In this paper a non-paradoxical interpretation of Hobbes’s defence of scientific realism of materialistic type is proposed. It attempts to explain how this author was able to defend the truth of materialism and at the same time to deny that it could be demonstrated in a metaphysical way. The key to his position depends on the metaphorical use of the concept of ‘imitation’ and the treatment of the infinite and irresistible power as the philosophically relevant attribute of God. So Hobbes’s (...) intention would consist of saying that the explanation, but not the demonstration, of the truth of materialism depends on the ontological parity and continuity between the world and the human being, in the way in which they are explained by empirical science. In this sense Hobbes’s project, very different to Descartes’s one, would be an attempt to naturalise the epistemology that yet is conscious of the metaphysical limits affecting the naturalistic proposals of philosophy. El objetivo de este artículo es analizar qué tipo de respuesta al escepticismo filosófico podemos esperar de los llamados argumentos transcendentales. La conclusión general es que los argumentos transcendentales no son capaces de neutralizar las dudas escépticas en tanto que formulaciones verbales de posibilidades lógicas. Ahora bien, teniendo en cuenta que el escéptico no puede presentar sus dudas significativamente, parece que sólo tiene tres opciones: dudar con la ayuda de un silencio místico, dudar usando las palabras de una manera metafórica (...) o evocativa, o dudar usando las palabras con sentido literal pero siendo consciente de estar diciendo algo sin sentido. En suma: la duda escéptica nunca puede tener el valor de una duda real. (shrink)

This paper is devoted to analyse both the epistemology and ontology of James’s pragmatism and his metaphysical proposals. The conclusions are: first, that James did not defend a metaphysical realism, but a anti-realist realism; and secondly that this position was what he needed to defend the possibility of human freedom and religious experience.

The concept of randomness has been unjustly neglected in recent philosophical literature, and when philosophers have thought about it, they have usually acquiesced in views about the concept that are fundamentally flawed. After indicating the ways in which these accounts are flawed, I propose that randomness is to be understood as a special case of the epistemic concept of the unpredictability of a process. This paper aims at reconstructing how the positive image of Octavian resp. Augustus, which can be found in the Greek literature of the early 2nd century AD (e. g. in Plutarch), was formed. During their conflict with Octavian, Marc Antony and his party were creating an image of their opponent which displayed numerous forms of disparagement and of invective elements. After his victory, Octavian faced the challenge to restore his reputation also in the Greek East. As a starting point for (...) this restoration he provided his autobiography, which was probably published at an early date, i. e. about the late 20s BC. At the same time, both in poetry (Crinagoras) and prose (Dionysius of Halicarnassus and Strabo) an image of the princeps as a bringer of peace and culture was created. After a cooperation with Timagenes had failed, Nicolaus of Damascus added to the positive image of Augustus by composing a panegyrical biography of Augustus which incorporated also his childhood and youth. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. The first segment starts with a definition of two dimensions of the concept of rule of law; related to the notion of sovereignty and as a concept to control arbitrariness on the part of the ruler. The segment proceeds to give a historical account of the notion and the different stages of its epistemological configuration, from the ancient Greek notion of Eunomia and its incompatibility with the popular rule to the current notion, where the rule of law has become fused (...) with democracy and human rights. The first segment also focuses on the relation between the concept of the rule of law and other principles, such as proportionality, neutrality, and effectiveness. The second segment of the paper analyses the phenomenon of juridification of the rule of law in international treaties and domestic constitutions. It pays particular attention to the role that constitutional accommodation plays in the process of rationalization of the rule of law as a prerequisite to its idealization and mystification. It analyses the reason why this principle is an essential feature of the constitutionalism despite the inner plurality of legal systems. The next aspect, analysed in the third segment of this paper, is the messianic use of the concept of the rule of law. The paper performs a critical definition of messianic, covering a theological perspective and the different theories and concepts that go hand in hand with the idea of the Messiah, such as the “coming”, prophetical and apocalyptical messianism, the phenomena of eschatology, expiation and redemption pictured in Judaism. The segment also covers the secular transplantation of the messianic thought. The last segment is a conclusion returning to the themes identified in the paper and summarises how the messianic thought is applied in the realm of the rule of law. (shrink)

Philosophers and theologians from within Europe respond to Caputo's attempt to configure a less rigid, less dogmatic form of religion. These scholars, in turn, receive responses by Caputo, thereby strengthening the development of radical theology in Europe and abroad.

En este artículo se analiza cuál pudo haber sido la antropología filosófica del segundo Wittgenstein. La conclusión es que, para el Wittgenstein maduro, los seres humanos son animales expresivos, simbólicos, intencionales, creativos, rituales y ubicados que, a partir de su naturaleza común pero a través socializaciones divergentes, crean significaciones,instituciones, reglas, es decir, realidades intensionales, mundos.

En este trabajo se analizan los argumentos de Berkeley a favor del inmaterialismo. Especial atención se dedica al argumento a priori que subyace en el lema esse est percipi, y sobre todo a la manera en que Berkeley entiende el concepto de existencia y el valor metafísico que otorga a su significación. Asimismo, se explica también cómo este inmaterialismo es un espiritualismo o realismo teológico puesto al servicio de causas apologéticas.

This article intends to analyze, in general, the romantic roots of Wittgenstein thought and, specifically, what could have been the position of Wittgenstein, especially the second Wittgenstein, on the philosophical problem of the language-reality relationship. No doubt it is a bold exercise, since Wittgenstein did not openly deal with this question, and would have considered it nonsense. However, its elucidation- the idea that Wittgenstein was committed to antirealism- seems to make his conception of language more understandable, and in particular how (...) private languages would not be possible. En este escrito se analiza la significación y el uso filosófico que Wittgenstein dio en su pensamiento maduro al concepto de forma de vida. Así, aunque se señala que Wittgenstein sólo hizo uso de dicho concepto en el contexto de la justificación de la praxis lingüística como límite epistemológico, se enfatiza no obstante que en ese uso ya es posible vislumbrar una cierta concepción antropológica sobre los seres humanos como animales de conducta expresiva, intencional, simbólica, lingüística generadora de reglas y (...) amante de regularidades. El artículo acaba con un análisis del problema de la forma de vida de los animales y su relación con la forma de vida humana: en concreto se destaca el carácter lingüístico y cultural de la forma de vida humana, y se muestran los límites en la atribución a los animales no-humanos de los predicados mentales humanos. En este artículo se pretende analizar hasta qué punto las filosofías de Ortega y Wittgenstein compartirían un horizonte filosófico común. En este sentido se presentan, aunque con matices distintos, los siguientes elementos comunes: el rechazo del realismo metafísico y el cientismo, el abandono de la concepción sustancialista del sujeto, la irrupción en la discusión filosófica del significado o el sentido como algo que necesita comprensión o aclaración, la urgencia de solucionar el problema de la autenticidad.

We examined social facilitation and emotional convergence in amusement, sadness, and fear in dynamic interactions. Dyads of friends or strangers jointly watched emotion-eliciting films while they either could or could not communicate nonverbally. We assessed three components of each emotion (expressions, appraisals, and feelings), as well as attention to and social motives toward the co-participant. In Study 1, participants interacted through a mute videoconference. In Study 2, they sat next to each other and either were or were not separated by (...) a partition. Results revealed that facilitation and convergence are not uniform across different emotions and emotion components. Particularly strong supporting patterns emerged for the facilitation of and convergence in smiling. When direct interaction was possible (Study 2), friends showed a general tendency for strong convergence, with the exception of fear-related appraisals. This suggests that underlying processes of emotional contagion and social appraisal are differentially relevant for different emotions. (shrink)

There is something puzzling about statistical evidence. One place this manifests is in the law, where courts are reluctant to base affirmative verdicts on evidence that is purely statistical, in spite of the fact that it is perfectly capable of meeting the standards of proof enshrined in legal doctrine. After surveying some proposed explanations for this, I shall outline a new approach – one that makes use of a notion of normalcy that is distinct from the idea of statistical frequency. (...) The puzzle is not, however, merely a legal one. Our unwillingness to base beliefs on statistical evidence is by no means limited to the courtroom, and is at odds with almost every general principle that epistemologists have proposed as to how we ought to manage our beliefs. According to a captivating picture, epistemic justification is essentially a matter of epistemic or evidential likelihood. While certain problems for this view are well known, it is motivated by a very natural thought—if justification can fall short of epistemic certainty, then what else could it possibly be? In this paper I shall develop an alternative way of thinking about epistemic justification. On this conception, the difference between justification and likelihood turns out to be akin to the more widely recognised difference (...) between ceteris paribus laws and brute statistical generalisations. I go on to discuss, in light of this suggestion, issues such as classical and lottery-driven scepticism as well as the lottery and preface paradoxes. (shrink)

In der Vorlesung des Sommersemesters 1927 unter dem Titel Die Grundprobleme der Phanomenologie nimmt Martin Heidegger eine Neue Ausarbeitung des 3. Abschnitts des I. Teiles von 'Sein und Zeit' in Angriff. Der Gesamtbestand der Grundprobleme der Phanomenologie in ihrer Systematik und Begrundung besteht in der Diskussion der Grundfrage nach dem Sinn von Sein uberhaupt und der aus ihr entspringenden Probleme. Die so gekennzeichnete Thematik von Zeit und Sein wird auf dem Umweg einer phanomenologischen Erorterung von vier geschichtlichen Thesen uber (...) das Sein behandelt. Die phanomenologisch-kritische Diskussion dieser Thesen fuhrt zu der Einsicht, dass allem zuvor die Grundfrage nach dem Sinn von Sein uberhaupt beantwortet sein muss, um die aus den vier geschichtlichen Thesen herausgeschalten vier Grundprobleme in zureichender Weise systematisch ausarbeiten zu konnen. Recent years have seen an explosion of interest in metaphysical explanation, and philosophers have fixed on the notion of ground as the conceptual tool with which such explanation should be investigated. I will argue that this focus on ground is myopic and that some metaphysical explanations that involve the essences of things cannot be understood in terms of ground. Such ‘essentialist’ explanation is of interest, not only for its ubiquity in philosophy, but for its being in a sense an ultimate (...) form of explanation. I give an account of the sense in which such explanation is ultimate and support it by defending what I call the inessentiality of essence. I close by suggesting that this principle is the key to understanding why essentialist explanations can seem so satisfying. (shrink)

Sentence comprehension involves maintaining and continuously integrating linguistic information and, thus, makes demands on working memory. Past research has demonstrated that semantic WM, but not phonological WM, is critical for integrating word meanings across some distance and resolving semantic interference in sentence comprehension. Here, we examined the relation between phonological and semantic WM and the comprehension of center-embedded relative clause sentences, often argued to make heavy demands on WM. Additionally, we examined the relation between phonological and semantic WM and the (...) comprehension of transitive and dative active and passive sentences, which may also draw on WM resources depending on the number of propositions that must be maintained and the difficulty of processing passive clauses. In a large sample of individuals with aphasia, we assessed whether comprehension performance on more complex vs. simpler active-passive or embedded relative clause sentences would be predicted by semantic but not phonological WM when controlling for single word comprehension. For performance on the active-passive comprehension task, we found that semantic WM, but not phonological WM, predicted comprehension of dative sentences when controlling for comprehension of transitive sentences. We also found that phonological WM, but not semantic WM, predicted mean comprehension for reversible active-passive sentences when controlling for trials with lexical distractors. On the relative clause comprehension task, consistent with prior results, we found that semantic WM, but not phonological WM, predicted comprehension of object relative clause sentences and relative clause sentences with a passive construction. However, both phonological WM and semantic WM predicted mean comprehension across all relative clause types for reversible trials when controlling for trials with lexical distractors. While we found evidence of semantic WM’s role in comprehension, we also observed unpredicted relations between phonological WM and comprehension in some conditions. Post-hoc analyses provided preliminary evidence that phonological WM maintains a backup phonological representation of the sentence that may be accessed when sentence comprehension processing is less efficient. Future work should investigate possible roles that phonological WM may play across sentence types. (shrink)

According to the principle of Conjunction Closure, if one has justification for believing each of a set of propositions, one has justification for believing their conjunction. The lottery and preface paradoxes can both be seen as posing challenges for Closure, but leave open familiar strategies for preserving the principle. While this is all relatively well-trodden ground, a new Closure-challenging paradox has recently emerged, in two somewhat different forms, due to Backes :3773–3787, 2019a) and Praolini :715–726, 2019). This paradox synthesises elements (...) of the lottery and the preface and is designed to close off the familiar Closure-preserving strategies. By appealing to a normic theory of justification, I will defend Closure in the face of this new paradox. Along the way I will draw more general conclusions about justification, normalcy and defeat, which bear upon what Backes :2877–2895, 2019b) has dubbed the ‘easy defeat’ problem for the normic theory. In this article we consider certain elements of the normative theory of Jürgen Habermas in the light of the proposals of Bruce Ackerman, with a view to strengthening a concept of deliberative democracy applied to the legitimation of juridical rules. We do not construct a hierarchy of the two positions, but seek to bring together certain elements to achieve a common project. As the starting point for examining the work of the two authors, we take the scheme proposed by Habermas (...) in Faktizität und Geltung. In this connection, through the work of Ackerman, we intend to fill in some of the gaps that Habermas appears to have left in the theory of radical democracy applied to the law. The work of Ackerman can make a significant contribution to deliberative democracy, to the discourse principle that Habermas defines, and to the contractualist theories from a liberal perspective. The study of these contributions makes possible a critical judgment that enables the legitimation of juridical rules carried out by Habermas to acquire greater practicity. In examining the epistemological status of juridical science and law, we attempt to determine the weight and the performance of normative democracy. In Tarr's view, it is a matter for philosophers to examine direct democracy and its desirability. (shrink)

In this paper, I identify a theoretical and political role for ‘white ignorance’, present three alternative accounts of white ignorance, and assess how well each fulfils this role. On the Willful Ignorance View, white ignorance refers to white individuals’ willful ignorance about racial injustice. On the Cognitivist View, white ignorance refers to ignorance resulting from social practices that distribute faulty cognitive resources. On the Structuralist View, white ignorance refers to ignorance that results as part of a social process that systematically (...) gives rise to racial injustice, and is an active player in the process. I argue that, because of its greater power and flexibility, the Structuralist View better explains the patterns of ignorance that we observe, better illuminates the connection to white racial domination, and is overall better suited to the project of ameliorating racial injustice. As such, the Structuralist View should be preferred. (shrink)

In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.

I argue for adopting a conception of obligation that is broader than the conception commonly adopted by moral philosophers. According to this broader conception, the crucial marks of an obligatory action are, first, that the reasons for the obliged party to perform the action include an exclusionary reason and, second, that the obliged party is the appropriate target of blaming reactive attitudes, if they inexcusably fail to perform the obligatory action. An obligation is directed if the exclusionary reason depends on (...) the relationship between the obliged person and the person to whom they owe the obligatory action, and the latter person is positioned to personally blame the obligated person for inexcusably failing to perform the obligatory action. Some direc- ted obligations are not owed as a matter of right, and the person to whom the obligatory action is owed is the only person positioned to blame nonperformance. Other directed obligations are owed as a matter of right, and people who are not part of the relationship grounding the obligation nevertheless are also positioned to (impersonally) blame non-performance. Only the rights-based form of directed obligation has received signifi- cant attention from moral philosophers, yet the former—which is at the heart of what I call “personal bonds”—is a pervasive and significant theme of our ordinary interpersonal lives. One of the most intriguing claims in Sven Rosenkranz’s Justification as Ignorance is that Timothy Williamson’s celebrated anti-luminosity argument can be resisted when it comes to the condition ~K~KP—the condition that one is in no position to know that one is in no position to know P. In this paper, I critically assess this claim.
