution of AI writing systems in public discourse and deliberation can support the process of mutual understanding within the community of speakers, the human actors involved in the development, use, and diffusion of these systems share a collective responsibility for the disclosure of AI authorship and verification and adjudication of validity claims. Contra las imágenes que pretendían representar a las sociedades del siglo XXI como sociedades del conocimiento reflexivo (Beck, Giddens y Lash, 1997), en las que se habría vuelto finalmente posible un uso autorreflexivo y un control democrático de los efectos de la ciencia y la tecnología, vemos cómo reaparecen en la actualidad los viejos dilemas que Habermas había diagnosticado a finales de la década de 1960 sobre la función ideológica de la ciencia y la técnica. Tanto el dilema político, que (...) abarca el dislocamiento trágico entre la libertad y el sometimiento del sujeto que produce el discurso científico, como el dilema teórico, en el que la ciencia oscila entre la apertura y la clausura del mundo cultural, generan una serie de problemas que continúan exigiendo investigaciones teóricas y prácticas. En esta ocasión, quisiera pensar la actualidad de estos dilemas políticos y teóricos de la relación de la ciencia con la sociedad a través de una reflexión en dos pasos: primero, voy a intentar reactualizar el diagnóstico crítico que estudiaba las transformaciones de la ciencia y la técnica como nuevas formas de ideología, que seguía de cerca a las transformaciones de la esfera pública y el desarrollo de nuevas formas de poder que se justifican exclusivamente con criterios de perfeccionamiento técnico; luego, intentaré demarcar, mediante un análisis de algunos límites que este planteo podría tener en nuestra actualidad, cuáles son a mi entender los principales desafíos que la ciencia y la técnica vuelven a plantearle a nuestro mundo social contemporáneo. This book discusses and provides insight on the legal and ethical dilemmas of managing those with Fetal Alcohol Spectrum Disorder (FASD). This book provides a clear perspective for those clinicians and legal professionals who are working with those with this disorder, and correspondingly increases their understanding when arranging effective supports for this population. Historically, the primary focus on FASD has been on children. However, this is a lifelong disorder, and the implications of this disorder become even more prominent and complex (...) in adulthood. Those with this condition can struggle with impulsiveness, and a host of cognitive difficulties. This correspondingly impacts their independence and employability, and produces an elevated risk for homelessness and other residential issues, involvement in substance use, being exploited, development of behavioural issues, and subsequent legal difficulties. Their cognitive difficulties result in challenges for legal systems around the world to understand their issues, and to design appropriate remedial strategies, recommendations for treatments and supports, and even for understanding the failure of many of these individuals to be able to change their behaviours effectively. This produces various legal and ethical dilemmas, which are discussed in detail in this volume by 28 authors from Europe, New Zealand, and North America. These include discussions regarding the rights of the unborn child, the alcohol industry's duty to warn, whether small amounts of alcohol during pregnancy can be condoned, and even the current use of involuntary hospitalization for addicted mothers. Other chapters discuss the need for training on FASD for front line officers, use of lies during interrogation of those with FASD, medical and legal interventions for offenders with FASD, access to diagnostic services and follow-up supports, and whether FASD can be considered a mitigating factor for sentencing. Furthermore, caregivers also provide their stories regarding the daily dilemmas that are faced in raising those with FASD. (shrink)

From Physical World to Transcendent God(s): Mediatory Functions of Beauty in Plato, Dante and Rupa Gosvami -/- Dragana Jagušić -/- In various philosophical, religious and mystical traditions, beauty is often related to intellectual upliftment and spiritual ascent, which suggests that besides its common aesthetic value it may also acquire an epistemic, metaphysical and spiritual meaning or value. I will examine in detail three accounts in which beauty, at times inseparable from desire and love, mediates between physical, intellectual and spiritual levels (...) of existence. Since beauty, in all three accounts, takes on a mediatory role or function,1 I will name these mediations as follows: ancient Greek Eros-mediation or Beauty-mediation (Plato: ca. 429-347 BCE), late medieval Italian Beauty and Love-mediation (Dante Alighieri: 1265-1321) and pre-modern Indian Beauty and Love-mediation (Rūpa Gosvāmi: 1470/90-1564 CE).2 In the first section, I will analyse the stages of Eros or Beauty mediation in Plato; in the second section, I will turn to Dante’s Beauty and Love-mediation and compare it with Plato’s account. In the third section, I will analyse Rūpa’s account of Beauty and Love-mediation in comparison with both Plato and Dante. I will argue that there are certain patterns of mediation mutually shared if not between all three accounts, then at least between two of them. While Plato’s account clearly influenced Dante and was well integrated into Dante’s account, there is no mention or evidence of a pre-modern Bengali theologian influenced by ancient Greek and medieval Italian philosophy and mysticism. However, a strong convergence of elements of Beauty-mediations in Plato and Dante, as well as Beauty and Love-mediations in Dante and Rūpa Gosvāmi, confirms the universality of certain features of Beauty and Love-mediation and speaks in support of an all-inclusive account of them.3 -/- 1 By Beauty-mediation I mean an aesthetic, intellectual or spiritual reconciliation between opposites, such as human and divine, mortal and immortal, particular and universal, sexual and sacred and so on. 2 Rūpa Gosvāmi was an Indian theologian. How do actors cope when their repeated efforts to bring change seem futile? In this qualitative study, we consider sustainable development initiatives within a U.S. higher education institution where repeated efforts by actors led to nominal change. We focus on understanding how actors sought to enact sustainable development initiatives in the face of an unresponsive context, that is, in a context characterized by pressures to maintain the status quo. We show how actors’ attempts to embed sustainable development practices into the (...) university represent a dynamic process, characterized by periods of persistence and suspension. Our theorizing reveals that actors used three coping mechanisms to maintain focus on their sustainability goals: community building, resourcefulness, and vision. By emphasizing these dimensions of their initiatives, actors’ emotional response is focused on encouragement and hope to persist in a context that is largely unresponsive to sustainable development. Our study contributes to the sustainability literature by explicating how actors develop resilience in their efforts to pursue sustainable development in unresponsive contexts. (shrink)

En cuanto a Locke, hemos señalado su defensa de la tolerancia en nombre de la racionalidad, su reivindicación de la utilidad de una actitud tolerante como medio para preservar la coexistencia pacífica. Observamos que las contribuciones de ambos pensadores trascendieron ampliamente los horizontes de su tiempo para arribar a nuestros días con una vigencia sorprendente. De allí que estos autores se convierten en lecturas obligatorias sobre esta materia al intentar buscar posibles soluciones a uno de los problemas políticos más apremiantes. Sin embargo, es importante señalar que, en la historia del pensamiento político, el principio de tolerancia fue desarrollado, no solo por autores modernos, sino asimismo por autores medievales, entre ellos, Marsilio de Padua. Este pensador tuvo una influencia decisiva en el pensamiento filosófico-político de los teóricos modernos anteriormente mencionados a raíz de sus aportes a la discusión de la tolerancia, sus contribuciones en lo que se refiere a la circunscripción del poder pontificio, su crítica a la doctrina de la plenitudo potestatis papal y sus reflexiones en torno a la relación entre el poder temporal y espiritual. Por tal motivo, dedicamos un primer capítulo a presentar y analizar los argumentos filosóficos-políticos centrales de Marsilio de Padua, con el fin de señalar los alcances de este antecedente medieval en el desarrollo de la noción moderna del principio de tolerancia religiosa. En el segundo capítulo, examinamos los argumentos de Hobbes, e intentamos señalar que su preocupación central fue, no tanto la tolerancia religiosa, sino antes bien el problema de la regulación de la religión. En el tercer capítulo, pasamos revista de los aportes de Locke en lo que respecta a esta materia desde una perspectiva liberal. Por último, en el cuarto capítulo realizamos un estudio comparativo entre Marsilio y Hobbes, por un lado, y entre este último y Locke, por otro. (shrink)

In our research, we examine the efforts made by Latin American business schools in the last decade to deliver a value-based education. We carry out a survey with a sample of faculty members and program directors from the whole region. We find that societal demands influenced the direction of managerial education toward values and social responsibility, changing contents and teaching methodologies in the process. Our research shows that the teaching of value-based contents—social responsibility, business ethics and environmental sustainability—has gained ground (...) in the region in the last decade, and that the emphasis on value-based contents goes hand-in-hand with a more intensive use of active learning methodologies—the case method in particular. From the perspective of respondents, the emphasis on active learning seems to correlate positively with observed changes in students’ civility. (shrink)

This article seeks to contribute to the history of the idea of 'middle class', an idea that was fundamental to Aristotle's philosophy but disappeared from the repertoire of political thinking for centuries, re-emerging shortly before the French Revolution to be developed by Diderot and other French liberals. The modern notion of 'middle class' is compared with that of Aristotle, and the similarities between the two contexts of emergence -- the crisis of Ancient Greek democracy and that of the French Ancien (...) Régime -- are explored to cast new light on the meaning and political function of that idea, and on the metaphorical operations it performs. (shrink)
