In Brazil, the normative landscape around advertising is complex, not the least because of limitations inherent to dispute resolution mechanisms. Focusing on unhealthy food and beverages, this case study identifies some challenges and opportunities around advertising restrictions, including in relation to freedom of speech.

Complex systems can be characterized by classes of equivalency of their elements defined according to system specific rules. We propose a generalized preferential attachment model to describe the class size distribution. The model postulates preferential growth of the existing classes and the steady influx of new classes. According to the model, the distribution changes from a pure exponential form for zero influx of new classes to a power law with an exponential cut-off form when the influx of new classes is (...) substantial. Predictions of the model are tested through the analysis of a unique industrial database, which covers both elementary units (products) and classes (markets, firms) in a given industry (pharmaceuticals), covering the entire size distribution. The model's predictions are in good agreement with the data. The paper sheds light on the emergence of the exponent tau approximately 2 observed as a universal feature of many biological, social and economic problems. (shrink)

ABSTRACT I present a new model of the self-regulation of virtue that integrates perspectives on emotion, cognition, and motivation. Across three vignette-based studies in US/uk (N = 1,540), I developed through exploratory and confirmatory factor analysis a multi-item measure of broadening and defensive responses, the Self-Regulation of Virtue Inventory (SRVI). I applied that measurement model to two new scenarios portraying prototypical moral exemplars (selected from a set of 12) and fitted structural models that identify key antecedents: motivational dispositions (regulatory focus (...) and hedonic orientation) and moral comparisons (opinion- and ability-based). The findings were consistent with network analysis, providing initial evidence of their robustness. By integrating literatures on motivation, emotion, social cognition and comparison within a self-regulation framework, I provide initial evidence to advance theory on moral self-regulation and moral education, with practical implications on how to maximise the upsides of virtue while mitigating or channelling its possible drawbacks. Human nature is something of a taboo on the left wing of contemporary political theory and scarcely more than a commonsense assumption on its right wing. This article aims to expose the taboo and to challenge the assumption. There is no way, we argue, to defeat conservative political theory without delving into political anthropology. With this purpose in mind, our article analyses the writings of Marx and Engels, and Simondon’s concepts of the transindividual and technics. It shows that Simondon’s theory (...) of technics allows new interpretations of many of the themes scattered in Marx’s and Engels’s works and helps to formulate a materialist political anthropology which entails a political project of liberating ‘human nature’ _from_ labour. Lógica, formação escolar e filosofia entre os jesuítas Resumo: O interesse mais direto deste artigo é a relação entre a Lógica e a formação filosófica na educação jesuíta. Para compor uma imagem da importância e da concreção da Lógica na formação proposta pelos inacianos, nós nos concentraremos na Ratio Studiorum e na obra do jesuíta português Pedro da Fonseca (1526-1599). A razão do recorte proposto é que as reflexões de Fonseca sobre o tema parecem, por um lado, orientar outros jesuítas, (...) como é o caso de Sebastião do Couto, que é o autor da dialética do Curso Conimbricense; por outro, elas são mais completas, sobretudo pela atenção dada por Fonseca ao método e às disputationes. In order to produce an image of the importance and concretion of Logic in the formation proposed by the Ignatians, we will focus on the Ratio Studiorum and on the work of the Portuguese Jesuit Pedro da Fonseca (1526-1599). The reason for the proposed approach is that Fonseca's reflections on the subject seem, on the one hand, to guide other Jesuits, such as Sebastião do Couto, who is the author of the dialectic of Curso Conimbricense; on the other hand, Fonseca’s conception of logic is more complete regarding the other Jesuits, especially due to the attention given by our author to the method and the disputationes. A covid-19 tem gerado grande mobilização por parte das sociedades contemporâneas. Como forma de prevenção e controle da doença, o isolamento social tem sido uma medida eficaz, recomendada por diversos órgãos da saúde. Por isso, pensar o isolamento social como prática solidária tem sido fundamental. Nesta perspectiva, o presente artigo busca problematizar o isolamento social enquanto isolamento solidário. Para isso, partimos da tematização da enfermidade, até agora conhecida, seus modos de prevenção e controle e, por conseguinte, o diálogo entre a (...) Saúde Coletiva e a Hermenêutica Filosófica, na tentativa de repensar o isolamento criticamente, para além de uma questão biomédica. Assim, discutir o isolamento solidário como noção essencial ao enfrentamento da pandemia da COVID-19 significa contribuir para uma visão mais ampla de saúde, ao passo que se encontra em jogo o restabelecimento da vida comunitária para além de sua concepção biomédica. Riassunto: In una prospettiva naturalistica, lo studio della religione presenta subito un punto problematico: se essa è così diffusa, tanto da apparire un tratto inscritto nella natura umana, ciò significa che la religione comporta dei vantaggi adattivi o, quantomeno, significa che essa non comporta svantaggi tali da ostacolare la sopravvivenza di chi la pratica. Nel primo caso, si tratta di individuare la possibile funzione della religione, ovvero una qualche utilità che ne giustificherebbe il suo permanere nella storia umana. Alla luce (...) di un modello antropologico che vede l’identità soggettiva segnata da una fragilità ontologica, in questo articolo offriremo una particolare versione della tesi che assegna alla religione, quale byproduct, una funzione positiva, ipotizzando quella che potrebbe essere una sua utilità nella difesa dell’unità dell’autocoscienza. Sarà dunque sulla religione quale insieme di tecniche difensive del self che concentreremo la nostra indagine. In the former case, we need to understand the function of religion, viz. a utility it confers that may justify its persistence across human history. Against the backdrop of an anthropological model that considers subjectivity identity to be characterized by ontological fragility, this article will offer a special version of the claim that religion, viewed as a byproduct, has a positive function: we will make the hypothesis that it contributes to the defense of the unity of self-consciousness. Thus our focus will be on religion construed as a repertoire of strategies designed to protect the self. Le statut théorique du rapport cognitif entre sujet et objet a été refusé par Sartre depuis ses premiers textes phénoménologiques et surtout dans L?Être et le Néant . C?est justement le rapport existentiel et immédiat de la conscience au monde, c?est-à-dire la conscience (de) soi, qui nous donne le point le plus substantiel dans la description phénoménologique sartrienne de la liberté. La conscience est plongée dans le monde et elle ne peut jamais lui échapper. Toutefois, elle peut quand même essayer (...) de se cacher à elle-même dans une conduite de mauvaise foi, bien que dans ce cas elle soit vouée à l?échec. C?est à partir du concept de mauvaise foi que la morale même devient possible dans la pensée du Sartre phénoménologue. La possibilité de conversion est ce qui permet de la préciser et de la définir ; autrement dit, d?envisager l?authenticité de la conscience dans sa relation à autrui. La description de la conversion, c?est ce qui nous renvoie au sens moral de la liberté à travers son rapport pratique dans le monde. Nous essayerons de reconstituer brièvement le parcours qui a amené Sartre à cette idée fonda­mentale. 1. O artigo reflete sobre o procedimento hermenêutico utilizado pelo professor, crítico e filósofo Benedito Nunes em sua obra. Reconstruindo diálogos do autor com Nunes, procura-se compreender as peculiaridades da sua abordagem interpretativa em relação a três pensadores com os quais sua obra dialoga em permanência, Heidegger, Gadamer e Ricoeur. Compreende- se que a abordagem de Nunes procura superar alguns impasses da hermenêutica contemporânea por meio da problemática heideggeriana da co-referencialidade entre fundamento e abismo, tema presente na questão geral do conflito (...) ôntico ontológico, compreendendo-se fundamento como aquilo que é a fundamentação do ser relativamente ao ente, e abismo como o ser enquanto tal. A partir dessa equação, considerando o estatuto da co-presença (Zusammengeböririgkeit) entre os dois elementos, entende-se que a ação de interpretação de Nunes valoriza não apenas as dinâmicas de desvelamento, mas também de ocultamento do ser e, em o fazendo, permite uma abertura da hermenêutica para a alteridade. Desde los remotos tiempos de la tragedia Ática en Grecia, el teatro es y ha sido siempre movimiento, siendo este una característica esencial de los seres orgánicos, es decir, de los dotados de vida. No obstante, se corre el riesgo de reemplazar su mecánica natural con metafísica, cuando ello no es coherente ni siquiera en hipótesis. Cabe demostrar las disimilitudes del teatro con las doctrinas escolásticas, idealistas, o hinduistas, y su compatibilidad con los átomos, electrones y las leyes de la (...) física, sometiendo sus conceptos al rigor epistemológico. La creación artística nace del psiquismo humano, aun no siendo material en primera instancia, pero ya luego cobra su forma cualitativa definitiva. Para ello atraviesa por varios tipos de censura, tanto física como psicológica, buscando expresarse mediante el lenguaje en que se comunican los distintos géneros dramáticos, dando a conocer su situación de crisis sin retorno, esa que se debate entre crueldad y violencia. Antonin Artaud intrinca al teatro las ideas cabalísticas y no busca contrastarlas con argumentación lógica. La evidencia demuestra que, si es que hay una unidad, esa es la del teatro con lo físico. Lo físico es su verdadero “doble”. Un sucinto pero conciso repaso histórico, bien prodigado de documentación y basado en los preceptos erigidos por el materialismo dialectico, nos dará la certeza de que el teatro pertenece exclusivamente al mundo físico, no solo en la práctica, sino también en esencia, y esta es la materia, siendo solo la metafísica un estadio improbable dentro de ella. Fábio Alves dos Santos (1954-2013) cursou Pedagogia, Ciências Sociais e Teologia, era Especialista em Filosofia da Religião (PUC Minas), Advogado (PUC Minas) e Mestre em Direito Constitucional (UFMG). Lecionou na PUC Minas como professor de Cultura Religiosa e depois como professor no Curso de Direito, atuando principalmente no Serviço de Assistência Judiciária – SAJ, especialmente cuidado de causas populares como as da ASMARE (Associação dos Catadores de Papel, Papelão e Material Reaproveitável de Belo Horizonte), da Pastoral de Rua, da Pastoral (...) Carcerária, de movimentos de “Sem Casa”, de ocupações e tantos outros grupos. Fábio sofria de grave problema de visão há mais de 15 anos. Quase ficou cego depois de diversas cirurgias de miopia. Isso, porém, não o impedia de seguir seu constante compromisso com as lutas populares. Na última entrevista que concedeu, menos de um mês antes de sua morte (19 de outubro de 2013), depois de duro sofrimento de quase dois anos, no tratamento de um câncer no pâncreas, conta um pouco de sua vida, sua luta e sua percepção de várias realidades, especialmente da Igreja e da pastoral. Militante formado na Teologia da Libertação, de profunda espiritualidade, marcada por traços da religiosidade popular nordestina e comprometida com a libertação, Fábio Alves também buscou em sua vida abrir-se à teologia do pluralismo religioso, especialmente com o Santo Daime, em cuja tradição religiosa chegou a ser “fardado”, mantendo uma profunda atitude espiritual aberta ao diálogo inter-religioso. Sua primeira publicação foi “Começo de mundo novo: sofrimento, luta e vitória dos posseiros de Santana dos Frades”, Sergipe, numa versão popular em 1981 e outra pela Editora Vozes (1990). Fruto de sua dissertação de mestrado, publicou o livro “Direito Agrário: política fundiária no Brasil (1995). Em 2001 saiu seu último livro, uma coletânea de artigos publicados em diversos jornais: “Em defesa da vida”. Num artigo em Horizonte (2004), juntamente com o advogado, amigo e colega Prof. Cristiano de Melo Bastos, discutiu “A prática jurídica na missão da PUC Minas”. O presente artigo propõe uma análise dos riscos de degeneração da democracia contemporânea em três pontos. No primeiro ponto, retomamos o tema da possibilidade de degeneração da democracia segundo a perspectiva de Platão e Aristóteles com o objetivo de apresentar os seus traços elementares. No segundo ponto, fazemos uma análise do pensamento de Alexis de Tocqueville, particularmente do modo como ele tratou as ameaças à democracia no quadro do liberalismo político do século XIX. Procuramos mostrar, em um terceiro ponto, que (...) o cenário contemporâneo exige que se coloquem em relevo os efeitos produzidos pelas novas mídias e pelo retorno de um discurso totalitário. Utilizamos, para tanto, alguns textos escolhidos de Baudrillard e Rancière, na tentativa de melhor explicitar o modo como as ameaças atuais à democracia se entrelaçam à sociedade de consumo, às novas mídias e ao retorno de um discurso totalitário. This paper analyzes concepts of independence and assumptions of convexity in the theory of sets of probability distributions. The starting point is Kyburg and Pittarelli’s discussion of “convex Bayesianism” (in particular their proposals concerning E-admissibility, independence, and convexity). The paper offers an organized review of the literature on independence for sets of probability distributions; new results on graphoid properties and on the justification of “strong independence” (using exchangeability) are presented. Finally, the connection between Kyburg and Pittarelli’s results and recent developments (...) on the axiomatization of non-binary preferences, and its impact on “complete” independence, are described. Implicações da noção de consciência histórica nas ciências humanas e sociais: um modo de projeção para o futuro e de posição em relação ao passado Resumo: O presente texto, de caráter bibliográfico, discute o problema da consciência histórica com o objetivo de pensar o sentido dessa expressão na atualidade e as variações que esse conceito adquiriu ao longo da história das Ciências Humanas e Sociais, com ênfase no século XX. A hipótese é que a discussão a respeito da consciência histórica (...) passou a se ocupar, na modernidade, com uma múltipla relatividade de pontos de vista, o que é destacado por Gadamer em sua análise sobre os preceitos implicados na definição do que significa “ter senso histórico”. É defendida a tese, portanto, de que a noção de consciência histórica não se limita ao conhecimento das experiências vivenciadas no passado, mas se apresenta como condição de possibilidade de projetar o futuro e se posicionar em relação ao passado, especialmente no que diz respeito às ciências humanas e sociais. A defesa desta ideia central é realizada por meio de dois gestos reflexivos, com apresentação, primeiramente, do marco teórico da consciência histórica e, posteriormente, de suas implicações na constituição das Ciências Humanas e Sociais. Implications of the notion of historical consciousness in human and social sciences: a mode of projection for the future and position in relation to the past: This bibliographic text discusses the problem of historical consciousness with the purpose of thinking about the meaning of this expression in the present time and the variations that this concept has acquired throughout the history of the Humanities and Social Sciences, with emphasis on the twentieth century. The hypothesis is that the discussion about historical consciousness has come to concern itself, in modernity, with a multiple relativity of points of view, which is highlighted by Gadamer in his analysis of the precepts involved in defining what “having a historical sense” means. Therefore, the thesis that the notion of historical consciousness is not limited to the knowledge of past experiences is defended, but is presented as a condition of possibility of projecting the future and positioning itself in relation to the past, especially with regard to humanities and social sciences. The defense of this central idea is made through two reflexive gestures, presenting, first, the theoretical framework of historical consciousness and, later, its implications in the constitution of the Human and Social Sciences. We are used to regarding actions and other events, such as Brutus’ stabbing of Caesar or the sinking of the Titanic, as occupying intervals of some underlying linearly ordered temporal dimension. This attitude is so natural and compelling that one is tempted to disregard the obvious difference between time periods and actual happenings in favor of the former: events become mere “intervals cum description”.1 On the other hand, in ordinary circumstances the point of talking about time is to talk about (...) what actually happens or might happen at some time or another. We talk about ‘now’ and ‘then’ in an effort to put some order in our description of what goes on. And since different events seem to overlap in so many different ways, a full account of their temporal relations seems to run afoul of a reductionist strategy. This raises two philosophical questions. The first is whether we can actually go beyond time, as it were, i.e., whether we can take events as bona fide entities and deal with them directly, just as we can deal with spatial entities such as physical bodies or masses without confining ourselves to their spatial representations. This is a controversial issue (though probably not as controversial as it used to be), and ties in with a number of unsettled problems concerning, e.g., the structure of causality or the definition of adequate identity and individuation criteria for events. 2 The second question is whether we can perhaps do without time, i.e., whether we can dispense with time points or intervals as an independent ontological category and focus only on actual or potential happenings, in opposition to the form of reductionism mentioned above—in short, whether we can account for the temporal dimension in terms of suitable relations among events. This is also a highly controversial issue, and relates to the classical dispute concerning relational vs. absolutist conceptions of (space and) time.3 It is this second question that we intend to focus on here.. Plutarch’s account of Lucullus unsuccessfully begging his soldiers to follow him further, shortly before being forced to leave his command, is commonly read as the apex of his failure as a military leader. A close reading, however, reveals two hitherto overlooked aspects. Firstly, the story offers valuable information on late Republican military history, regarding the duration of military service before Augustus’ reform and the existence of clearly defined subgroups within the army. Secondly, the conflict between Lucullus and his soldiers allows (...) us to get a glimpse of the political debate of the time, characterised by the competing claims to Sulla’s heritage, the shift of military loyalty towards specific individuals, and above all the question of who really represented the interests of the res publica. ABSTRACT Quaderni piacentini, set up in 1962 by Piergiorgio Bellocchio and Grazia Cherchi, was probably the most iconic leftist periodical in Italy before 1968. Its criticism against both the Italian Communist Party for its non-revolutionary policy and the reformist centre-left coalition, its uncompromising ethics, and its exploring into non-orthodox Marxist approaches made it representative of the intellectual New Left in Italy, against the background of advanced industrialization. This article explores the changing perception of the role of intellectuals in society from (...) classic forms of an elitist political involvement to the desired identification with the masses. It argues that between the two different ways to approach culture that intersected in Quaderni piacentini and characterized the debate around 1968, namely the one expressed by Franco Fortini – advocate of the function of intellectuals and of the use of literature for political purposes – and the one supported by Alberto Asor Rosa – convinced of the need for a self-destruction of traditional ʻbourgeois' disciplines – the periodical tended to side with the former, in order to keep culture a credible and legitimate tool for militancy. This paper addresses the relationship between epistemic difference and hermeneutical injustice, starting from an example discussed by Townsend and Townsend: the case of the Kichwa Indigenous People of Sarayaku v. Ecuador before the Inter-American Court of Human Rights. My thesis is that translation is inevitably at work in communicative exchanges involving epistemic difference, and that considering the problem of translation allows us to refine our understanding of epistemic injustice and mobilise further resources to respond to it. In a first step, (...) I will discuss McGlynn’s critique of Townsend and Townsend’s approach, and in particular the notion of discursive injustice elaborated by Kukla. Drawing on the notion of symbolic institution as theorised by the Belgian phenomenologist Marc Richir, I will show how translation is at work in this case, seeking to pinpoint the hermeneutical injustice at play. In a second step, I will reflect on the different paradigms of translation and argue for a broad, processual and layered conception of it. Building on Antonio Gramsci’s concept of translatability of languages, I will introduce the notion of epistemic translatability as that which allows translational strategies to be devised across epistemic difference in order to counter hermeneutical injustice. We present a new puzzle about logical truth, necessity, and moral responsibility. We defend one solution to the puzzle. A corollary of our preferred solution is that prominent arguments for the incompatibility of determinism and moral responsibility are invalid.

RESUMO: O objetivo deste artigo é examinar o que entendemos ser uma prova original da existência de Deus na obra de Pierre Duhem. Cremos que a originalidade dessa prova consiste especialmente nas premissas usadas pelo filósofo. Quanto à forma, a mesma assemelha-se ao conhecido argumento do desígnio, mas a sua versão se caracteriza por buscar na história das teorias físicas a matéria da qual a existência de uma Providência é derivada. É a complexa evolução das teorias e, a despeito dela, (...) a sua espantosa progressividade em direção a estágios sempre mais perfeitos que servem de premissa para a via duhemiana de acesso a Deus. Tudo se passa como se houvesse uma suposta pré-ordenação divina do curso das teorias, uma finalidade intrínseca a ele. ABSTRACT: The aim of this paper is to examine what we believe to be an original proof of the existence of God in the work of Pierre Duhem. We think that the originality of this proof consists especially in the assumptions used by the French philosopher in his argumentation. Regarding the form, it resembles the well-known design argument, but his version is characterized by seeking in the history of physical theories the matter from which the existence of a Providence is derived. It is the complex evolution of theories and, despite it, its amazing progress towards ever more perfect theories that serves as the premise for Duhem's way of access to God. Everything goes as if it had been a divine preordainment and an intrinsic goal ruling the evolution of theories. (shrink)

This paper expands on the theory of event structures put forward in previous work by further investigating the subtle connections between time and events. Specifically, in the first part we generalize the notion of an event structure to that of a refinement structure, where various degrees of temporal granularity are accommodated. In the second part we investigate how these structures can account for the context-dependence of temporal structures in natural language semantics.
