Considering the sensory dimension of clinical decision-making is a challenge for the training of health professionals. Therefore, how can we help them stimulate a form of sensory acuity? We conducted a study in partnership with the Simulation Laboratory of a Canadian hospital to understand the sensory work accomplished by nurses during a clinical decision-making. To do this, we analyzed the interactions occurring during focus groups to reveal the sensory work performed by nurses during the clinical evaluation of patients (personas).

As a result of economic crisis, it becomes very difficult to find a solution for conflicts of interests concerning redistribution. Nevertheless agreements between employers and trade unions remain important instruments.The financial and economic debate concerning conception and orientation of National Product is far from being wound up. Chaque jour, les professionnels de la santé doivent prendre des décisions dans des environnements complexes où s'affrontent de multiples normes qu'il n'est pas toujours facile de départager ni de mettre au clair afin de prendre une décision éclairée. Pourtant, les modèles de prise de décision dont disposent actuellement les éthiciens cliniques ou les comités de bioéthique comportent souvent des lacunes lorsqu'il s'agit d'aborder des problèmes à plusieurs niveaux (micro, méso et macro). Les décisions reposent ainsi trop souvent (...) sur l'intuition plutôt que sur une démarche systématique rigoureuse et facilement reproductible. Afin de pallier la situation, cet ouvrage fournit des outils théoriques et pratiques facilitant la prise de décision. Fondé sur l'étude collective d'un cas complexe ayant trait aux dimensions tragiques des choix éthiques en fin de vie (doit-on ou non administrer un médicament coûteux pour le traitement d'un cancer au stade avancé?), il réunit les contributions de plusieurs experts reconnus travaillant dans le système de santé (cliniciens, éthiciens, chercheurs, gestionnaires et décideurs publics). En raison de l'actualité des enjeux qui y sont traités et de la qualité des textes qui y sont rassemblés, cet ouvrage sera un outil pédagogique efficace pour les étudiants, les enseignants et les professionnels de la santé et aura certainement une incidence importante sur le mode de prestation des soins. Many physiotherapists are reluctant to treat a client with bone metastases, as treatment indications are not clearly defined. The paradigmatic case presented here, and a review of the literature, allow us to highlight some ethical and clinical issues in physiotherapy care at the end of life, particularly for patients with bone metastases. The objective of this article is not to create an ethical decision making model but rather to serve as additional guidance to existing decision models in rehabilitation. This guidance (...) is based on principlism and is specific to the oncology clients in palliative care. The proposed principles, without being exhaustive, are beneficence, non-maleficence, respect for autonomy and justice. With a review of clinical indications and precautions, the article also helps to clarify both the theoretical and the evidence-based risks. These principles provide avenues for reflection to guide the management of these patients. The physiotherapist will then be able to conduct a critical analysis, in collaboration with the interdisciplinary team, whose goal is to respect the client’s right to appropriate care at the right time and that is based on clinical need. Les décisions politiques sur les risques environnementaux complexes font fréquemment intervenir des éléments scientifiques contestés. Il n’y a généralement pas de « faits » qui conduisent à une politique correcte unique. Les éléments de preuve qui sont intégrés dans les avis scientifiques destinés à une décision politique nécessitent une évaluation de leur qualité. En 2003, l’Agence néerlandaise d’évaluation environnementale a adopté une méthode standardisée, désignée sous le nom de « guide », dans le cadre de laquelle les principaux aspects (...) de la production et de l’utilisation des connaissances sont présentés grâce à une liste de contrôle visant à l’évaluation et à la communication des incertitudes. Dans cet article, nous présentons des résultats de l’application de ce guide à la controverse sur les risques des particules en suspension. La délibération active sur l’incertitude dans un contexte d’expertise entraîne un processus d’apprentissage commun entre les experts et les décideurs politiques, ce qui conduit à une meilleure prise de conscience du phénomène d’incertitude et de ses implications politiques.Policy decisions on complex environmental risks often involve disputed science. Typically, there are no “ facts” to support a single unequivocally correct policy. The evidence provided in scientific studies for policy-making decisions requires high-quality assessment. In 2003, the Netherlands Environmental Assessment Agency adopted a standardized method, referred to as “guidelines”, whereby key quality aspects of knowledge production and use are presented in the form of a checklist for uncertainty assessments and communication. In this article, we present the outcomes of applying the guidelines in controversies on the risks of ambient particulate matter. In the policy–advisory context, active deliberation on uncertainty produces a common learning process for advisors and policy makers, which leads to a deeper understanding and increased awareness of the phenomenon of uncertainty and its policy implications. Dans ces moments de crise, de basculement et de réalisation de l’improbable, se révèlent des enjeux et des logiques de choix qui resteraient invisibles dans le cours tranquille des choses.À partir d’une enquête qualitative longitudinale auprès d’un panel de jeunes, je propose (...) ici une tentative d’exploration de la notion de bifurcation. Les récits et les argumentaires développés permettent d’identifier les « ingrédients » mobilisés dans la prise de décision. Sont parcourus là divers registres structurels, contextuels, relationnels et individuels, ainsi que des temporalités diverses en interaction. C’est peut-être justement leur conjonction qui autorise cette « rupture » de l’ordre social attendu.The trajectories of entry into adulthood are cluttered with events, periods of crisis, life crossroads to which young people have to face up, to make choices and sometimes operate radical changes in the course of their lives. In these moments of crisis, upheavals and unexpected turning points, new stakes and logics of orientation appear, which would have remained unseen in a quieter course of things.Working from a qualitative longitudinal survey of a panel of young people, this paper offers an attempt to explore the notion of bifurcation. The life stories and the arguments these young people developed allow to identify the components of choice-making. Various structural, topical, relational and individual registers have been identified, along with various interacting temporalities. This critical edition allows readers to better understand Condillacs essential contributions to Enlightenment philosophy. French description: L'Essai sur l'origine des connaissances humaines que Condillac publie en 1746 est un texte surprenant a plusieurs points de vue. Il l'est tout (...) d'abord du fait qu'on ne sait pas exactement dans quelles conditions il a ete compose, et que, faute de manuscrits, il reste impossible a ce jour d'en connaitre la redaction initiale. Dans ses ouvrages ulterieurs, Condillac en a par ailleurs critique plusieurs elements, mais rien ne nous permet de savoir s'il a touche a l'Essai quand il a entrepris de reviser ses ecrits en vue de leur publication dans ses oeuvres completes qu'il n'aura pas eu le temps de mener a bonne fin. Background: This article describes the overall attitudes of children, their parents, and attending physicians toward including or excluding pediatric patients in medical communication and health care decision-making processes. Methods: Fifty-two interviews were carried out with pediatric patients (n = 17), their parents (n = 19), and attending oncologists (n = 16) in eight Swiss pediatric oncology centers. The interviews were analyzed using thematic coding. Results: Parenting styles, the child's personality, and maturity are factors that have a great impact upon the (...) inclusion of children in their health care processes. Children reported the desire to be heard and involved, but they did not want to dominate the decision-making process. Ensuring trust in the parent–child and physician–patient relationships and respecting the child as the affected person were important values determining children's involvement. These two considerations were closely connected with the concern that fantasies are often worse than reality. Seeking children's compliance with treatment was a practical but critical reason for informing them about their health care. The urge to protect them from upsetting news sometimes resulted in their (partial) exclusion. Conclusions: The ethical imperative for inclusion of children in their health care choices was not so much determined by the right for self-determination, but by the need to include them. If children are excluded, they imagine things, become more isolated, and are left alone with their fears. Nevertheless, the urge to protect children is innate, as adults often underestimate children's coping capacities. (shrink)

In this paper, we examine two highly influential theories of how people form beliefs about risks: the theory that risk beliefs are errors caused by bounded rationality and the theory that such beliefs are part and parcel of people’s core value systems. We then discuss the implications of the psychological theories for questions regarding liberal-democratic decision making: Should policy be responsive to the preferences of citizens in the domain of risk regulation? What risk-regulation policies are legitimate? This individual differences study examined the relationships between three executive functions (updating, shifting, and inhibition), measured as latent variables, and performance on two cognitively demanding subtests of the Adult Decision Making Competence battery: Applying Decision Rules and Consistency in Risk Perception. Structural equation modelling showed that executive functions contribute differentially to performance in these two tasks, with Applying Decision Rules being mainly related to inhibition and Consistency in Risk Perception mainly associated to shifting. The results suggest that the successful application (...) of decision rules requires the capacity to selectively focus attention and inhibit irrelevant (or no more relevant) stimuli. This paper analyses the role of foreign and local companies in shaping Brazilian positions on global sustainability. It deals with an empirical investigation of CSR practices of firms from the electronics, food, and personal care sectors in response to pressures of 'market' and 'non-market' stakeholders. The results demonstrate that CSR decisions by foreign and local firms are triggered by organisational considerations and anticipated economic gains. The degree of implementation of CSR activities by foreign firms is more advanced than that of (...) local firms. The survey also confirms the hypothesis that market stakeholders exert pressure on companies and positively influence CSR. Non-market stakeholders seem to have a minor effect on corporate social responsibility decisions. We conclude that the institutional environment is a critical determinant of the extent to which the dialogue between stakeholders and companies leads to the attainment of sustainable development. The majority of Dutch physicians feel pressure when dealing with a request for euthanasia or physician-assisted suicide. This study aimed to explore the content of this pressure as experienced by general practitioners. We conducted semistructured in-depth interviews with 15 Dutch GPs, focusing on actual cases. The interviews were transcribed and analysed with use of the framework method. Six categories of pressure GPs experienced in dealing with EAS requests were revealed: emotional blackmail, control and direction by others, doubts about fulfilling the (...) criteria, counterpressure by patient’s relatives, time pressure around referred patients and organisational pressure. We conclude that the pressure can be attributable to the patient–physician relationship and/or the relationship between the physician and the patient’s relative, the inherent complexity of the decision itself and the circumstances under which the decision has to be made. To prevent physicians to cross their personal boundaries in dealing with EAS request all these different sources of pressure will have to be taken into account. (shrink)

Decision-making assisted by algorithms developed by machine learning is increasingly determining our lives. Unfortunately, full opacity about the process is the norm. Would transparency contribute to restoring accountability for such systems as is often maintained? Several objections to full transparency are examined: the loss of privacy when datasets become public, the perverse effects of disclosure of the very algorithms themselves, the potential loss of companies’ competitive edge, and the limited gains in answerability to be expected since sophisticated algorithms usually are (...) inherently opaque. It is concluded that, at least presently, full transparency for oversight bodies alone is the only feasible option; extending it to the public at large is normally not advisable. Moreover, it is argued that algorithmic decisions preferably should become more understandable; to that effect, the models of machine learning to be employed should either be interpreted ex post or be interpretable by design ex ante. Dans cet article, je reviens sur un constat bien connu, mais jamais parfaitement élucidé : Rousseau n’emploie que très exceptionnellement l’expression « intérêt général », à laquelle il préfère celle d’« intérêt commun ». Je m’efforce d’y apporter une explication nouvelle, en partant d’un réexamen du concept même d’« intérêt » dans son œuvre, auquel il faut prêter un sens assez différent de celui auquel la philosophie politique nous a accoutumés : l’intérêt ne saurait être individuel, il ne saurait s’identifier (...) à l’« avantage », il ne saurait faire l’objet d’un « calcul ». À ce titre, il existe une véritable antinomie entre la notion d’intérêt commun chez Rousseau et celle d’intérêt général qui se formalise chez les physiocrates de façon quasi contemporaine. L’intérêt commun est la base de formation démocratique d’une volonté politiquement orientée, qui prend comme telle le nom de « volonté générale », là où l’intérêt général est le langage normatif dans lequel une décision politique non nécessairement démocratique cherche à fonder sa légitimité en raison. Il proposa une nouvelle éthique, établie à partir de la lecture d'Aristote, mais (...) une lecture essentiellement rationaliste qui, aux yeux des autorités, s'écartait en tous points de la sagesse chrétienne - affirmant notamment que c'est en cette vie que l'on peut trouver le. bonheur, et non dans l'autre. Siger de Brabant contribua ainsi à une renaissance de la philosophie, qui commence par la Logique qui ordonne la pensée et le discours du philosophe, lui donne aussi son style, au sens littéraire du terme - ce dont le Traité de l'éternité du monde est une bonne illustration. We present the fundamentals of the quantum theoretical approach we have developed in the last decade to model cognitive phenomena that resisted modeling by means of classical logical and probabilistic structures, like Boolean, Kolmogorovian and, more generally, set theoretical structures. We firstly sketch the operational-realistic foundations of conceptual entities, i.e. concepts, conceptual combinations, propositions, decision-making entities, etc. Then, we briefly illustrate the application of the quantum formalism in Hilbert space to represent combinations of natural concepts, discussing its success in modeling (...) a wide range of empirical data on concepts and their conjunction, disjunction and negation. Next, we naturally extend the quantum theoretical approach to model some long-standing ‘fallacies of human reasoning’, namely, the ‘conjunction fallacy’ and the ‘disjunction effect’. Finally, we put forward an explanatory hypothesis according to which human reasoning is a defined superposition of ‘emergent reasoning’ and ‘logical reasoning’, where the former generally prevails over the latter. The quantum theoretical approach explains human fallacies as the consequence of genuine quantum structures in human reasoning, i.e. ‘contextuality’, ‘emergence’, ‘entanglement’, ‘interference’ and ‘superposition’. As such, it is alternative to the Kahneman–Tversky research programme, which instead aims to explain human fallacies in terms of ‘individual heuristics and biases’. (shrink)

This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. L'ouvrage présente et discute d'hypothèses, d'enjeux et de théories contemporaines sur l'action, les attitudes, la rationalité et la décision. La première partie intitulée Pensées, actions et engagements contient des contributions de John Searle, Daniel Vanderveken, Candida Jaci de Sousa Melo et (...) Raimo Tuomela traitant de problèmes généraux de la philosophie de l'esprit et de l'action. Dans la deuxième partie de l'ouvrage intitulée Phénoménologie, ontologie et philosophie de l'esprit, nous avons regroupé, autour d'un texte de Nicolas Kaufmann, quatre études qui traitent diversement de la contribution de la phénoménologie classique, principalement de la phénoménologie de Husserl, à des questions centrales de la philosophie contemporaine dans les domaines de la philosophie de l'esprit, de la théorie de l'action et de l'ontologie formelle. La troisième partie de l'ouvrage, Causalité et naturalisme, réunit trois contributions qui portent sur des questions centrales de la philosophie contemporaine. Daniel Laurier se penche sur la question de savoir si le normativisme sémantique est compatible avec le naturalisme sémantique, alors qu'André Leclerc et Wilson Mendonça s'intéressent à la notion de causalité mentale et examinent différents arguments qui contestent le bien-fondé de cette notion. La dernière partie de l'ouvrage intitulée Rationalité et décision réunit trois contributions logico philosophiques de Storrs McCall, Mathieu Marion et Michel Paquette qui traitent de la rationalité des agents lors de leurs prises de décision et délibérations. How management philosophy is conceived depends on if pragmatism is acknowledged or not! After having been under the main domination of management science both research and education has until recently widened its scope from a decision-making to an action-perspective. It seems to be a recent reconnection to pragmatism that makes the 2011 Carnegie report propose to rethink management in liberal arts terms, whilst the vastly influential 1959 Carnegie Pierson report distanced itself from American pragmatism thus focusing on decisions and forgetting (...) actions. Actions may contain decisions and choices but contain more than that. A decision-perspective explains by causal inference modelling choices as calculated or programmed. The action-perspectives strive at understanding intentions of agents by philosophical interpretations of action stories. It is less limited to finding the logics for constructing worlds, to paraphrase Herbert Simon’s favorite philosopher Rudolf Carnap, than embarking on plausible, although not certain, reconstructions of intentions giving meaning to action stories. This can be illustrated by turning to Elizabeth Anscombe’s Wittgensteinian investigation of intentions as Aristotelian syllogistic reasoning. Her constant analytical care to defend a philosophy of action against metaphysical assumptions and taken-for-granted “psychologisms” shows that an action-perspective is as analytic as ever one of decision-making. What differs is that the latter seems constantly attracted by programming inquiry by “scientific methodology” whilst the latter is charmed by philosophical approaches to action welcoming fascinating conundrums, enigmas and human goofs in the reality of managerial practice. Management science wants to reduce management to logics, programs and models for formal decision making whereas management philosophy is closer to spotting the artfully entrepreneurial in actions. The latter points in the direction of engineering tools, the former to appreciate the toys of management as artwork. Finally the argument of Georg Henrik von Wright helps us see that the two are philosophically compatible; for in a pragmatically inspired management philosophy actions may well contain decisions. There is a death by suicide in the world every 40 seconds, and suicide is the second leading cause of death for 15–29-year-olds. Experts say that one of the best ways to prevent suicide is for those in distress to hear from people who care about them. Facebook is in a unique position—through its support for networks and friendships on the site—to help connect a person in these difficult situations with people who can support them. Connecting people with the resources (...) they need is part of Facebook’s ongoing efforts to help build a safe community inside and outside of Facebook. This article provides a brief overview of how Facebook’s work to develop suicide prevention tools started and evolved, and the ethical considerations which surfaced during the process in the form of concrete product decisions around the implementation of these tools. This article is structured into three sections. Section 1 reviews what has been done in this space and lists and briefly describes other suicide prevention apps and tools. Section 2 describes Facebook’s overall approach to suicide prevention. Here, we’ll delve first into how that approach originated and how it was influenced by the external community’s proactive interactions with Facebook, highlighting our unique position to help address the problem. Afterwards, we’ll explain how that approach evolved, describing its various stages and iterations: understanding, reactive reporting, queue prioritization, and proactive reporting. This section describes the tools and resources Facebook has developed for people who may be at risk. Particular attention is devoted to the use of ArtificiaI Intelligence and Machine Learning to detect posts or live videos where someone might be expressing thoughts of suicide. Section 3 will elaborate on the ethical questions addressed when developing our approach and when making concrete product decisions to implement our suicide prevention tools. In this last section, we’ll expound the competing values and interests that were at stake during the product development process, and how we reached ethical balances between them. (shrink)

In spite of the important discoveries made by Adam Smith and later by the economists of the Austrian School, Friedrich Hayek remained intellectually challenged by the miracle of the price mechanism. As it turned out there was still some pioneering to do in describing the price mechanism. This became clear when Hayek identified the dispersal of information relevant to exchange transactions as the central issue of economic study. In the context of his distinction between competition as a state of things (...) and as a process the price mechanism manifests itself as a powerful integrator of information which is at first sight hopelessly dispersed in modern society. In 1945 he pointed out another intellectual challenge which the miracle of the price mechanism poses: How could such a marvelous functionality come into existence? “I am convinced that if it [the price mechanism] were the result of deliberate human design, and if the people guided by the price changes understood that their decisions have significance far beyond their immediate aim, this mechanism would have been acclaimed as one of the greatest triumphs of the human mind”. It is precisely because the free determination of prices is obviously not an invention, and because actors on the market in general do not realize that their decisions are at once also signals for the information-processing system that the market is, that in general this market order is not highly estimated. The market order is nevertheless the best illustration of the dual principle that the most beautiful forms of complex functionality are not deliberately created and are not deliberately maintained. The increasing use of Artificial Intelligence for making decisions in public affairs has sparked a lively debate on the benefits and potential harms of self-learning technologies, ranging from the hopes of fully informed and objectively taken decisions to fear for the destruction of mankind. To prevent the negative outcomes and to achieve accountable systems, many have argued that we need to open up the “black box” of AI decision-making and make it more transparent. Whereas this debate has primarily focused on (...) how transparency can secure high-quality, fair, and reliable decisions, far less attention has been devoted to the role of transparency when it comes to how the general public come to perceive AI decision-making as legitimate and worthy of acceptance. Since relying on coercion is not only normatively problematic but also costly and highly inefficient, perceived legitimacy is fundamental to the democratic system. This paper discusses how transparency in and about AI decision-making can affect the public’s perception of the legitimacy of decisions and decision-makers and produce a framework for analyzing these questions. We argue that a limited form of transparency that focuses on providing justifications for decisions has the potential to provide sufficient ground for perceived legitimacy without producing the harms full transparency would bring. In the past decades, computers have become more and more involved in society by the rise of ubiquitous systems, increasing the number of interactions between humans and IT systems. At the same time, the technology itself is getting more complex, enabling devices to act in a way that previously only humans could, based on developments in the fields of both robotics and artificial intelligence. This results in a situation in which many autonomous, intelligent and context-aware systems are involved in decisions (...) that affect their environment. These relations between people, machines, and decisions can take many different forms, but thus far, a systematic account of machine-assisted moral decisions is lacking. This paper investigates the concept of machine-assisted moral decisions from the perspective of technological mediation. It is argued that modern machines do not only have morality in the sense of mediating the actions of humans, but that, by making their own decisions within their relations with humans, mediate morality itself. A classification is proposed to differentiate between four different types of moral relations. The moral aspects within the decisions these systems make are combined into three dimensions that describe the distinct characteristics of different types of moral mediation by machines. Based on this classification, specific guidelines for moral behavior can be provided for these systems. (shrink)

Notre travail s’inscrit dans les ancrages théoriques de l’ethnométhodologie et de l’analyse conversationnelle. Notre intérêt est avant tout d’analyser les pratiques interactionnelles entre joueurs en situation de jeux vidéo ; et d’autre part, de comparer différents jeux sur le plan de leur organisation interactionnelle ainsi que leur structure séquentielle et multimodale. Á partir des pratiques de joueurs, nous questionnons les problèmes et contraintes rencontrés, d’une part lors des analyses de ces données en situation de jeux vidéo, et d’autre part lors (...) de présentations académiques de nos recherches. Une étude en cours, sur les séquences d’encouragement et d’instruction dans les interactions entre joueurs, nous permet de montrer qu’il est indispensable de contextualiser le type de jeu joué, ses règles, ses options spécifiques parfois, les relations entre les joueurs, les rôles de chacun à l’instant de l’extrait, et aussi les actions en cours dans l’univers du jeu lui-même qui donneraient du sens à l’analyse. Ces contextualisations et prises en compte des ressources multimodales permettent d’expliquer et de décrire plus clairement et objectivement le phénomène linguistique, l’action ou encore la problématique analysée. My aim is to discuss the impact of higher-order evidence on aesthetic appreciation. I suggest that this impact is different with respect to aesthetic beliefs and to aesthetic affective attitudes (such as enjoyment). More specifically, I defend the view that higher-order evidence questioning the reliability of one’s aesthetic beliefs can make it reasonable for one to revise those beliefs. Conversely, in line with a plausible account of emotions, aesthetic affective attitudes are not directly sensitive to this type of higher-order evidence; (...) they are sensitive only to those features of objects that make such attitudes (un)fitting. Thus, I argue, there are cases of non-defective recalcitrant aesthetic attitudes where the subject has both a non-defective, fitting aesthetic affective attitude and a reasonable belief questioning the fittingness of this attitude. I further discuss whether, in this type of case, the subject has decisive reasons to try to change her recalcitrant attitudes—say by trying to modify her aesthetic affective dispositions. My answer is negative. Even granting that subjects always have aesthetic reasons to try to avoid aesthetically unfitting attitudes, these can be outweighed by further reasons not to do so—perhaps including aesthetic reasons related to the construction of valuable aesthetic identities or to the value of aesthetic engagement. Diderot s’est passionné toute sa vie pour les questions musicales. C’est à travers elles que cet article traite du thème de la « perception des rapports » dans l’esthétique diderotienne. Le trait saillant des « Principes généraux d’acoustique » (1748) est le refus de distinguer un point de vue strictement scientifique et esthétiquement neutre, et un point de vue proprement esthétique. Dans les pas du Descartes de l’Abrégé de musique, et dans une discussion serrée avec le père André, Diderot soutient (...) une thèse que l’on pourrait qualifier d’empirico-malebranchienne. Si, sur le modèle de l’optique cartésienne, Diderot soutient que l’oreille perçoit les consonances et le beau musical selon une sorte de trigonométrie naturelle, il refuse de l’appuyer sur l’action directe d’une puissance supérieure à l’esprit, comme chez l’auteur de De la recherche de la vérité. La « perception des rapports » est au contraire fondée sur une conception empiriste du nombre : c’est dans l’expérience du dénombrement, et par le biais des sens, que nous connaissons le nombre. La conception des « corps harmoniques », développée dans la « Lettre à Mlle *** », permet d’associer la réalité des rapports des nombres, leur rationalité et le plaisir des corps – sans faire appel à une raison universelle sur le modèle malebranchien. When many people are involved in an activity, it is often difficult, if not impossible, to pinpoint who is morally responsible for what, a phenomenon known as the ‘problem of many hands.’ This term is increasingly used to describe problems with attributing individual responsibility in collective settings in such diverse areas as public administration, corporate management, law and regulation, technological development and innovation, healthcare, and finance. This volume provides an in-depth philosophical analysis of this problem, examining the notion of moral (...) responsibility and distinguishing between different normative meanings of responsibility, both backward-looking and forward-looking. Drawing on the relevant philosophical literature, the authors develop a coherent conceptualization of the problem of many hands, taking into account the relationship, and possible tension, between individual and collective responsibility. This systematic inquiry into the problem of many hands pertains to discussions about moral responsibility in a variety of applied settings. (shrink)

RESUMENEl artículo analiza el papel desempeñado por los argumentos de pendiente resbaladiza en los debates prácticos. Por un lado, estos argumentos suelen ejemplificar una forma d razonamiento imperfecto o paradójico. De hecho, la Filosofía clásica griega ya identificó las principales dificultades del sorites, el argumento del «montón». Por otro lado, la pendiente resbaladiza llama de nuevo la atención de la Filosofía contemporánea, ya que ocupa un lugar destacado en determinadas cuestiones morales, como pueden ser la eutanasia, los límites de la (...) investigación biomédica, o las posibles consecuencias de la intervención humana sobre el medio ambiente natural y sobe otras especies, no humanas. De esta forma, la Ética aplicada examina los riesgos y efecto son deseables de decisiones que, el comienzo, eran o parecían perfectamente aceptables, y lo hace así a pesar de que la metáfora de la pendiente resbaladiza no pueda aportar suficientes evidencias para frenar aquellas decisiones que comportan riesgos. Aun así, la pendiente sirve para expresar el peligro, la tragedia, los efectos negativos que amenazarían nuestra existencia, o la de las generaciones futuras. Por lo tanto, imágenes como la «caja de Pandora», la «ruptura de los diques», el «alud», no solo transmiten que algunas acciones pueden poner en riesgo la vida sino que, además, ilustran el uso práctico de los argumentos imperfectos.PALABRAS CLAVEpendiente resbaladiza, argumentación práctica, Ética aplicada.ABSTRACTThe article would analyze the role of the slippery-slope arguments in practical debates. On the one hand, they usually exemplify the imperfect, paradoxical reasoning; in fact, the ancient Greek Philosophy already identified the central flaws of the sorites, the «heap» argument. On the other hand, the metaphor of the slippery-slope draws again the attention of contemporary Philosophy, since it has a central part in some ethical issues, as happens with questions like euthanasia, the limits of biomedical research, and the possible consequences of the human action on the natural environment, and on non-humans. So, applied Ethics considers risks and undesirable effects of decisions that, at the very beginning, are, or seem acceptable, in spite of the fact that the slippery-slope could not allege enough evidences to prevent from this risky decision. However, it expresses how danger, tragedy, negative outcome would intrude in our existence, or in the existence of the next generations. Therefore, images like the «Pandora’s box», the «broken docks», the «avalanche», etc, not only suggest that some actions could definitively endanger life, but they illustrate the practical use of imperfect arguments.KEY WORDSslippery- slope, practical argumentation, applied Ethics. BackgroundThis article is part of a study to gain insight into the decision-making process by looking at the views of the relatives of potential brain dead donors. Alongside a literature review, focus interviews were held with healthcare professionals about their role in the request and decision-making process when post-mortal donation is at stake. This article describes the perspectives of the relatives.MethodsA content-analysis of 22 semi-structured in-depth interviews with relatives involved in an organ donation decision.ResultsThree themes were identified: ‘conditions’, ‘ethical considerations’ (...) and ‘look back’. Conditions were: ‘sense of urgency’, ‘incompetence to decide’ and ‘agreement between relatives’. Ethical considerations result in a dilemma for non-donor families: aiding people or protecting the deceased’s body, especially when they do not know his/her preference. Donor families respect the deceased’s last will, generally confirmed in the National Donor Register. Looking back, the majority of non-donor families resolved their dilemma by justifying their decision with external arguments. Some non-donor families would like to be supported during decision-making.DiscussionThe discrepancy between general willingness to donate and the actual refusal of a donation request can be explained by multiple factors, with a cumulative effect. Firstly, half of the participants stated that they felt that they were not competent to decide in such a crisis and they seem to struggle with utilitarian considerations against their wish to protect the body. Secondly, non-donor families refused telling that they did not know the deceased’s wishes or contesting posthumous autonomy of the eligible. Thirdly, the findings emphasise the importance of Donor Registration, because it seems to prevent dilemmas in decision-making, at least for donor families.ConclusionDiscrepancies between willingness to consent to donate and refusal at the bedside can be attributed to an unresolved dilemma: aiding people or protect the body of the deceased. Non-donor families felt incompetent to decide. They refused consent for donation, since their deceased had not given any directive. When ethical considerations do not lead to an unambiguous answer, situational factors were pivotal. Relatives of unregistered eligible donors are more prone to unstable decisions. To overcome ambivalence, coaching during decision-making is worth investigation. (shrink)

The ethics of autonomous vehicles has received a great amount of attention in recent years, specifically in regard to their decisional policies in accident situations in which human harm is a likely consequence. Starting from the assumption that human harm is unavoidable, many authors have developed differing accounts of what morality requires in these situations. In this article, a strategy for AV decision-making is proposed, the Ethical Valence Theory, which paints AV decision-making as a type of claim mitigation: different road (...) users hold different moral claims on the vehicle’s behavior, and the vehicle must mitigate these claims as it makes decisions about its environment. Using the context of autonomous vehicles, the harm produced by an action and the uncertainties connected to it are quantified and accounted for through deliberation, resulting in an ethical implementation coherent with reality. The goal of this approach is not to define how moral theory requires vehicles to behave, but rather to provide a computational approach that is flexible enough to accommodate a number of ‘moral positions’ concerning what morality demands and what road users may expect, offering an evaluation tool for the social acceptability of an autonomous vehicle’s ethical decision making. Most behavioral decision research takes place in carefully controlled laboratory settings, and examination of relationships between performance and specific real-world decision outcomes is rare. One prior study shows that people who perform better on hypothetical decision tasks, assessed using the Adult Decision-Making Competence (A-DMC) measure, also tend to experience better real-world decision outcomes, as reported on the Decision Outcomes Inventory (DOI). The DOI score reflects avoidance of outcomes that could result from poor decisions, ranging from serious (e.g., bankruptcy) to minor (...) (e.g., blisters from sunburn). The present analyses go beyond the initial work, which focused on the overall DOI score, by analyzing the relationships between specific decision outcomes and A-DMC performance. Most outcomes are significantly more likely among people with lower A-DMC scores, even after taking into account two variables expected to produce worse real-world decision outcomes: younger age and lower socio-economic status. We discuss the usefulness of DOI as a measure of successful real-world decision making. (shrink)

On Carlos Moya's Reply to the Argument from Luck Resumen: Esta nota crítica se centra en el argumento de Carlos Moya a favor de la conclusión de que el Argumento de la Suerte representa en realidad un problema mayor para los compatibilistas que para los libertaristas. La Sección 1 introduce brevemente el Argumento de la Suerte. La Sección 2 discute la distinción de Moya entre dos concepciones de deliberación práctica, y propone una manera alternativa a la de Moya de entender (...) la crítica al libertarismo que se basa en la condición de que cualquier decisión libre debe tener una explicación contrastiva. Finalmente, la Sección 3 resume la respuesta libertarista de Moya al Argumento de la Suerte, y sugiere un modelo alternativo de determinismo que Moya podría considerar para completar su argumento. Although empirical evidence may provide a much desired sense of certainty amidst a pandemic characterised by uncertainty, the vast gamut of available COVID-19 data, including misinformation, has instead increased confusion and distrust in authorities’ decisions. One key lesson we have been gradually learning from the COVID-19 pandemic is that the availability of empirical data and scientific evidence alone do not automatically lead to good decisions. Good decision-making in public health policy, this paper argues, does depend on the availability of reliable (...) data and rigorous analyses, but depends above all on sound ethical reasoning that ascribes value and normative judgement to empirical facts. Algorithmic decision-making based on profiling may significantly affect people’s destinies. As a rule, however, explanations for such decisions are lacking. What are the chances for a “right to explanation” to be realized soon? After an exploration of the regulatory efforts that are currently pushing for such a right it is concluded that, at the moment, the GDPR stands out as the main force to be reckoned with. In cases of profiling, data subjects are granted the right to receive meaningful information (...) about the functionality of the system in use; for fully automated profiling decisions even an explanation has to be given. However, the trade secrets and intellectual property rights (IPRs) involved must be respected as well. These conflicting rights must be balanced against each other; what will be the outcome? Looking back to 1995, when a similar kind of balancing had been decreed in Europe concerning the right of access (DPD), Wachter et al. (2017) find that according to judicial opinion only generalities of the algorithm had to be disclosed, not specific details. This hardly augurs well for a future right of access let alone to explanation. Thereupon the landscape of IPRs for machine learning (ML) is analysed. Spurred by new USPTO guidelines that clarify when inventions are eligible to be patented, the number of patent applications in the US related to ML in general, and to “predictive analytics” in particular, has soared since 2010—and Europe has followed. I conjecture that in such a climate of intensified protection of intellectual property, companies may legitimately claim that the more their application combines several ML assets that, in addition, are useful in multiple sectors, the more value is at stake when confronted with a call for explanation by data subjects. Consequently, the right to explanation may be severely crippled. (shrink)
