El presente texto se interroga sobre los efectos performativos del himno de Chile en cuanto éste designa al país en la forma de una "copia feliz del Edén". A partir de ahí, se pregunta ¿cómo podría una copia afirmarse en la originalidad de una soberanía? Para solucionar la distancia entre copia y original y, por tanto, dar lugar al funcionamiento de la soberanía, el himno designa a esa copia como "feliz". El término "feliz" se constituye, así, en el operador que (...) vendría tanto a apuntalar a la constitución de una soberanía como a revelar el límite de su imposibilidad. "Feliz" permite disminuir la distancia entre copia y original, pero a la vez, la conserva irremediablemente. Por eso, decir que el país es la copia "feliz" es lo mismo que decir "infeliz" toda vez que ambos términos no hacen más que corroborar la diferencia ontológica entre copia y original. Se argumenta que el término "feliz" constituye un dispositivo teológico político, toda vez que replica la función angélica destinada a la administración de la creación divina. En estos términos se pregunta: ¿no será el proyecto de la República de Chile un proyecto esencialmente administrativo? A esta luz, el texto plantea la contraposición entre himno con el poema: el himno -se plantea- constituye el operador angélico que hace posible la articulación de una soberanía. El poema, en cambio, constituiría el resto irreductible que le resiste. This essay asks on the performative efects of the chilean hymn, because it names the country as a "happy copy of Eden". Since this problem, the essay asks: how could the copy may posits as the originality of the sovereignity? To solve the distance between the copy and the original and make posible the sovereignity´s operation, the hymn names the copy as "happy". The word "happy" supports the constitution of the sovereignity and reveals the limit of its own imposibility. "Happy" reduce the distance between the copy and the original but, at the same time, absolutely preserve it. That´s why, say that the country is the "happy" copy is the same than to say that is a "unhappy" one, because both words shows the ontological difference between the copy and the original. This essay argues that the word "happy" is a political theological device because repeats the angelical task of manage the divine creation. In theses terms we ask: ¿Is the chilean republican proyect an administrative one? In this light, the essay posits an aporia between the hymn and poem: the hymn constitutes the angelical operator that makes sovereignity posible, the poem constitutes a singular rest that resist it. Agamben, el presente ensayo argumenta que la figura del prudente en Aristóteles constituiría el lugar de la soberanía y, en cuanto tal, tendría un carácter estrictamente biopolítico pues, permite “producir” la humanidad del ser vivo hombre, en cuanto zoon politikón (zoon lógon ekhon). Así, el presente texto da cuenta de una aporía inscrita en el seno de la política occidental y su concepto de justicia que, encarnado en la figura aristotélica del prudente (...) –en cuanto lugar de la decisión soberana- ha de producir la propia “humanidad” del ser vivo hombre, separando, al mismo tiempo, algo así como una nuda vida. El presente artículo problematiza la cuestión de la “masa” a propósito de su irrupción en el contexto chileno del 18 de octubre del 2019, situando el límite que tiene el tratamiento que hace Sigmund Freud para pensarla y atender tanto la dinámica del deseo como su deriva destituyente respecto de las instituciones que, como se sabe, se articulan en función de la noción de “ilusión”.

El presente texto problematiza el llamado “fe-minismo musulmán” contemporáneo a la luz de la crítica averroísta a la teología política desarrollada por el filósofo cordobés en el Fasl Al Maqal (“Tratado Decisivo”) argumentando que el ejercicio crítico de las teóricas feministas musulmanas actuales reedita la iytihad o “es-fuerzo personal de interpretación” de los textos (con independencia de su tradición), operación presente en la tradición jurídica que, en su momento, Averroes extrapolará a la práctica filosófica. Para ello se analizará el razonamien-to (...) de algunas críticas feministas musulmanas para mostrar su semejanza con la crítica ave-rroísta desarrollada en el siglo XII. (shrink)

El presente ensayo se propone dilucidar el modo en que el problema de la soberania tiene lugar en el pensamiento de Michel Foucault. Su tesis es que la soberanía aparece de tres formas a lo largo de su obra: en primer lugar, bajo la rúbrica de la “soberanía jurídica” propia del “modelo del Leviatán”, en segundo lugar, en la forma de una “soberania política” que se despliega en la época de la gubernamentalidad neoliberal y, en tercer lugar, la “vida soberana” (...) que constituye un lugar para articular una genealogía de la vida ética en Occidente. Esta última forma de situar la soberanía representa un intento, por parte de Foucault, de pensar en una noción de la Ilustración en la forma de una “actitud” más allá de cualquier época histórica. Shepherd propounds a theory of mind with a fair claim to be better than Hume’s at explaining the sources of commonly held human beliefs about causal necessity due largely to her relational theory of sense perception. In comparison with Hume’s account, it incorporates a more sophisticated treatment of mental representation, especially the role of relational structure and logical form. Most important, perhaps, Shepherd’s theory enforces the division, obscured by Hume, between the evidence of necessity and the metaphysical foundation of necessity.

This paper argues that Locke has a representative theory of sensitive knowledge. Perceivers are immediately aware of nothing but sensory ideas in the mind; yet perceivers think of real external substances that correspond to and cause those ideas, and they are warranted in believing that those substances exist (at that time). The theory poses two questions: what warrants the truth of such beliefs? What is it in virtue of which sensory ideas represent external objects and how do they make perceivers (...) think of those objects? Both the epistemic and semantic issues need to be addressed. This paper urges that Locke's basic account of warrant is roughly reliabilist. The causal origin of sensory ideas assures that, in general, sense based beliefs are true. Locke defines the limit of this warrant by the theoretical point that we cannot discuss skeptical doubt without assuming the truthfulness of our perceptual faculty. Turning to the semantic question, the paper argues that ideas are mental modifications or entities. They are not intrinsically representative (satisfiable), but rather represent only by virtue of their causal origin. They merely “track” the presence of substances and their qualities. Ideas nevertheless prompt perceivers to think of their causes. This is roughly because sensory ideas have a specific mental role, namely, to serve as marks for distinguishing substances and their respective qualities for purposes of action. The paper suggests that, for Locke, the challenge posed by the semantic veil of ideas is to explain this externally directed marking function within bounds of his anti‐innatism. But it concludes that his answers to the twin questions fit together reasonably well. (shrink)

The question "What is mental illness?" raises many issues in many contexts, personal, social, legal, and scientific. This chapter reviews mental health problems as they appear to the person with the problems, and to family and friends-before the person attends the clinic and is given a diagnosis-a time in which whether there really is a problem, as opposed to life's normal troubles and variations, is undecided, as also the nature of the problem, if such it be, and the related matter (...) what kind of expert advice should be sought. Once at the clinic, a diagnosis may be given-using criteria well-worked-out in the diagnostic manuals. The chapter discusses the conceptualizations of mental disorder in the diagnostic manuals, their rationale, and what can and cannot be reasonably expected of them. There are more position statements than definitions, and while they signal many dilemmas, they do not resolve them. Attempts to do so in the surrounding literature on the concept of mental illness are reviewed in the chapter, with conclusions favoring the features emphasized in the diagnostic manuals: distress and impairment. Finally the chapter considers how far the science may help draw boundaries around mental illness. (shrink)

This interesting and challenging book addresses the apparent gap between the empiricist account of the origin of ideas and the theory of knowledge in the Essay concerning Human Understanding. Matthew Priselac makes an impressive argument that they are complementary parts of a coherent program. It consists of a naturalistic interpretation on which the Essay's main aim is to provide the kind of understanding of the mind, knowledge, and probability afforded by modern methods of natural scientific inquiry.On this view, the Essay (...) advances a hypothesis intended to explain the epistemic phenomena of everyday life, that is, what we take ourselves to know rather than hold as probable. Reading the moral philosophy of Iris Murdoch alongside film enables us to see Murdoch's notions of practical moral good in action. For Murdoch, moral philosophy can be seen as “a more systematic and reflective extension of what ordinary moral agents are continually doing”. Murdoch can help us further by her consideration of the value of a moral fable: does a morally important fable always imply universal rules? And how do we decide whether a fable is morally important? By bringing Murdoch (...) and Margaret together in an exploration of the moral decision making of the film's protagonist and our assessment of her choices, we can learn more about the idea of film as a morally important fable rather than a fable that is purely decorative. Laboratory studies find a strategic component to moral behaviour that differs in significant ways from common perceptions of how morality works. Models based on a preference for relative payoffs offer an explanation.

This article examines the different approaches to the relation between law, state and economy in the works of Hans Kelsen, Carl Schmitt and Evgeny Pashukanis. It begins with Kelsen’s depiction of law as a dynamic and ‘self-regulating’ system of norms, founded on his rejection of ‘dualist’ separations of state and law, before turning to Schmitt and Pashukanis’s respective critiques. For all their differences, both agree Kelsen ignores the historical basis of the law – for Schmitt, the sovereign power of ‘the (...) political’, for Pashukanis, the social relations of commodity exchange. The article responds to these criticisms in a most un-Kelsenian manner, drawing upon historical sociological literature on early modern state formation to cast doubt on both Schmitt and Pashukanis’s historical accounts. It argues that the forms of political power and commodity exchange upon which Schmitt and Pashukanis’s theories rely were historically specific possibilities opened up by the same process of generalisation and depersonalisation of power relations that allowed for an autonomous ‘public’ system of legal norms. Thus, rather than the fixed causal ground for the development of modern law, ‘the political’ and exchange between equals exist in a relation of ‘difference-in-unity’ with the law. The article concludes that Kelsen’s notion of the Grundnorm is best explained as an attempt to capture the new possibilities and responsibilities opened up a normative system whose ultimate justification now lies only within itself. This article presents a model for doing clinical ethics consultations. It describes four phases of a consultation: investigation, assessment, action, and review. The consultant must identify the problem and determine whether it is a nonmoral problem (e.g., lack of information) or a moral problem involving uncertainty or conflict. The consultant must be able to identify the types of moral arguments that are used by participants to the situation. A simplified taxonomy of moral arguments is presented. The consultant must then assess (...) the arguments for their cogency and identify where they align and where they conflict. The action phase of the consultation involves finding ways for the arguments to be presented and hopefully reconciled. The normative limitations to the role of the consultant are described. (shrink)
