The legitimacy of humanitarian intervention has been contested for more than a century, yet pressure for such intervention persists. Normative evolution and institutional design have been closely linked since the first debates over humanitarian intervention more than a century ago. Three norms have competed in shaping state practice and the normative discourse: human rights, peace preservation, and sovereignty. The rebalancing of these norms over time, most recently as the state’s responsibility to protect, has reflected specific international institutional environments. The contemporary (...) legitimacy of humanitarian intervention is based on UN Security Council authorization of the use of force. Although the Security Council is often viewed as representative of great-power influence, international acceptance of its role is based on the role of non-permanent members and their support for the sovereignty norm. The current rebalanced norms supporting humanitarian intervention, institutional bias that protects state sovereignty, and the changing character of mass violence may undermine the tenuous contemporary legitimacy of humanitarian intervention. Normative adjustments and new institutional designs are required to insure the legitimacy of international action that protects populations against mass violence. (shrink)

Law is an ontologically ideal entity. This feature shall be explored in order to explain why law cannot be perceived by the senses, why its contents can remain constant over time, why it can in principle be translated and why it does not have a dual nature. Due to law’s ontologically ideal nature it is independent from time and space, normative in kind and open for rational arguments. In a recent paper [J. G. Vargas and D. G. Torr, Found. Phys. 27, 599 (1997)], we have shown that a subset of the differential invariants that define teleparallel connections in spacetime generates a teleparallel Kaluza-Klein space (KKS) endowed with a very rich Clifford structure. A canonical Dirac equation hidden in this structure might be uncovered with the help of a teleparallel Kähler calculus in KKS. To bridge the gap to such a calculus from the existing Riemannian Kähler calculus in (...) spacetime, we commence the construction of a teleparallel Kähler calculus in spacetime. In the process, we notice: (a) Unknown to him, one of Einstein's equations in his attempt at unification with teleparallelism states that the interior covariant derivative of the torsion is zero. (b) A mechanism exists in the tangent bundle of teleparallel spaces for producing confinement (in the applicable cases, one would have to show why nonconfinement also occurs, rather than the other way around). (c) When the torsion is not zero, the interior covariant derivative in the sense of Kähler, δF, does not coincide with *d*F. The system (dF = 0, δF = j) rather than (dF = 0, *d*F = j) should then be used for generalizations of Maxwell's electrodynamics. (shrink)

In 1960–1962, E. Kähler enriched É. Cartan’s exterior calculus, making it suitable for quantum mechanics (QM) and not only classical physics. His “Kähler-Dirac” (KD) equation reproduces the fine structure of the hydrogen atom. Its positron solutions correspond to the same sign of the energy as electrons.The Cartan-Kähler view of some basic concepts of differential geometry is presented, as it explains why the components of Kähler’s tensor-valued differential forms have three series of indices. We demonstrate the power of his calculus by (...) developing for the electron’s and positron’s large components their standard Hamiltonian beyond the Pauli approximation, but without resort to Foldy-Wouthuysen transformations or ad hoc alternatives (positrons are not identified with small components in K ähler’s work). The emergence of negative energies for positrons in the Dirac theory is interpreted from the perspective of the KD equation. Hamiltonians in closed form (i.e. exact through a finite number of terms) are obtained for both large and small components when the potential is time-independent.A new but as yet modest new interpretation of QM starts to emerge from that calculus’ peculiarities, which are present even when the input differential form in the Kähler equation is scalar-valued. Examples are the presence of an extra spin term, the greater number of components of “wave functions” and the non-association of small components with antiparticles. In this paper, we present an intrinsic characterisation of projective special Kähler manifolds in terms of a symmetric tensor satisfying certain differential and algebraic conditions. We show that this tensor vanishes precisely when the structure is locally isomorphic to a standard projective special Kähler structure on \/\mathrm {S}\mathrm {U})\). We use this characterisation to classify 4-dimensional projective special Kähler Lie groups.

The letters convey a picture of Broch’s political discussions with Kahler. Once Weber's entire conception of science is taken as a basis for an inspection of Kahler's argumentation against Weber, then against Kahler's opinion Weber's positions do not at all appear obsolete or outmoded, but innovative and topical. Depending more upon fundamental axioms of the George-Circle than it has been outlined in scholarship so far, Kahler's own claim for novelty at the same time has to be clearly repudiated.

The theory of exterior differential systems plays a crucial role in Cartan’s whole mathematical production. As he once recognized, all the germs of his subsequent work were contained there. Indeed, it provided him with powerful technical tools that turned out to be very useful in many different fields such as the theory of partial differential equations, the theory of infinite dimensional Lie groups (Lie pseudogroups) and differential geometry. Nevertheless, scarce attention has been paid to this area of historical research thus (...) far. Although authoritative scholars have investigated the foundation of exterior differential calculus in Cartan’s early papers, no specific analysis of Cartan’s subsequent works laying the foundations of what nowadays is known as the Cartan–Kähler theory has been yet provided. This article represents a first attempt to remedy this unsatisfactory state of affairs by focusing on Cartan’s work on Pfaffian systems at the very beginning of the past century. The analysis of Cartan’s relevant papers is preceded by a description of the historical context in which such contributions were conceived. In this respect, special emphasis will be put on some works by Engel and von Weber on Pfaffian systems, which laid the basis for the subsequent geometrical developments of Cartan’s theory of exterior differential systems. This Article falls into three general parts. The first part starts with an important question: is the insanity defense constitutionally required? The United States Supreme Court will finally try to answer this question next term in the case of Kahler v. Kansas. -/- I say “finally” because the Court refused to answer this question in 2012 when it denied certiorari to an appeal brought by John Joseph Delling, a severely mentally ill defendant who was sentenced to life in prison (...) three years earlier for two murders. Delling never had the opportunity to plead the insanity defense because his home state, Idaho, had abolished it in 1982. -/- By depriving Delling of the right to plead insanity, Idaho violated Delling’s Fourteenth Amendment right to due process and his Eighth Amendment right against “cruel and unusual” punishment. Naturally, the same is true for many other mentally ill and disabled defendants who have been prosecuted in Idaho and in the other three states that have abolished the insanity defense: Kansas, Montana, and Utah. -/- The second general part of this Article notes an insight that I stumbled upon in the course of researching the first part: the insanity defense and the mistake of law defense both require ignorance of the law, what I refer to as “normative ignorance.” Indeed, normative ignorance is what makes both of these defenses exculpatory in the first place. -/- Given this critical connection, there is a way for Idaho, Kansas, Montana, and Utah to resume compliance with the Constitution. Instead of reinstating the insanity defense per se, which might be politically unpopular, they should just broaden their mistake of law defense to include normative ignorance caused by cognitive incapacity that is itself caused by mental illness or disability. -/- Still, this Article is not merely directed at these four western states. It is directed at the other forty-six states as well. Because they already have an insanity defense, they need not incorporate it into their mistake of law defense. But in the third general part, I will argue that they should still expand their mistake of law defense to cover defendants who either lack a reasonable opportunity to learn the law or reasonably but mistakenly infer from widely accepted norms or ethics that their conduct is lawful. The power of the Dirac algebra is illustrated through the Kähler correspondence between a pair of Dirac spinors and a 16-component bosonic field. The SO(5, 1) group acts on both the fermion and boson fields, leading to a supersymmetric equation of the Dirac type involving all these fields.

It is shown that relativistic spacetimes can be viewed as Finslerian spaces endowed with a positive definite distance (ω0, mod ωi) rather than as pariah, pseudo-Riemannian spaces. Since the pursuit of better implementations of “Euclidicity in the small” advocates absolute parallelism, teleparallel nonlinear Euclidean (i.e., Finslerian) connections are scrutinized. The fact that (ωμ, ω0 i) is the set of horizontal fundamental 1-forms in the Finslerian fibration implies that it can be used in principle for obtainingcompatible new structures. If the connection (...) is teleparallel, a Kaluza-Klein space (KKS) indeed emerges from (ωμ, ω0 i), endowed ab initio with intertwined tangent and cotangent Clifford algebras. A deeper level of Kähler calculus, i.e., the language of Dirac equations, thus emerges. This makes the existance of an intimate relationship between classical differential geometry and quantum theory become ever more plausible. We point out that a certain complex compact manifold constructed by Lieberman has the dimensional order property, and has U-rank different from Morley rank. We also give a sufficient condition for a Kahler manifold to be totally degenerate (that is, to be an indiscernible set, in its canonical language) and point out that there are K3 surfaces which satisfy these conditions.

Though containing some duplication of the contents of the earlier volume, Weitz's collection makes many additional, fine selections available--e. g., three examples of Erwin Panofsky's techniques; Hospers' "The Concept of Artistic Expression"; Malraux on style; Chapter IX of Cassirer's Essay on Man; and a direct encounter in which Erich Kahler has prepared a traditional, humanistic rebuttal to Weitz's own contention that 'art' cannot be (...) defined. This is a basically expository article, with some new observations, tracing connections of the quantum potential to Fisher information, to Kähler geometry of the projective Hilbert space of a quantum system, and to the Weyl-Ricci scalar curvature of a Riemannian flat spacetime with quantum matter.

The article is devoted to social problems of modern science (as it were interpreted Max Weber) considered in the context of the system-communicative approach by N. Luhmann. In contrast to the modern work of art, the modern science, as M. Weber believes, is associated with the fundamental unattainability of “true being”, and, as a result, with the transitory character of any scientific achievement. The specialty of modern science, as Weber noted, is determinated, on the one hand by its self-understanding, due (...) to the “peculiarity of the current moment”, and, on the other, by its transformation into a kind of blind spot of scientific observation. As a result, Weber formulated the main problem of the meaning of modern science: he wondered why any scientist needs a science under (1) external alienation and (2) inaccessibility of a scientific object? Moreover, the category of truth not just acquires its special value, but also sets a special meaning to the purpose of scientific communication, that becomes an object but not a property of scientific search. The main content of the article is the study of the Weberian concepts of the external (science as a profession) and internal (science as vocation) social factors of modern science as they were interpreted by E. von Kahler, G. Rickert, M. Scheller, K. Loewit. The authors discuss their attempts to modernize the fundamental Weberian distinction of truth/value as a principle of inclusion in the scientific community, that was formulated as a response to the “Weber’s challenge”. The authors argue that von Kahler criticized the Weberian concept for the incompatibility of the spatial and temporal discreteness of science within the “organic understanding” of the unity of the world. At the same time Scheler and Rickert payed special attention to the problem of subject specification of science. K. Levit discussed the possibility of Weber’s substitution of objectivity as a key distinction of modern knowledge with some opposite attribute. In the final part, the authors summarize the inconsistency of predictions about the further internal differentiation of scientific disciplines and the rejection of research motive for “genuine being”. To celebrate the four-hundredth anniversary of Galileo's birth, the University of Rochester held a series of lectures on the thought and influence of Galileo; there were six contributors and their work groups itself into three areas. The first of these is the importance and relevance of Galileo in modern thought and society: these were discussed by Giorgio di Santillana and Gilgerto Bernardino respectively. Norwood Hanson and E. W. Strong study the work of Galileo in dynamics and his theory of measurement. (...) The last two papers are concerned with the role of science in society—they spring from the confrontation of Galileo and the Church, the first indication of the special problems the scientific disciplines would face in their intercourse with the rest of society—and are by Philip Abelson and Erich Kahler. Although this brief collection cannot provide a full view of the scope of Galileo's activities and their subsequent impact, we are still able to feel that some of the vast gap between ourselves and the initiator of modern physics has been spanned, and that he can be seen more clearly for it.—P. The article deals with the so-called „System Althoff“, that is the network of advisers Friedrich Althoff, ministerial director of the Prussian ministry of cultural affairs, created and employed in order to administer the faculties of theology at Prussian universities. In addition to leading the process of decision making in the ministry itself, he recruited a number of theology professors from the two dominant Church parties to advise him on appointing new professors. Famously, he consulted the opponents Hermann Cremer, a “positive” (...) biblicistic Systematic professor in Greifswald, and Adolf Harnack, a Ritschlian Church Historian in Berlin, but he also counted theologians like Friedrich Loofs and Martin Kähler among his advisers. The article’s main body focusses on Althoff’s correspondence with Cremer and Harnack in order to analyse the minister’s practice of administration in depth. In a second step the paper will relate the minister’s relationship with his two most prominent theological advisers to the wider „System Althoff“ in theology. Both parts serve to show that Althoff rationalized and professionalized the process of decision making in the ministry of cultural affairs by carefully considering different professorial advises in light of the current (church) political climate. A growing body of literature has engaged with mass incarceration as a public health problem. This article reviews some of that literature, illustrating why and how bioethicists can and should engage with the problem of mass incarceration as a remediable cause of health inequities. “Mass incarceration” refers to a phenomenon that emerged in the United States fifty years ago: imprisoning a vastly larger proportion of the population than peer countries do, with a greatly disproportionate number of incarcerated people being members (...) of marginalized racial and ethnic groups. Bioethicists have long engaged with questions of health justice for incarcerated people, including consent issues for those participating in research and access to health care. This article provides an overview of the individual and public health impacts of mass incarceration. The article argues that mass incarceration is a bioethics issue that should be addressed in medical education, identifies opportunities for bioethicists to guide hospitals’ interactions with law enforcement officials, and calls on bioethicists to be in conversation with medical and nursing students and health care professionals about these groups’ advocacy efforts concerning structural racism, police violence, and mass incarceration. This study concerns the ideas of one particular philosopher, Henri Bergson, whose views of time, intuition, and creativity have had a significant impact on art, literature, and the humanities, both in his time and in our own. Although it is generally recognized that Bergson's ideas have significantly impacted the arts and the humanities, it has not been recognized how they have also had a creative influence on the sciences as well. Nor has it been realized that this was one of (...) his most basic contentions. Bergson's conception of intuition--his fundamental insight into reality--was not limited to fugitive insights into human existence. By realizing previously unsuspected possibilities for research and discovery, his endeavors were also meant to make possible new advances in the sciences. If it enabled his cousin by marriage, Marcel Proust, to explore human memory in depth, it also inspired psychologists like Daniel Schachter to use Bergson's ideas to make real contributions to contemporary memory science. If his notion of creative evolution brought many thinkers to a belief in human creative freedom, it brought others (notably Alexis Carrel and Pierre Lecomte de Noüy) to a scientific study of biological time. Among his successful speculations was the theory of the Big Bang cosmology. 'Getting Bergson Straight' shows many points at which Bergson's ideas anticipated future developments in the sciences. This was seen clearly by the Nobel Prize-winning physicist Luis de Broglie who viewed Bergson's physics as presaging quantum physics. Thus, the text is well situated for arts, humanities, social science, and natural science classrooms studying creative thinking and/or intellectual history. (shrink)

International Mindedness (IM) has become an underpinning philosophy of the International Baccalaureate and schools which adopt its programmes. However, the concept of IM is relevant to any school that offers international education given its potential and importance to drive the school’s mindset and mission. The international school market has grown significantly in terms of the number of schools and their diversity. Increasing in popularity are schools that follow the British-based International General Certificate of Secondary Education (IGCSE) and A-level programmes. Moreover, (...) the dgreatest expansion of international schools is now occurring in local markets, in which students are no longer predominantly expatriates but come from the host countries. This study explores the concept of international mindedness in six international schools in Cyprus. Based on data collected from headteachers and teachers, we argue that international mindedness is applicable in various contexts of international schooling and that factors other than the curriculum can affect its development within a school. Social suffering commands increasing public attention in the wake of several historical processes that have changed the ways victims are perceived. In making suffering eloquent by rendering it in conceptual form, philosophy runs the risk of muting suffering, thereby neutralizing its ability to mobilize responses. In the experience of suffering philosophy finds a limit it must recognize as its own. Yet only by fulfilling its duty towards suffering - only by having the abolition of suffering as its ultimate goal - (...) can philosophical thinking withstand a tacit complicity with injustice. The conflict in Gaza and Israel that ignited on October 7, 2023 signals a catastrophic breakdown in the possibility of ethical dialogue in the region. The actions on both sides have revealed a dissolution of ethical restraints, with unimaginably cruel attacks on civilians, murder of children, destruction of health facilities, and denial of basic needs such as water, food, and shelter. There is a need both to understand the nature of the ethical singularity represented by this conflict and what, if (...) any, options are available to allow the reconstruction of communication between the warring parties. This article seeks to address these tasks by analysing the conflict as inherently an ethical one, in the sense that it exposes a rupture in the fabric of communicative relationships that has evolved systematically out of the deep cultural structures from which all protagonists have emerged. Drawing on the work of Levinas, Habermas, Arendt, and others, and referring to the specific circumstances in the region, it examines the ethical sources of the crisis and tries to identify conditions for its resolution. The possibility of reconciliation—that is, of refiguring relationships to open up a space for dialogue to create pathways to heal the ruptures—is examined. The dark legacy of the Holocaust is identified as an abiding cultural vulnerability for both societies. It is concluded, however, that the rich history of partnerships and collaborations between Jews and Palestinians provides a robust infrastructure on the basis of which a sustainable peace might be built, providing a much-needed source of hope. In _Discrimination Against the Dying_, Philip Reed argues, among other things, that ‘right to die laws (euthanasia and assisted suicide) also exhibit terminalism when they restrict eligibility to the terminally ill’. 1 Additionally, he suggests ‘the availability of the option of assisted death only for the terminally ill negatively influences the terminally ill who wish to live by causing them to doubt their choice’. 1 I argue that on scrutiny, neither of these two points hold. First, we routinely limit a (...) course of treatment to only those for whom we believe the treatment might provide a benefit. Typically, we do not think hastening death provides benefit when an individual is not experiencing a terminal illness. Thus, I conclude, either all treatments are discriminatory, or medical aid in dying is not. Second, I argue that permitting individuals to refuse or remove life sustaining care may very well cause... Some individuals facing dementia contemplate hastening their own death: weighing the possibility of living longer with dementia against the alternative of dying sooner but avoiding the later stages of cognitive and functional impairment. This weighing resonates with an ethical and legal consensus in the United States that individuals can voluntarily choose to forgo life‐sustaining interventions and also that medical professionals can support these choices even when they will result in an earlier death. For these reasons, whether and how a terminally (...) ill individual can choose to control the timing of their death is a topic that cannot be avoided when considering the dementia trajectory. With a focus on the U.S. context, this landscape review considers the status of provisions that would legally permit people facing dementia to hasten death with appropriate support from medical professionals. This review can be used to plan and guide clinical and legal practitioner discussion and policy development concerning evolving questions not fully covered by existing medical decision‐making provisions. The constitutional monarchy of present-day Britain hardly seems the same sort of institution as fourteenth-century feudal kingdoms, but Dante’s Monarchia (c. 1313) and Walter Bagehot’s The English Constitution (1872) share fundamental assumptions about what the purpose and strengths of monarchy are. In the Monarchia, Dante lays out the essential attributes of monarchy that endure even today: authority, impartiality, and unity. Dante values and promotes monarchy as final arbiter of conflicts, sole just judge without cupidity, and unifying will. More than 550 (...) years later, Bagehot, despite his distrust concerning the Crown’s actual effectiveness, conceives of monarchy in surprisingly similar terms. The monarch is ‘the regulating wheel of our Constitution’, an authority outside and above partisan politics, and the ‘dignified’, ‘intelligible’, unifying element of government. In both cases, the monarch functions as the government’s source of impartial, unifying authority – whether monarch or Parliament ultimately wields that authority. The broad outlines of monarchy are surprisingly similar for both writers, suggesting a basic continuity in the conceptualization of monarchy from the fourteenth to the nineteenth century (and beyond) and an abiding store of reserve symbolism within the monarchic concept that writers, thinkers, and politicians throughout those centuries are able to tap at will. Ray and Cooper (2024) make a very compelling argument for vastly increasing bioethicists’ engagement with environmental justice. I strongly support this proposal and agree with their arguments. Yet...

According to some philosophers, a sentence's semantics can fail to constitute a complete propositional content, imposing mere constraints on such a content. Recently, Daniel Harris has begun developing a formal constraint semantics. He claims that the semantic values of sentences constrain what speakers can literally say with them—and what hearers can know about what was said. However, that claim is undermined by his conception of semantics as the study of a psychological module. This study examines the outcomes of a four-year faculty learning community (FLC) that aimed to transform departmental ethics curriculum by supporting Earth Sciences faculty members as they ethically inquired into their teaching of ethics and refined existing courses in alignment with an Integrated Community-Engaged Learning and Ethical Reflection (ICELER) framework. We present ethnographic case studies that unpack processes through which three faculty members transformed undergraduate courses. We assembled case studies by triangulating interview data, course artifacts, and faculty reflections. We examine (...) how faculty (1) built awareness around teaching ethics, (2) took responsibility for and made judgments about teaching ethics, (3) experimented by designing and implementing ICELER-inspired courses, and (4) interrogated the outcomes of their ethics teaching, utilizing findings to enhance awareness and revise courses. Despite the salient experience of encoding threatening events, these memories are prone to distortions and often non-veridical from encoding to recall. Further, threat has been shown to preferentially disrupt the binding of event details and enhance goal-relevant information. While extensive work has characterised distinctive features of emotional memory, research has not fully explored the influence threat has on temporal memory, a process putatively supported by the binding of event details into a temporal context. Two primary competing hypotheses have been proposed; (...) that threat can impair or enhance temporal memory. We analysed two datasets to assess temporal memory for an in-person haunted house experience. In study 1, we examined the temporal structure of memory by characterising memory contiguity in free recall as a function of individual levels of heart rate as a proxy of threat. In study 2, we replicated marginal findings of threat-related increases in memory contiguity found in study 1. We extended these findings by showing threat-related increases in recency discriminations, an explicit test of temporal memory. Together, these findings demonstrate that threat enhances temporal memory regarding free recall structure and during explicit memory judgments. (shrink)

Background Scientific and technological advancements in mapping and understanding the interrelated pathways through which biological and environmental exposures affect disease development create new possibilities for detecting disease risk factors. Early detection of such risk factors may help prevent disease onset or moderate the disease course, thereby decreasing associated disease burden, morbidity, and mortality. However, the ethical implications of screening for disease risk factors are unclear and the current literature provides a fragmented and case-by-case picture. Methods To identify key ethical considerations (...) arising from the early detection of disease risk factors, we performed a systematic scoping review. The Scopus, Embase, and Philosopher’s Index databases were searched for peer-reviewed, academic records, which were included if they were written in English or Dutch and concerned the ethics of (1) early detection of (2) disease risk factors for (3) disease caused by environmental factors or gene-environment interactions. All records were reviewed independently by at least two researchers. Results After screening 2034 titles and abstracts, and 112 full papers, 55 articles were included in the thematic synthesis of the results. We identified eight common ethical themes: (1) Reliability and uncertainty in early detection, (2) autonomy, (3) privacy, (4) beneficence and non-maleficence, (5) downstream burdens on others, (6) responsibility, (7) justice, and (8) medicalization and conceptual disruption. We identified several gaps in the literature, including a relative scarcity of research on ethical considerations associated with environmental preventive health interventions, a dearth of practical suggestions on how to address expressed concerns about overestimating health capacities, and a lack of insights into preventing undue attribution of health responsibility to individuals. Conclusions The ethical concerns arising with the early detection of risk factors are often interrelated and complex. Comprehensive ethical analyses are needed that are better embedded in normative frameworks and also assess and weigh the expected benefits of early risk factor detection. Such research is necessary for developing and implementing responsible and fair preventive health policies. (shrink)
