I address the long-standing problem of toleration in diverse liberal societies in light of the progress of same-sex marriage and continued vehement opposition to it from a significant portion of the population. I advance a view that contrasts with recent discussions by Teresa Bejan, Mere Civility, and especially Cecile Laborde, Liberalism’s Religion. Laborde emphasizes the importance of state sovereignty in fixing the boundaries of church and state, emphasizing the priority of public authority and constitutional supremacy. I argue that emphasis on (...) priority needs to be complemented by a recognition of the importance of forms of reconciliation that go beyond ‘mere civility’. Reflections on toleration in the liberal and democratic traditions – including in the canonical discussions of Locke, Rousseau, Smith and Tocqueville, and in more recent political science – have recognized that the health of liberal democracy benefits enormously from the educative and morally formative resources furnished by religious c... The opening strophe of the parodos in Sophocles’ Trachiniae takes the form of a prayer to the sun. Many of its traditional hymnic features have already been noted, but one of them seems to have escaped the attention so far. In some Greek prayers - and in prayers from other Indo-European traditions as well - the appeal for the deity to come or to listen is accompanied by a list of the possible places the god might be in, phrased in (...) the following terms: “whether you are in A or in B or in C…”. In the specific case of the disjunctive clause in the Trachiniae (100-101), it is my contention that Sophocles, by syntactic and structural means, remodels this traditional prayer motif in order to achieve his literary purpose of exalting Heracles by asking of his whereabouts in a language reminiscent of a prayer addressed most properly to a deity. Ao tomar como referência o projeto de formação Direitos Humanos e diversidade afetivo-sexual na escola: homofobia, trabalho docente e cotidiano escolar, o texto busca sistematizar aspectos relacionados ao referido projeto, tendo em vista possibilitar que os professores em processo de formação construam novos modos de intervenção e práticas no seu cotidiano, capazes de combater o preconceito e promover a igualdade, no que concerne à homofobia no cotidiano social e escolar. É importante salientar que as questões especificamente sobre orientação sexual, homossexualidade (...) e homofobia devem estar situadas no âmbito de discussão dos Direitos Humanos e devem, necessariamente, partir de uma compreensão sócio-histórica e cultural dessas questões, objetivando a incorporação, por parte do corpo docente, da transversalidade deste tema quando na construção do projeto político-pedagógico da Unidade Escolar, enfatizando o respeito às diferenças com o fito de promover a construção de alternativas práticas de trabalho. O texto organiza-se a partir de duas entradas sobre narrativas biográficas e fabricação de identidades, especialmente no que se refere aos dispositivos e às práticas disciplinares construídas no cotidiano escolar, no tocante à homossexualidade. A primeira entrada centra-se na discussão dos conceitos de biografização, identidade e formação como modos de narração constituídos de discursos da memória, a partir da centralidade do sujeito que narra, na perspectiva de analisar modos próprios vividos pelos professores sobre a homofobia na escola. A segunda entrada analisa questões concernentes à fabricação da igualdade, à estruturação de dispositivos pedagógicos engendrados no cotidiano escolar, no tocante à homossexualidade, no que se refere à construção de um projeto de homogeneização e negação das diferenças. Assim, tenciono discutir conceitos de igualdade e de diferença e de que forma escamoteia-se, a partir do “micropoder”, do “disciplinamento” – “poder disciplinar” – e do “dispositivo de sexualidade”, mecanismos tácitos e silenciosos inerentes à educação sexual com base nas relações entre corpo-poder-saber e suas correlações com o disciplinamento, o qual demarca papéis sociais e sexuais do processo identitário do adolescente e da polifonia de expressões da homossexualidade e de experiências homofóbicas na cultura social e escolar. Se discute la atribución a Pitágoras de la creación de esos términos a partir de la importancia decisiva de Platón y Aristóteles en el establecimiento y configuración de la doxografía.

The authors present a case study involving truth telling responsibilities in the setting of nonepileptic seizures. Specifically, over the course of several suspected nonepileptic seizures, a patient’s seizures stopped after he received a saline flush meant to precede the administration of anti-seizure medication. The patient and his surrogate believed he had received the medication each time, and the team wondered whether they should disclose the truth. Some worried that disclosure would reinforce the suspected psychogenic behavior, exacerbating the patient’s condition. In (...) this way, the case study presents a twist on the traditional truth telling archetype. While most truth telling cases center on navigating cultural differences or worries about emotional harm, this case presented concerns about medical harm in the form of exacerbating the patient’s condition. The authors describe the complex patient-family-team dynamic that preceded this ethical dilemma, describe the case, analyze the ethical issue, and describe the outcome. (shrink)

O estudo visa evidenciar o lugar que os princípios primeiros ocupam na filosofia moral de Alasdair MacIntyre, bem como o conceito de teleologia a eles articulado. Consistirá, no estudo panorâmico das categorias centrais da ética das virtudes de MacIntyre, onde ele constrói sua teoria da racionalidade das tradições que, por sua vez, é essencial para sua compreensão da retomada da ética aristotélica das virtudes e o papel dos princípios primeiros na sua filosofia moral. A partir destes, o desenvolvimento do artigo (...) se dá com a identificação do lugar que os primeiros princípios ocupam na filosofia moral de MacIntyre, como também a relevância que eles têm para o desenvolvimento de sua teoria do resgate da ética aristotélica. Why is it important for people to agree on and articulate shared reasons for just laws, rather than whatever reasons they personally find compelling? What, if any, practical role does public reason play in liberal democratic politics? We argue that the practical role of public reason can be better appreciated by examining the confluence of normative and positive political theory; the former represented here by liberal social contract theory of John Rawls and others, and the latter by rational choice or (...) game theory. Citizens in a diverse society face a practical as well as a moral problem. How can they have confidence that others will reciprocate their commitment to supporting governing principles that depart from their own ideal conceptions of truth and value in order to be reasonable to all? Citizens face a practical problem of mutual assurance that public reason helps them solve, and solve as a matter of common knowledge. The solution, on both views, requires citizens’ reciprocal commitment to basing law on a system of shared reasons. Both views place public reason at the core of liberal democratic politics in conditions of diversity, and for quite similar reasons. Our argument illustrates the complementary roles of positive and values-based analysis in constitutional design. (shrink)

The banner of deliberative democracy is attracting increasing numbers of supporters, in both the world's older and newer democracies. This effort to renew democratic politics is widely seen as a reaction to the dominance of liberal constitutionalism. But many questions surround this new project. What does deliberative democracy stand for? What difference would deliberative practices make in the real world of political conflict and public policy design? What is the relationship between deliberative politics and liberal constitutional arrangements? The 1996 publication (...) of Amy Gutmann and Dennis F. Thompsons Democracy and Disagreement was a signal contribution to the ongoing debate over the role of moral deliberation in democratic politics. Sunstein, Michael Walzer, and Iris Marion Young, and the editor of the volume, Stephen Macedo. The book concludes with a thoughtful response from Gutmann and Thompson to their esteemed critics. Este texto apresenta algumas reflexões de um Trabalho de Conclusão de Curso, escrito a partir de uma pesquisa de Iniciação Científica, realizada durante os anos de 2017 a 2019. Este estudo tem como objetivo conhecer as histórias e memórias da comunidade quilombola de Queimadas, situada no município de Guanambi Ba, tendo como foco as trajetórias de vida dos líderes locais e sua relação com a educação escolar. Foram utilizados como instrumentos de pesquisa entrevistas semiestruturadas com sete lideranças quilombolas, observação participante (...) e diário de campo. Para a análise e a interpretação dos dados recorreu-se da técnica de análise de conteúdo na modalidade temática. Os resultados sinalizam as dificuldades vivenciadas durante a infância e juventude dos quilombolas e que permanecem até os dias atuais. É possível perceber como os olhares se cruzam através dos discursos que retomam nas experiências durante a formação da comunidade. Além disso, a intensa relação com o trabalho e ausência de políticas públicas é recorrente nos relatos apresentados. Dentre os vários fatores que dificultaram e/ou dificultam os quilombolas permanecerem na escola, com vistas ao processo de escolarização, podemos destacar, o currículo que produz a invisibilidade desses sujeitos e a migração em busca da sobrevivência. Nesse sentido, é urgente uma escola dentro da comunidade, referenciada na perspectiva de uma educação escolar quilombola, tendo os líderes locais como protagonistas, para que os conteúdos escolares dialoguem com suas histórias, memórias, lutas e vivências. Ademais, é imprescindível investimento do poder público local, para a melhoria da qualidade de vida dos quilombolas, bem como formação específica dos professores, tendo em vista a construção de uma educação diferenciada, contextualizada e antirracista. Both Carnap and Quine made significant contributions to the philosophy of mathematics despite their diversedviews. Carnap endorsed the dichotomy between analytic and synthetic knowledge and classified certainmathematical questions as internal questions appealing to logic and convention. On the contrary, Quine wasopposed to the analytic-synthetic distinction and promoted a holistic view of scientific inquiry. The purpose of thispaper is to argue that in light of the recent advancement of experimental mathematics such as Monte Carlosimulations, limiting mathematical inquiry to the domain of (...) logic is unjustified. Robustness studies implemented inMonte Carlo Studies demonstrate that mathematics is on par with other experimental-based sciences. (shrink)

Postcolonial science studies entails ostensibly contradictory critical and empirical commitments. Science studies scholars influenced by Bruno Latour and Isabelle Stengers embrace forms of realist, radical empiricism, while postcolonial studies scholars influenced by Jacques Derrida trace the limits of the knowable. This essay takes their common use of the term cosmopolitics as an unexpected point of departure for reconciling Derrida’s program with Stengers’s and Latour’s. I read Derrida’s critique of hospitality and Stengers’s and Latour’s ontological politics as necessary complements for conceiving (...) a care-oriented subalternist cosmopolitics, a process of composing common worlds that remains attentive to the limits of representation. Do famous athletes have special obligations to act virtuously? A number of philosophers have investigated this question by examining whether famous athletes are subject to special role model obligations (Wellman 2003; Feezel 2005; Spurgin 2012). In this paper we will take a different approach and give a positive response to this question by arguing for the position that sport and gaming celebrities are ‘ambassadors of the game’: moral agents whose vocations as rule-followers have unique implications for their non-lusory lives. According (...) to this idea, the actions of a game’s players and other stakeholders—especially the actions of its stars—directly affect the value of the game itself, a fact which generates additional moral reasons to behave in a virtuous manner. We will begin by explaining the three main positions one may take with respect to the question: moral exceptionalism, moral generalism, and moral exemplarism. We will argue that no convincing case for moral exemplarism has thus far been made, which gives us reason to look for new ways to defend this position. We then provide our own ‘ambassadors of the game’ account and argue that it gives us good reason to think that sport and game celebrities are subject to special obligations to act virtuously. O artigo propõe apresentar o movimento de desconstrução do humanismo em Derrida em A escritura e a diferença. Parto de um trabalho exegético, na trilha das ocorrências do termo “humanismo” na mencionada obra, com o intuito de determinar seus usos diferentes e em que sentidos a desconstrução derridiana deve ser compreendida já, em seus primeiros escritos, como uma desconstrução do humanismo. Para tal, minha análise se dedicou a três textos centrais no referido livro: Violence et métaphysique, essai sur la pensée (...) d’Emmanuel Lévinas; La parole souflée; La structure, le signe, le jeu dans le discours des Sciences Humaines. O presente artigo apresenta resultados de uma pesquisa que enfocou a avaliação de desempenho (AD) como um instrumento de poder utilizado na gestão de pessoas. Realizou-se um estudo de caso que utilizou entrevistas individuais com 14 participantes, sendo 4 diretores e gerentes e 10 trabalhadores da área administrativa e operacional. Para análise dos dados, utilizou-se a análise gráfica do discurso de Lane (1985). A análise dos dados indicou que os participantes (diretoria) percebiam as políticas de gestão de pessoas permeadas pela (...) ideologia dominante como uma forma de garantir a competitividade da empresa no mercado. Já os trabalhadores a percebiam como a possibilidade para o desenvolvimento profissional e a promoção. Os dados sugerem que os resultados da AD eram utilizados na gestão de pessoas apenas quando sustentavam/confirmavam as práticas e decisões da diretoria relacionadas às políticas de pessoal. Assim, a AD pode ser considerada um instrumento de poder na gestão de pessoas, porém tendo seu uso limitado a fatores externos à técnica quando subsidia as ações dos diretores. (shrink)

BREVE RELATO DE UMA OUTRA EXPERIÊNCIA EDUCACIONAL: O ENSINO JURÍDICO NOS ESTADOS UNIDOS.

This book compares the respective concepts of the law of nations put forward by the Spanish theologian Francisco Suárez and by the Dutch jurist Hugo Grotius. This comparison is based on the fact that both thinkers developed quite similar notions and were the first to depart from the Roman conception, which persisted throughout the entire Middle Ages and the early Renaissance. In Rome, jus gentium was a law that applied to foreigners within the Empire, and one which was often mistaken (...) for Natural Law itself. These two features can be found even in the works of writers such as Francisco de Vitória and Alberico Gentili. In Suárez and Grotius, the law of nations is applicable to an extra-national domain and inarguably becomes positive law. Yet, it also contains an ethical element that prevents it from transforming into a mere reflection of state interests. This work argues that this resemblance is hardly a coincidence: Grotius has read Suárez, and that influence has modified the foundations of his early thoughts on jus gentium. This should not be taken to imply that the Dutch jurist wasn't original: in both authors, the definition of the law of nations pursues his own internal logic. Nevertheless, Suárez's oeuvre allowed Grotius to solve a fundamental problem touched on in his early writings that had remained unanswered. Accordingly, his oeuvre promises to clarify one of the most significant moments in the History of International Law. (shrink)
