The definition of the novel's frame has been familiar to literary researchers since the appearance structural theory. They are defined by the compositional norm or form of expression or the boundaries in which the plot is located. In all these approaches, the frame is only a reference point for artistic expression. At the same time, since the 1970s, there has been a clear turn towards autothematicism in literature, accompanied by a postmodern type of narrative, focusing on this context. The narrative (...) itself and the narrator's self-awareness play a kind of game with the reader. From the theoretical point of view, it is the frame on which the recipient focuses. On the example of Łukasz Orbitowski's book Cult, the article shows this mechanism of shifting attention to the frame of expression. (shrink)

In reflection concerning the study of literature, both categories, memory and forgiveness, are quite frequently contrasted. Literature, which activates memory, is perceived as a tool of settling the past. In this perspective, it takes the position opposite to that of forgiveness, which requires that 'one does not seek redress'. Using the example of the film bearing the title of The Tale, the author attempts to consider the conflict between a writer's duty to remember and the Christian appeal for forgiving. If (...) literature is the reservoir of memory, the very act of writing is purifying, and involves leaving the limits of own existence towards another human being, namely a reader. Reaching beyond the limits of own ego is not unlike the attitude of forgiveness, which requires reaching beyond the borders of personal pain. (shrink)

Criminologists have long acknowledged the link between a number of cognitive deficits, including low intelligence and impulsivity, and crime. A new wave of research has demonstrated that pharmacological intervention can restore or improve cognitive function, particularly executive function, and restore neural plasticity. Such restoration and improvement can allow for easier acquisition of new skills and as a result, presents significant possibilities for the criminal justice system. For example, studies have shown that supplements of Omega-3, a fatty acid commonly found in (...) food such as tuna, can decrease frequency of violent incidents in an incarcerated population. Research has also begun to explore the use of selective serotonin reuptake inhibitors to reduce impulsivity in some violent offenders. However, there are significant legal and ethical implications when moving from dietary supplements to prescription pharmaceuticals and medical devices for cognitive intervention. This paper will explore the legal and ethical issues surrounding the use of pharmacological intervention on prisoners as an effort to reduce crime and recidivism. (shrink)

This book makes available five classic studies of the organisation of behaviour in face-to-face interaction. It includes Adam Kendon's well-known study of gaze-direction in interaction, his study of greetings, of the interactional functions of facial expression and of the spatial organisation of naturally occurring interaction, as recorded by means of film or videotape. They represent some of the best work undertaken within the 'natural history' tradition of interaction studies, as originally formulated in the work of Bateson, Birdwhistell and Goffman. (...) Chapter 2, written especially for this new book, provides an historical and theoretical discussion of this tradition, and a new final chapter takes up the theme of the organisation of attention in interaction. The introduction provides details of the circumstances of how each paper came to be written. Each of the papers reprinted is accompanied by a short postscript, placing the work in the context of more recent research. Several of the papers presented in this volume, although widely referred to, have long been difficult to obtain. In a recent paper, Selim Berker develops an abductive argument against practical reasons for belief that exploits an alleged difference between epistemic and practical reasons. According to Berker, epistemic reasons for belief balance to suspension. If I have equally strong epistemic reasons to believe and disbelieve some proposition, I lack sufficient reason either to believe or disbelieve it. Rather, I have decisive reason to suspend judgment. In contrast, practical reasons balance to permission. If I have equally strong practical reasons to (...) φ or ψ, I have sufficient reason to do either. Given this difference, Berker argues that defenders of practical reasons for belief cannot offer a plausible explanation of how practical and epistemic reasons interact in order to yield all-things-considered normative verdicts. In this essay, I defend a non-interactionist “pure” form of pragmatism against Berker’s objection. I outline a pure pragmatist theory, recapitulate why Berker thinks it also falls prey to his objection, and explain why the objection fails to undermine pure pragmatism. Finally, I consider an additional reason Berker’s argument might seem persuasive and show that it depends on conflating Berker’s objection and a separate challenge to pure pragmatism. Once these distinct challenges are disambiguated, it is easier to see why Berker’s objection is not a significant concern for pure pragmatists. (shrink)

A central task of comparative constitutional law scholarship is categorization and classification of constitutions. Recent scholarship, no doubt informed by the populist tide, has sought to develop the concept of a mixed constitution. Broadly speaking, a mixed constitution is a constitution that integrates liberal and illiberal elements, elements that are usually separate and not found under the same constitution. The study of “mixed constitutions” encompasses both descriptive and normative aspects. First, an attempt to ascertain what, exactly, makes a constitution “mixed.” (...) Second, an attempt to analyze either the desirability of such a system or an attempt to figure out how to harness mixed constitutions in the service of particular normative goals, for example the protection of human rights. This article has two goals. First, an inquiry into the descriptive aspect of mixed constitutions. My aim is to show that given the seeming consensus of what constitutes a mixed constitution, the category itself might encompass many more constitutions than is often acknowledged, to the point that many constitutions are likely to be mixed to a certain extent. My second goal is to demonstrate that given this definitional consensus, what makes a constitution mixed is not necessarily because the constitution itself is mixed, but because sub-constitutional norms shape our constitutional understanding. Put differently, the meaning of a constitution is not determined exclusively through an analysis of the constitution, but also by shifts in sub-constitutional understandings. If this is correct, then it turns out that the universe of mixed constitutions is much larger than thought, which casts doubt on the utility of the category of mixed constitutions. (shrink)

In this article I argue for rule-based, non-monotonic theories of common law judicial reasoning and improve upon one such theory offered by Horty and Bench-Capon. The improvements reveal some of the interconnections between formal theories of judicial reasoning and traditional issues within jurisprudence regarding the notions of the ratio decidendi and obiter dicta. Though I do not purport to resolve the long-standing jurisprudential issues here, it is beneficial for theorists both of legal philosophy and formalizing legal reasoning to see where (...) the two projects interact. Sommers (2010) argues that experimental philosophers of free will have largely been asking the wrong question – the question whether philosophically naïve individuals think that free will and moral responsibility are compatible with determinism. The present studies begin to alleviate this concern by testing the intuitive plausibility of Pereboom’s (2001) four case argument. The general pattern of responses from two experiments does not support Pereboom’s predictions. Moreover, those who were high in the personality trait emotional stability tended to judge that (...) manipulated agents were more free and morally responsible compared to individuals low in emotional stability. This article discusses the desirability and feasibility of modeling precedents with multiple interpretations within factor-based models of precedential constraint. The main idea is that allowing multiple reasonable interpretations of cases and modeling precedential constraint as a function of what all reasonable interpretations compel may be advantageous. The article explains the potential benefits of extending the models in this way with a focus on incorporating a theory of vertical precedent in U.S. federal appellate courts. It also considers the costs of extending (...) the models in this way, such as the significant increase in the functional size of the case base and the need to provide some kind of ordering on interpretations to select a “best” interpretation. Finally, the article suggests partially incorporating multiple interpretations of dimensions as a realistic starting point for incorporating interpretations generally, and shows how doing so can help address difficulties with dimensions. The most apparent obstacles to a just, enlightened and peaceful social world are also, according to Kant, nature’s way of compelling us to realize those and other morally good ends. Echoing Adam Smith’s idea of the ‘invisible hand’, Kant thinks that selfishness, rivalry, quarrelsomeness, vanity, jealousy and self-conceit, along with the oppressive social inequalities they tend to produce, drive us to perfect our talents, develop culture, approach enlightenment and, through the strife and instability caused by our unsocial sociability, push (...) us towards justice, political equality and the highest good. What are we to make of these arguments, which seem to rely on questionable empirical assumptions, invoke dubious claims about natural teleology and sit uncomfortably with fundamental aspects of Kant’s ethical framework? I suggest that the arguments reveal one of Kant’s deep and important insights about the moral life by partially describing what a good and virtuous person reasonably hopes for. (shrink)

Alison Adam admirably fills the large gap in science and technology studies by showing us that gender bias is inscribed in AI-based computer systems. Her treatment of feminist epistemology, focusing on the ideas of the knowing subject, the nature of knowledge, rationality and language, are bound to make a significant and powerful contribution to AI studies. Drawing from theories by Donna Haraway and Sherry Turkle, and (...) using tools of feminist epistemology, Adam provides a sustained critique of AI which interestingly re-enforces many of the traditional criticisms of the AI project. _Artificial Knowing_ is an esential read for those interested in gender studies, science and technology studies, and philosophical debates in AI. Proponents of strict rule-based theories of judicial reasoning in common-law systems have offered a number of criticisms of analogical alternatives. I explain these criticisms and show that at best they apply equally well to rule-based theories. Further, I show how the analogical theories explain a feature of judicial common-law reasoningthat rule-based theories ignore. Finally, I show that reason-based, analogical theories of common-law judicial reasoning, such as those offered by John Horty and Grant Lamond, offer especially strong rejoinders to the rule-theorist (...) objections and persuasive accounts of distinguishing. This article explores the significance of authenticity for debates about the ethics of enhancement. According to the view defended here, what lies at the heart of authenticity is a disdain for phoniness or fakery – two notions which essentially concern the way we present ourselves to others and, in turn, the way we are viewed by those others. Being authentic thus requires that we not pretend to be something or someone we are not or otherwise represent ourselves falsely to the (...) outside world. As far as authenticity is concerned, then, the primary ethical challenge to the use of enhancements is to those uses that are hidden or unacknowledged – instances in which individuals represent themselves as having achieved or become something without technological assistance when, in fact, the converse is true. One is not undermining one's authentic self when one uses technology to accomplish a particular goal or undergoes some procedure to alter oneself, even quite radically. Rather, one is only being inauthentic to the degree that one passes off oneself and one's achievements as something they are not. (shrink)

In Merleau-Ponty and Nishida, Adam Loughnane initiates a dialogue between two of the twentieth century's most important phenomenologists from the Eastern and Western philosophical worlds. Loughnane guides the reader through the complexities and innovations of Nishida's and Merleau-Ponty's theories of artistic expression and their rarely explored concepts of faith. The intricacies of both philosophers' views are illuminated by analyses of artists, including Cézanne, Sesshū, Rodin, Hasegawa, and other major figures of European, Chinese, and Japanese art history, who enact a (...) radical form of expression that Loughnane calls the practice of "motor-perceptual faith." He argues that the artist's motor-perceptual body, as poetically articulated in Nishida's and Merleau-Ponty's early works, enacts a form of faith that can be parsed in the final writings of both philosophers. The concept of faith is enlarged through its enactment by the artist, while the concept of artistic expression is broadened by casting it as a motor-perceptual conception of faith. Merleau-Ponty and Nishida is an exciting new intercultural reading of these philosophers' writings that opens up under-explored areas of their projects. It forms an important conceptual bridge between the two, while challenging distinctions between art, philosophy, and religion, and ultimately philosophy East and West. (shrink)

Argumentation Frameworks provide a fruitful basis for exploring issues of defeasible reasoning. Their power largely derives from the abstract nature of the arguments within the framework, where arguments are atomic nodes in an undifferentiated relation of attack. This abstraction conceals different senses of argument, namely a single-step reason to a claim, a series of reasoning steps to a single claim, and reasoning steps for and against a claim. Concrete instantiations encounter difficulties and complexities as a result of conflating these senses. (...) To distinguish them, we provide an approach to instantiating AFs in which the nodes are restricted to literals and rules, encoding the underlying theory directly. Arguments in these senses emerge from this framework as distinctive structures of nodes and paths. As a consequence of the approach, we reduce the effort of computing argumentation extensions, which is in contrast to other approaches. Our framework retains the theoretical and computational bene.. "Fans largely regard sports as an escapist pursuit-something that provides distraction from the cares and concerns of "real life". This book pushes back against the fully escapist account of sports fandom and argues that we understand the value of fandom in terms of the ability of sports to prompt fans to reflect meaningfully on the notion of the good life. Even if we are not engaged in high-level athletics ourselves, it is possible to learn a great deal from those who (...) are: about what sacrifices are required to achieve our goals; about how to persevere through failure and disappointment; and about teamwork and the rewards of accomplishing things together. In a recent article in Argumentation, O’Keefe (Argumentation 21:151–163, 2007) observed that the well-known ‘framing effects’ in the social psychological literature on persuasion are akin to traditional fallacies of argumentation and reasoning and could be exploited for persuasive success in a way that conflicts with principles of responsible advocacy. Positively framed messages (“if you take aspirin, your heart will be more healthy”) differ in persuasive effect from negative frames (“if you do not take aspirin, your heart will be less healthy”), (...) despite containing ‘equivalent’ content. This poses a potential problem, because people might be unduly (and unsuspectingly) influenced by mere presentational differences. By drawing on recent cognitive psychological work on framing effects in choice and decision making paradigms, however, we show that establishing whether two arguments are substantively equivalent—and hence, whether there is any normative requirement for them to be equally persuasive—is a difficult task. Even arguments that are logically equivalent may not be information equivalent. The normative implications of this for both speakers and listeners are discussed. (shrink)

The problem of translation confronts every English, or French-language reader of Geschlecht III, from its title page on, by way of Derrida’s decision not to translate the German noun Geschlecht. In this paper, I explore the stakes of Derrida’s refusal to translate, by situating it within the context of the 1984–5 seminar, ‘Philosophical Nationality and Nationalism’, from which the text of Geschlecht III was taken. I show that the question of translation is already at the heart of that seminar, which (...) concerns the place of the idiom in philosophy, and why approaching the difficulty posed by the untranslatability of a term like Geschlecht might be the very objective of Derrida’s reading of Heidegger on Trakl. It is commonly claimed that fully virtuous individuals cannot be ignorant and that everyday intuitions support this fact. Others maintain that there are virtues of ignorance and most people recognize them. Both views cannot be correct. We report evidence from three experiments suggesting that ignorance does not rule out folk attributions of virtue. Additionally, results show that many of these judgments can be predicted by one’s emotional stability—a heritable personality trait. We argue that these results are philosophically important for the (...) study of virtue and we discuss some of the ways individual differences may inform and facilitate current debates in ethics. We close with a cautionary argument detailing the risks of discounting some intuitions simply because they are associated with seemingly less desirable personality traits. (shrink)

In this essay, the tension that Benacerraf identifies for theories of mathematical truth is used as the vehicle for arguing against a particular desideratum for semantic theories. More specifically, I place in question the desideratum that a semantic theory, provided for some area of discourse, should run in parallel with the semantic theory holding for the rest of the language. The importance of this desideratum is also made clear by means of tracing out the subtle implications of its rejection.

This paper examines the relationship between monadic and bipolar forms of normativity. As the distinction is usually drawn, monadic normativity concerns whether a given action is right or wrong while bipolar normativity concerns who, if anyone, is wronged in any putative instance of wrongdoing. My central thesis is that in the moral realm, we do well to discard the notion of monadic normativity altogether and focus instead on the contours and limits of bipolar normativity. For by placing greater weight on (...) the significance of wronging particular others, as opposed to simply doing something wrong, we get a more compelling picture of the distinctive importance of morality and its relationship to other norms that govern our lives. Science and technology have been integral issues of development cooperation for more than sixty years. Contrary to early efforts’ transfer of established technologies from the West to developing countries, contemporary technology aspirations increasingly articulate and practice the Global South as a live laboratory for technological experimentation. This approach is especially furthered by a group of private foundations and philanthrocapitalists whose endeavors in developing countries are, like their companies, shaped by logics of the individual, the market, and of societal progress through (...) technological innovation and experimentation. This article draws upon critical intellectual thought about the political and social ramifications of technology to reflect on the renascent role of technology in development cooperation. It traces the discourses and practices of philanthrocapitalist organizations, in particular the Bill and Melinda Gates Foundation, to understand how their experimentalist technology aspirations influence human life and relations in the Global South. This article argues that this newfound focus on technology in development cooperation may challenge the essence of democracy, reduce participation, and have undesirable consequences for populations in the Global South. Two challenges have lately been posed to the importance of sincerity for our public discourse. On the one hand, it has been suggested that because sincerity is so difficult to identify, a preoccupation with the inner lives of others distracts us from the substance of what people say. On the other hand, some worry that making sincere statements can sometimes undermine the very deliberation that advocates of sincerity are so concerned to protect. In light of these challenges, I attempt to (...) analyze our interest in sincerity in terms of a concern for solidarity with our fellow citizens. I then argue that focusing on the sincerity of various assertions is not a good way to promote social cohesion and that this concern is better addressed by looking at the commitment that others have to the process of democratic deliberation. Modern empirical psychology, as a reductionist, materialist, and positivist science, has to a great extent replaced philosophical psychology – or more precisely philosophical anthropology– in our contemporary world, and this has caused modern psychology to lose sight of what was most interesting in pre-modern psychology, namely the attempt to situate the human person in his experience of reality in the lifeworld (lebenswelt). This has resulted in the practice of psychology becoming detached from the realities of lived experience as its view (...) of human nature becomes increasingly narrow, rigid and scientistic. This is evidenced by the current “replication crisis” in modern psychology, which has severely impacted the credibility of modern psychology as a field of enquiry. This crisis arose with an increasing methodological standardisation that is being pursued at the expense of interrogating the scientistic presuppositions that ground the study of modern psychology. This study takes into account some important issues in appraising the role of the United Nations in international relations including: the UN's restriction on the use of force, the rapid expansion of UN peacekeeping and election-monitoring activities, the debates concerning the reform of the Security Council and the UN's promotion on international standards and norms. Detailing the connection between the various functions of Buddhist karma theory and rebecoming is a profoundly difficult aspect of Buddhist philosophy. While there is no definitive answer to these questions, suggestions can be found in early Buddhism that may help to reconcile the early Buddhist interpretations of karma with other philosophical and scientific theories.A great difficulty in analysing the functional aspects of Buddhist karma theory is the conflation of karma as causality with karma as ethics to create a strongly deterministic (...) ethical theory of karmic retribution which de-emphasises notions of free will and personal responsibility that are fundamental to Buddhist practice. This research is intended as a new model to evaluate karma in light of early Buddhist karma theory. Following this model may allow karma theorists to shed our accumulated assumptions from the Abhidharma and western philosophy that bring substance metaphysics into the analysis of Buddhist karma doctrine. This essentialism is an unnecessary obstacle to understanding. When karma as causality is located within early Buddhist process metaphysics it can easily be analysed in a practical fashion and is found to accord with contemporary thought. Karma as ethics is more properly analysed as a satisfactory, but underdeveloped ethical theory. Only with these conceptions in place can the connection between karma and rebecoming can be detailed.
