Published in 1821, Outlines of the Philosophy of Right is considered the definitive articulation of the legal, moral, social, and political philosophy of G.W.F. Hegel. However, shortly before its publication, Hegel delivered a series of lectures on the subject matter of the work at the University of Berlin. These lectures are unlike any others Hegel gave on the philosophy of Right in that they do not supplement a published text but rather give a full and (...) independent presentation of his mature political thought. Yet, they are also unlike Hegel's formal treatise in that they form a smooth and flowing discourse, much like Hegel's lectures on the philosophy of history, philosophy of art, philosophy of religion, and history of philosophy. Substantively, these lectures contain more extensive discussions of poverty and the proletariat than are found in Hegel's published text--discussions that carry out the retreat from optimism about the present age intimated in the preface to Outlines but nowhere evident in the text itself. Translated with an introduction and notes by Alan Brudner, Hegel's 1819/20 lectures on the philosophy of Right present his complete thoughts on law and the state in a manner that is more accessible and engaging than any other Hegelian text on these subjects. In the Phenomenology Hegel insists there are no presupposed standards of truth: standards are internal. "Consciousness provides its own criterion from within itself, so that the investigation becomes a comparison of consciousness with itself"(PhdG 84). We need only contemplate "the matter in hand as it is in and for itself"(PhdG 84). The Phenomenology is a characterisation of consciousness taking on increasingly adequate forms, testing its own internal standards against experience. The Philosophy of Right is a search for (...) class='Hi'>right, not, as in the Phenomenology, for the reality of cognition; but one of the methods Hegel adopts and which helps make sense of the structure of Philosophy of Right is the method he uses in the Phenomenology. This paper offers an alternative, though not necessarily conflicting, interpretation to that given in recent accounts of Philosophy of Right that emphasize its "logical spirit." Broadly speaking, two views of modernity are prevalent in contemporary debates. According to the first view, i.e. “modernization theory,” there is one single form of modernity, which is tantamount to liberal, capitalist modernity. The West has already and fully achieved modernity; non-Western societies have lagged behind and must simply catch up with the West. In contrast, according to the second view, “post-colonial theory,” there is no such thing as modernity. What the West erroneously calls “modernity” is nothing but a highly (...) parochial way of thought, and of economic and political organization, that developed by accident first in the West and then by the exercise of military violence or economic power was subsequently “universalized.” In this chapter, I argue that Hegel, read properly, provides a third conception of modernity, one which, contrary to the modernization theory, respects differences between societies, and yet, contrary to post-colonial theory, does not engage in dividing the human species into fundamentally different or incommensurate groups. I argue that Hegel’s theory of modernity must be sought at the conjunction of the Science of Logic (specifically the logic of the Concept) and the Philosophy of Right. I then elaborate on Hegel’s theory of modernity, thus construed. (shrink)

Hegel’s Philosophy of Right responds to two dichotomies. One is between the freedom of rational thought in its practical application and the givenness of natural impulses and desires. Against Kant Hegel argues that pure reason alone cannot determine the content of any maxim or principle of action. Thus Hegel must find a way in which the content of natural needs and impulses – the only source of content for maxims of action – can be transfigured into contents of (...) rationally self-given principles and maxims. Hegel also responds to the dichotomy between the individual agent and the social whole within which agents act. Hegel argues that this dichotomy is specious because human beings are fundamentally social practitioners and because neither social practices nor individual agents have priority over the other. There are no social practices without social practitioners and there are no social practitioners without social practices. Hegel’s response to this second dichotomy allows him to respond to the first one as well. The elaboration and specialization of natural needs and desires through exchange relations and the social division of labor transfigures the contents of those needs and desires into collectively self-given ends. The social practices producing this transfiguration and meeting these ends form the contents of implicit principles of right. These implicit principles are collectively self-given because they result from the social practices collectively developed to meet these needs. Only acts that are executed and accepted by an agent are free acts. This strong condition requires that an agent’s intentions correspond to the actual nature and consequences of his or her act. Since the aims, the principles, and the means of action are fundamentally social, these strong constraints entail that free action is possible only within a community which makes known its structure and the role of its members within it and their contribution to it, so that its members can act on the basis of that knowledge. Hegel’s theory of the state is a theory of a communal structure that makes such explicit, free action possible. In briefest compass, Hegel holds that laws are legitimate only insofar as they codify those practices that have been developed in order to achieve human freedom, and laws are obligatory only insofar as they are necessary for achieving human freedom. Hegel’s government is designed to codify and promulgate such laws. Hegel’s legislature is designed to make known to the citizens at large, through their corporate representatives, that laws have such a basis and how individual roles and actions fit within the community as a whole. The notion of being-at-home-in-otherness is the distinctive way of thinking of freedom that Hegel develops in his social and political thought. When I am at one with myself in social and political structures they are not external powers to which I am subjected but are rather constitutive of my self-relation, that is my self-conception is mediated andexpandedthrough those objective structures. How successfully Hegel may achieve being-at-home-in-otherness with regard to these objective structures of right in thePhilosophy of Rightis arguable. What (...) is at issue in this paper is however to argue that there is a blind spot in the text with regard to nature. In Ethical Life the rational subject's passions and inclinations are brought into the subject such that she is ‘with herself’ in them; with regard to external nature no such reconciliation is achieved or even attempted. In Abstract Right external nature is effectively dominated by and subsumed into the will and it is never something in which one is with oneself. It remains outside the model of freedom that Hegel develops in thePhilosophy of Right. There is something troubling about this formulation, since it excludes nature from freedom, but also something accurate, as it reflects the unresolved attitude of moderns to the natural world. Against these positions, Hegel upholds his “realism of the idea”: the claim that a rational world is neither a pre-given whole nor an unattainable ideal, but the dynamic, immanent orientation of reason that continually constructs and animates the world. In addition, among policy makers and in the legal arena—the so called workings fields of human rights—there have been noteworthy investigations of human rights that tackle philosophical issues.
