Although Mr. Schrader states that "it is beyond the scope of [his] paper to examine Kant's argument in the Analytic that our empirical knowledge rests upon a priori knowledge of space and time," he does offer a hint as to how he would go about this: "[Kant] seeks to show that the categories are necessary in order to cognize events in one space and one time, and that all empirical judgments rest upon the assumption that space and time are unitary." (...) This is undeniably the foundation of Kant's theory of time. It shows, however, a bias for the special manner of the objective deduction, where emphasis falls on the unity of consciousness as the basic premiss, instead of on the conditions of representations in general, which is how the basic premiss is stated in the subjective deduction in the first edition. The two are equivalent, as Kant insists, but the formulation in the subjective deduction wears a bolder, more radical countenance, since it stresses what is less explicit in the objective deduction, that all the Analytic is derived from nothing more than the nature of a representation. For most purposes the two transcendental deductions are interchangeable, but for the theory of time we turn most profitably to that deduction which dwells more meticulously on the earliest stages, and elaborates the most primitive steps of the deduction of the categories. The essay is an attempt to examine aspects of legal interpretation from an external, sociological point of view. “Interpretation”, in its normal juristic sense, is primarily a process in which decision‐makers with secondary legitimacy link their decisions to authority of primary legitimacy. The type of legitimacy which is dominant within the legal system greatly influences the style of interpretation ‐ in “closed” systems, where the stock of premises is fixed, “legalism” will abound. Legal interpretation is not concerned with what a (...) text really means, in any literal sense; and standards for judging legal interpretation are different from the standards of judging other forms of communication, for example, literature. BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

Few novel or emerging infectious diseases have posed such vital ethical challenges so quickly and dramatically as the novel coronavirus SARS‐CoV‐2. The World Health Organization declared a public health emergency of international concern and recently classified Covid‐19 as a worldwide pandemic. As of this writing, the epidemic has not yet peaked in the United States, but community transmission is widespread. President Trump declared a national emergency as fifty governors declared state emergencies. In the coming weeks, hospitals will become overrun, stretched (...) to their capacities. When the health system becomes stretched beyond capacity, how can we ethically allocate scarce health goods and services? How can we ensure that marginalized populations can access the care they need? What ethical duties do we owe to vulnerable people separated from their families and communities? And how do we ethically and legally balance public health with civil liberties? (shrink)

Health inequalities are embedded in a complex array of social, political, and economic inequalities. Responding to health inequalities will require systematic action targeting all the underlying (“upstream”) social determinants that powerfully affect health and well‐being. Systemic inequalities are a major reason for the rise of modern populism that has deeply divided polities and infected politics, perhaps nowhere more so than in the United States. Concerted action to mitigate shocking levels of inequality could be a powerful antidote to nationalist populism. A (...) basic yet critical start to addressing health inequalities is to recognize them, which demands improving data collection and analysis. Certainly, global indicators show vast progress in reducing poverty and extending life. Yet aggregate health data mask a deeper reality: health gains have disproportionately benefited the well‐off, leaving the poor and middle‐class behind. (shrink)

The Democratic Republic of the Congo is facing two crises: a potentially explosive Ebola epidemic and a major insurgency. But they are not wholly distinct from each other: the first is intertwined with the second, and public mistrust and political violence add a dangerous dimension to the Ebola epidemic. The World Health Organization and other health emergency responders will increasingly find themselves fighting outbreaks in insecure, misgoverned or ungoverned zones, possibly experiencing active conflict. Yet the WHO has neither the mission (...) nor the capabilities to navigate these security threats. We cannot expect that the usual public health strategy will succeed when health workers’ lives are directly imperiled and community resistance runs deep. Tackling health emergencies amidst complex humanitarian crises requires fresh thinking. Here, we offer a blueprint for fighting diseases in complex humanitarian emergencies. The building blocks of security and trust include high‐level political support, street‐level diplomacy, community engagement, enhanced funding, and protection of health professionals working in conflict or disaster zones. The singular message in Global Health Law is that we must strive to achieve global health with justice—improved population health, with a fairer distribution of benefits of good health. Global health entails ensuring the conditions of good health—public health, universal health coverage, and the social determinants of health—while justice requires closing today’s vast domestic and global health inequities. These conditions for good health should be incorporated into public policy, supplemented by specific actions to overcome barriers to equity. A new global (...) health treaty grounded in the right to health and aimed at health equity—a Framework Convention on Global Health —stands out for its possibilities in helping to achieve global health with justice. This far-reaching legal instrument would establish minimum standards for universal health coverage and public health measures, with an accompanying national and international financing framework, require a constant focus on health equity, promote Health in All Policies and global governance for health, and advance the principles of good governance, including accountability. While achieving an FCGH is certainly ambitious, it is a struggle worth the efforts of us all. The treaty’s basis in the right to health, which has been agreed to by all governments, has powerful potential to form the foundation of global governance for health. From interpretations of UN treaty bodies to judgments of national courts, the right to health is now sufficiently articulated to serve this role, with the individual’s right to health best understood as a function of a social, political, and economic environment aimed at equity. However great the political challenge of securing state agreement to the FCGH, it is possible. States have joined other treaties with significant resource requirements and limitations on their sovereignty without significant reciprocal benefits from other states, while important state interests would benefit from the FCGH. And from integrating the FCGH into the existing human rights system to creative forms of compliance and enforcement and strengthened domestic legal and political accountability mechanisms, the treaty stands to improve right to health compliance. The potential for the FCGH to bring the right to health nearer universal reality calls for us to embark on the journey towards securing this global treaty. (shrink)

Roughly speaking all economists can be divided into two groups--those who agree with Milton Friedman and those who do not. Both groups, however, espouse the view that science is a series of approximations to a demonstrated accord with reality. Methodological controversy in economics is now merely a Conventionalist argument over which comes first--simplicity or generality. Furthermore, this controversy in its current form is not compatible with one important new and up and coming economic (welfare) theory called "the theory of the (...) Second Best." In this paper I offer a Second Best meta-theory that says that (1) any compromise between simplicity and generality must yield a theory which is "third best" by these Conventionalist criteria; and (2) there exists a better way than a compromise. This essay seeks to start a dialogue between two traditions that historically have interpreted the economy in opposing ways: the individualism of classic economic liberalism (CEL), represented by Adam Smith and Milton Friedman, and the communitarianism of Catholic social teaching (CST), interpreted primarily through the teachings of popes and secondarily the U.S. Catholic bishops. The present authors, an economist and a moral theologian who identify with one or the other of the two traditions, strive to clarify objectively their similarities and (...) differences with the opposing perspective. Section one focuses on each position''s perspective of love of self and love of others. We find both CEL and CST saying that self-love, rightly understood, constitutes a moral good and that the love of others serves as an important principle in the political economy. We find less agreement in section two regarding justice and rights, but even here, we discover a few surprises. Both traditions uphold justice (giving to each party what is due) as essential to the political economy, and recognize some similarity in that type of justice called commutative. We note, however, substantial differences regarding a second type of justice that we call "public justice." First, they differ over the extent to which government should be involved. Here the meaning of rights, especially that of individual freedom, arises. Secondly, the traditions diverge over whether benevolence as a motivator ought to serve as a partner for public justice. Thirdly, CEL in general opposes CST''s emphasis on social justice that calls upon institutions to be proactive in helping citizens and groups to become active participants in the economy. We conclude our essay by summarizing our discoveries and by suggesting areas for further dialogue. (shrink)

In recent years consciousness has become a significant area of study in the cognitive sciences. The Frontiers of Consciousness is a major interdisciplinary exploration of consciousness. The operation of developing a concept is a common procedure in mathematics and in natural science, but has traditionally seemed much less possible to philosophers and, especially, logicians. Meir Buzaglo's innovative study proposes a way of expanding logic to include the stretching of concepts, while modifying the principles which block this possibility. This book introduces a new approach to the issue of radical scientific revolutions, or "paradigm-shifts," given prominence in the work of Thomas Kuhn. The book articulates a dynamical and historicized version of the conception of scientific a priori principles first developed by the philosopher Immanuel Kant. This approach defends the Enlightenment ideal of scientific objectivity and universality while simultaneously doing justice to the revolutionary changes within the sciences that have since undermined Kant's original defense of this ideal. Through a modified (...) Kantian approach to epistemology and philosophy of science, this book opposes both Quinean naturalistic holism and the post-Kuhnian conceptual relativism that has dominated recent literature in science studies. Focussing on the development of "scientific philosophy" from Kant to Rudolf Carnap, along with the parallel developments taking place in the sciences during the same period, the author articulates a new dynamical conception of relativized a priori principles. This idea applied within the physical sciences aims to show that rational intersubjective consensus is intricately preserved across radical scientific revolutions or "paradigm-shifts and how this is achieved. McQueen and Vaidman argue that the Many Worlds Interpretation (MWI) of quantum mechanics provides local causal explanations of the outcomes of experiments in our experience that is due to the total effect of all the worlds together. We show that although the explanation is local in one world, it requires a causal influence that travels across different worlds. We further argue that in the MWI the local nature of our experience is not derivable from the Hilbert space structure, but has (...) to be added to it as an independent postulate. This is due to what we call the factorisation-symmetry and basis-symmetry of Hilbert space. (shrink)

We present a novel reductive theory of type-identity physicalism, which is inspired by the foundations of statistical mechanics as a general theory of natural kinds. We show that all the claims mounted against type-identity physicalism in the literature don’t apply to Flat Physicalism, and moreover that this reductive theory solves many of the problems faced by the various non-reductive approaches including functionalism. In particular, we show that Flat Physicalism can account for the appearance of multiple realizability in the special sciences, (...) and that it gives a novel account of the genuine autonomy of the kinds and laws in the special sciences. We further show that the thesis of genuine multiple realization, which is compatible with all forms of non-reductive approaches including functionalism, implies what we call token-dualism; namely the idea that in every token there are non-physical facts, which may either be non-physical properties or some non-physical substance. In other words, we prove that non-reductive kinds necessarily assume non-reductive tokens, i.e., token dualism. Finally, we show that all forms of non-reductive approaches including functionalism imply a literally multi-leveled structure of reality. (shrink)

Jewish business ethics in Israel addresses two major sources of economic immorality—unbounded desire and fear of economic uncertainty—through enforcement and spiritual education. Business is seen as a path to sanctity, when time is set apart for religious study, wealth is seen as originating from God, the vulnerable are protected against fraud and theft, charity is seen as an obligation, and mercy towards debtors is tempered by justice.

The philosophy of Solomon Maimon is usually considered an important link between Kant’s transcendental philosophy and German idealism. Highly praised during his lifetime, over the past two centuries Maimon’s genius has been poorly understood and often ignored. Meir Buzaglo offers a reconstruction of Maimon’s philosophy, revealing that its true nature becomes apparent only when viewed in light of his philosophy of mathematics. This provides the key to understanding Maimon’s solution to Kant’s _quid juris_ question concerning the connection between intuition (...) and concept in mathematics. Maimon’s original approach avoids dispensing with intuition while reducing the reliance on intuition in its Kantian sense. As Buzaglo demonstrates, this led Maimon to question Kant’s ultimate rejection of the possibility of metaphysics and, simultaneously, to suggest a unique type of skepticism. (shrink)

Is freedom compatible with determinism? Davidson famously rephrased this question by replacing “freedom” with “anomaly of the mental”, that is, failure to fall under a law. In order to prove that the anomaly of the mental is compatible with other conjectures he makes, in particular that: there is psycho-physical causation; “where there is causality, there must be a law” ; and the mental supervenes on the physical, Davidson proposed a model, that came to be known as anomalous monism. Accepting all (...) of Davidson’s conjectures, we compare the structure of Davidson’s argument with that of Einstein’s argument for the special theory of relativity. This leads us to an exposition of Davidson’s ontology in terms that are inspired by recent results in the philosophy of physics, that is, in terms of fundamental ontology and high-level coarse-grained descriptions. We explain in what sense Davidson’s model is a principle theory and discuss some requirements that the constructive theory underlying Davidson's principle approach must satisfy. We propose two constructive theories of description that may underlie Davidson's approach and this deeper structure leads us to formulating a dilemma according to which Davidson's approach entails either a non-physicalist type-identity reductive and monistic structure of events; or else it entails a structure of events that requires what we call token-substance dualism. We consider some issues which seem to suggest that the first horn of this dilemma collapses into a reductive type-identity physicalist theory, contrary to Davidson's intent. Finally, we show how Davidson's achievement of accounting for some freedom of the mental from the physical and the anomaly of the mental within anomalous monism can be achieved in a fully reductive type-identity physicalist theory. This paper describes a version of type identity physicalism, which we call Flat Physicalism, and shows how it meets several objections often raised against identity theories. This identity theory is informed by recent results in the conceptual foundations of physics, and in particular clar- ifies the notion of ‘physical kinds’ in light of a conceptual analysis of the paradigmatic case of reducing thermody- namics to statistical mechanics. We show how Flat Physi- calism is compatible with the appearance of multiple realisation (...) in the special sciences, and how and in what sense the special sciences laws are autonomous from the laws of physics, despite the full reductive picture of Flat Physicalism. We compare our view with a recent proposal by William Bechtel that accounts for the appearance of levels in mechanistic explanations. (shrink)

This article exploits the unique consequences of the COVID-19 pandemic outbreak to examine whether time constraints drive the unequal division of unpaid labor between dual-earner couples in Israel. Using the first wave of longitudinal household data that was collected in Israel since the outbreak of the pandemic, we focused on 325 dual-earner couples who stayed employed during the first lockdown. By employing OLS regressions, we examined the association between changes in employment hours and changes in unpaid labor for partnered men (...) and women. Strong evidence was found for a gendered translation of the time constraints mechanism: A decrease in hours of paid work is related to an increase in hours of care for children among men and women, but time devoted to housework increased only among women. We conclude that time constraints that resulted from the dramatic effect of the first lockdown on paid and unpaid work in Israel did not significantly change the gender division of unpaid housework but did change the distribution of childcare. The theoretical implications of this conclusion for future research are discussed. (shrink)

The topic of my essay is Palestinian morgue photography in the wake of the Israeli air strikes and the ground invasion of Gaza, during Operation Cast Lead. I especially focus on a fashionable angle that is prevalent among the local Palestinian press-photographers. I term it the acrobatic gaze: from the heights of the fridges in the morgue the photographers try to be omniscient absently-present witnesses that are capable of combining in a single composition both the faces of the standing relatives (...) and the faces of the supine bodies. These photographs raise ethical, aesthetical, and political questions about the representation of the dead who are displayed to their families and to the photographers for propaganda reasons as well.
