Iedereen zoekt geborgenheid in een eigenhuis, een plek onder de zon. Het vinden van een thuisplek is nochtans niet zo idyllisch als René Froger bezingt. Vooral in een multiculturele samenleving is de drang naar een thuisplek hevig. Op die plek exclusieve rechten uitoefenen wars van elke vorm van diversiteit, is een nieuw adagio. Wat voor de ene gemeenschap geborgenheid betekent, vormt voor een andere een regelrechte bedreiging. Hiertegen formuleren de auteurs een alternatieve landethiek in het spoor van Aldo (...) Leopold. Deze landethiek bouwen zij uit tot een fundamentele filosofie die radicaal breekt met de klassieke opvattingen van de Verlichting. De Leibniziaanse ruimte-tijd wordt de fundamentele basis voor de thuisplek. Cultuur, taal en landschap creeren de geborgenheid. Alle participanten van de thuisplek worden door diversiteit en het vreemde uitgenodigd tot openheid. Een ecologische ágape'verschijnt als een hernieuwde horizon. De onherbergzaamheid van de postmoderne samenleving heeft afgedaan. Steden transformeren tot multiculturele thuisplekken. Kunstwerken creeren landschappen tot plekken van identificatie. In hoeverre kan een literair werk bijdragen tot de ethische ontwikkeling van zijn lezers, of juist niet? Behalve een genuanceerd antwoord op deze vraag, wil dit boek premissen bieden voor een methode om de ethische inslag van een literair werk aan het licht te brengen. Dat de romans van de Nederlandse schrijver Frans Kellendonk (1951-1990) een goede casus vormen om dieper op deze problematiek in te gaan, ligt voor de hand. Kellendonk staat immers bekend als een van de meest controversiële (...) Nederlandse auteurs van het einde van de twintigste eeuw. Vandaag wordt hij vooral beschouwd als een soort profeet van het hedendaagse scepticisme omtrent de multiculturele samenleving. Zijn laatste roman, 'Mystiek lichaam' (1986), zorgde bijvoorbeeld voor een geruchtmakende ideologische rel, terwijl er volgens sommige critici geen vuiltje aan de lucht was. Internationale markten zijn de afgelopen decennia sterk mondiaal ontwikkeld en veel bedrijven zijn in deze geglobaliseerde context uitgegroeid tot belangrijke, quasi-politieke spelers. Deze stormachtige economische ontwikkelingen bieden kansen en welvaart aan velen, maar kennen echter ook schaduwzijden, van milieubelasting tot belastingontwijking. In deze bundel verkennen de auteurs het idee van de ‘open samenleving’ om vat te krijgen op deze nieuwe realiteit. De open samenleving naar het ideaal van Popper, waarin mensen de vrijheid hebben om hun mening uit te (...) drukken, initiatief te nemen, en elkaar tegen te spreken, wordt gezien als de grondslag voor vrijheid, welvaart, en vooruitgang. Deze bundel onderzoekt of de toegenomen openheid van markten de open samenleving als politiek ideaal dichterbij heeft gebracht. De auteurs werpen vanuit verschillende perspectieven een kritisch licht op de bedreigingen die voortvloeien uit mondiale markten en de toegenomen macht van ondernemingen. Ze stellen óók de vraag of het gedachtegoed van de open samenleving inspiratie kan bieden bij het tegengaan van die bedreigingen. After a short interlude in which the conceptions of justice of Marx and Rawls are compared (IB) the author presents some considerations of a critical nature as regards the principles of justice (IC). The distinction between the general and the special conception of justice hinges on the lixical priority of freedom. Now, a contradiction seems to emerge between the fact that the choice in favor of the special conception is an absolute one, valid for all societies regardless of time and place, and the fact that the general conception is sometimes presented as a first phase in the evolution of a well-ordered society (sect.82). This is an indication that in Rawl's theory the priority of freedom is not as absolute as he thinks it to be. The decisive point in this respect seems to be the fact that the „fair value of liberty” (Sect. 36) would demand that a subsistence minimum is lexically prior to freedom. These seem to be serious inconsistencies for which nnno remedy can be found and which are apt to lead us back to „instuitionism” The author considers next (and this is his main point) the logical structure of Rawls's contract theory, which in his opinion stands in urgent need of clarification. It is argued that the concept of contract as such implies a certain indifference or indeterminateness as regards its result. At the other hand, the result (that which is agreed upon, i.e. the principles of justice) is ex hypothesi considered to explain „our considered judgements” in reflective equilibrium. In this way it appears that Rawl's central idea (rather implicitly) is : there exists a consensus as regards our considered judgements concerning justice and this consensus may be explained as resulting from a (hypothetical) contract. So the argument really is of a hypothetico-deductive nature and it would have been much better if Rawls had been clear about it himself. Some critical considerations follow. First attention is paid to the fact that strict observance is an essential element of the concept of contract and that from this point of view the three psychological laws (chapt. VIII) are of crucial importance to the theory. Their nature, however, is not altogether clear. They are neither empirical laws (because they presuppose a just institutional structure and a just society is said not to exist), nor are they a priori ones. So it is only left for us to say that they are construed as empirical laws. Now, the difficulty for Rawls with this must be that reliance on such laws is inconsistent with the rationality of the parties in the original position, because as a matter of fact these laws have not been tested empirically (the fact that they can not be tested in this way makes no difference at all). Secondly it is asked whether we are dealing with a contract doctrine at all. Starting from the question, whether in this theory the notion of contract (intended to explain our considered judgements as givens) really is an ultimate explanatory concept, it is argued that there are some anthropological presuppositions, which rather point in the direction of a theory of self-realization. This seems to be confirmed by some other features of the theory, e. g. the Aristotelian principle, the Kantian interpretation, the concept of natural rights, and society as a social union of social unions. In conclusion, neither Rawls's principles of justice nor his contract theory are sufficiently consistent to escape the need of reconsideration. (shrink)

Se situant au confluent du libéralisme politique rawlsien et de l’anthropologie néoaristotélicienne, l’approche des capabilités de Martha Nussbaum offre un cadre théorique permettant de répondre aux tensions multiculturelles. Cet article constitue une analyse détaillée de la réponse de Nussbaum à ces enjeux, qui prétend unir un pluralisme axiologique à un universalisme moral fort. Nous avancerons que la démarche entreprise par la philosophe porte une tension entre le libéralisme politique rawlsien et le cadre conceptuel apporté par la liste des capabilités. Cette (...) liste pose une difficulté par le déficit démocratique de ses fondements, n’intégrant pas suffisamment des normes d’inclusion et de représentation. Dans un dernier temps, nous tenterons de pallier ces problèmes en intégrant à l’approche de Nussbaum des exigences délibératives. (shrink)

Les notions républicaines de liberté des citoyens et de liberté des peuples sont d’une aide précieuse pour qui veut comprendre les luttes contemporaines pour la reconnaissance. Ces luttes visent à modifier les normes, jugées trop contraignantes, qui régissent la participation des citoyens. La solution n’est pas, comme le croient les auteurs libéraux, de définir une fois pour toutes les normes régissant la participation dans les milieux multiculturels, puisque les différences identitaires chères aux citoyens changent avec le temps. Il s’agit plutôt (...) d’instituer une forme de démocratie constitutionnelle dont les normes publiques de reconnaissance des citoyens ne sont pas fixes mais souples et au sein de laquelle les citoyens seraient libres de contester, de négocier et de modifier les normes dominantes de la participation. La réponse ne réside pas dans une théorie de la justice, mais dans des pratiques républicaines de liberté renouvelées. (shrink)

Niettegenstaande de tendens van het failliet van het multiculturalisme is multiculturele dialoog niet weg te denken in een zich globaliserende wereld. Taylor, Gadamer, Honneth en Kymlicka hebben een bijdrage geleverd op het vlak van de erkenning van identiteit, respect en waardering van verschil. Wij voeren het argument aan dat bovenstaande auteurs niet ontsnappen aan het postmodernistisch dilemma van zelfautonomie en slachtofferschap. Dit komt doordat zij in hun rationale vertrekken van het afzonderlijke subject en deze situeren in een ruimte-tijd waarin (...) de tijd slechts een historische rol heeft en de ruimte geen actieve rol speelt. Tegenover deze uitvloeisels van het postmodern denken stellen wij het eco-communau-tarisme. Vanuit de vaststelling dat het individu denkt, spreek en handelt in de context van zijn taal en cultuur en dus vanuit zijn gemeenschap, situeren wij dit subject en de gemeenschap tevens in een particulier territorium of het ecotoop. Door middel van Hacking’s sociaal constructivisme, het Leibniziaanse meerwereldenbeeld en het biologische paradigma als nieuw denkkader, structureren wij de gemeenschap volgens een cyclisch en een lineair tijdverloop. Het cyclische waarborgt de traditie van een gemeenschap, het lineaire doet de gemeenschap evolueren naar een moreel betere toekomst en heeft een transcendent statuut. Het eco-communautarisme biedt het kader voor een kwalitatieve evolutie van individuen en gemeenschappen. Het normerend aspect hiervan is de pluriforme en multiculturele dialoog. (shrink)

L’évolution du processus de communication met en attention un concept qui permet une analyse plurivalente sur les espaces multiculturels – la culture communicationnelle. Ce concept rend possible le déchiffrage des relations entre ethos, logos et pathos, contient l’échange d’information obtenue par un message dans un contexte qui libère le processus communicationnel des barrières nationales. La culture communicationnelle est une résultante du processus de globalisation, entraînant les acteurs sociaux vers de nouvelles coordonnées axiologique par l’internationalisation des économies et des cultures. Au (...) neveu global, on observe l’apparition de nouveaux standards éthiques dont les actants de la communication ont besoin au moment du passage au-delà des espaces culturels nationaux. La communication joint d’un caractère bivalent étant un instrument d’émancipation de l’individu mais aussi le moyen de contrôle des autorités économiques et politiques par l’impôt de certains modelés de comportement et de certaines représentations sociales. Les régimes républicains y sont présentés comme ceux qui refoulent les différences ethnoculturelles, « en les laissant en marge », tandis que le multiculturalisme accorderait une place prioritaire à la diversité. Wetenschappelijke speurtocht naar de betekenis van democratie in een technologische samenleving, met een pleidooi voor aanpassing van democratische concepten en werkwijzen, teneinde de soevereiniteit van burgers voldoende te kunnen waarborgen.

Vraagt onze samenleving om een nieuwe politieke formule, om met Alexis de Tocqueville (1805-1859) te spreken? Op het eerste gezicht niet. De democratie is stevig verankerd in de Grondwet en verdragen en is ingebed in de rechtsstaat, en zowel democratie als rechtsstaat maken deel uit van ons collectieve bewustzijn. Toch is er wat aan de hand in de verhouding tussen overheid, samenleving en individu, zoals de inmiddels structurele onvrede met het publieke domein laat zien. Dat vraagt om een (...) richtinggevende doordenking van de vooronderstellingen van ons democratisch bestel en de fundamenten waarop het berust. Dat is wat dit boek zich ten doel stelt. Het biedt toekomstgerichte ideeën voor ons publieke domein aan de hand van kernbegrippen als legitimiteit, staat, politiek, instituties, identiteit, burgerschap, kerk en theologie. Het gedachtegoed van Tocqueville, die geldt als een van de grootste en meest interessante denkers over de moderne democratie, de democratische samenleving en de democratische mens, vormt daarvoor de inspiratiebron. The public reason project recommends that basic public matters should be decided by public reasons alone, so that citizens’ plural non-public or private reasons will not endanger the unity of the society’s public reason, which is responsible for the stability of the basic structure of society. PRP employs the strategy of insulation and accords priority to public reasons over private reasons. This much is normative or prescriptive, but for PRP to be a tenable and genuinely authoritative normative scheme, it should (...) also incorporate reliable means to win citizens’ firm allegiance to its mandates, which forms the 3rd major strategy of PRP. While much effort has been devoted to investigating the first two strategies of PRP, the third is relatively neglected. But this should not be the case, as the third strategy is also a constitutive part of PRP and it has profound implications for the other two strategies. This dissertation thus sets out to make up on this, by taking John Rawls’s particular approach to PRP as an example, which exhibits the most complete picture of PRP. I ask, in a nutshell, how are PRP’s prospects? More specifically, I scrutinize the attainability of the ideal of public reason, in which citizens heartily uphold or even endorse the spirit of public reason, just as depicted in Rawls’s ideal of well-ordered pluralistic society. To reliably measure the prospects/feasibility of a certain ideal, some rigorous metric is indispensable. For this we can, very intuitively, measure the all-purpose resources for bringing about the ideal: based on comparison between the amount of resources available and the amount required/expected by the ideal, we can decide if the ideal is attainable or not. Few philosophers have thought about the prospects of their moral/social/political ideals along this line. Fortunately, Rawls provides a well-defined interface between ideal and reality in his approach to PRP, so we can still carry out the comparison. This interface is the conception of a well-ordered society, which consists primarily of the conception of the person/citizen as rational and reasonable and the conception of the society as the framework of social cooperation. As these conceptions contain elements informed both by the ideal and by reality, their inner coherence provides crucial clue for deciding the prospects of the ideal as a whole. The major part of this dissertation is devoted to the investigation of these two conceptions, respectively in the domestic and the global settings. The focus is on whether reality can meet the requirements laid down by the ideal of public reason. Specifically, with regard to the conception of the person/citizen, I examine whether a citizen can develop firm allegiance to public reason either by living a well-ordered society or by deliberating on the congruence between her private reasons and the society’s public reason. With regard to the conception of the society, I examine whether the ethos of reciprocity can be elicited and sustained by citizens’ viewing themselves as civic friends with each other and by recognizing the great value of actively participating in social/public life with others. After extending PRP into the global setting a similar investigation is carried out, focusing on the conception of the people and that of the Society of Peoples. With regard to the conception of the people, I examine whether a liberal people can develop and maintain a moral disposition that effectively uphold GPR and whether a non-liberal but decent people can be attracted to the liberal way. With regard to the conception of the Society of Peoples, I examine whether the ethos of reciprocity can be elicited and sustained by peoples’ mutual affinity and, relatedly, whether the thesis of democratic peace can be sustained within the global circumstances of justice. On all these fronts, the prospects of the ideal are severely undermined by the weakness in our moral capacity as well as by the deep connection between public reason and private reasons. As a result, the prospects of public reason are much less secure than commonly assumed. (shrink)

Suvremena multikulturna društva velikim se dijelom okviruju u smislu proceduralne prije nego supstantivne etike, naglašavajući ispravnost umjesto dobrote, te uzdižu toleranciju kao ključnu vrijednost. No to ne može sâmo zamijeniti supstantivnu i motivacijsku normu dobroga života te se može iskusiti kao gubitak, otuđenje građana. Isto tako neće uspjeti suočiti se s granicama prihvatljivog djelovanja, neuvjetovanošću povezanom s moralnim gledištem. Klasična tradicija u etici, koja predlaže normu ljudskog blagostanja, može se ponovno izraziti kako bi iznijela na vidjelo ovu neuvjetovanost. Ukazat ću (...) na korisnost suprotne tradicije etičkog rasuđivanja u vidu proporcionalnosti, primjerice u slučaju ratne etike, te razmotriti alternativni koncept demokracije ne pod vidom formalnih i supstantivnih prava, nego etike participacije.Contemporary multicultural societies for the most part frame themselves in terms of a procedural rather than substantive ethics, by emphasizing rightness rather than goodness, and elevate tolerance to key value. But this cannot of itself replace a substantive and motivating norm of the good life and can be experienced as a loss, disaffecting citizens. It will also fail to confront the limits of acceptable action, the unconditionality associated with the moral point of view. The classical tradition in ethics, proposing a norm of human flourishing, can be re-expressed to bring out this unconditionality. I point to the counter tradition of ethical reasoning in terms of proportionality, exampled in the case of war ethics, as useful and draw on an alternative concept of democracy in terms not of formal or substantive rights but of an ethic of participation.Gegenwärtige multikulturelle Gesellschaften gestalten sich zumeist unter dem Aspekt der eher prozeduralen als materialen Ethik, indem sie die Richtigkeit anstelle der Güte herausheben, und werten die Toleranz zum Schlüsselwert auf. Dies per se vermag es immerhin nicht, die materiale und motivierende Norm des guten Lebens zu ersetzen, dagegen kann es als Verlust, als Bürgerentfremdung verspürt werden. Es versagt desgleichen in der Konfrontierung mit den Limits des akzeptablen Handelns, mit der moralitätsbetreffenden Bedingungslosigkeit. Die klassische Gepflogenheit in der Ethik, welche einen Maßstab der Menschheitsblüte nahelegt, kann wieder dargetan werden, um auf diese Bedingungslosigkeit Nachdruck zu legen. Ich deute auf die Nützlichkeit einer Gegentradition der ethischen Erwägung hin, aus der Perspektive der Proportionalität, exempli causa in der Angelegenheit der Kriegsethik, und stelle ein alternatives Demokratieschema auf, nicht im Sinne der formalen bzw. substantiven Rechte, sondern von der Ethik der Partizipation her. Sartre's Critique of theUniversal: Elements for a Multicultural Thinking The question of cultural justice, which refers in different contexts to the exigency of universality, constitutes a central aspect of Sartre's writings after World War II as f. ex. Réflexions sur la question juive, Orphée noir, Cahiers pour une morale, the famous Preface to Les damnés de la terre of Franz Fanon, and his article on the "question basque". In this texts Sartre poses some questions, which are crucial for the contemporary (...) multiculturalism debates, specially the questions of cultural justice, of the concepts of universality and the practical subject, of the articulation between cultural justice and distributive justice, as well as of the relation between person, economics and culture. The aims of this article is to discuss the main points of Sartre's critique of the abstract universality on the basis of his Réflexions sur la question juive, and to articulate the fields where Sartre's thought offers the theoretical resources for a contemporary debate on cultural justice. De bijdragen in deze bundel zijn een uitwerking van een symposium over Erasmus (1467/69-1536), georganiseerd door Driestar hogeschool naar aanleiding van zijn vijfhonderd jaar geleden verschenen Griekse editie van het Nieuwe Testament. Deze Bijbeltekst gold eeuwenlang als de standaard. Verschillende vertalingen zijn hierop gebaseerd, waaronder de Statenvertaling. Erasmus hield zich verder intensief bezig met de vraag hoe de religieuze verdeeldheid kon worden opgeheven. Zijn opvattingen over opvoeding en onderwijs blijken ook invloedrijk onder gereformeerde pedagogen in de zeventiende eeuw. De auteurs (...) illustreren niet alleen Erasmus? veelzijdigheid en zijn betekenis als christenhumanist, maar schenken ook aandacht aan zijn onderbelicht gebleven invloed binnen de protestants-christelijke traditie.
