The proposed reflection intends to present the problem of judicial adjudication as a substantially-axiologically founded autonomous moment on the practical realization of law, and to explore this understanding in confrontation with external exigencies, mostly teleologically determined—hence, beyond strict deductive application, as a syllogistic reference of facts to norms, and finalistically determined decision, as an option among possible alternatives to achieve specific aims. The main objective is to enter into a discussion on the methodological meaning of “integrity”, “hard cases” and “right (...) answer”, as presented by Ronald Dworkin, and a critical reflection on the criticism of that approach levelled by Neil MacCormick, so as to confront the relevance of principle and policy arguments, in order to bring about a different methodological approach, an alternative jurisprudentialist conception of adjudication, incorporating a practical-normative constitutive dialectics between legal controversy and legal system, such as that presented by Castanheira Neves. The focus will, then, be the legitimacy of the connection of arguments of principle and consequentialist arguments in adjudication, its selection and its justification, stating, therefore, a specifically assumed judicium, a judicative decision, having the legal system as its horizon of normative reference and of substantial and institutional autonomy. Rationality and reasonableness can be illustrated as Janus-faced concepts, not only in a descriptive diagnosis but also in a normative construction of adjudication, and in the analysis of its practical and rhetorical effects. Considering such an illustration, the present reflection returns to the discussion on the relevance of rationality and reasonableness in legal interpretation, aiming at distinguishing and/or connecting principles and criteria, beyond formally logical and/or procedurally argumentative decision-making, and, thus, within a normatively practical adjudication. Such an approach will be (...) presented in two main steps. In a first step, the rationality/reasonableness dichotomy will be discussed within a constitutive connection between principles and criteria in adjudication, and understanding legal principles as normatively substantial foundations to legal criteria—the former as axiological references filtered into the juridical system and the latter as their concretizations, and whose practical adequacy is rhetorically assigned by the interpretive communities involved in/by adjudication, and normatively referred both to their practical accordance to the axiological normativity of the principles they shall presuppose and to their suitability as practical operators to the problematic relevance of the sub judice cases. In a second step, and consequently, encompassing the projection of legal interpretation, in semiotic and in practical-normative perspectives, in order to discuss their constituting practical relevance in adjudication, the rationality/reasonableness dichotomy will be experimented within formal-logical procedures and within practical-dialectical connections between juridical problem and juridical system—therefore stating a discussion on the foundations, the intentionality and the consequences of adjudication, amongst deduction and analogy. The concept of shared mental models refers to the shared understanding among team members about how they should behave in different situations. This article aimed to develop a new shared mental model measure, specifically designed for the refereeing context. A cross-sectional study was conducted with three samples: national and regional football referees (n = 133), national football referees and assistant referees and national futsal referees (n = 277), and national futsal referees (n = 60). The proposed version of the Referee (...) Shared Mental Models Measure (RSMMM) has 13 items that are reflected on a single factor structure. The RSMMM presented good validity evidence both based on the internal structure and based on relations to other variables (presenting positive associations with team work engagement, team adaptive performance, and team effectiveness). Such promising psychometric properties point to an optimistic outlook regarding its use to measure shared mental models in futsal and football referee teams. -/- . (shrink)

To identify how digital media are being used by community-led initiatives of the Centro Region of Portugal, and to identify the requirements that a digital platform for mediation between agents in the territory should have, two focus groups were conducted, involving six small-sized community-led initiatives and six larger-sized community-led initiatives. This article details the results of these focus groups, according to the following main categories: use of existing communication and mediation tools; the purpose of use of digital tools; type of (...) experiences prompted by digital tools and attributes and features desired in a digital platform to support community-led initiatives. The results show differences between the use and needs of digital tools by small- and larger-sized initiatives and offer interesting insights to prototype an innovative digital solution, to enhance the actions of community-led initiatives. A reference framework for digital mediation strategies and a mobile app prototype were developed, based on these surveys. The article contributes with an analytical view about the development of digital solutions, which aim to strengthen the relationship among agents of local communities and promote mediation mechanisms among all stakeholders in territorial-based innovation. Teaching is, to date, one of the most prone jobs to experiencing occupational stress and burnout. Owing to burnout’s negative personal, social, organizational and economic impacts, researchers, practitioners and education policy leaders are interested in developing practices and interventions aimed at preventing/reducing its prevalence. With teachers’ main professional demands to be of a social and emotional nature, interventions designed with a view to promote teachers’ social and emotional competence appears to be particularly promising, positively impacting teachers’ well-being and personal accomplishment (...) and contributing to a decrease in their psychological distress, namely emotional exhaustion. However, theoretical and empirically grounded interventions with ecological validity and specifically targeting teachers are still scarce. Thus, to bridge the previously identified gaps, the present study aimed to evaluate the efficacy and the quality of the intervention’s implementation of the A+, an online social and emotional learning intervention for elementary-school teachers. A quasi-experimental study was conducted with a total of 81 participants from three different school contexts. School clusters were similar in size, organizational structure and socioeconomic level, and as regards previous attendance at social and emotional learning interventions; however, they differed with regards to perceived organizational climate. Data on the efficacy of the A+ was collected across four waves using a set of self-report questionnaires that assessed proximal variables and distal variables, and analyzed through Robust Linear Mixed-Effects Models. Coefficient omegas suggested adequate reliability of the measures. Additionally, two trained observers completed an observation grid to evaluate the quality of the A+ implementation, with excellent inter-rater reliability. Results suggested that, over time, the A+ had positive impacts across proximal and distal variables favoring the experimental group. However, results differed across the school contexts. These findings were accompanied by good implementation quality indicators, namely high fidelity in the delivery of the A+ contents and high participants’ responsiveness. Despite its limitations, this study contributes to a growing body of research which reinforces the importance of investing in social and emotional learning interventions to prevent teachers’ burnout and improve their occupational health. Furthermore, it highlights the importance of implementation quality research as a component of program planning with a view to enhancing programs’ efficacy, as well as the need to adapt and consider context variables in research and practice. From an early age, exposure to a spoken language has allowed us to implicitly capture the structure underlying the succession of speech sounds in that language and to segment it into meaningful units. Statistical learning, the ability to pick up patterns in the sensory environment without intention or reinforcement, is thus assumed to play a central role in the acquisition of the rule-governed aspects of language, including the discovery of word boundaries in the continuous acoustic stream. Although extensive evidence has (...) been gathered from artificial languages experiments showing that children and adults are able to track the regularities embedded in the auditory input, as the probability of one syllable to follow another syllable in the speech stream, the developmental trajectory of this ability remains controversial. In this work, we have collected Event-Related Potentials while 5-year-old children and young adults were exposed to a speech stream made of the repetition of eight three-syllable nonsense words presenting different levels of predictability to mimic closely what occurs in natural languages and to get new insights into the changes that the mechanisms underlying auditory statistical learning might undergo through the development. The participants performed the aSL task first under implicit and, subsequently, under explicit conditions to further analyze if children take advantage of previous knowledge of the to-be-learned regularities to enhance SL, as observed with the adult participants. These findings would also contribute to extend our knowledge of the mechanisms available to assist SL at each developmental stage. Although behavioral signs of learning, even under explicit conditions, were only observed for the adult participants, ERP data showed evidence of online segmentation in the brain in both groups, as indexed by modulations in the N100 and N400 components. A detailed analysis of the neural data suggests, however, that adults and children rely on different mechanisms to assist the extraction of word-like units from the continuous speech stream, hence supporting the view that SL with auditory linguistic materials changes through development. La première position est celle de Simon de Faversham, développée vers 1280 et probablement durant son séjour à la Faculté des arts de Paris. La seconde position est celle de Raoul le Breton, dernier des plus grands (...) maîtres ès arts parisien. Família e escola são os dois primeiros contextos de desenvolvimento afetivo, cognitivo e social da criança. As experiências vividas nos contextos familiar e escolar interferem nas aprendizagens escolares. O objetivo deste estudo foi investigar os efeitos das relações afetivas familiares no desempenho escolar de alunos do Ensino Fundamental I e conhecer quais orientações são dadas a professores diante de alunos com problemas de aprendizagem ocasionados por afetos negativos nas relações familiares. Foi realizada uma revisão bibliográfica integrativa de artigos científicos nas (...) bases de dados SciELO, PePSIC e BVS-Psi, utilizando-se o operador booleano AND e os descritores “relações familiares”, “desempenho acadêmico”, “desenvolvimento infantil”, “problemas de aprendizagem” e “afeto”, “interação pai(s) e filho(s)”, “motivação”, “parentalidade”, “empatia”, “rendimento escolar” e “aluno”. Foram adotados como critérios de inclusão: artigos publicados entre 2012 e 2022, em português, disponibilizados gratuitamente on-line e na íntegra. De 11.557 artigos encontrados, após aplicação dos critérios de inclusão, foram selecionados 80 e, destes, cinco contemplaram os objetivos deste estudo. Os dados foram analisados por meio da análise de conteúdo e apontam que a relação afetiva familiar positiva apresenta consequências positivas no desempenho escolar; as relações afetivas familiares negativas afetam negativamente; e que não são dadas orientações a professores sobre como lidar com alunos com problemas de aprendizagem, devido a problemas nas relações afetivas familiares. Observa-se que novos estudos devem ser desenvolvidos, considerando-se as lacunas identificadas no acervo selecionado. (shrink)

O presente artigo debruça-se na crítica de Diderot à Helvétius. Apesar da crítica ser feita pontualmente a cada trecho comentado do livro De l’Homme de Helvétius, consideramos que ela possui um núcleo principal, que é a diferente concepção de materialismo dos autores e suas consequências para o que ambos anseiam para a sociedade. Por isso, investigamos o que há no horizonte do materialismo de Helvétius e de Diderot no que concerne à educação e como, apesar de estarem próximos no ponto (...) de partida, o materialismo, seu norte é diferente. A escolha do tema da educação justifica-se por tratar-se de algo que ultrapassa a teorização filosófica e busca inserção prática na sociedade, mostrando assim não só as consequências práticas das teses materialistas como também o ideal de sociedade proposto por cada autor. Aqui, apontamos para as principais diretrizes sobre a construção de uma educação institucional em De l’Esprit (1754) e De l’Homme (1771), de Helvétius, nas Em Reflexions sur le livre De l’Esprit (1877) e Refutations suivre l’ouvrage intitule De l’Homme (1877)1, e em outras obras de Diderot. 1 As críticas reunidas de Diderot foram publicadas apenas postumamente. Estima-se que a segunda, dedicada à De l’Homme foi redigida em um longo período, que coincide com a redação do Plan d’Université (1775) e Elements de Phisiologie (1875). (shrink)

ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. Abordaremos inicialmente os conceitos de direito e obrigação, refletindo sobre as necessidades da alma pensadas por Weil, em que a obrigação abre o ser humano para o impessoal da pessoa, que por sua vez é conexo com o sentido do eterno e do sagrado. Neste escrito pretende-se resgatar alguns traços desta reflexão e destacar a relação entre (...) o impessoal com o eterno e o sagrado, enquanto constitutivos do ser humano, estudando como a partir do impessoal emerge uma nova percepção da relação ética. O presente artigo aborda a recente decisão do Secretário de Educação do Estado do Paraná de retirar metade da carga-horária das aulas de Artes, Filosofia e Sociologia no Ensino Médio. Ao analisarmos, podemos associar tal medida com a lenta e gradual redução do Ensino Médio a um ensino profissionalizante, e não mais com o desenvolvimento global dos estudantes, afastando-o assim do Ensino Básico.

Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. Hence, a significant relationship exists between learning strategies, motivation, and the online learning environment. (shrink)

En este trabajo exponemos algunas categorías modales orientadas al estudio y comprensión de los sistemas autoorganizados que muestran complejidad. Para ello centramos nuestra investigación en el área de la ecología y, más en particular, en el ámbito de la ecología aural, es decir, en el estudio de los sonidos que componen los ecosistemas. Las categorías modales aquí desarrolladas son, por un lado, la «repertorialidad», referida a la coherencia y estabilidad interna de todo sistema autoorganizado; la «disposicionalidad» o experimentación y variación (...) inherente a estos sistemas y, finalmente, el «paisaje», que tiene en consideración lo realmente efectivo, lo dado. Este conjunto de categorías nos lleva a explorar el sistema modal de necesidad-contingencia-posibilidad-imposibilidad, el cual, aplicado a los estudios sonoros se convierte en el juego de señales-redundancia-ruido-silencio. Estas categorías, aplicadas a ejemplos en la naturaleza, nos ayudan a comprender el devenir inherente a todo ecosistema. Finalmente, descubrimos cómo la investigación categorial de los paisajes sonoros aporta información sobre el comportamiento evolutivo y el estado de conservación de estos sistemas. (shrink)

ABSTRACT Drawing upon a distinction between epistemically and metaphysically motivated notions of a concept, I consider the insurmountable problems of theories that appeal to our epistemic capacities to address the problem of the nature of concepts satisfactorily. Prominent theories of concepts hold that primitive concepts must have internal structure if they are to account for the explanatory functions that cognitive scientists have attributed to such constructs as prototypes, exemplars, and theories. Vindicating the role of non-experimental philosophy in the critical examination (...) of empirical theories, I argue that the explanatory effectiveness of those constructs is orthogonal to an argument concerning the structure of primitive concepts. Conceptual atomism provides an alternative approach to individuating primitive concepts the precise formulation of which has yet to be worked out. Despite its unpopularity, the atomist alternative is still in a better position to face the question of what concepts are than its competitors. RESUMEN Haciendo una distinción entre nociones de concepto epistémica y metafísicamente motivadas, considero las dificultades insuperables que enfrentan las teorías que apelan a nuestras capacidades epistémicas para abordar el problema de la naturaleza de los conceptos. Las teorías de conceptos más importantes sostienen que los conceptos primitivos deben poseer una estructura interna para cumplir aquellas funciones explicativas que científicas y científicos cognitivos les han atribuido a constructos tales como prototipos, ejemplares y teorías. Reivindicando el aporte de la filosofía no experimental en la evaluación de teorías empíricas, planteo que un argumento a favor de la estructura de los conceptos primitivos es independiente del poder explicativo de dichos constructos. El atomismo conceptual proporciona un enfoque alternativo para individualizar conceptos primitivos cuya formulación precisa aún no se ha elaborado. Pese a su impopularidad, la alternativa atomista está en una mejor posición que sus rivales para enfrentar la pregunta acerca de qué tipo de cosas son los conceptos. (shrink)

This article examines how parents should make health decisions for one child when they may have a negative impact on the health interests or other interests of their siblings. The authors discuss three health decisions made by the parents of Alex Jones, a child with developmental disabilities with two older neurotypical siblings over the course of eight years. First, Alex’s parents must decide whether to conduct sequencing on his siblings to help determine if there is a genetic cause for Alex’s (...) developmental disabilities. Second, Alex’s parents must decide whether to move to another town to maximize the therapy options for Alex. Third, Alex’s parents must decide whether to authorize the collection of stem cells from Alex for a bone marrow transplant for his sibling who developed leukemia. We examine whether the consensus recommendations by Salter and colleagues (2023) regarding pediatric decision-making apply in families with more than one child. (shrink)

Caracterizar a demanda de atendimento psicológico e compreender a experiência dos profissionais que atuaram na pandemia do COVID-19, em uma plataforma de atendimento psicológico on-line. Realizou-se uma análise documental e entrevista semiestruturada com 20 psicólogos que atuaram no mínimo 6 meses na plataforma entre mar/2020 à dez/2022, em que foram atendidos um total 15.963 pacientes. Dentre as demandas, prevaleceram ideação suicida com planejamento, ansiedade e depressão. O perfil prevalente dos pacientes atendidos na pandemia corresponde à literatura, em períodos não pandêmicos, (...) bem como a prevalência de sintomas ansiosos e depressivos. Porém, destacou o surgimento do alto número de pacientes com ideação suicida, o que sugere um agravamento dos transtornos mentais, despertado pela pandemia, além de uma dificuldade comum aos entrevistados, relacionada a clareza dos critérios clínicos utilizados para determinação da gravidade dos casos. Os psicólogos apontaram dificuldades no manejo destes casos graves, intensificados pelo impacto emocional pandêmico também sentido por eles, junto ao despreparo para sua atuação online, as percebendo como limitações. Apesar do despreparo, a alta demanda incitou os profissionais aderirem as especificidades da modalidade. Estes relataram ter buscado aporte teórico e apoio emocional para manterem os recursos internos, cognitivos e emocionais, necessários ao setting terapêutico. Pode-se concluir que os resultados evidenciaram a importância de se refletir sobre os critérios de avaliação clínica utilizados para compreensão da severidade dos casos, sem deixar de considerar os recursos internos dos pacientes relativos à sua capacidade de sofrer, os quais podem ser identificados quando mantida a capacidade de rêverie do profissional. In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

The justification of Natural Law is a very controversial issue, not only after the Positivist’s rebuttals, but since its very anthropological foundations in the early modern age. In this paper, I try do give an account of Natural Law and natural rights in terms of a phenomenological description of the background of normative intentionality. Taking a genetic stance, I go from the positive norm and the intentionality that constitutes it to the underling pregiveness that supplies the condition of its possibility. (...) I exhibit it as the experience of the live-world, and I analyze it as an intersubjective world, where persons are given as equals and worth-counting. This is the very root of the concept of human dignity. Starting from it, I develop an account of the sense and content of the concept of Human Rights as a set of eidetic laws creating the framework for authentic human relationships. (shrink)

In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. In her recent book Gillian Brock argues that states’ legitimacy depends on their being part of a just state system that protects human rights. Here I discuss some practical limitations raised by Brock’s legitimacy framework: mainly, (1) the problematic real-world implications of such an account, and (2) the epistemic challenges that judgements inspired by this account would have to face, were we to proceed solely on the basis of it.

La composición polifónica musical nos permite hablar de la emergencia, en el sur y desde el sur que somos, de Voces de la Tierra, que han susurrado, cantado, llorado o gritado el dolor producido por las maneras de habitar humanas construidas en la modernidad cosificadora de la tierra y del mundo de la vida, modernidad mercantil, industrial y global cuya ética se ha reducido a valores absolutamente euro-antropo-racional-centristas, permeados por el valor supremo del capital. En este artículo, emergente de pensadores (...) ambientales latinoamericanos y pensadores-otros que han sospechado radicalmente del edificio de la ética ambiental emergente de la conferencia del Club de Roma o del Informe Burndtland, intentamos desplegar lo ético, como ethos con e larga, que en griego significa casa, y desde este lugar de enunciación, intentamos salirnos del sujeto y del objeto en la variación ética ambiental eurocentrista, y proponer con las voces de la tierra sur, abya yala, diseños del ethos, ligado óntica-relacionalmente con el cuerpo-tierra. Diseñamos, inspirados en Husserl, Heidegger, Deleuze, Guattari, Ángel-Maya, Enrique Leff, Noguera, Echeverri, pensadores-otros y voces de montañas, animales, ríos, y plantas, la vida, territorios de libertad entendida ésta como expansión de los cuerpos en la naturaleza y de paz integral y completa, entendiendo que no puede haber paz, si no amamos ni respetamos la tierra que somos. Esto exige el giro óntico-etico- estético-político de la ética en clave de un Pensamiento Ambiental Sur. (shrink)

A más de 300 años de la primera edición del Leviatán, las lecturas acerca de las pasiones allí descritas deben realizarse teniendo en cuenta cambios históricos, políticos y discursivos. Aún así, continúa siendo posible hacer un rastreo conceptual de algunas de las pasiones aquí tratadas, sobre todo de las que en la actualidad participan con efervescencia de la vida pública. ¿Qué valor podemos rescatar de ellas a más de 300 años? Al consistir la presente obra de un tratado de filosofía (...) política sobre los orígenes y desarrollos del pacto social, es posible comprender estas pasiones, en principio, desde sus valores contractuales. Cada una de ellas representa un valor en la relación con los otros, formas de ser y de estar en el mundo de los propios sujetos en contrato. Reflexionamos con especificidad aquí sobre la indignación, sobre su potencial político y jurídico para contornear los bordes del contrato, pero también sobre su potencial hermenéutico, habilitando otros modos de recorrer la lectura a través de la pregunta por las injusticias, los mecanismos de devolución legítimos ante ellas exigidos y el uso de la violencia racionalizada. The integration of nanotechnology’s ‘social and ethical issues’ (SEI) at the research and development stage is one of the defining features of nanotechnology governance in the United States. Mandated by law, integration extends the field of nanotechnology to include a role for the “social”, the “public” and the social sciences and humanities in research and development (R&D) practices and agendas. Drawing from interviews with scientists, engineers and policymakers who took part in an oral history of the “Future of Nanotechnology” symposium (...) at the Cornell NanoScale Facility, this article examines how nanotechnology’s ‘social and ethical issues’ are brought to life by these practitioners. From our analysis, three modes of enactment emerge: enacting SEI as obligations and problems-to-be-solved, enacting SEI by ‘not doing it’ in the laboratory, and enacting SEI as part of scientific practice. Together they paint a complex picture where SEI are variously defined, made visible or invisible, included and excluded, with participants showing their skill at both boundary-work (Gieryn Am Sociol Rev 48:781–795, 1983, 1999) and at integration. We conclude by reflecting on what this may mean for the design and implementation of SEI integration policies, suggesting that we need to transform SEI from obligations into ‘matters of care’ (Puig de la Bellacasa Soc Stud Sci 41(1):85–106, 2011) that tend to existing relationalities between science and society and implicate practitioners themselves. This book advances a 'naturalized' normative theory of deliberative democracy; one that is informed by an empirically-grounded analysis of public deliberation in naturalistic settings and in unadulterated form, and goes on to provide institutional design proposals for how to improve it.

Ante los indicadores de insostenibilidad ambiental y social, se busca un enfoque educativo eficaz que contribuya a revertirla. A tal efecto, se propone una educación moral, que no se centre tanto en contenidos como en facilitar que cada estudiante aprenda a buscarlos, hacerlos propios y los traduzca en compromisos de conducta personal. La propuesta educativa se presenta ejemplificada en una asignatura concreta, que sirve de hilo expositivo y ejemplo de aplicación. Tras una breve introducción sobre los indicadores de insostenibilidad, se (...) presenta la planificación, metodología y objetivo de la asignatura. A continuación, se reflexiona sobre dos de los obstáculos a los que se enfrenta la educación moral en la actualidad: la fragmentación del saber y la dificultad para que los aprendizajes teóricos se traduzcan en conductas. Por último, se exploran dos oportunidades para la educación moral que pueden facilitar ese vínculo: la búsqueda de las causas profundas de problemas ambientales y sociales actuales, y el empleo de la belleza. This paper addresses the Harmful Dysfunction Analysis of mental disorder. We argue that some mental conditions meet both of its criteria —the dysfunction criterion and the harm criterion— and yet should not count as mental disorders because of their value. We contend that the harm criterion, by taking harm as a proxy for disvalue, is an inadequate normative criterion in these cases. Therefore, further ethical considerations should be included as a normative criterion. In the context of a public health emergency it is imperative to conduct research studies that will produce evidence rapidly while upholding ethical standards. The Ebola and Zika outbreaks highlighted the importance of devising agile processes for ethics review in emergencies, and international research ethics guidelines stress the duty to depart from standard processes for ethics review in emergency circumstances. However, before the COVID-19 pandemic it was not entirely clear what emergency procedures should look like. An additional challenge is that (...) while the same substantive ethical standards apply in emergency and non-emergency settings, deciding what these standards entail in the specific circumstances of a pandemic may be difficult. During the COVID-19 pandemic, challenges included identifying thresholds of social and scientific value, along with duties towards research participants, given the absence of therapeutic options; assessing continually changing risk–benefit profiles of studies, given rapidly emerging new evidence; developing appropriate informed consent processes, given lockdown scenarios; and even addressing the ethics of offering unproven interventions outside research settings. Additional issues raised during epidemics include devising feasible and meaningful community engagement strategies, mechanisms to ensure fairness in the distribution of the benefits that may result from research, and equitable and effective data-sharing plans that will inform pandemic response. Learning from these procedural and substantive challenges encountered in the ethics review of COVID-19 research is important for enhancing ethics preparedness for future emergencies. It can also potentially contribute to improving the ethics review of research in non-emergency circumstances. The seven cases in this chapter highlight ethical issues associated with ethics approval of multi-centre studies in pandemics, the need for careful consideration of the social and scientific value of research and challenges encountered when interventions are being transitioned from research to rollout, and issues that can arise when existing regulations and policies may limit capacities to appropriately adapt research to pandemic contexts. As the ecological crisis becomes increasingly pressing, the relation of environmentalism and democracy is spotlighted with new instancy. On one hand, the capability of present democratic governments to take adequate political action is seriously questioned. On the other hand, environmentalism is charged of being anti-democratic. This paper, in a first step, examines the “green” criticism of and sometimes actual departures from democracy. Drawing on that analysis as well as a pragmatist concept of democracy, the elements of an “ecological democracy” will (...) be outlined in a second step. Democracy, then, is not only a way of collective-problem solving, but also a form of life that has an intrinsic value, even in the face of unresolvable problems and failure. Striving for transformation and the best possible scenario nevertheless, finally, demands an attitude of ecological meliorism, which will be briefly outlined. (shrink)

Refugee protection depends, minimally, on the identification of agents capable of discharging international obligations in this area of international law. Commonly discussed “agents of justice” include states, IOs, and NGOs. This article focuses on a different set of actors: subnational units (cities, states, and provinces in federal States) and the legal mechanisms they may use to discharge international obligations in the area of refugee protection. I advance three distinct theoretical models for understanding subnational units’ responsibilities vis-à-vis international law: (1) derived (...) delegated responsibilities; (2) derived back-up responsibilities; and (3) assumed responsibilities. I conclude by sketching some ways in which subnational units could play an even more salient role in the promotion of international law. (shrink)

In this paper I suggest an alternative reading of the value of Hegel’s systematic approach to nature from the perspective of environmental philosophy. Taking the paradigmatic example of the “new materialist” ontologies, I present the problems with an inflationary justification for the argument for the need of a shift in the “scientific” representation of nature. On the basis of these problems, I suggest that Hegel’s view of nature as axiologically impotent sheds light into why emancipatory environmental theory needs not hinge (...) on a determinate understanding of nature. In my reading, this rejection can be harmonized with the asymmetric nature of our responsibility towards non-human nature. (shrink)

Deliberative democracy started out as an ideal for mass democracy. Lately, however, its large-scale ambitions have mostly been shelved. This article revivifies the ideal of mass deliberative democracy by offering a clear mechanism by which everyone in the community can be included in the same conversation. The trick is to make use of people’s overlapping social communicative networks through which informal deliberative exchanges already occur on an everyday basis. Far from being derailed by threats of polarization, echo chambers, and motivated (...) reasoning, informal networked deliberation can indeed put everyone in touch, directly or indirectly, with everyone else.
