A fresh look at the importance of natural and international law in the religious politics at the heartlands of the Reformation, from the Low Countries, the German principalities up to Transylvania; from Niels Hemmingsen to Gian Battista Vico; from religious reasons for the universalist claims of natural law to political arguments for the sacred polity, their tension and creative potential.

Sixteen essays discuss _De iure praedae_ – Hugo Grotius’s 1604-1605 commentary on booty –, its sources, circumstances and consequences, and explore how Grotius the humanist, the theologian, the jurist and the politician concur in this his first exercise in natural law and rights.

SummaryGrotius has a rudimentary theory of sociability. Only with hindsight has a remark about appetitus societatis been promoted to the starting point of a theory that flourished in the writings of later natural jurists. In this article, I address the issue of the appearance in Grotius's natural law of sociability [as the 1715/38 English translation of John Morrice renders appetitus societatis, following Barbeyrac's sociabilité]. Writing in the just war tradition, Grotius is first of all interested in finding out the conditions (...) for peace, and although injustice is a condition of war, it is not per se true that injustice is a perversion of society. Apparently, not all societies are perfect and the violence of war and the legal actions of peace are both instruments for achieving a greater modicum of justice in this world. Yet appetitus et custodia societatis is called the foundation of justice. Grotius achieved this context for sociability in phases, through a series of writings from c. 1600 until De iure belli ac pacis of 1625, and its revision of 1631. In this development the notion of fides plays an intriguing role, through which we can obtain a better understanding of the meaning of appetitus societatis in the later work. The present article is a sequel to a previous publication, on fides in De iure praedae. Analysing the genesis of appetitus societatis in De iure belli ac pacis, I argue that Grotius was changing his strategy over the years, without however arriving at a definitive solution to the question of what commits men to the pursuit of justice. Dutch decline is usually studied as a topic in economic history: when did it really start, what shape did it take? In this article an attempt is made to show the actual awareness of the strengths and weaknesses of the Dutch economy, in the terms used by participants in three public debates. The classical Dutch discourse of decay and decline evolved in response to national and international political reality. The Bickerse Beroerten debate of 1650 shows the conflict between neo-Roman and (...) neo-Athenian tendencies. Subsequently, the explanation of Dutch decline (the effect of luxury) by the Anglo-Dutch pamphleteer Bernard Mandeville is shown to be markedly different from his advice to the English (to allow luxury). Finally, the 1630s Dutch debate between Lieven de Beaufort and his critics represents the maturing of the Dutch vocabulary of decline, including its failure to take into account the organisational preconditions of modern society. We review recent progress in the stem cell biology of the respiratory system, and discuss its scientific and translational ramifications. Several studies have defined novel stem cells in postnatal lung and airways and implicated their roles in tissue homeostasis and repair. In addition, significant advances in the generation of respiratory epithelium from pluripotent stem cells (PSCs) now provide a novel and powerful platform for understanding lung development, modeling pulmonary diseases, and implementing drug screening. Finally, breakthroughs have been made in the (...) generation of decellularized lung matrices that can serve as a scaffold for repopulation with respiratory cells derived from either postnatal or PSCs. These studies are a critical step forward towards the still distant goal of stem cell‐based regenerative medicine for diseases of lung and airways. (shrink)

BackgroundConsent for data research in acute and critical care is complex as patients become at least temporarily incapacitated or die. Existing guidelines and regulations in the European Union are of limited help and there is a lack of literature about the use of data from this vulnerable group. To aid the creation of a patient-centred framework for responsible data research in the acute setting, we explored views of patients and next-of-kin about the collection, storage, sharing and use of genetic and (...) health-related data for observational research.MethodsWe conducted qualitative interviews (n = 19) with Dutch sudden cardiac arrest survivors who donated clinical and socio-economic data and genetic samples to research. We also interviewed their next-of-kin. Topics were informed by ethics literature and we used scenario-sketches to aid discussion of complex issues.ResultsSudden cardiac arrest survivors displayed limited awareness of their involvement in health data research and of the content of their given consent. We found that preferences regarding disclosure of clinically actionable genetic findings could change over time. When data collection and use were limited to the medical realm, patients trusted researchers to handle data responsibly without concern for privacy or other risks. There was no consensus as to whether deferred consent should be explicitly asked from survivors. If consent is asked, this would ideally be done a few months after the event when cognitive capacities have been regained. Views were divided about the need to obtain proxy consent for research with deceased patients’ data. However, there was general support for the disclosure of potentially relevant post-mortem genetic findings to relatives.ConclusionsSudden cardiac arrest patients’ donation of data for research was grounded in trust in medicine overall, blurring the boundary between research and care. Our findings also highlight questions about the acceptability of a one-time consent and about responsibilities of patients, researchers and ethics committees. Finally, further normative investigation is needed regarding the (continued) use of participants’ data after death, which is of particular importance in this setting. Our findings are thought to be of relevance for other acute and life-threatening illnesses as well. (shrink)

A partial ordering in the class of observables (∼ positive operator-valued measures, introduced by Davies and by Ludwig) is explored. The ordering is interpreted as a form of nonideality, and it allows one to compare ideal and nonideal versions of the same observable. Optimality is defined as maximality in the sense of the ordering. The framework gives a generalization of the usual (implicit) definition of self-adjoint operators as optimal observables (von Neumann), but it can, in contrast to this latter definition, (...) be justified operationally. The nonideality notion is compared to other quantum estimation theoretic methods. Measures for the amount of nonideality are derived from information theory. (shrink)

The problem of joint measurement of incompatible observables is investigated. Measurements are represented by positive operator-valued measures. A quantitative notion of inaccuracy is defined. It is shown that within this framework joint inaccurate measurements are possible for arbitrary maximal projection-valued measures on finite-dimensional spaces. The accuracy of such measurements is limited, as is shown by an inaccuracy inequality we derive. This new type of uncertainty relation can be unambiguously interpreted as referring to measurement precision rather than preparative quality. Universities are occupied by management, a regime obsessed with ‘accountability’ through measurement, increased competition, efficiency, ‘excellence’, and misconceived economic salvation. Given the occupation’s absurd side-effects, we ask ourselves how management has succeeded in taking over our precious universities. An alternative vision for the academic future consists of a public university, more akin to a socially engaged knowledge commons than to a corporation. We suggest some provocative measures to bring about such a university. However, as management seems impervious to cogent arguments, (...) such changes can only happen if academics take action. We model three examples of beliefs that agents may have about other agents' beliefs, and provide motivation for this conceptualization from the theory of mind literature. We assume a modal logical framework for modelling degrees of belief by partially ordered preference relations. In this setting, we describe that agents believe that other agents do not distinguish among their beliefs ('no preferences'), that agents believe that the beliefs of other agents are in part as their own ('my preferences'), and the special (...) case that agents believe that the beliefs of other agents are exactly as their own ('preference refinement'). This multi-agent belief interaction is frame characterizable. We provide examples for introspective agents. We investigate which of these forms of belief interaction are preserved under three common forms of belief revision. (shrink)

Developments in medical big data analytics may bring societal benefits but are also challenging privacy and other ethical values. At the same time, an overly restrictive data protection regime can form a serious threat to valuable observational studies. Discussions about whether data privacy or data solidarity should be the foundational value of research policies, have remained unresolved. We add to this debate with an empirically informed ethical analysis. First, experiences with the implementation of the General Data Protection Regulation (GDPR) within (...) a European research consortium demonstrate a gap between the aims of the regulation and its effects in practice. Namely, strictly formalised data protection requirements may cause routinisation among researchers instead of substantive ethical reflection, and may crowd out trust between actors in the health data research ecosystem; while harmonisation across Europe and data sharing between countries is hampered by different interpretations of the law, which partly stem from different views about ethical values. Then, building on these observations, we use theory to argue that the concept of trust provides an escape from the privacy-solidarity debate. Lastly, the paper details three aspects of trust that can help to create a responsible research environment and to mitigate the encountered challenges: trust as multi-agent concept; trust as a rational and democratic value; and trust as method for priority setting. Mutual cooperation in research—among researchers and with data subjects—is grounded in trust, which should be more explicitly recognised in the governance of health data research. (shrink)

Rationale At the request of a Dutch governmental organization, a multidisciplinary group of osteoporosis experts in the Netherlands published in 2002 a guideline on case finding, diagnosis, prevention and treatment of osteoporosis. These guidelines were evaluated for their validity and applicability. Methods Analysis by 5 external osteoporosis experts using the 'Appraisal of Guidelines for Research & Evaluation' ('AGREE') instrument. Results The score for the 6 domains of AGREE was 88% for the scope and purpose domain, 76% for stakeholder involvement, 81% (...) for rigour of development, 84% for clarity and presentation, 77% for applicability and 73% for editorial independence. For single components of the domains of AGREE, highest scores were found for systematic methods used to search for evidence (100%), inclusion of individuals from all the relevant professional groups (95%) and ease of identifying key recommendations (95%). Lowest scores to single components of the several domains were given for piloting among target users (44%). All experts recommended the guidelines for use in practice. Conclusions The AGREE instrument scored high for development, clarity and presentation but low for piloting among target users and implementation. Based on the guideline, algorithms from case finding to treatment were constructed that could be tested for piloting among target users and for implementation of the guideline. (shrink)

Why is religion such a widespread human experience? In enlightenment Scotland, philosophers had already attempted to answer this question turning to natural histories of mankind, and to a careful analysis of the human mind and of those cognitive capacities responsible for religious-type beliefs and attitudes. This early approach is also echoed today, as scholars from the cognitive sciences seek to show how religious-type beliefs and practices are produced either directly or as a by-product of natural cognitive processes. Others continue to (...) study the dependence of religious beliefs on cultural traditions, symbolic meanings and ritualistic practices. Han Bertens' The Idea of the Postmodern is the first introductory overview of postmodernism to succeed in providing a witty and accessibile guide to the sometimes befuddling subject. In clear, straight forward, and always elegant prose, Bertens sets out the interdisciplinary aspects, the critical debates, the historical development and the key theorists of postmodernism. He also explains, in thoughtful and illuminating language, the relationship between postmodernism and poststructuralism, lucidly distinguishing modernism from postmodernism through an examination of the fields of architecture, (...) visual arts, and photography. Emphasizing the importance played by heterogeneity and difference in postmodern culture, Bertens carefully and adroitly defines the characteristics of postmodernism at every turn of the page. The focus of this article is the analysis of generative mechanisms, a basic concept and phenomenon within the metatheoretical perspective of critical realism. It is emphasized that research questions and methods, as well as the knowledge it is possible to attain, depend on the basic view – ontologically and epistemologically – regarding the phenomenon under scrutiny. A generative mechanism is described as a trans empirical but real existing entity, explaining why observable events occur. Mechanisms are mostly possible to grasp only (...) indirectly by analytical work, based however on empirical observations. In order to achieve such an explanatory analysis, five methodological steps are suggested and discussed, among them abduction and retroduction. These steps are illustrated throughout by examples drawn from empirical research regarding social work practice. The article is concluded with a discussion of the need for knowledge of generative mechanisms. (shrink)
