This paper outlines a procedure for assessing the quality of failure explanations in engineering failure analysis. The procedure structures the information contained in explanations such that it enables to find weak points, to compare competing explanations, and to provide redesign recommendations. These features make the procedure a good asset for critical reflection on some areas of the engineering practice of failure analysis and redesign. The procedure structures relevant information contained in an explanation by means of structural equations so as to (...) make the relations between key elements more salient. Once structured, the information is examined on its potential to track counterfactual dependencies by offering answers to relevant what-if-things-had-been-different questions. This criterion for explanatory goodness derives from the philosophy of science literature on scientific explanation. The procedure is illustrated by applying it to two case studies, one on Failure Analysis in Mechanical Engineering (a broken vehicle shaft) and one on Failure Analysis in Civil Engineering (a collapse in a convention center). The procedure offers failure analysts a practical tool for critical reflection on some areas of their practice while offering a deeper understanding of the workings of failure analysis (framing it as an explanatory practice). It, therefore, allows to improve certain aspects of the explanatory practices of failure analysis and redesign, but it also offers a theoretical perspective that can clarify important features of these practices. Given the programmatic nature of the procedure and its object (assessing and refining explanations), it extends work on the domain of computational argumentation. (shrink)

The term discourse is generally used either as a technical equivalent for 'verbal communication' or as referring to a particular scientific notion, where discourses are spans of texts or of utterances obeying specific principles of organisation. The aim of this paper is to suggest that an account of discourse is possible, in both cases, only through a theory of utterance-meaning construction. If discourse stands for verbal communication, then it can be explained only with regard to speaker's intended meaning. If discourse (...) stands for organised spans of texts or utterances, then they must be meaningful spans of texts or meaningful utterances. Yet it is argued that a pragmatic explanation of meaning provides all the elements that discourse analysis describes. In the end, the paper claims that a theory of context combined with a theory on the semantic-pragmatic interface should prove sufficient to explain discourse, in whichever sense, along the idea that discourse should be viewed as a process, not as a whole, following the claims of a number of scholars in the field. A possible way to tackle this process is proposed in terms of procedures through the approach of procedural pragmatics. (shrink)

This chapter begins with an empirical analysis of attitudes towards the law, which, in turn, inspires a philosophical re-examination of the moral status of the rule of law. In Section 2, we empirically analyse relevant survey data from the US. Although the survey, and the completion of our study, preceded the recent anti-police brutality protests sparked by the killing of George Floyd, the relevance of our observations extends to this recent development and its likely reverberations. Consistently with prior studies, we (...) find that people’s ascriptions of legitimacy to the legal system are predicted strongly by their perceptions of the procedural justice and lawfulness of police and court officials’ action. Two factors emerge as significant predictors of people’s compliance with the law: (i) their belief that they have a (content-independent, moral) duty to obey the law (which is one element of legitimacy, as defined here); and (ii) their moral assessment of the content of specific legal requirements (‘perceived moral content of laws’). We also observe an interactive relationship between these two factors. At higher levels of perceived moral content of laws, felt duty to obey is a better predictor of compliance. And, similarly, perceived moral content of laws is a better predictor of compliance at higher levels of felt duty to obey. This suggests that the moral content incorporated in specific laws interacts with the normative force people ascribe to legal authorities by virtue of other qualities, specifically here procedural justice and lawfulness. In Section 3, the focus shifts to a philosophical analysis, whereby we identify a parallel (similarly interactive) modality in the way that form and content mutually affect the value of the rule of law. We advocate a distinctive alternative to two rival approaches in jurisprudential discourse, the first of which claims that Lon Fuller’s eight precepts of legality embody moral qualities not contingent on the law’s content, while the second denies any independent moral value in these eight precepts, viewing them as entirely subservient to the law’s substantive goals. In contrast, on the view put forward here, Fuller’s principles possess (inter alia) an expressive moral quality, but their expressive effect does not materialise in isolation from other, contextual factors. In particular, the extent to which it materialises is partly sensitive to the moral quality of the law’s content. (shrink)

Sections 1, 2 and 3 contain the main result, the strong finite axiomatizability of all 2-valued matrices. Since non-strongly finitely axiomatizable 3-element matrices are easily constructed the result reveals once again the gap between 2-valued and multiple-valued logic. Sec. 2 deals with the basic cases which include the important F i from Post's classification. The procedure in Sec. 3 reduces the general problem to these cases. Sec. 4 is a study of basic algebraic properties of 2-element algebras. In particular, we (...) show that equational completeness is equivalent to the Stone-property and that each 2-element algebra generates a minimal quasivariety. The results of Sec. 4 will be applied in Sec. 5 to maximality questions and to a matrix free characterization of 2-valued consequences in the lattice of structural consequences in any language. Sec. 6 takes a look at related axiomatization. problems for finite algebras and matrices. Climate change governance is extremely challenging because of both the intrinsic difficulty of the issues at stake and the plurality of values and worldviews. For these reasons, the ethical concerns that characterise climate change should also be meaningfully addressed through a specific version of procedural justice. Accordingly, in this article we adopt an impure notion of procedural justice. On this theoretical basis, we define relevant fairness criteria and contextualise them for climate governance systems. Then, we empirically justify fairness criteria against (...) a critical and divisive element for the future governance of the Green Climate Fund, i.e., the no-objection procedure. In 2017, Ukraine’s Parliament passed legislation establishing a single health benefit package for the entire population called the Programme of Medical Guarantees,‎ financed through general taxes and administered by a single national purchasing agency. This legislation was in line with key principles for financing universal health coverage. However, health professionals and some policymakers have been critical of elements of the reform, including its reliance on general taxes as the source of funding. Using qualitative methods and drawing on deliberative democratic theory (...) and criteria for procedural fairness, this study argues that the acceptance and sustainability of these reforms could have been strengthened by making the decision-making process fairer. It suggests that three factors limited the extent of stakeholders’ participation in this process: first, a perception among reformers that fast-paced decision-making was required because there was only a short political window for much needed reforms; second, a lack of trust among reformers in the motives, representativeness, and knowledge of some stakeholders; and third, an under-appreciation of the importance of dialogic engagement with the public. These findings highlight a profound challenge for policymakers. In retrospect, some of those involved in the reform’s design and implementation believe that a more meaningful engagement with the public and stakeholders who opposed the reform might have strengthened its legitimacy and durability. At the same time, the study shows how difficult it is to have an inclusive process in settings where some actors may be driven by unconstrained self-interest or lack the capacity to be representative or knowledgeable interlocutors. It suggests that investments in deliberative capital (the attitudes and behaviours that facilitate good deliberation) and in civil society capacity may help overcome this difficulty. (shrink)

The whistleblower system assumes that an element necessary for proper functioning about an organization is to see irregularities occurring in it. For this reason, whistleblowing and follow-up internal investigations occupy a central place in the organization’s compliance management system and an important role in the organization’s culture. These two areas constantly complement each other. However, compliance systems seem to be a broader concept, where the organization’s culture is part of it. The culture of an organization represents the habits, traditions, and (...) customs of organizations, which are not always written down. It is often referred to as the “company atmosphere.” Compliance is a system of procedures and rules, most often written down, which define procedures for dealing with specific situations, rights and obligations of employees, co-workers, or contractors. The regulations that emerge from the compliance system derive from laws, industry regulations, ethical norms, including the culture of a particular organization. Well-developed and implemented whistleblowing procedures that become part of the organization’s culture for good influence the existence of a highly developed compliance system that guarantees the multifaceted success of the organization. Knowledge about human wellbeing is a central part of ethical knowledge. But it is a neglected topic not only in ethics in general, but also in wellbeing theorizing, which has focused on enumerating the basic elements of wellbeing rather than on how to gauge, foster and maintain wellbeing in actual human lives. I consider the prospects for a procedural approach to wellbeing that sees it as depending on a process of continual adjustment between values, preferences, actions and emotions. The value-fulfilment (...) theory of Valerie Tiberius provides a model for such an approach, but needs to be corrected and supplemented in certain respects. I propose a version of the approach that is only partly, but still significantly procedural, and which does not privilege higher-order mental states. Considering the relevance of such an approach for ethics, I finally suggest that (certain forms of) moral agency may be best analyzed as an intersubjective process of adjustment and fulfilment of values and desires (etc.), and as a process of acquiring and exercising collective moral knowing how. Various writings of mixed genres, drifting between scientific treatises, mystical epiphanies, and prose fiction related to the school of “cosmism,” have been explored for more than fifty years, and the interpretations range from (religious) utopia to theories of sustainable development. The author discusses the question of whether “cosmism” is exclusively “Russian,” compares its general postulates with the techno-Cosmist approaches of the last ten years (including those involving fiction, such as by Eugene Thacker, and the more philosophical approaches, like that applied (...) by Yuk Hui), and proposes clarifying how the Cosmists literally viewed the structure of the world and how they conceptualized its elements as contrasted with the interest of contemporary theorists in openness to planetary and cosmic horizons. The latter, often oriented to nuclear physics and fragmenting “reality” into stochastic agencies whose temporary couplings are formed by cutting and assembling procedures, can be reformulated from the “cosmist” perspective as gleaned in this case from the works of Valerian Murav’ev and Vladimir Vernadsky, with the aid of the categories of expansion and accomplishment. One of the most influential of the Victorian philosophers, Henry Sidgwick also made important contributions to fields such as economics, political theory and classics. A proponent of the utilitarianism of Jeremy Bentham and John Stuart Mill, which he analysed in his classic work The Methods of Ethics, he later turned to the practical side of politics in this work, published in 1891. His aim was to have a 'rational discussion of political questions in modern states', and he offers a thorough (...) examination of Victorian politics, beginning with a discussion of political theory before moving on to more concrete matters such as property and law. The later chapters discuss the function of government through themes such as procedural matters, international affairs, war, political parties, and public participation, giving a comprehensive account of both ideas about and the functioning of late-nineteenth-century government. The fundamental characteristics of the various systems studies, and their relations to each other are established by meta-logical proofs, which are used freely in all sections of the book. In this paper I argue that the debate between subjective and objective theories of prudential value obscures the way in which elements of both are needed for a comprehensive theory of prudential value. I suggest that we characterize these two types of theory in terms of their different aims: procedural (or subjective) theories give an account of the necessary conditions for something to count as good for a person, while substantive (or objective) theories give an account of what is good (...) for a person, given some set of necessary conditions. Characterizing the theories in this way allows us to see their mutual compatibility. To make this case, I assume that a theory of prudential value ought to be descriptively and normatively adequate. The criterion of descriptive adequacy requires that our theory explain the subject relativity of prudential value. I characterize subject relativity in terms of justifiability to subjects and I argue that certain procedural theories are well suited to meet this criterion. The criterion of normative adequacy requires that our theory be capable of guiding action and I argue that a certain kind of substantive theory is needed to meet this requirement. (shrink)

The article analyses the legal status of the natural gas market regulatory institutions in Lithuania and in the member states of the European Union. First, the authors assess the most important elements of the legal status of the natural gas market regulators in the EU member states, namely, the degree of autonomy (type of institution, appointment and dismissal procedures of management, duration of the terms of office, sources of funding) and the measures aimed at ensuring accountability, transparency, and prevention (...) of conflicts of interest. Second, the legal status of the National Control Commission for Prices and Energy, which carries out functions of regulation and control of the natural gas sector in Lithuania, is examined. Finally, the authors conclude that the imperfections in the regulation of the legal status of the Commission result in several negative effects and provide reasoned proposals regarding the improvement of the legal status of the Commission. It has been suggested that focusing on procedures when setting priorities for health care avoids the conflicts that arise when attempting to agree on principles. A prominent example of this approach is “accountability for reasonableness.” We will argue that the same problem arises with procedural accounts; reasonable people will disagree about central elements in the process. We consider the procedural condition of appeal process and three examples of conflicts over coverage decisions: a patients’ rights law in Norway, health technologies (...) coverage recommendations in the UK, and care withheld by HMOs in the US. In each case a process is at the center of controversy, illustrating the difficulties in establishing procedures that are widely accepted as legitimate. In the paper a decision procedure for S5 is presented which uses a cut-free sequent calculus with additional rules allowing a reduction to normal modal forms. It utilizes the fact that in S5 every formula is equivalent to some 1-degree formula, i.e. a modally-flat formula with modal functors having only boolean formulas in its scope. In contrast to many sequent calculi for S5 the presented system does not introduce any extra devices. Thus it is a standard version of SC but (...) with some additional simple rewrite rules. The procedure combines the proces of saturation of sequents with reduction of their elements to some normal modal form. (shrink)

The Oxford English Dictionary says that a rite is ‘a formal procedure or act in a religious or other solemn observance’. The word comes into English through the French rite from the Latin ritus . Its original meaning escapes etymologists; and this is a mixed blessing, for we neither can nor must attempt a retrieval of its hidden roots. We are told by respectable etymologists that the word is associated from earliest times with Latin religious usage, but that even in (...) the early Latin it was already extended to ‘custom, usage, manner or way’ of a non-religious sort. [Lewis and Short, A Latin Dictionary .] So, too, in modern languages the terms ‘rite’ and ‘ritual’ have specifically religious meaning, but they are also used in social and cultural settings that we would not call religious. What first strikes us about the terms ’ and ‘ritual’ is an emphasis upon a certain formality, upon a regular and stable way in which an action or set of actions is to be performed. A ritual is more than a formalism, however, since there are formalisms that are not rites, such as the logical rules for making a valid argument. Moreover, the term is frequently associated with the terms ‘myth’, ‘symbol’ and ‘faith’. These, too, are primarily religious, but are also extended to non-religious contexts. Indeed, there seems to be a network of such terms whose usage touches upon some extraordinary quality in things. Like them, the term ‘ritual’ shares both a wide variety of meanings and a certain hint of impropriety. The variety of ritual forms is notorious, ranging from the most sacred religious liturgies to the absurdities of a fraternity initiation; and the impropriety of the term breaks out whenever we brand a certain action ‘ritualistic’, just as we sometimes refer slightingly to an assertion, saying it is ‘mythical’, ‘merely symbolic’ or ‘credulous’. “Frontier” is included in the general category of “limit” (limes: a road bordering a field). But what is at the origin of limit, frontier? An authority, a power that can exercise “the social function of ritual and social significance of the line, the limit whose ritual legitimizes passage, transgression” (Bourdieu, 1982, p. 121). The limit, a traced line, sets up an order that is not only spatial but temporal, since it not only separates a “this side” from a “that side” (...) but also a “before” and an “after”. This dual nature of the limit is at work in the myth of the founding of Rome. Any limit, any frontier, is intentional: it proceeds from a will; it is never arbitrary. Its legitimacy was originally established by a religious ritual and later, by a political procedure. (shrink)

De igual forma representa un reto para los docentes en el diseño del proceso enseñanza- aprendizaje. En este empeño es necesario prestar atención a los métodos, procedimientos y estrategias que permitan al estudiante la adopción de una posición reflexiva e independiente en la búsqueda del conocimiento, su actualización y aplicación en (...) la diversidad de tareas de estudio que como parte de su formación integral deben realizar. En ello resulta importante el análisis de las vías que favorecen un mejor funcionamiento de la memoria como proceso cognoscitivo fundamental. El presente artículo ofrece elementos teóricos y metodológicos esenciales que pueden servir de guía a docentes y estudiantes en la regulación y autorregulación de los procesos mnémicos desde la perspectiva del estudio eficiente, aspectos que no siempre son valorados en correspondencia con los aportes teóricos existentes. The development of the studying activity, based on ever growing efficiency levels, constitutes an indispensable requirement for the students' passing through higher education. Likewise, this fact represents a challenge for the professors to teach the students how to study. In doing so, it is necessary to pay attention to methods, procedures and strategies that allow the students to take a reflexive and independent position while searching for knowledge, its updating and application in the diversity of studying tasks which as a part of its integral formation the students have to accomplish. It is of uppermost importance the analysis of the ways that favor a better functioning of memory as a fundamental cognitive process. This article offers essential theoretical and methodological elements which may be guidelines to professors and students for regulating and self- regulating the memory processes from an efficient study perspective, which are not always valued in correspondence to the existing theoretical outcomes on the field. This introductory logic text for philosophers stresses decision procedures for the propositional and predicate calculi. In the treatment of the former the authors first present the apparatus for constructing logical inferences and establishing their validity; they then reformulate the system in an axiomatic way and prove its consistency and completeness; they also discuss, for example, techniques for proving independence of axioms. The lower predicate calculus is then developed, first in a monadic form, then in an extended one for which (...) decision procedures are available. Although the authors introduce predicates of degree two or more along with multiple quantification, they do not prove this system of the full predicate calculus complete. The last chapter provides a well-articulated treatment of syllogistic in connexion with quantification theory. There are appendices on conjunctive normal forms and notation without parentheses. The basic element of the considerations is to indicate the legal conditions for this type of use of medical technologies understood in this way, also in a broader context – with the characteristics of ethical conditions for „the media message”, including ensuring its proper quality for the protection of public health._. Die Notwendigkeit, die Theorie des Aristoteles in Einklang mit der Evidenz der Erde über dem Meeresspiegel – der ‘terra firma’ – zu bringen, hat eine entscheidende konzeptuelle Veränderung verursacht, in deren Folge auf paradoxe Weise anti-aristotelische Argumente in die aristotelische Tradition integriert wurden. Der deutsche Jesuitenpater Christophorus Clavius spielte eine relevante Rolle bei diesem Prozess. Er führte die Idee des aus Erde und Wasser bestehenden Globus in die scholastische Kosmologie ein, indem er das logische System der Physik des Aristoteles abwandelte. (...) Dieser Artikel analysiert die Theorie des Clavius sowie die angewandte Vorgehensweise, die er benutzte, um sein Vorhaben zu realisieren. Clavius verwendet kombinatorische Ansätze, um die Beziehungen der vier Elemente – Erde, Wasser, Luft und Feuer – zueinander zu untersuchen. Er sieht ihre Verbindung aus einer physischen Perspektive und schlägt schließlich eine mögliche Struktur der sublunaren Welt vor.The need to reconcile Aristotle's theory of elementary spheres with the evidence of earth above sea level – the so-called ‘terra firma’ – induced an important conceptual shift. As a consequence anti-Aristotelian arguments were brought to the fore in order to be incorporated into the very same Aristotelian tradition. The German Jesuit Christophorus Clavius played a momentous role in this process. He introduced the idea of the terraqueous globe into the Scholastic cosmology, modifying the logical frame of Aristotelian physics. The present work analyses Clavius' theory as well as the procedures he considers to reach his purpose. He used a combinatorial approach to study the relations occurring between the four elements – earth, water, air and fire – and analysed their relations from a physical perspective, proposing a possible structure of the sublunary world. The paper analyzes, on the basis of Ryle’s concepts of knowledge that and knowledge how, both objectified forms of expert knowledge and the performative nature of expertise. Both theoretical and practical aspects of the identified categories are studied from historical and social perspectives as phenomena characteristic of post-modern information society. In virtue of the selected social examples an epistemological model of performative expert knowledge and expertise is constructed in which crucial elements are distinguished: experts’ cognitive attitudes and dispositions, intellectual skills, (...) intuition and mistakes as well as types of interactional versus contributory expertise. Also considered are the epistemological consequences derived from the research concerning expertise in psychiatric treatment where both expert knowledge and expertise fall into line with institutional requirements as well as procedures. The article deals with the discussion of the concept and implementation of immunities of the witness in the criminal proceedings in abstracto. The problem is whether the additional guarantee of protection of the witness’ procedural interests, which is fixed in the Law of the Criminal Procedure, is appropriately methodologically regulated, or whether certain immunities of the witness are appropriately perceived and applied in practice, is raised in the present article. Through this reason, the author, searching for the answers to these (...) questions—how is all this and how must all this be?—singles out, in abstracto, two elements of immunities of the witness, in concreto—the immunities of the witness and witnessing. It would seem that these protective guarantees are similar in principle. The analysis of this article allows for the answer that they are analogous from the point of view of their value. However, they differ by the mechanisms of implementation. According to the author, the immunity of the witness protects the person from becoming a witness, whereas the immunity of witnessing secures protection from witnessing, which may cause harm to the witness himself/herself. Accordingly, it also determines the need not only to analyze these two elements, but their interrelation and interrelations as well. (shrink)

Respect for patient autonomy is paramount in resolving ethical tensions in end-of-life care. The concept of relational autonomy has contributed to this debate; however, scholars often use this concept in a fragmented manner. This leads to partial answers on ascertaining patients’ true wishes, meaningfully engaging patients’ significant others, balancing interests among patients and significant others, and determining clinicians’ obligations to change patients’ unconventional convictions to enhance patient autonomy. A satisfactory solution based on relational autonomy must incorporate patients’ competence (apart from (...) decisional capacity), authenticity (their true desires or beliefs) and the involvement level of their significant others. To that end, we argue that John Christman’s procedural approach to relational autonomy provides critical insights, such as the diachronic or socio-historical personhood, sustained critical reflection and his recent explication of the nature of asymmetrical relationships and helpful interlocutors. This study reviews Christman’s account, proposes minor modifications and advocates for an integrated three-dimensional model for medical decision-making. Clarifying the relationship among the three elements promotes an ethical framework with a coherent understanding of relational autonomy. This model not only provides a descriptive and normative framework for end-of-life care practice but also reconsiders the nature of the clinician–patient relationship and its normative implications. We further present a case study to illustrate the merits of our proposed model. Altogether, our proposal will help navigate complex medical decision-making, foster trust and negotiate shared values between patients and their significant others, particularly in end-of-life care. The central issue of the presentation is two questions: the first one is related to the issue of competences which are currently penetrating into philosophy curricula. The second, also related to the first one, is the issue of formulation of curriculum objectives and consequently of teaching methodology and practice. The controversial thesis that “the practice of philosophy is a whole which can not be divided into parts, procedures and techniques” is discussed and the reasons for more articulated learning objectives (...) are offered. On the level of the curriculum a reflective approach to objectives-driven curriculum and the inclusion of process-driven curriculum is offered as a solution. On the level of the teaching methodology and practice the need for appropriately articulated learning objectives for the purpose of the conceptualisation of the process is shown. (shrink)

Care staff in Norway usually work in the private homes of people with intellectual disabilities. Staff experience ethical challenges daily in their interactions with their clients. The aim of this paper is to introduce a vignette validation procedure for selection of practice-close vignettes that can be used to elicit and explore staff reflections on ethical challenges in their work. Staff participants were recruited from different municipalities in one county of Norway. To develop vignettes with good internal validity, the validation process (...) consisted of (1) a field study to identify situations to be included as vignettes, (2) a six-step categorization process to select vignettes with good internal validity, (3) transforming the situations into vignettes, including removal of elements that were too leading or constricting, (4) testing the familiarity and relevance of the preliminary sample of vignettes (external validation), (5) final selection of four vignettes to be included in the investigation, and (6) a validation of the four vignettes? familiarity and practical relevance as ethical challenges by the final sample of interviewees. Our preliminary experience indicates that the validation procedure enhanced the selection of vignettes to elicit staff perceptions and reflections on daily ethical challenges. (shrink)

Measurement theory in (Hand in The world through quantification. Oxford University Press, 2004; Suppes and Zinnes in Basic measurement theory. Psychology Series, 1962) is concerned with the assignment of number to objects of phenomena. Representational aspect of measurement is the extent to which the assigned numbers and arithmetics truthfully represent the underlying objects and their relations, and is characteristic to natural sciences; pragmatic aspect is the extent to which the assigned numbers serve purposes other than representing the underlying phenomena, and (...) is characteristic to social sciences (Hand in The world through quantification. Oxford University Press, 2004). Here I criticise this distinction of representational and pragmatic measurements on the basis of the earlier history of the periodic system of chemical elements, viewed in terms of a practice based philosophy of science by Rein Vihalemm. I argue that the periodic system, although a natural scientific system interpretable as a measurement system, has considerable, in Hand’s terms pragmatic, aspects in it. Those aspects include: tampering with the material measurement results for the theoretical ideal of systematicity; adopting metaphysical assumptions that cannot be experimentally proven, like individuality of elements and atomicity; theoretical construction of the abstract entity—element—as the reference of the measurement system amenable to mathematically elegant ordering. Contrary to Suppes and Zinnes (Basic measurement theory. Psychology Series, 1962) I also argue for the dependence of the assigned numerical system on the material-procedural base of the measurement. Whoever compares the genomes of distantly related species might find aberrantly high sequence similarity at certain loci. Such anomaly can only be explained by genetic material being transferred through other means than reproduction, that is, a horizontal transfer. Between multicellular organisms, the transferred material will likely turn out to be a transposable element. Because TEs can move between loci and invade chromosomes by replicating themselves, HT of TEs profoundly impacts genome evolution. Yet, very few studies have quantified HTT at large (...) taxonomic scales. Indeed, this task currently faces difficulties that range from the variable quality of available genome sequences to limitations of analytical procedures, some of which have been overlooked. Here we review the many challenges that an extensive analysis of HTT must overcome, we expose biases and limits of current methods, suggest solutions or workarounds, and reflect upon approaches that could be developed to better quantify this phenomenon. With the large amount of genomic resources now available, horizontal transfer of transposable elements can be studied as an evolutionary process, rather than as isolated cases. We discuss some of the difficulties encountered in detecting and counting such transfers and propose guidelines and directions for future research in this area. (shrink)

In this paper, I present an interpretation of the use of constructions in both the problems and theorems of Elements I–VI, in light of the concept of given as developed in the Data, that makes a distinction between the way that constructions are used in problems, problem-constructions, and the way that they are used in theorems and in the proofs of problems, proof-constructions. I begin by showing that the general structure of a problem is slightly different from that stated by (...) Proclus in his commentary on the Elements. I then give a reading of all five postulates, Elem. I.post.1–5, in terms of the concept of given. This is followed by a detailed exhibition of the syntax of problem-constructions, which shows that these are not practical instructions for using a straightedge and compass, but rather demonstrations of the existence of an effective procedure for introducing geometric objects, which procedure is reducible to operations of the postulates but not directly stated in terms of the postulates. Finally, I argue that theorems and the proofs of problems employ a wider range of constructive and semi- and non-constructive assumptions that those made possible by problems. (shrink)

The objective to which this manuscript is oriented to is focused on the analysis of interpersonal communication in sport. The multimodal essence of human nature adopts special characteristics in individual and team sports, given the roles that athletes adopt in different circumstances, depending on the contingencies that characterize each competition or each training session. Themixed methodsframework allows us to advance in the ways of integration between qualitative and quantitative elements, taking advantage of the proven possibilities of systematic observation, which we (...) can considermixed methodin itself, and which provides rigor and flexibility in the study of the communicative flow in sport. In any sport, the procedure followed by systematic observation may require direct observation, which is characterized by its high perceptiveness, or indirect observation, when it comes to verbal behavior or documentary material. In all cases, the procedure is structured in three macro-stages: QUAL-QUAN-QUAL. In this work we start from a conceptual positioning about interpersonal communication, to later show the sequential gear in sports about obtaining qualitative data, its transformation into other types of data that are still qualitative but have been structured, analyze them quantitatively, and return to a qualitative stage where the interpretation of the results is possible. This process ofquantitizingconstitutes the cornerstone that gives shape and structure to any research on interpersonal communication in sport that combines the fine nuances of qualitative data (a motor action, a gesture, an exclamation,…) with the power of robust quantitative data analysis suitable for the treatment of organized qualitative data, which will provide qualitativefeed-back. Feminists have argued that oppressive socialization undermines the liberal model of autonomy. We contend that this argument can also be employed effectively as a challenge to the standard bioethical model of informed consent. We claim that the standard model is inadequate because it relies on presumptions of procedural autonomy and rational choice that overlook the problem of how agents are often socialized so that they adopt and internalize oppressive norms as part of their motivational structure. The argument that oppressive socialization (...) undermines liberalism’s view of autonomy is most relevant to what Beauchamp and Childress call the threshold elements of informed consent—competence and voluntariness. Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

A qualitative study with an exploratory, descriptive and documentary design that was conducted with the objective of identifying the elements to constitute a method for the analysis of accusations of and proceedings for professional ethics infringements. The method is based on underlying elements identified inductively during analysis of professional ethics hearings judged by and filed in the archives of the Regional Nursing Board of Santa Catarina, Brazil, between 1999 and 2007. The strategies developed were based on the results of an (...) analysis of the findings of fact (occurrences/infractions, causes and outcomes) contained in the records of 128 professional ethics hearings and on the structural elements (statements, rules and practices) identified in five example professional ethics cases. The strategies suggested for evaluating accusations of ethics infringements and the procedures involved in deliberating on ethics hearings constitute a generic proposal that will require adaptation to the context of specific professional ethics accusations. In this chapter I argue that there is a normative aspect to self-control that is not captured by the purely procedural account to be drawn from dual process theories of cognition – which we only uncover when we consider what self-control is for and why it is valuable. For at least a significant sub-group of addicts their loss of control over their drug use may not be due to a lack or depletion of cognitive resources. Rather it may be that (...) they have little confidence in their ability to exert control over their circumstances and shape the life they would value having and the person they would value being. Recent scientific studies have shown that involving children in music activities influences their mental, emotional, and social development; music is, thus, being used increasingly for medical and therapeutic purposes. In order to discover whether some elements of particular methods of music therapy can be applied in music teaching in primary schools, we conducted a qualitative research in which the participants were third-year elementary school pupils in Osijek. To collect the data, we used a systematic observation procedure. Data analysis involved both (...) qualitative and quantitative analyses. The research results show that the introduction of elements of certain methods of music therapy is possible and that pupils are happy to participate in all the activities carried out. In doing so, pupils demonstrate imagination, creativity, independence at work, and willingness to cooperate. Novija znanstvena istraživanja pokazuju da uključivanje djece u glazbene aktivnosti utječe na njihov psihički, emocionalni i socijalni razvoj zbog čega se glazba sve više koristi i u medicinske, odnosno terapeutske svrhe. Kako bismo saznali je li moguće neke elemente iz pojedinih metoda glazboterapije primijeniti i u nastavi glazbe u osnovnoj općeobrazovnoj školi, proveli smo kvalitativno istraživanje u kojemu su sudionici bili učenici trećeg razreda jedne osnovne škole iz Osijeka. Za potrebe prikupljanja podataka koristili smo postupak sustavnog promatranja, a za analizu podataka kvalitativnu i kvantitativnu analizu. Rezultati istraživanja pokazali su da je uvođenje elemenata iz pojedinih metoda glazboterapije moguće te da učenici rado sudjeluju u svim provedenim aktivnostima. Pritom učenici iskazuju maštovitost, kreativnost, samostalnost u radu te spremnost na suradnju. (shrink)

In the article the basic procedures for finding of connective elements and resolving conflicts of references is analyzed. On the basis of this, a generalized algorithm is proposed that combines advantages of existing procedures for search for connective elements between phrases. The advantages of the selected procedures and their sequence are described, the formal description of input data and the results of the algorithm are presented. To optimize the procedure for scanning the text, the algorithm is performed (...) as an iterative reduction of the candidates for communication elements. This is achieved through the confirmation of non-conflict links and the gradual resolution of conflicts. (shrink)

Ce texte répond à trois objectifs : 1) dégager quelques éléments théoriques et méthodologiques essentiels au travail en Analyse du Discours, dans une perspective qui situe le discours comme objet dans un rapport déterminé entre langue et idéologie; 2) exposer la mise en oeuvre de ces éléments à travers la démarche suivie dans un travail d'Analyse du Discours ayant eu pour objet un corpus de discours du Parti communiste français adressés aux Chrétiens ; 3) indiquer le type de résultats auxquels (...) de telles orientations peuvent conduire : une redéfinition des notions de corpus, d'énoncé et d'énonciation dans l'analyse linguistique des processus discursifs.This paper aims at three goals: 1) to draw some essential theoretical and methodological elements from the works in the field of Discourse Analysis, in a perspective that situates discourse as a certain relation between language and ideology; 2) to expose the use of those elements through the approach followed in a Discourse Analysis research which took a corpus of speeches of the French Communist Party addressed to the Christian Community as its object; 3) to indicate the type of results to which such orientations may lead: a redefinition of the notions of corpus, enounced and enounciation in the analysis of discourse processes. Psychological literature has deemed that people can perceive which procedures and decisions are just or not. In this paper, we argue that management control systems need to include justice criteria explicitly, beyond mere market value, in both their design (formal justice) and use (informal justice). The aim of the article is to explain the relationship between the ethical evaluation of scientific research involving personal data and the assessment of compliance with data protection law. The article presents the mutual relationship between the protection of personal data and scientific activity from a dogmatic perspective, the legal regulation of the processing of personal data in scientific research, and the so-called research exceptions that apply when data are processed for scientific research. It also covers the importance of meeting (...) the ethical requirements of scientific research in order to profit from the indicated exceptions. Finally, it provides a comparison between the ethical and the legal systems of personal data protection in research (objectives, criteria, authorities, and procedures). (shrink)

Disjunctivism, as a theory of visual experience, claims that the mental states involved in a “good case” experience of veridical perception and a “bad case” experience of hallucination differ, even in those cases in which the two experiences are indistinguishable for their subject. Consider the veridical perception of a bar stool and an indistinguishable hallucination; both of these experiences might be classed together as experiences (as) of a bar stool or experiences of seeming to see a bar stool. This might (...) lead us to think that the experiences we undergo in the two cases must be of the same kind, the difference being that the former, but not the latter, is connected to the world in the right kind of way. Such a conjecture has been called a “highest common factor” or “common kind” assumption. At heart, disjunctivism consists in the rejection of this assumption. According the disjunctivist, veridical experiences and hallucinations do not share a common component. There are a host of interesting questions surrounding disjunctivism including: What is involved in the claims that good case and bad case experiences differ? Why might one might want to be a disjunctivist? What kinds of claims can the disjunctivist make about hallucination and illusion? These questions, and problems for the thesis, will be discussed as we proceed. (shrink)
