The recent Catalanian crisis raises three issues, each of which is dealt with in a section of this intervention. First, the issue of a proper reconstruction of facts, which attributes the responsability to Spanish nationalism no less than Catalonian one. Second, the issue of a sociopolitical interpretation of Catalonian events, in a context charachterized by the difficulty of the various national establishments to handle the global challenges and the emergence of so-called populist movements. Third, the issue of a legal-constitutional way-out, (...) which could only consist of a federalist compromise. A very narrow way-out, however, entrusted more to the institutional fancy of jurists than to the agenzy of politicians. (shrink)

General theory of law (general jurisprudence, allgemeine Rechtslehre) has often claimed to deal with general or universal concepts, i.e., concepts which are deemed to be common to any legal system whatsoever. At any rate, this is the classic determination of such a field of study as provided by John Austin in the nineteenth century—a determination, however, which deserves careful analysis. In what sense, indeed, can one assert that some legal concepts are common to different legal systems? And, above all, in (...) what sense can one assert that some concepts are common to different languages and cultures? My paper sets out to discuss such questions—although, obviously, they are too complicated to be answered in a single paper. The first section reconstructs the Austinian argument for general jurisprudence by placing it in its historical context. The second section tries to apply to legal concepts some suggestions derived from the contemporary debate on conceptual relativism. The third section, returning to the Austinian problem, comes to the following conclusion: Even if conceptual relativism were true and there were no general or universal legal concepts, this would not invalidate in any way the didactic and scientific value of (general) theory of law. A truly realistic theory of law – the possibility of which is examined in this work – should have the following characteristics. It should be more general than current theories, that is, be applicable to both common law and civil law; in consequence, it should invert the relationship, commonly instituted by positivist theories, between legislation and adjudication. Both in historiography and in legal comparison, of which legal theory is an extension to a higher level of abstraction, adjudication is the central (...) moment of the legal process, while legislation can be seen as one of the many attempts, and perhaps not even the most successful, to limit and control adjudication. An example of the explanatory capacity of a truly realistic theory is the so-called crisis of sources: legislation institutes judges, but they are, ultimately, those who set the hierarchy of sources and the hierarchical position of legislation itself. ‘Néoconstitutionnalisme’ est assurément le nouveau nom pour une famille de théories du droit bien connues: un nom jusqu'à maintenant utilisé seulement au sein de la théorie du droit du monde latin. Mais contrairement à une critique récente de Riccardo Guastini, et conformément à une plus large analyse de ce mouvement dans mon dernier livre, Manuale di filosofia del diritto, le néoconstitutionnalisme existe effectivement – exactement comme le droit naturel, le positivisme juridique ou encore le réalisme juridique existent. Dans cette contribution, (...) en fait, trois thèmes centraux du néoconstitutionnalisme sont examinés – la connexion droit-morale, la distinction règle-principes et le balancement ou pondération – afin d’en fournir une meilleure théorie positiviste. Ainsi, je reconnais une connexion contigente mais théoriquement essentielle entre le droit et la morale; j’admets une distinction quasiment radicale entre les règles et les principes juridiques, et je fournis une théorie du balancement positiviste, réaliste et axiologiquement pluraliste. Una teoría realmente realista del derecho –cuya posibilidad se examina en este trabajo– debería tener las siguientes características. Al mismo tiempo, debería ser más general que las teorías corrientes, es decir, valer tanto para el common law cuanto para el civil law; en consecuencia, debería invertir las relaciones, comúnmente instituidas por las teorías positivistas, entre legislación y adjudicación. Tanto en la historiografía cuanto en la comparación jurídica, de las cuales la teoría del derecho es una extensión a un nivel de (...) abstracción más alto, el momento central del proceso legal es la adjudicación, mientras que la legislación puede ser concebida como una de las tantas tentativas, y quizás ni siquiera la más lograda, de limitar y controlar a aquella. Un ejemplo de la capacidad explicativa de la teoría realmente realista es la llamada crisis de las fuentes: la legislación instituye a los jueces, pero son estos, en última instancia, los que fijan la jerarquía de las fuentes y la propia posición jerárquica de la legislación. Istinski realistička teorija prava – čija se mogućnost ispituje u ovome radu – trebala bi imati sljedeća obilježja. U svakom slučaju, trebala bi biti općenitija od postojećih teorija, to jest vrijediti kako za common law tako i za kontinentalnoeuropsko pravo; posljedično tome, trebala bi obrnuti odnos između zakonodavstva i pravosuđenja kakav obično uspostavljaju pozitivističke teorije. I u historiografiji i u poredbenom pravu, pri čemu je teorija prava njihov produžetak na višoj razini apstrakcije, središnji trenutak legal processa je pravosuđenje, dok se (...) zakonodavstvo može shvatiti kao jedan od mnogih pokušaja, možebitno ne i najuspješniji, ograničavanja i nadziranja pravosuđenja. Primjer objašnjavalačke sposobnosti istinski realističke teorije prava jest tzv. kriza izvora: zakonodavstvo uspostavlja suce, no oni su ti koji potom, u konačnici, određuju hijerarhiju izvora prava i sam položaj zakonodavstva u hijerarhiji. En este trabajo sostengo que la concepción mecanicista no captura la relevancia explicativa de la ley de polarización dinámica de Cajal. La relevancia explicativa de la ley se fundamenta en su rol como principio de diseño neuronal. Como tal, la ley nos brinda acceso epistémico a intervenciones ideales, conceptualmente posibles, sobre la localización de los diversos componentes de los centros nerviosos, y nos permiten evaluar el impacto de esas intervenciones sobre las condiciones de viabilidad del organismo.

This chapter provides a brief overview of the history of behavioral neurology, dividing it roughly into six eras. In the ancient and classical eras, emphasis is placed on two transitions: firstly, from descriptions of head trauma and attempted neurosurgical treatments to the exploratory dissections during the Hellenistic period and the replacement of cardiocentrism; and secondly, to the more systematic investigations of Galenus and the rise of pneumatic ventricular theory. In the medieval through post-Renaissance eras, the scholastic consolidation of knowledge and (...) the role of compendia are emphasized, along with the use of new methods from within a mechanistic framework. With the discovery of electrical conductance and the rise of experimentalism, we frame the modern era as period of intense debate over localization, decomposition, and other mechanistic principles, and marked by rapid discovery about the brain. The chapter ends with a discussion of the contemporary era, focusing on the establishment of behavioral neurology research on aphasia, apraxia, and neuropsychiatric conditions. (shrink)

The paper argues against the growing tendency to interpret Brentano’s conception of inner consciousness in self-representational terms. This trend has received support from the tendency to see Brentano as a forerunner of contemporary same-order theories of consciousness and from the view that Brentano models intransitive consciousness on transitive consciousness, such that a mental state is conscious insofar as it is aware of itself as an object. However, this reading fails to take into account the Brentanian concept of object, which is (...) ultimately derived from ancient and medieval philosophy, as well as the secondary, elusive character that Brentano attributes to inner perception. According to Brentano, we have an aspectual but transparent consciousness of transcendent objects, whereas our awareness of our own mental acts is always complete but incidental, and ultimately opaque. Reversing the relationship between intentionality and consciousness faces difficulties at the textual interpretative level, but also raises theoretical problems, for it risks treating Brentano’s theory of mind as a form of subjectivism and idealism. In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. In this paper I examine the role of dispositional properties in the most frequently discussed interpretations of non-relativistic quantum mechanics. After offering some motivation for this project, I briefly characterize the distinction between non-dispositional and dispositional properties in the context of quantum mechanics by suggesting a necessary condition for dispositionality – namely contextuality – and, consequently, a sufficient condition for non-dispositionality, namely non-contextuality. Having made sure that the distinction is conceptually sound, I then analyze the plausibility of the widespread, monistic (...) ontological thesis about the reducibility of dispositional properties to categorical properties in the context of the philosophy of quantum mechanics. I conclude that with the exception of Bohmian mechanics, the other “minimally realist” views of quantum mechanics require essential dispositions, i.e., dispositions of a non-reducible kind. Interestingly, seen behind the lenses of dispositionalism, Bohr’s and Bohm’s interpretations of quantum mechanics are much closer than it is usually recognized, a fact that could teach us something about the way the quantum world is. La thèse de l’« inexistence intentionnelle » formulée par Brentano a été traditionnellement interprétée comme une théorie de la « relation intentionnelle », autrement dit de la relation entre l’acte mental et son « objet immanent » ou « intentionnel », c’est-à-dire interne à la conscience. Se fondant sur la lecture du fameux passage sur l’intentionnalité de la Psychologie du point de vue empirique , le présent article démontre que l’interprétation ontologique de la théorie de l’intentionnalité du premier Brentano est (...) insoutenable, toute dominante qu’elle est. Pour ce faire, nous partirons des sources de la pensée de Brentano, en particulier de la théorie de la perception et des relatifs d’Aristote, pour rejeter la conception de l’objet immanent ou intentionnel comme entité immanente à la conscience et mettre en évidence la continuité qui existe entre la première conception de Brentano de l’intentionnalité et la seconde, consécutive à ce qu’on définit comme le tournant réiste de sa pensée.Brentano’s thesis of “intentional inexistence” has been traditionally interpreted as a theory of “intentional relationships”, i.e., of the relation between a mental act and its “immanent” or “intentional object”, within consciousness. Starting from the famous passage on intentionality in Psychology from an Empirical Standpoint , the present paper shows that the dominant ontological interpretation of Brentano’s former theory of intentionality is untenable. Proceeding from the sources of Brentano’s thought, in particular from Aristotle’s theory of perception and of relatives, the conception of the immanent or intentional object as an immanent entity to consciousness is rejected. Instead, the continuity between Brentano’s former conception of intentionality and the subsequent one, following the so-called reistic turning-point in his thought, is highlighted. (shrink)

Franz Brentano was a leading philosopher and psychologist of the nineteenth century. Indeed, the impact of his scholarship was so great that he became synonymous with a school of thought and a new approach in scientific philosophy. The Brentano School stood against the Idealistic and post-Kantian German tradition and Brentano played a crucial role in the founding of Austrian philosophy. He had an enormous impact on the work of Husserl and Heidegger, as well as on Moore’s _Ethics_ and Stout and (...) Russell’s analysis of mind. In particular, situated between the phenomenology movement and the analytic tradition, the concept of intentionality was redefined by Brentano and has been—and remains—a key concept of twentieth- and twentieth-first century philosophy of mind. But Brentano not only reshaped philosophy of mind; he was also a remarkable and innovative thinker in several other fields of philosophy, and recent debate in metaethics, metaphysics, and the history of analytic philosophy shows a strong resurgence of interest in Brentano’s thought. Thomas Kuhn is mostly known for his contributions to the philosophy of science. However, it was chiefly to investigations in philosophy of language that he dedicated the last part of his career. The aim of this paper is to present a systematic view of Kuhn’s main ideas on this subject. I start by describing his theory of concept, in particular what he says about kind terms. Such terms, acquired in blocks that form contrast sets or “taxonomies,” are learned through ostensible (...) definitions. Next, I analyze Kuhn’s concepts of “meaning” and “truth.” Finally, I discuss a second type of kinds terms, not fully investigated by him, which is learned together with scientific laws. Resumo Thomas Kuhn é conhecido principalmente por suas contribuições para a filosofia da ciência. No entanto, foi em grande medida à filosofia da linguagem que ele dedicou a última parte de sua carreira. O objetivo deste artigo é apresentar uma visão sistemática das principais ideias de Kuhn sobre esse assunto. Começo descrevendo sua teoria do conceito, em particular o que ele diz sobre termos para espécie. Tais termos, aprendidos em blocos que formam conjuntos de contraste ou “taxonomias”, são aprendidos através de definições ostensivas. Em seguida, analiso as concepções de Kuhn de “significado” e “verdade”. Finalmente, discuto um segundo tipo de termo para espécies, não totalmente investigado por ele, que é aprendido junto com as leis científicas. (shrink)

This paper argues that Deonna and Teroni's attitudinal theory of emotions faces two serious problems. The first is that their master argument fails to establish the central tenet of the theory, namely, that the formal objects of emotions do not feature in the content of emotions. The second is that the attitudinal theory itself is vulnerable to a dilemma. By pointing out these problems, our paper provides indirect support to the main competitor of the attitudinal theory, namely, the perceptual theory (...) of emotions. (shrink)

This book covers the basic guidelines of Vittorio Benussi’s research during the period at Graz and at Padua. It does so in the light of a thorough study of his Nachlass. The book re-evaluates Benussi’s work as a historical piece, and shows how his work is still relevant today, especially in the areas of cognitive psychology and cognitive science. The volume deals with this original and ingenious - though largely ignored - scholar and discusses his work as a leading experimental (...) psychologist. Benussi’s contributions as discussed in this book were particularly relevant in the fields of visual and tactile perception, time perception, forensic psychology, hypnosis and suggestion, unconscious, and emotions. His classical papers are impressive in their originality, energy, range of approaches, experimental skill, the wealth of findings, and the quality of theoretical discussions. This book demonstrates that Benussi was ahead of his time and that his themes, experiments and research programmes are highly relevant to contemporary cognitive psychology. (shrink)

Summary The paper celebrates the person and work of Vittorio Benussi, a forgotten genius of psychology. In particular, it addresses the two most important scientific projects that Benussi developed during his time in Graz and Padua, respectively: the psychology of perception and the psychology of emotions and the unconscious. It highlights the originality and topicality of Benussi’s work and emphasizes its proximity to the latest trends in these research fields.

Through an examination of French organicism–one of the models proposed for the nascent science of sociology in the late 19th century–this article argues two main points: that organicism was crucial in the establishment of ‘society’ as a scientific object; and that the specific characteristics of this new object were retained by later sociology long after the organic analogies and evolutionary views that justified them had been explicitly abandoned. Organicism played a significant role in establishing a strong notion of society as (...) a concrete, real entity–a notion that had a lasting impact on sociological theory and became one of the most important ‘categories of thought’ of the 20th century. The aim of this paper lies in characterizing the explanations and models used in the field of evolutionary developmental biology throughout its history. While manipulative experiments in controlled conditions have been useful to set the bases of the discipline and are still routinely performed, this approach supposes a tension between the reliability and the representativity of the conclusions. Given the recent changes in the understanding of evolutionary phenomena, different authors currently emphasize the need of avoiding excessive simplifications in experimental approaches, (...) incorporating the complexity of the analyzed systems as a relevant trait in the study of biological diversity. On the other hand, the fragile and contingent nature of evolutionary processes and the impossibility of intervening some of these phenomena underscore the importance of non-manipulative models that allow the elucidation of how-possibly mechanisms. We argue that a pluralism characterized by the integration of different kinds of explanations, models and metaphors used in evo-devo allows to exploit their respective advantages, favours interdisciplinarity and can contribute to form a representative description of evolutionary processes without relinquishing the local and detailed study of actual mechanisms. Mechanisms are a way of explaining how biological phenomena work rather than why single elements of biological systems are there. However, mechanisms are usually described as physiological entities, and little or no attention is paid to malfunction as an independent theoretical concept. On the other hand, malfunction is the main focus of interest of applied sciences such as medicine. In this paper I argue that malfunctions are parts of pathological mechanisms, which should be considered separate theoretical entities, conceptually having a (...) priority over physiological sequences. While pathological mechanisms can be described in terms of a Cummins-like mechanistic explanation, they show some unnoticed peculiarities when compared to physiological ones. Some features of pathological mechanisms are considered, such as outcome variability, ambivalence and dependence on a range. (shrink)

In line with earlier works, this article argues for a “continuist” interpretation of Brentano’s conception of intentionality. It maintains that Brentano’s conception of intentionality rests on a complex set of notions, which are reduced to a minimal core or applied more fully depending on the complexity of the mental phenomenon under consideration and perspective from which it is analyzed. The article positions this conceptual structure in relation to theories of objects developed within the framework of late- and Neo-Scholastic philosophy where, (...) since the psychic act can relate to its object in different ways, the different types and roles of objects must be distinguished. This theory of objects enables Brentano to reinterpret Aristoteles’s idea of the intentionality of mental phenomena in light of the commentaries and interpretations of Thomas Aquinas while also giving space to other medieval texts. The goal of this paper is to offer a new theory of moods, according to which moods are perceptual experiences that represent undetermined objects as possessing specific evaluative properties. I start by listing a series of features that moods are typically taken to possess and claim that a satisfactory theory of moods must be able either to explain why moods genuinely possess these features or to explain these appearances away in a non-ad hoc way. I show that my account provides (...) a plausible explanation of all the main features of moods. I conclude by addressing some objections against my account. (shrink)

Resumo: A narrativa de Rousseau sobre a origem do Estado foi retomada nos últimos séculos por diversas tradições, fazendo-se notar no seio do iluminismo escocês e nos trabalhos de Engels. James Scott, em seu recente livro Contra o grão, de 2017, ecoa algumas teses de Rousseau. Dentre tantos pontos de convergência, três se destacam e serão analisados no decorrer deste artigo: i) de um lado, a variedade dos modos de ser e de se relacionar com a natureza dos povos sem (...) Estado, a idade de ouro dos bárbaros; de outro, a estratificação dos povos sob o Estado, o empobrecimento dos agricultores cerealistas; ii) as condições ecológicas raras e especialíssimas favoráveis à emergência do aparelho estatal, em oposição às dificuldades de se formar o Estado, em regiões de abundância naturais, donde se faz necessário estabelecer a hipótese de mudanças climáticas que alteram as condições de existência; iii) e, por fim, a importância dos grãos para o processo civilizatório, isto é, a afinidade entre economia agrária de cereais e Estado.: Rousseau’s narrative about the origin of the State was recovered in the last centuries by several traditions, being noticed in the heart of the Scottish Enlightenment and in the works of Engels. James Scott, in his recent book Against the Grain of 2017, echoes some of Rousseau’s theses. Among many points of convergence, three stand out and will be analyzed in the course of this article: i) on the one hand, the variety of ways of being and relating to the nature of stateless peoples, the golden age of the barbarians; on the other, the stratification of peoples under the State, the impoverishment of cereal farmers; ii) the rare and very special ecological conditions favorable to the emergence of the State apparatus, as opposed to the difficulties of forming a State in regions of natural abundance, which imposes the necessity to establish the hypothesis of climate changes that alters the conditions of existence; iii) and, finally, the importance of grains for the civilizing process, that is, the affinity between the agrarian economy of cereals and the State. Since the onset of logical positivism, the general wisdom of the philosophy of science has it that the kantian philosophy of (space and) time has been superseded by the theory of relativity, in the same sense in which the latter has replaced Newton’s theory of absolute space and time. On the wake of Cassirer and Gödel, in this paper I raise doubts on this commonplace by suggesting some conditions that are necessary to defend the ideality of time in the sense (...) of Kant. In the last part of the paper I bring to bear some contemporary physical theories on such conditions. (shrink)

Der Triestiner Vittorio Benussi (1878-1927), Mitglied der Grazer gegenstandstheoretischen und psychologischen Schule um Alexius Meinong, war einer der bedeutendsten Experimentalpsychologen seiner Zeit. Seine Pionierleistungen auf dem Gebiet der experimentellen Gestaltpsychologie gerieten jedoch bald durch die fortschreitende Durchsetzung der Berliner Schule der Gestalttheorie in Vergessenheit, so daß sein Werk bis heute weitgehend unbekannt geblieben ist. Benussis wissenschaftliche Tätigkeit, die sich durch eine streng experimentelle Vorgangsweise auszeichnet, erweist sich rückblickend als fruchtbarer Anknüpfungspunkt für die zeitgenössische Kognitionswissenschaft. Dies ermöglicht eine Neubewertung seiner wissenschaftlichen (...) Arbeit und jener aktpsychologischen Tradition, der er angehörte. Benussis Untersuchungen nehmen ihren Ausgangspunkt in der Voraussetzung der Intentionalität des Psychischen. Seine Arbeiten thematisieren das Problem des subjektiven Eingriffs in die Konstitution der Erfahrungsgegebenheiten, indem sie die Vorherrschaft des Subjektes über die elementaren Sinnesbedingungen betonen. In Benussis Gesamtwerk läßt sich ein einheitliches Programm erkennen: Ausgehend von der Gegenstands- und Produktionstheorie der Grazer Schule, entwickelt Benussi seinen eigenen theoretischen Standpunkt, der ihn - bewußt - der Phänomenologie Husserls nähebringt. Benussi verlagert schrittweise den Schwerpunkt seiner Forschungen von der gegenstandstheoretischen Perspektive zur Hervorhebung der latenten Subjektivität, die im Konstitutionsprozeß des Gegebenen wirksam ist. Leben und Werk Vittorio Benussis rückblickend zu betrachten, heißt sich mit einem Klassiker der Psychologie zu beschäftigen, dessen Modernität erst in der heutigen Zeit erkannt werden kann. (shrink)

Partiendo de la distinción filosófica entre las leyes de la ciencia y las leyes de la naturaleza, en el presente artículo se defiende la indispensabilidad explicativa de las leyes de la ciencia en el campo de las ciencias cognitivas. Se sostiene que las leyes de la ciencia desempeñan un papel epistémico indispensable tanto en el análisis funcional como en la explicación mecanicista de las capacidades cognitivas. De esta manera, se ofrece una elucidación plausible del poder explicativo de las ciencias cognitivas (...) en términos del papel epistémico de las leyes de la ciencia, suspendiendo el juicio, de manera prudente, respecto del controvertido estatus metafísico de las leyes naturales. Se pone en evidencia que tanto quienes defienden como quienes rechazan el compromiso ontológico con leyes causales intencionales presuponen que esas leyes no contribuyen a la explicación funcionalista ni mecanicista de los fenómenos que describen. Sin embargo, en el presente trabajo se argumenta, primero, que el análisis funcional requiere la especificación de leyes científicas no causales y, segundo, que la representación científica precisa de las actividades y de la organización dinámica de un mecanismo se despliega mayoritariamente, en el contexto de un modelo mecanicista, mediante la especificación de leyes científicas. La conclusión es que las leyes científicas (aunque no necesariamente las leyes de la naturaleza) desempeñan un papel indispensable en la explicación en ciencias cognitivas. (shrink)

I aim to present a solution to the apparent paradox of the Tractatus by means of a minimalist reading grounded in the idea that the correct logical symbolism alone “finally solves” in essentials the philosophical problems. I argue that although the sentences of the Tractatus are nonsensical, rules presented in its symbolism are not. The symbolism itself expresses only a priori rules of logic through schematic variables that do not say anything. I argue that this reading correctly expresses the ladder (...) structure of the book, and that it can account for Wittgenstein's critique of the Tractatus in Some Remarks on Logical Form. (shrink)
