In this paper I argue that Kant’s political and juridical philosophy justifies a type of normative legal positivism that implies specific notions of law and legal freedom which determine and restrict the sphere of action of judges and jurists. Finally, I defend that, according to Kant’s practical philosophy, the normative connection between justice and law is not supposed to be carried out at the juridical level, as a meta-juridical theory, but at the political one, making it a meta-political theory.

In this article I argue that the current readings of permissive law fall into hermeneutical difficulties and do not completely explain Kant’s complex use of the concept. I argue that the shortcomings of these interpretations can only be overcome by relating permissive law to practical teleology. That teleological thinking has a role in Kant’s moral thought by way of history is not new. Here, however, I argue that the system of rights itself is in some manner teleologically situated. This book investigates several dimensions of the concept of cosmopolitanism since Kant. The first of these dimensions is a world vision that considers the construction of a 'cosmopolitan self' as a question of justice. The second is the idea that a local political-legal order is fully democratic only if it respects the environment and the human rights of all people of the world, regardless of their citizenship. The third dimension concerns the practice of crossborder associations between individuals, institutionalized or not (...) (cosmopolitics, as Balibar called it). The fourth considers individuals as subjects of international law, as in the case of individual petitions concerning human rights through the European Court of Human Rights and individual responsibility in international criminal law. Finally, the fifth dimension is a form of ecological consciousness based on the relationship between the self and the cosmos, which would imply a profound revision of modern anthropocentric concepts."--Publisher. A argumentação desenvolvida no presente artigo se propõe a defender a interpretação austera do construtivismo em Kant das objeções a ela levantadas por Jeremy Schwartz (2017) em seu artigo _Was Kant a ‘Kantian Constructivist’?_. Tendo isso em vista, primeiramente, procede-se à reconstrução da interpretação de Schwartz para a distinção analítico-sintética na esfera prática a partir da caracterização por contradição e à indicação de objeções para sua aceitação. Na sequência, apresenta-se a caracterização de analiticidade por continência e como esta pode ser (...) transposta para o caso dos imperativos sem resultar em conflitos com a interpretação austera do construtivismo. Por fim, delineiam-se considerações quanto à formalidade dos princípios constitutivos da razão prática e seu escopo, chegando à conclusão de que não se pode estabelecer uma identidade entre construtivismo austero e logicismo prático. There is growing philosophical interest in “affective injustice”: injustice faced by individuals specifically in their capacity as affective beings. Current debates tend to focus on affective injustice at the psychological level. In this paper, I argue that the built environment can be a vehicle for affective injustice — specifically, what Wildman et al. (2022) term “affective powerlessness”. I use resources from ecological psychology to develop this claim. I consider two cases where certain kinds of bodies are, either intentionally or unintentionally, (...) deprived of access to goods affording the development and maintenance of their subjective well-being: hostile architecture and masking practices in autism. This deprivation, I argue further, leads to a significant weakening and diminishment of their spatial agency, hinders their well-being, and in so doing gives rise to a pervasive experience of affective powerlessness. By drawing attention to these themes, I show that an ecological approach helpfully supplements existing approaches. It highlights how affective injustice can emerge via the way bodies are positioned in space, and the central role that built environments play in determining this positioning. (shrink)

Este artigo pretende apresentar uma discussão sobre a possibilidade de identificarmos as possíveis contribuições das viagens de descobrimento, enfatizando as navegações portuguesas, para a construção do pensamento científico moderno. Por um lado, é analisado o valor da experiência direta valorizada pelos portugueses como critério de certeza acerca das afirmações sobre o mundo geográfico que acabaram por colocar em questão a concepção de mundo difundida a partir dos clássicos antigos – os gregos – e, por outro lado, é apresentado uma concepção (...) de ciência moderna que comporta as contribuições dos chamados homens práticos, como os navegadores, cuja atividade marítima promove um debate, no campo da geografia e cartografia sobre a própria constituição do mundo, sem, contudo, romper definitivamente com a tradição cosmológica. Starting from the hunting treatise Cynegeticus, assigned to Xenophon, this article seeks to reflect on the way in which the construction of the ideal hunter of the polis described by the Attic author. This aim will aboard both practical terms - equipment, prey, methods of hunting conducting etc - and moral terms, taking in account the numerous attacks made against the sophists throughout the booklet. To accomplish this aim, the present text includes a brief recapitulation of Xenophon's life, the most (...) important historiographical interpretations on the Cynegeticus and its dating, and, finally, the way in which the Attic author describes his ideal Greek hunter. Some recent developments in Artificial Intelligence—especially the use of machine learning systems, trained on big data sets and deployed in socially significant and ethically weighty contexts—have led to a number of calls for “transparency”. This paper explores the epistemological and ethical dimensions of that concept, as well as surveying and taxonomising the variety of ways in which it has been invoked in recent discussions. Whilst “outward” forms of transparency may be straightforwardly achieved, what I call “functional” transparency about the inner (...) workings of a system is, in many cases, much harder to attain. In those situations, I argue that contestability may be a possible, acceptable, and useful alternative so that even if we cannot understand how a system came up with a particular output, we at least have the means to challenge it. O objetivo da pesquisa é demonstrar a importância da fraternidade na democracia brasileira, caracterizada como representativa, ao menos em tese, visto que a vontade do povo não tem sido considera nas decisões que promovem mudanças legislativas substanciais. Diante disto surge a indagação central do presente estudo: Qual a contribuição da categoria da fraternidade em uma democracia? A metodologia aplicada a pesquisa é qualitativa e bibliográfica ao buscar fontes na doutrina jurídica relacionada com o tema e também quantitativa ao trazer dados (...) como forma de argumentação. The ideological challenges based on the fundamental characteristics of this moment in history touching human relationships and pastoral practice because they relate primarily to the truth, (...) values, ethics and life. Resenha do Livro "O ofício do filósofo estóico", de Rachel Gazolla.

Este artigo apresenta duas teses sobre as vantagens do uso de obras de arte para o ensino de Filosofia no Ensino Médio: a primeira é a de que obras de arte podem servir de introdução ao filosofar na escola - indo além das questões estéticas e chegando a interrogações da filosofia política, metafísica, moral e epistemológica. Num primeiro momento, apresenta-se exemplos de obras e casos ricos para esse intuito. Num segundo momento, parte desses particulares para uma compreensão mais ampla, explicando, (...) a partir das teses de Arthur Danto, Ronald Moore e Ronai Rocha, o valor didático e filosófico daquelas no Ensino Médio. Ainda quanto à primeira tese, sustenta-se que a arte também serve ao exercício de uma das principais competências filosóficas: a argumentação. A segunda tese é a de que as artes podem servir de ponto de partida para uma proposta curricular interdisciplinar: no presente caso, entre a Filosofia e as demais disciplinas escolares. Apresenta-se possíveis cruzamentos conceituais e temáticos entre as disciplinas em questão, fornecidos por obras de arte e outros fenômenos estéticos. Nossa conclusão é a de que abordar a arte no Ensino Médio, sob o ponto de vista filosófico, é uma oportunidade didática e cognitiva que não deve ser menosprezada. (shrink)

Besides the better-known Nelson logic and paraconsistent Nelson logic, in 1959 David Nelson introduced, with motivations of realizability and constructibility, a logic called $\mathcal{S}$. The logic $\mathcal{S}$ was originally presented by means of a calculus with infinitely many rule schemata and no semantics. We look here at the propositional fragment of $\mathcal{S}$, showing that it is algebraizable, in the sense of Blok and Pigozzi, with respect to a variety of three-potent involutive residuated lattices. We thus introduce the first known algebraic (...) semantics for $\mathcal{S}$ as well as a finite Hilbert-style calculus equivalent to Nelson’s presentation; this also allows us to clarify the relation between $\mathcal{S}$ and the other two Nelson logics $\mathcal{N}3$ and $\mathcal{N}4$. Group judgements are often – implicitly or explicitly – influenced by their members’ individual expertise. However, given that expertise is seldom recognized fully and that some distortions may occur (bias, correlation, etc.), it is not clear that differential weighting is an epistemically advantageous strategy with respect to straight averaging. Our paper characterizes a wide set of conditions under which differential weighting outperforms straight averaging and embeds the results into the multidisciplinary group decision-making literature.

Many people think that the capacity for criticism and reflection, as well as the attitude of welcoming contingency, the other, and debate, is some internal and well-intentioned energy of open-minded people, as advocated by liberals, whether from the right or the left. What they don’t realize is how much the capacity for reflection and dialogue is an external phenomenon, present in the world itself, produced only thanks to a space of resistances, encounters, and even frustrations, as in the academic and (...) scientific sphere. It prevents my cogito and my precious epistemic schemes from getting out of control, in a dangerous transcendentalist delirium, and taking over the world and the circumstances themselves. The aim of this essay is precisely to understand this aesthetic dimension of science, this ontological feature that crosses its contours, taking as a starting point the concepts of “importance” in Whitehead and “matters of concern” in Bruno Latour. Neste artigo pretendemos discutir a noção de construção da mente consciente a partir da perspectiva de Antonio Damásio. Para isso, centraremos nossa análise em Self comes to Mind. Em um primeiro momento é necessário delimitarmos o conceito de consciência na visão de Damásio, visando, com isso, a evitarmos equivocidades, na medida em que há várias definições de consciência. Acreditamos que, para uma melhor compreensão acerca do surgimento da mente consciente, é necessário levarmos em consideração os processos evolutivos aos quais o (...) homem está sujeito. A consciência é, pois, fruto de um desenvolvimento evolutivo já bem estabelecido pela ciência. Compreender o desenvolvimento evolutivo do self se torna tarefa de suma importância, na medida em que Damásio estrutura sua compreensão de mente consciente a partir do papel desempenhado pelo self na tarefa de agregar conteúdos mentais. Para Damásio, a origem da mente está associada ao momento em que um processo do self é adicionado a um processo mental básico. Quando não ocorre um self na mente, esta mente não é propriamente consciente, o que significa dizer que é o self que garante consciência a uma mente. Isso quer dizer que precisaremos discutir de forma clara e distinta o conceito de self e seus estágios, para que finalmente possamos entender os passos delimitados por Damásio para discutir a construção da mente consciente. Em trabalhos anteriores, analisamos as formas pelas quais a sociologia vem sendo cobrada nos vestibulares de algumas universidades em diferentes regiões brasileiras e no ENEM. Além do entendimento de que formas são essas, uma das conclusões a que chegamos foi a de que, no ENEM, dificilmente há o acionamento de conhecimento sociológico prévio para a resolução da prova. Entendemos que, por mais que a cobrança na redação e de modo interdisciplinar traga algum reconhecimento ao saber sociológico, a construção de questões (...) que possam ir além da interpretação de texto é fundamental para a consolidação da sociologia no exame. Sendo assim, como continuidade de nossa reflexão, objetivamos, no presente trabalho, discutir, afinal, o que é esse conhecimento prévio, que pode ser entendido como conceitos, temas e teorias sociológicos. Mas quais são eles e como são cobrados na prática? Como sabemos, não há uma definição nacional dos conteúdos da sociologia, mas algumas propostas estaduais. Analisaremos quais são, segundo os editais das universidades, as matérias de sociologia presentes em alguns vestibulares, se é possível chegar a um mapa comum e se esse mapa é compatível ou não com os currículos mínimos estaduais. Para isso, analisaremos editais dos vestibulares em que a sociologia está presente e do ENEM. (shrink)

Parte das concepções pseudocientíficas propagadas pela comunidade científica em seus principais periódicos, especialmente no início do século XX, tomaram alcance com os conceitos de Eugenia e Darwinismo Social, em que o cerne das discussões considerava as distinções de raça enquanto fenômeno biológico. O presente ensaio expõe a contribuição nefasta promovida pela renomada revista Nature, que, há até pouco tempo, indiretamente acabou por reforçar crenças e culturas racistas, como o apartheid, a colonização, o trabalho forçado e a escravidão, deixando uma marca (...) indelével em sua trajetória histórica. As discussões sobre a inferioridade de raças, povos e indivíduos não somente fomentaram o negacionismo, uma vez que careciam de evidências, de consenso e de ceticismo científico adequados, como foram utilizadas como uma camada de verniz científico para legitimar projetos colonialistas e expandir os interesses do grande capital à época. Esse texto assinala ainda que as estratégias adotadas pelo capitalismo para alcançar seu patamar atual de forma hegemônica de sociabilidade somente tiveram êxito devido à apropriação do conhecimento científico que forneceu os aperfeiçoamentos tecnológicos para a conquista de novas terras e povos e, por fim, o acúmulo de capitais. Em conclusão, destacam-se autores que defendem uma perspectiva do negacionismo atual enquanto fenômeno social, o qual mais se liga às consequências da negação do fato do que propriamente ao fato em si. Essa perspectiva amplia o debate em torno do negacionismo para além das ideias difundidas nas mídias sociais, situando-o numa dimensão em que é necessário discutir o impacto das mudanças propostas pela ciência na hegemonia de determinados setores e de países dominantes da economia global. This essay aims to explore the impact of Object-Oriented Ontology (O.O.O) within the realm of pedagogy, critically examining its departure from humanistic and traditional paradigms. Simultaneously, it presents an alternative perspective on education that decenters the human as an inevitable ground. In a contrasting move, attention is directed towards Bruno Latour and Graham Harman, elucidating key facets of their ideas. This shift also signifies a departure from the conventional realm of “critical pedagogy”, as championed by Brazilian pedagogue Paulo Freire. However, (...) it is crucial to acknowledge and appreciate the contributions and significance of Freire’s work. This essay adopts a left-wing stance, with no intention of launching moral attacks on Paulo Freire, as is sometimes witnessed when reactionaries and conservatives enter the academic arena. Criticisms within these pages focus on the content of Freire’s writings, tracing the trajectory from his seminal work, “Pedagogy of the Oppressed”, published in 1968, to his final piece, “Pedagogy of Autonomy” written in 1996. The aim is not to exhaust all arguments put forth by Freire but to engage with select ideas, since his oeuvre is extremely complex and full of different layers. It is essential to clarify that the critique presented here does not target the character of Paulo Freire but rather delves into some of the theoretical references behind the scenes, particularly the anthropocentrism associated with his ideas. Consequently, this essay emerges as an interdisciplinary endeavor, a conjunction between philosophy and social theory. What doors will this discussion open? What new field of possibilities awaits us? I invite you to dive into this debate, exploring the potential for an Object-Oriented Pedagogy (O.O.P) on the horizon. (shrink)

This brief essay unpretentiously seeks to highlight the relevance of some of the central questions in Jean-Paul Sartre's Being and Nothingness, thus aiming to contribute to broadening the scope of the French philosopher's ideas. Without fearing controversy, it presents the correlation between the concept of freedom and the responsibility necessarily implied. Such concepts remind us that this work is current, for it demands to assume its political and ethical unfoldings as unavoidable demands. The debate is built, then, through Sartre's encounters (...) with his peers, highlighting the interlocutions and controversial divergences that mark his itinerary. Finally, the timeliness of the work seems to reside in the historical failure of the humanist project, that is, Being and Nothingness continues to be current, because we are still incapable of promoting a historical situation in which the human being is free. O presente artigo tem por finalidade demonstrar que, apesar de não estar expresso no rol das cláusulas pétreas, o macroprincípio da fraternidade jurídica não é passível de ser suprimido do texto constitucional. Ainda que não esteja presente expressamente na parte dogmática da Constituição Federal de 1988, a fraternidade se apresenta de forma implícita em diversos dispositivos normativos fundamentais e expressamente no preâmbulo, trecho inaugural da Lei Fundamental. Desse modo, a pesquisa que ora se apresenta parte do seguinte questionamento: O princípio (...) jurídico da fraternidade pode ser considerado uma cláusula pétrea constitucional? Decisões judiciais recentes e estudos doutrinários contemporâneos no campo das ciências jurídicas evidenciam que, além de estar presente na parte introdutória da Constituição brasileira, também se encontra consubstanciada em diversos dispositivos fundamentais do corpo normativo constitucional. Pretende-se aqui identificar como o princípio da fraternidade jurídica se entrelaça com outros princípios fundamentais presentes no texto dogmático da Constituição da República. A metodologia aplicada a esta pesquisa é qualitativa e bibliográfica ao buscar fontes na doutrina jurídica relacionadas com a fraternidade e os direitos humanos fundamentais. (shrink)

A Ontologia Orientada ao Objeto (OOO) é uma linha filosófica contemporânea muito difundida no universo acadêmico, com vários debates acalorados ao longo do globo, mas ainda bastante tímida quando o assunto é o campo da Teoria Social. O objetivo desse ensaio é compreender esse ponto de cruzamento, muitas vezes até de tensão, tomando como ponto de partida as ideias de Graham Harman e suas implicações epistêmico-ontológicas. Como resultado, existe nesse nosso horizonte investigativo uma nova atmosfera teórica, uma nova forma de (...) mergulhar no campo das ciências humanas e sociais, o que vai ser chamado aqui de Teoria Social Orientada ao Objeto (T. S. O. O). Quais os desdobramentos de uma T. S. O. O? Quais são suas vantagens diante de outras tradições já existentes? Essa e outras perguntas vão ser respondidas ao longo destas páginas, pelo menos, enquanto um breve aperitivo. (shrink)

One of liberalism’s core commitments is to safeguarding individuals’ autonomy. And a central aspect of liberal social justice is the commitment to protecting the vulnerable. Taken together, and combined with an understanding of autonomy as an acquired set of capacities to lead one’s own life, these commitments suggest that liberal societies should be especially concerned to address vulnerabilities of individuals regarding the development and maintenance of their autonomy. In this chapter, we develop an account of what it would mean for (...) a society to take seriously the obligation to reduce individuals’ autonomy-related vulnerabilities to an acceptable minimum. In particular, we argue that standard liberal accounts underestimate the scope of this obligation because they fail to appreciate various threats to autonomy. (shrink)

Este artigo apresentará a noção de “individual” de acordo com a filosofia de Tomás de Aquino buscando identificar os problemas que envolvem esta noção. Primeiro, como uma introdução, observamos esta noção de modo geral em algumas teorias filosóficas, mas depois adentramos propriamente na filosofia de Tomás de Aquino. Apenas a individuação da substância corpórea será apresentada, pois Tomás tem uma teoria diferente para a substância incorpórea, tal como os anjos, Deus e as almas separadas. Assim, a teoria de Tomás afirma (...) que o princípio de individuação é a matéria assinalada, mas tal matéria assinalada é aquela que é considerada como tendo dimensões determinadas. Nossa principal preocupação será identificar o que significa a expressão “dimensões determinadas”. Usaremos uma explicação pouco habitual para esclarecer este problema. Uma vez que Tomás afirma que, no hilemorfismo, a matéria recebe o ser da forma, defenderemos que existe um conjunto de propriedades da matéria que recebe o ser a partir da forma. (shrink)

This first volume in the four-volume series The Moral Limits of the Criminal Law focuses on the "harm principle," the commonsense view that prevention of harm to persons other than the perpetrator is a legitimate purpose of criminal legislation. Feinberg presents a detailed analysis of the concept and definition of harm and applies it to a host of practical and theoretical issues, showing how the harm principle must be interpreted if it is to be a plausible guide to the lawmaker.

This paper deals with the transnationalism of racial anthropological frameworks and its role in the understanding of human difference during India’s decolonization and nation-building. With attention to the circulation of scientific objects, I focus on the practices and articulations of Irawati Karve, an Indian anthropologist with a transnational scientific trajectory and nationalistic political engagements. I argue that Karve’s adaptation of an internationally validated German racial approach to study caste, ethnic and religious groups contributed to the further racialization of these categories (...) as well as to the racialization of nationalistic projects in Maharashtra and India. I conclude with a reflection on the transnationalization of the coloniality of racialization. (shrink)

A partir de algumas considerações de Max Horkheimer sobre o potencial crítico do pessimismo schopenhaueriano, o artigo visa mostrar em que medida o sofrimento específico da fome, em especial quando esta é registrada em contextos de pobreza, miséria e escravidão na obra de Schopenhauer, elucida empiricamente o pessimismo metafísico em forma de pessimismo crítico-social. Para tanto, descrevemos algumas presenças dos termos fome (Hunger) e pobreza (Armut) na obra do pensador da vontade para, em seguida, problematizarmos alguns de seus significados. Apesar (...) de não reconhecer um expediente ativo do Estado ou a necessidade de mudanças sociais estruturais em vista de seu combate, a fome enquanto dor ou sofrimento social de todos os tempos ganha em Schopenhauer um olhar crítico muito específico - em relação a outras críticas filosóficas -, que se soma às variadas condenações sociológicas, econômicas etc., a saber, como uma das expressões mais flagrantes das perversidades e mazelas de um mundo que não poderia ser justificado.
