Wallace, Max; Wallace, Meg On 31 July this year submissions closed to the government's Constitutional Advisory Panel concerning a constitution for New Zealand. New Zealand, like England, does not have a written constitution. On 13 July there was a day-long seminar sponsored by the Law Faculty at Victoria University in Wellington on the question of separation of church and state. One reason for this seminar was the lack of constitutional separation in New Zealand.

In 20th Century America, and in countries of similar political culture, it seemed a permanently established principle that there should be a "wall of separation" between Church and State. But the separation has again become contentious. It is rejected by Muslims and in the US it is under attack from "evangelical" Christians (see Theocracy watch " website). It seems useful to look again at the doctrine of "separation of Church and State", to see (...) what various things the phrase might mean, and what reasons there might be, for and against, regarding at least some of the possible formulations of the doctrine. The United States Constitution is arguably the greatest practical achievement of the Enlightenment. Yet most of the elements of the Constitution are borrowed from elsewhere. Its single wholly original component is the separation of church and state. The doctrine of separation has become controversial of late: Numerous ministers and politicians insist that the United States is in truth a "Christian nation" with Christian institutions that has been overtaken by secular humanism; they call for bringing the United (...) States back to its original unity with Christianity. They argue, accordingly, that although toleration of other faiths might be practiced, the explicitly Christian character of the nation and its political institutions should be reasserted in law and policy rather than denied by secularists. In June 2015, in Obergefell v. Hodges, the Supreme Court of the United States determined that there is a fundamental right to marriage that extends to same-sex couples. This Article analyzes the Obergefell decision in light of the Court’s 2014 decision in Burwell v. Hobby Lobby regarding religious protections that might by analogy be afforded under state Religious Freedom Restoration Acts. In particular, the article considers whether a government official may claim the right to religious freedom to deny issuing (...) marriage licenses to same-sex couples. Additionally, the article suggests that a new standard for the separation of church and state may be required. Although the 2015 decision prevents the government from denying marriage to same-sex couples, the decision does not directly affect private businesses that choose not to provide services for same-sex weddings. It may, however, have an important indirect effect if laws are already present that prohibit sexual orientation discrimination. Bender, Robert The USA constitution does not have a clause requiring any separation of church and state and until 1948 there were no Supreme Court rulings to ensure that this was seen as a basic constitutional principle. Then in 1945 Vashti McCollum, a 33-year-old part-time squaredancing teacher from Champaign, Illinois, initiated a legal action that changed all that.

John Locke is acknowledged to be one of the theoretical founders of the separation of church and state, a distinguishing feature of modern liberal democracies. Though Locke’s arguments for the merits of such separation have been subject to extensive investigation, his argument for its feasibility has remained relatively unexamined. This article argues that Locke was confident that separation of church and state can successfully be implemented in all times and places because of his (...) epistemological and psychological insights that human beings are moved to act by unease and that separating church and state removes the unease that causes religiously based political instability. We conclude by noting that Locke’s understanding of unease is foundational for his larger ambition to secure political liberty. (shrink)

This chapter considers restraint from making arguments based on religious grounds as a premium self-restraint principle in politics. There is a claim that such reliance is contrary to fundamental premises of separation of church and state and religious liberty, or is particularly threatening to social life. The chapter discusses the principle of secular motivation—that one should not advocate or promote any legal or public policy restrictions on human conduct unless one not only has and is willing to (...) offer, but is also motivated by, adequate secular reason; the principle of secular rationale—that people should not construct secular rationalizations when they are really persuaded by religious considerations; and the principle of secular resolution—that political issues be finally resolved along secular lines. A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

The separation of church and state is generally taken to be a requirement of constitutional democracies. However, there is little agreement on the precise meaning of the ideal of separation. Some liberal conceptions of democratic legitimacy interpret the ideal of separation such that religious beliefs and reasons should be excluded from political justification. This exclusivist view raises fears that a commitment to liberal democracy is suitable only for secular citizens and religious citizens who are practical (...) atheists, but not for genuinely religious citizens. Against this view, liberal critics argue that the democratic ideal of equal treatment requires the inclusion of religious reasons on equal footing with secular reasons in political deliberation. This inclusivist view, however, raises fears that a commitment to democracy is suitable only for members of religious majorities. For, according to this view, a majority of religious citizens could impose coercive policies on secular citizens or citizens of different faiths without any obligation to give them reasons that they can reasonably accept. Against both views, I defend a conception of political justification and democratic legitimacy that does not rely on the religious–secular distinction in order to show how the normative commitments of constitutional democracies can be reflectively endorsed by all democratic citizens, whether religious or secular. In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. The article offers a concise view on the problems related to the Church and State relationship in Latvia. The article presents the author’s hypothesis that under the new circumstances when special legal provisions apply to traditional churches, it must discussed whether the rest of religious organizations could be classified as religious societies, operating in accordance with the Law on Societies and foundations. The author also holds an opinion that it is important for every country to follow the principle (...) of separation of church from state; however, it must be combined with religious freedom. Nevertheless, the article reveals that the task is difficult to follow in practice, in Latvia and in other EU member states alike. (shrink)

This paper sketches a framework for the separation of church and state and, with the framework in view, indicates why a government’s maintaining such separation poses challenges for balancing two major democratic ideals: preserving equality before the law and protecting liberty, including religious liberty. The challenge is particularly complex where healthcare is either provided or regulated by government. The contemporary problem in question here is the contraception coverage requirement in the Obama Administration’s healthcare mandate. Many institutions (...) have mounted legal challenges to the mandate on grounds of religious freedom. The paper proposes a number of interconnected principles toward a resolution of the problem: for the institutional realm, specific principles for church-state separation and a principle concerning the protection of citizens’sense of identity; and for the ethics of citizenship in the conduct individuals, principles that provide an adequate place for natural (thus secular) reason in lawmaking and political decisions. Introduction. Judgments on church authority have been transformed depending on the changing posi- tion of the Church in society and its relationship with the state. In the process of rethinking, there have developed special traditions of its understand- ing, which reflected the specifics of the existence of Christian communities in different cultural and legal conditions. The purpose of the study is to outline the traditions of understanding church authority in three Christian denominations and offer grounds for (...) their comparison in the philosophical and canonical aspect. Methods. A comparative method is used on the basis of analyzing philosophical literature and canon-legal sources. Scientific novelty of the research. The article for the first time systematizes confessional differences in interpreting the form, content and levels of church authority. Results. It is shown that the decisive factor de- termining the differences between confessional traditions in the understanding of church authority is the nature of the boundary between the sacred and government authorities. Catholicism, consider- ing the governmental power established by God, includes it in the sacred, along with the teaching and sacramental. Protestantism, on the contrary, radically opposes it to the sacred, recognizing it as the prerogative of the state. Orthodoxy, as a rule, does not recognize government power as sacred, but it does not separate it from the church. Conclusions. An analysis of the positions ex- pressed by representatives of various Christian denominations regarding church authority makes it possible for us to conclude that the Orthodox tradi- tion tends to defend a position equidistant from polar opinions. The author discusses several models of the relation of church and state with respect to their advantages and shortfalls to freedom of religion and equality of religions. The first model is the separation of church and state at a great distance, the second the model of equal religions and the third the rapprochement model of civil religion and constitutional ethics. None of these possible models is fully satisfying. Precisely because the minimum pre-requisites for legitimacy and (...) liberality are preserved, or should be preserved, in all three models, the advocates of all of these church-state models should learn to cherish their respective assets in order to ‘bear’ the accompanying losses. This introduction is divided into two parts. First, drawing on Paul Guyer’s suggestion that we should turn to Kant to reinvestigate the foundations of religious liberty, I outline Kant’s views on the relations between the ethical and the political community, as presented in Part Three of the Religion within the Boundaries of Mere Reason, focusing in particular on his arguments for separation between religion and the state. Examining critically the idea to employ Kant in contemporary debates, I claim (...) that Kant’s account of pure moral faith and the church as its ‘vehicle’ may pose difficulties for any argument for religious liberty that appeals to his thought. For Kant is better equipped to offer resources to overcome rather than to accommodate the fact of so-called “moral pluralism,” i.e. the condition in which the principle of religious liberty can find its application. : Both Mendelssohn and Kant were strong supporters of the separation between church and state, but their arguments differed. Mendelssohn joined many others in following Locke in arguing that only freely arrived at conviction could be pleasing to God, so the state could not serve the purpose of religion in attempting to enforce it: a religious premise for religious liberty. Kant argued for religious liberty as an immediate consequence of the innate right to freedom. The work defends autonomy-based liberalism and elaborates how this liberalism can meet the requirements of liberal neutrality. The chapters also explore religious education and the financing of institutionalized religion. This volume collates the work of top scholars in the field. Starting from the idea that autonomy-based liberalism is an adequate framework for the requirement of liberal neutrality, the author elaborates why a (...) liberal state can support religions and how she should do this, without violating the principle of neutrality. Taking into account the principle of religious freedom and the separation of church and state, this work explores which criteria the state should take into account when she actively supports religions, faith-based schools and religious education. A number of concrete church-state models, including hands-off, religious accommodation and the state church are evaluated, and the book gives some recommendations in order to optimize those church-state models, where needed. Practitioners and scholars of politics, law, philosophy and education, especially religious education, will find this work of particular interest as it has useful guidelines on policies and practices, as well as studies of church-state models. In the article, the author deals with the political and social influences of the relationship between the state and religious communities in France. The first part of the paper is an analysis of historical context and the construction of laicism in France through its local characteristics, values and social strengths, contributing to its formation. The fact that Catholic Church was one of the main legitimizing pillars of?the old regime?, permanently determined the relationship between church and state, (...) most importantly - it?s subsequent social exclusion under the Republic. The 1789 French revolution in conjunction with the 1905 law on the Separation of church and state, up until present time, have been seen as the most important events in defining the relationship between political and religious entities in France. The second part of the paper continues in outlining the founding logic and principles of the contemporary relationship between religious communities and the French state. The article concludes in suggesting that through its persistence of a purely Laicistic model of state-church affiliation, view of the nation as a community of citizens, Weberian definition of the State, and the acceptance of the public sphere as common space in which communal interests are negated, France today represents an isolated island on the European continent. nema. There are good historical reasons for emphasis on separation of church and state in a democracy, but the separation can be carried too far. Concerning the relationship of church and state, various Chrístian denominations divide up into separatists and unificationists, and each tendency can lead into extremes which could under certain conditions be inimical to democracy. Going beyond questions of constitutional separation, one may argue for a mutual utility and complementarity of church (...) and democratic polity. Whether a strictly necessary relationship is entailed is a more complex problem. (shrink)

This paper explores the shift in the position of the Catholic Church regarding religious freedom, in the context of the changing perspective on the relationship between Church and State. The Declaration Dignitatis humanae of Vatican II recognised religious freedom as a human right deriving from the dignity of the person. It reflected a significant change in perspective as it understood religious freedom as abidance by convictions held in conscience and as freedom from coercion. Both the State (...) and the Church are expected to ensure freedom from external coercion and from psychological pressure. The process which led to the recognition of religious freedom in the Catholic Church went along with the acknowledgement of the autonomy of the State in secular matters. The State is expected to recognise the freedom to profess freely religious beliefs and the right to free worship, but religious freedom may not interfere with secular authority in its own sphere of competence. Dignitatis humanae is therefore known as the declaration of the separation between Church and State. Yet, a more attentive lecture shows that it actually also advances a balanced model for the collaboration between State and Church in the shared concern for the common good. Both are required to act in a manner that advances the common welfare of society. (shrink)

Washington, D.C.: The Catholic University of America Press, 1993. Pp. 541. $24.95 (paper). The Church, Community of Salvation: An Ecumenical Ecclesiology. By GEORGE H. TAVARD. Collegeville, Minnesota: The Liturgical Press, 1992. Pp. 264. $18.95 (paper). These two works represent two recent and very different attempts by contemporary (...) Catholic ecclesiologists to present a comprehensive or systematic theology of the church. I shall deal with the specifics of each work separately. Johann Auer (1910-1989) was professor of dogmatics and the history of dogma at the University of Bonn when in 1983 he first published his Die Kirche: Das allgemeine Heilssakrament. This present work is an English translation of that German text which was Volume VIII in a comprehensive, nine-part, dogmatic survey, with volumes addressing the traditional dogmatic themes: God, Creation, Christ, Grace, Eucharist, Sacraments, Church and Eschatology. Joseph Ratzinger was co-editor with Auer of the original series. And while Auer authored the first eight volumes, Ratzinger authored the final volume on eschatology. We have seen this kind of dogmatic survey in English before in the comparable six-volume work of Michael Schmaus called Dogma (1968). As with Schmaus's work, this dogmatic survey is intended as a series of textbooks for theology students and thus its method is to survey each dogmatic theme focusing upon three elements, the biblical foundation for the theme, the historical development of this theme, and finally its systematic inner coherence or integral rational development. In this volume, Auer accomplishes all three tasks in exemplary fashion and with a depth of treatment Schmaus never aimed at approaching. Auer's The Church is divided into eighteen chapters organized into four thematic sections bearing the titles, " Pathways towards the Proper Understanding of the Church," " Pathways towards a Theological Concept of the Church taken from Biblical Images," "Manifestations of the Church's Being, Life and Activity in the Light of its Sacramental Structure," and "The Church's Tasks and Its Ways to Self-Realization in the World." Under these titles are treated all the traditional themes expected of a comprehensive ecclesiology: the origin and authority of the church, its mission and ministries, biblical images, organizational BOOK REVIEWS 141 models and dogmatic marks of the church, ecumenism, the place of the Blessed Virgin Mary among the People of God, relations between church and state. Auer's consideration of each of these themes is marked by his thorough knowledge of the sources and his skillful handling of these materials. Even so, Auer's work is hardly beyond criticism. For example, arguably the heart of the book is the author's 213-page treatment of the history and theology of the ministries which comprises Part III, "Manifestations of the Church's Being, Life and Activity...." I want to call this section masterful because of the vastness of the enterprise (the development of the ministries over almost two thousand years) and the wealth of careful distinctions Auer brings to his treatment of so much material. To choose among the riches here one might single out Auer's treatment of the two principles of democracy and hierarchy and the numerous collegial forms for participative governance and administration that have been created or once existed in the church and have been revived since Vatican II (pp. 157-173). This is a stimulating but balanced discussion, blending historical material with more immediate and urgent concerns. But there are also some serious weaknesses in the larger section. For example, while extended attention is given to the offices of bishop and pope (almost a hundred pages on the papal office alone), comparatively little attention is given to the role of presbyters (four pages) and the laity. As for the latter, though Auer considers "The Question of the Secular Office of the Laity," he never addresses the question of the religious office of the laity, that is, their ministry in the church and not just to the world. He broaches this theme in his section on " Vocations or Charisms, Ministries and Offices or Commissionings " (pp. 179-194), but all too quickly he concludes this section... (shrink)
